City Attorney Linda Cohen read AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, RELATING TO SURFACE AND STORM WATER MANAGEMENT; AMENDING ORDINANCE 1523 AND CREATING TMC SECTION 14.28.080 TO ESTABLISH PENALTIES AND PROCEDURES FOR CHAPTER VIOLATIONS; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. MOVED BY DUFFIE, SECONDED BY HERNANDEZ, THAT ORDINANCE NO. 1755 BE ADOPTED AS READ. MOTION CARRIED. MOVED BY EKBERG, SECONDED BY CARTER, TO AUTHORIZE THE REIMBURSEMENT OF CHARGES TO RESIDENTS ALONG 42ND AVE. S. FOR UNDERGROUND WIRE IN THE RIGHT -OF -WAY NOT TO EXCEED $3,000.* Councilmember Robertson explained that the City's decision to reimburse these charges came about because they felt the current undergrounding policies were unclear regarding what the City would or would not pay for. (Council will address revisions to the policies under the CIP discussion.) Most Councilmembers favored the motion and agreed the policies should be revised. Councilmember Duffie opposed the motion stating that he disagreed with treating some residents differently than others. *MOTION CARRIED 6 -1 WITH DUFFIE VOTING NO. MOTION CARRIED Attorney Cohen read A RESOLUTION OF THE CITY COUNCIL OF TUKWILA, WASHINGTON, DECLARING AN EMERGENCY DUE TO HIGH WATER CONDITIONS IN THE GREEN RIVER. MOVED BY HERNANDEZ, SECONDED BY DUFFIE, THAT RESOLUTION NO. 1334 BE APPROVED AS READ. MOTION CARRIED. MOVED BY HERNANDEZ, SECONDED BY DUFFIE, THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED Attorney Cohen read AN ORDINANCE OF THE CITY OF TUKWILA, WASHINGTON, LEVYING THE GENERAL TAXES FOR THE CITY OF TUKWILA IN KING COUNTY FOR THE FISCAL YEAR COMMENCING JANUARY 1, 1996, ON ALL PROPERTY, BOTH REAL AND PERSONAL, IN SAID CITY WHICH IS SUBJECT TO TAXATION FOR THE PURPOSE OF PAYING SUFFICIENT REVENUE TO CARRY ON THE SEVERAL DEPARTMENTS OF SAID CITY FOR THE ENSUING YEAR AS REQUIRED BY LAW. MOVED BY HERNANDEZ, SECONDED BY DUFFIE, THAT ORDINANCE NO.1756 BE ADOPTED AS READ.* Alan Doerschel explained that property values throughout King County have fallen since Boeing vacated several commercial buildings over two years ago. Property owners individually protested their assessments and many won their cases, thus resulting in lower tax revenue for the City. Reduction in assessed valuations in Tukwila for 1996 have reached $86 million. Tukwila is currently at the maximum levy amount of $3.10. The proposed ordinance addresses the levy amount only. It does not address property tax assessments or any other assessment. *MOTION CARRIED 7 -0. MOTION CARRIED Cohen read AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, ADOPTING A 1995 COMPREHENSIVE LAND USE PLAN AND MAP FOR THE CITY OF TUKWILA; AMENDING CHAPTER 21.04 OF THE TUKWILA MUNICIPAL CODE; REPEALING ORDINANCE NOS. 487, 831,844, 1039, 1230, 1246, 1359, 1429, 1430, 1444, 1466, 1470, 1479, 1484, 1486, 1516 SECT. 1 AND 2, 1539, AND 1624; PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. MOVED BY HERNANDEZ, SECONDED BY DUFFIE, THAT ORDINANCE NO. 1757 BE ADOPTED AS READ.* Council agreed that developing the new Comprehensive Plan had been a lengthy but rewarding experience. The City was unique in its attention to detail and its efforts to bring many different people into the process. Council recognized the contributions of everyone involved. Peter Thompson, resident, noted that he remains unsatisfied with the final outcome of the Comprehensive Plan revisions as it forces him, as well as 50 percent of the residences in his neighborhood (near the Park and Ride), to be out of compliance with City codes. Thompson indicated he had contacted legal counsel. Councilmember Robertson emphasized that while recommendations were made by Tukwila Tomorrow and the Planning Commission, the City Council is the only body that has the authority and responsibility to make final decisions on the Comprehensive Plan and Zoning Code. Mayor Rants reminded the audience of a process for amendments to the Comp Plan on a yearly basis with major implementation on a three year basis. Linda Cohen read AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, REPEALING ORDINANCE NOS. 1679, 1689, 1706, 1721 AND 1737 REGARDING THE HIGHWAY 99 HOTEL/MOTEL MORATORIUM, PROVIDING FOR SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE. MOVED BY DUFFIE, SECONDED BY HERNANDEZ, TO ADOPT ORDINANCE NO. 1759 AS READ.* MOVED BY ROBERTSON, SECONDED BY DUFFIE, TO AMEND THE ORDINANCE AS FOLLOWS: DELETE THE WORDS HOTEL/MOTEL IN THE TITLE AND THE FIRST WHEREAS CLAUSE AND REPLACE IT WITH THE WORDS CERTAIN USES MOTION CARRIED. *MOTION CARRIED AS AMENDED 7 -0. Mayor Rants administered the Oath of Office to Pam Linder and Jim Haggerton. Both Councilmembers will serve a two -year (short) term which will expire 12/31/97. A 10 minute recess was called. Mayor Rants called the meeting back to order with Councilmembers Duffie, Hernandez, Ekberg, Robertson, Mullet, Haggerton, and Linder in attendance. Council completed their review of the Proposed 1996 Budget. Mayor Rants reviewed his recommendations for reduction of $900,000 from the general fund and capital plan in order to balance the budget for 1996. Rants addressed the difficulties involved in attempting to balance the Six Year CIP in light of the continued decline in property tax revenue. He recommended a fiscal analysis Tukwila City Council Regular Meeting December 4, 1995 Page 7 Old Business (con't) Review of CIP REPORTS Council Staff MISCELLANEOUS be done after the first of the year in order to obtain a more accurate picture of the City's financial structure before attempting to balance the remaining portions of the CIP. Council discussed the budget for the new community center. Don Williams, Parks and Recreation Director, and Project Manager Randy Berg reviewed suggested modifications to the original design needed in order to stay within budget. City Administrator John McFarland announced that all bids on construction of the new fire station #53 had been rejected as they were all over budget. The City will go out for bids again in the Spring. Councilmember Duffie requested a report on the number of families who use the Way Back Inn and their length of stay. Councilmember Hernandez reported she attended and enjoyed a performance of the Rainier Symphony at Foster High School recently. Of concern, however, was the $10 ticket price to attend the performance. Hernandez suggested a discount be given to Tukwila residents and /or family groups. Councilmember Ekberg requested discussion on committee assignments and regional committee assignments be held at the December 18th Council meeting. City Administrator John McFarland reported the Mayor's office intends to send a letter supporting King County's motion requesting the King County Executive prepare a requirement that would limit air traffic out of Boeing Field. In addition, the motion also calls for a moratorium on extended leases until the strategic planning group completes their work and the Noise Study is concluded. Mayor Rants announced the legislature has scheduled public hearings throughout the state in January regarding the new Washington Administrative Code pertaining to public /private partnerships. Rants said he would provide complete information to the Council Analyst.
