The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. This letter serves as the Notice of Decision per TMC 18.104.170. Based on the latest project submittal, preliminary approval is granted subject to the conditions stated below. There are three basic steps in the short plat approval process: 1. Preliminary Approval This letter constitutes your preliminary approval. The application was reviewed by the Tukwila Short Subdivision Committee and approved with conditions. The conditions imposed are to ensure the short plat is consistent with the Criteria for Preliminary Approval listed at TMC 17.12.020 C in the Tukwila Subdivision Code. Conditions of Preliminary Approval 1. Remove the existing shed and greenhouse from Lot B. A shed or greenhouse must be accessory to a house on the same lot. Do not show them on the final plans for recording. Structures greater than 120 square feet require a demolition permit with the City of Tukwila prior to demolition. Contact the Permit Center at 206 - 431 -3670 to obtain a demolition permit if needed. 2. A draft copy of Private Ingress, Egress and Utilities Easement and Maintenance Agreement for review by Public Works. i. This shall be a separate document from the Final Short Plat map. This document shall be recorded prior to recording of the Final Short Plat Map, and the recording number be shown on the short plat map. ii. The Private Ingress/Egress & Utility Easement should include language stating who will maintain the paved area and utilities, and by what portion. (See enclosed) iii. The Private Easement and Maintenance Agreement should be for future development on new Lot 2 and existing Lot 17. A draft copy of the Private Sanitary Sewer Easement. i. This document shall be recorded prior to recording of the Final Short Plat Map, and the recording number be shown on the short plat map. (See enclosed) When submitting for final approval provide a title report showing that the title of the land is vested in the name of the owner whose signature appears on the plat's certificate. Supplemental Information 1. Do not include Civil Plans for recording. 2. Sheet CO1, Water Supply notes #6 should state a 48 "clear area around the fire hydrant not 36 ". 3. The applicant shall apply for a Public Works (PW) type `C' permit for approval. A Street Use will be part of this permit and require bonding, insurance, and a Hold Harmless Agreement for work within the Right -of -Way. These forms are available at http: / /www.ci.tukwila .wa.us /pubwks /pwpermit.html. 4. Fire, Parks, and Traffic Impact Fees will apply to future building permits. Appeals This short plat approval decision is appealable to the Hearing Examiner. One administrative appeal of the decision on the short plat, excluding challenges to the DNS, is permitted. If no valid appeals are filed within the time, limit the decision of the Department will be final. In order to appeal the decision a written notice of appeal must be filed with the Department of Community Development within 21 days of the issuance of the Notice of Decision (04/21/2009). The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. Appeal materials shall include: 1. The name of the appealing party. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee of $115 in LDR. Any appeal shall be conducted as an open record hearing before the Hearing Examiner. The Hearing Examiner's decision on the appeal is the City's final decision. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision pursuant to the procedures and time limitations set forth in RCW ch. 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. 2. Final Approval The next step is to comply with the conditions of approval and submit the necessary short plat documents. The surveyor's original signature is required on the face of the survey. All taxes and fees assessed against the property must be current prior to final approval. Please check with the King County Assessor's Office and the City of Tukwila Finance Department prior to submitting final documents. After the documents have been found to be in order, and the all of the requirements of the short plat have been met, the Chair of the Short Subdivision Committee signs your short plat which constitutes a grant of final approval. Expiration The final approved short plat must be filed with the King County Department of Records by March 31, 2010, one year from the date of this preliminary approval or the application will expire. The City may grant a single one year extension if requested in writing prior to the expiration date. 3. Recording The signature of the Chairman of the Short Subdivision Committee certifies that your short plat application is ready for recording. You will need to pay the recording fees and submit your approved original short plat to King County. The short plat is not complete until the recording occurs and copies of the recorded documents are provided to the Department of Community Development. After recording, the County returns the recorded original to the City of Tukwila within 4 -6 weeks, at which time your short plat is considered complete. You can shorten this processing time by hand - delivering a copy of the recorded short plat to the project planner. In many circumstances, building permits on the short platted property may not be issued until a copy of the recorded short plat (or original) is returned to the Department of Community Development. CIVIL • STRUCTURAL •.L AND USE :CFfl En MEMORANDUM TO: City of Tukwila FROM: Tim Gabelein, EIT DATE: January 16, 2009 RE: Tukwila Shor Plat Drainage Narrative DEVELOPMENT The proposed short plat is located at 4624 S 146th St in Tukwila. The short plat consists of the division of the existing lot into 2 lots. The resulting lots shall have areas of 38,106 SF (Lot 2 = north lot) and 8,865 SF (Lot 1 = south lot). A 29.00' easement will be created on the east side of the southern lot containing the proposed utilities and the proposed 20' driveway for the new northern lot. The easement is proposed at 29.00' wide to accommodate a 5' wide sidewalk that will be required if the north lot is subdivided further in the future. The total area of added impervious surface to the project site is 1,668 square feet. According to the 1998 King County Surface Water Design Manual, a project is exempt from flow control (Core Requirement #3) if less than 5,000 square feet of new impervious is added. Our project is within this allowable threshold and therefore is not required to provide flow control. There are currently no proposed structures or roads for the northern lot, so the utilities will be extended to the end of the new driveway at the lot boundary between the two lots. The utilities will be extended in the future if and when the northern lot is further divided and developed. A new 12" storm drain is proposed for the north lot and will be extended to the end of the new driveway along with the other utilities. The storm drain is proposed as 12" diameter to accommodate the projected future development of the north lot and sufficiently handle the flow associated with it. The proposed 12" line will extend from a Type II — 48" catch basin along the north side of S 146th St in the public right -of -way for approximately 200' east of the site where it will connect to an existing Type 1 catch basin in the shoulder. The existing 12" storm drain exits the Type 1 catch basin routed east down S 146th in the existing public storm drain until it reaches a dead end at the end of S 146th St. At this point it empties into a flow control structure which empties into a SD running down a moderate slope covered in rip - rap. From the bottom of the slope, the flow enters the public storm drain in 51st Ave S. A downstream analysis of the site showed no visible problems with the local drainage system and we anticipate there to be no adverse impact on the surrounding homes, properties, or existing storm system by the proposed short plat. See the Drainage Plan (C05) in the associated sheet set for the proposed drainage design.
