REGULAR MEETING
MINUTES
CALL TO ORDER Mayor Rants called the Regular Meeting to order and led the
audience in the Pledge of Allegiance.

b. Approval of Vouchers: Nos. 82092 through 82392 in the
amount of $1,107,018.80
c. Approve Assignment of Solid Waste Franchise between
SeaTac Disposal and Nick Raffo Garbage Company.
d. Authorize Mayor to sign the Addendum to Solid Waste
Interlocal Agreement and Forum Interlocal Agreement with
King County.
e. A resolution authorizing the cancellation of outstanding
unredeemed warrants checks and gift certificates as of
June 30, 1993.
f. Authorize Mayor to sign Utility Franchise Agreement for
the Tukwila Storm Drainage Interceptor (P -1 Storm
Interceptor) with City of Renton.
g. Authorize Mayor to accept turnover of Circuit City
sidewalk/drainage facilities and utility easement.

Mayor Rants announced he had received a letter from Rodger Lacy
requesting the public hearing on his vacation of a portion of S.
158th Street be removed from the agenda.

COUNCIL REMOVE THE REQUEST FOR VACATION OF A
PORTION OF S. 158TH STREET PUBLIC HEARING FROM
THE AGENDA AT THE REQUEST OF RODGER LACY, THE
APPLICANT. MOTION CARRIED 7 -0.
City Engineer Ron Cameron explained the initial 48 meters were
purchased from the low bidder, Fogtite, Inc., for the East Marginal
Way water line construction project. The remaining 22 meters are
requested for replacing water meters that are 50 years old, worn out
and leaking.
MOVED BY ROBERTSON, SECONDED BY DUFFIE, TO
AUTHORIZE THE MAYOR TO PURCHASE 22 METERS IN
THE AMOUNT OF $64,167.76.*
Councilmember Robertson pointed out that the meters are 50 years
old. Some of them leak, some don't read correctly. The cost of
replacing the meters at a later date is three to four times the cost of
purchasing them now. Robertson concluded that even though the
project is significantly over budget, the wise thing to do would be
to spend the money now and save ripping up roads twice. Mayor
Rants added the contractor will install the additional meters
without charge if it is done at this time.

Mayor Rants announced the City Attorney had been called away
and asked Council to move on to New Business, Item d, until the
attorney returns. Council concurred.
MOVED BY MULLET, SECONDED BY DUFFIE, TO
APPROVE PHASE II SCOPE OF WORK AND CONTRACT
FOR HIGHWAY 99 REVITALIZATION PROJECT AND
AUTHORIZE THE MAYOR TO SIGN A CONTRACT WITH
MAKERS IN THE AMOUNT OF $57,607.*
Council was provided a draft work schedule on the project.
Councilmember Robertson explained that CA &P felt there were
two issues here: the contract and the schedule of work.

Consequently, the committee and DCD came up with plan to
change the rules and responsibilities somewhat. The task force
will work with the Council and everyone else, but the report will
work through DCD as a council agency. The task force and other
groups such as a real estate committee will review some of the
material and make reports back, but those will come back to the
Council. The original proposal had the task force and other people
modifying the proposals that came to the council. Instead, people
will be making recommendations. Also, the new schedule will
have a lot of council interaction upfront and along the way so that
there will be direction given. That way the task force, consultants,
and the Council will have the same general background, goals and
policies in mind as they work through the project. Joint Task
Force /Council meetings will be scheduled for future meetings.
Councilmember Mullet noted his concern with the wording in Task
10, Item d, on page 97. To address Mullet's concern, Steve
Lancaster, DCD Director, suggested the last sentence be changed
to read: Recommendations that differ from WSDOT and /or City
standards will be addressed in a separate technical memo, and
incorporated into the final report, if necessary, that explains the
deviation(s) and reasons for them.
Councilmember Hernandez clarified that CA &P modified the
matrix to include more feedback to the Council more frequently in
the process.

AMEND PAGE 97, PARAGRAPH D, LAST SENTENCE, OF
THE MAKERS CONTRACT TO READ:

REPORT IF NECESSARY. MOTION CARRIED 7 -0.

8.50.040(b) OF THE TUKWILA MUNICIPAL CODE
REGARDING THE DEFINITION OF PROSTITUTION
LOITERING; PROVIDING FOR SEVERABILITY; AND
ESTABLISHING AN EFFECTIVE DATE. MOTION CARRIED
7 -0.

AMENDING CHAPTER 8.50 OF THE TUKWILA MUNICIPAL
CODE CREATING A NEW SECTION 8.50.050 REGULATING
ILLEGAL SEXUAL CONDUCT, AND PROVIDING FOR
SEVERABILITY, AND ESTABLISHING AN EFFECTIVE
DATE.
MOVED BY HERNANDEZ, SECONDED BY DUFFIE, THAT
ORDINANCE #1753 BE ADOPTED AS READ.*
Attorney Cohen proposed an amendment to the ordinance to add
criminal penalties for violations.
MOVED BY ROBERTSON, SECONDED BY EKBERG, TO
AMEND THE TITLE OF ORDINANCE #1753 BY INSERTING
THE WORDS PROVIDING FOR CRIMINAL PENALTIES
FOR VIOLATIONS JUST PRIOR TO THE WORDS AND
PROVIDING FOR SEVERABILITY. MOTION CARRIED 7 -0.

CODE REGARDING ASSAULTS AGAINST POLICE
OFFICERS OR FIREFIGHTERS; PROVIDING FOR
SEVERABILITY, AND ESTABLISHING AN EFFECTIVE
DATE.

Council reviewed the Parks Recreation, DCD, Police
Administration Services, and City Council preliminary budgets.
Mayor Rants reminded Council of the kickoff for the Pond
fundraising tomorrow, November 21st, beginning at 7 a.m. at the
Doubletree Suites.
Councilmember Duffie referenced a letter Council received from a
parent who was concerned with underaged kids attending a teen
dance sponsored by the City. Duffie said the dance was supervised
by 14 individuals which included Parks and Recreation staff and
two police officers. Parks and Recreation Director Don Williams
is responding to the complainant.
Councilmember Robertson added that the Highway 99 Task Force
had requested a meeting with Council prior to the end of the year.
Council decided on December 1 lth, from 6 -8 p.m. for that
meeting. The COW scheduled for December 11th will begin at 8
p.m.
Duffie also reported 30 -40 people attended the recent Apartment
Managers' meeting. Attendees watched a slide presentation on
how some citizens took back their neighborhood.

Councilmember Hernandez suggested Council consider adding
about $15,000 to the budget in order to promote the City in special
monthly Tukwila/SeaTac editions of the Highline Times. Mayor
Rants responded the reporters for the Seattle Times South Edition
do a good job covering the City. Councilmember Mullet suggested
the City explore other avenues of promoting the City rather than
going for more volume. CA &P committee will look into this issue
further.
Councilmember Ekberg announced the dates for Council's annual
retreat January 19, 20, and 21, 1996.
Councilmember Carter reported that Phil Fraser, Public Works,
gave a good presentation on the Southgate Creek and the Fostoria
Storm Water Quality Management Plan at last week's Foster
Community Club meeting. Karen Wright also attended and gave a
report on Human Services. Carter reported volunteers are needed
at the community center from 10 a.m. 3 p.m. tomorrow to help
sort clothes for the fire victims of the O1'Cara Apartments.
City Administrator John McFarland said it took 20 minutes for the
fire department to extinguish the fire at the O1' Cara Apartments
over the weekend. It took the fire department only five minutes to
arrive at the scene at 4:30 a.m. McFarland commended the fire
department and the staff for their quick response to the
community's needs and their assistance to the Red Cross.
John McFarland announced the City was presented a plaque from
the youth soccer association in appreciation for our assistance for
scheduling an maintaining the fields.
Attorney Linda Cohen reported the City prevailed in the Dempere
appeal in superior court. The appeal was dismissed wt. prejudice.
It was one of the first HB 1724 cases to come through superior
court.
