That letter outlined the maintenance requirements for the site and the requirement for monitoring and annual reporting to the City. As you know, you are required to submit monitoring reports through 2015. As you are aware, the City is holding a financial assurance from you to ensure that the restored area is monitored and maintained. If maintenance and monitoring are not performed, you risk having the City use the financial assurance to hire a biologist and maintenance crew to carry out site monitoring and maintenance. Since we have not received any monitoring reports, we would like to schedule an inspection of the buffer to see how well the plants are surviving and to evaluate the presence of invasive species. The Tukwila Department of Community Development conducted a final inspection on December 22, 2011 and accepted the remaining part of the mitigation that needed to be completed. Now that the work has been accepted, maintenance of the buffer area is your responsibility through April 9, 2015. The City normally requires submittal of detailed maintenance plans and monitoring reports, prepared by a qualified biologist, but since you did all the work yourself and due to your cooperation in restoring the site, we are willing to assist you in developing your own detailed maintenance and monitoring plan as presented below. Maintenance of the restored buffer area will include the following activities: 1. Hand weeding the restored areas by pulling weeds out by the roots, being careful not to disturb the roots of native plants. 2. Mowing or weed - wacking weeds frequently enough to keep invasive plants low (ivy, Reed Canarygrass, blackberry, etc.), or digging them out, thus preventing the native plants from being engulfed by them. The use of any plastic or fabric weed block is not allowed in the stream buffer. The use of herbicides is not allowed in the stream buffer without written permission from the City. 3. Watering plants during dry periods for at least 2 to 3 dry seasons (longer if necessary). A general rule of thumb is to apply at least 1 inch of water per week to each plant. 4. Replacing dead or dying plants or adding new plants where there is poor performance or survival (you can contact the City to obtain suggestions on where to purchase plants). For your site, the target would be 100% survival of the plants for the next year and healthy growing plants with good aerial coverage for the remaining years. If more plants than that die or if they are not healthy enough to provide coverage, you will be required to plant additional native plants. 5. Adding mulch (bark, wood chips, other organic materials) as needed to help control weeds and keep plants moist (no thicker than 3 inches around plants, keeping the mulch a few inches away from the crowns and trunks of the plants) 6. Once the plants are established and the invasive plants under control, the frequency of maintenance can be reduced, but the buffer plantings must be maintained in perpetuity. This information must be reported to the City once a year (per the City's Sensitive Areas Ordinance) starting next December. The monitoring report can be a simple letter format (handwritten is acceptable) and shall contain: 1. Owner name, address, site address and permit number. 2. The number of plants that died and a description of the condition of the surviving plants (such as health, amount of growth and spread). 3. Brief description of maintenance activities during the year, including any plant replacements. 4. Photographs (taken from approximately the same locations each year) in different areas of the stream buffer to document plant growth. Once the City receives each monitoring report, we will do an annual site inspection. As you are aware, the City is already holding a financial assurance from you to ensure that the restored area is monitored and maintained. If the property is sold, prior to that date, you will need to make arrangements to ensure that the new owner takes responsibility for the site maintenance and monitoring. This may include arranging for the financial assurance to be transferred to the new owner or refunded and re- established in the new owner's name. If you fail to do so, you risk having the City use the financial assurance that you provided to continue with site monitoring and maintenance. Even though the monitoring period ends in 2015, the restoration must be preserved in perpetuity, with no encroachments on the stream buffer or removal of any native vegetation (without a permit). I. PROJECT INFORMATION Project File Number: L09 -011 Applicant: Leroy Gray Type of Permit Applied for: Special Permission from the Director to deviate from the City's buffer requirements for a Type II stream. Project Description: Location: Associated Files: Comprehensive Plan Designation/Zoning District: Mr. Leroy Gray has applied for a Special Permission decision from the Director to reduce a Type 2 stream buffer from 100 feet to 50 feet. The request for a buffer reduction is to allow a change of use for a single family residence that is being converted to an office building and paving of an existing gravel parking that is required for the new use. Buffer enhancement plans were also required in response to a code violation for the dumping of gravel into the stream buffer without a permit. The applicant has provided an enhancement plan for the remaining buffer area. 12607 and 12609 East Marginal Way South D08 -520 (Development Permit) Commercial/Light Industrial II. DECISION SEPA Determination: The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt under WAC 197 -11 -800 (2), other minor new. construction. The following conditions have been placed on the project: 1. This permit does not allow for the construction of a pedestrian bridge across the stream. 2. Plants must be watered during at least the first two dry seasons until well established. Frequency of watering shall be sufficient to ensure plant survival, generally 1 -2 inches per week in dry periods. 3. Annual replacement of plants and mulching materials is acceptable, but monthly maintenance of invasive plants is necessary. 4. No herbicide use is allowed in the stream buffer without the written permission of the City of Tukwila. 5. Owner shall submit annual monitoring reports to the City for five years, starting approximately one year after the plants are installed. The report may be prepared by the owner (or contracted out to a biologist), and should include: site address, permit number, original plant list and plant count, percent survival rate, percent of invasive plants present in the buffer, photos, and maintenance activities carried out during the year. The City will schedule inspections annually after reports are received. 6. The applicant shall provide a bond or cash assignment in the amount of 150% of the cost of the wetland mitigation and monitoring prior to final approval of the associated building permit (D08 -520). City staff has estimated maintenance and monitoring costs for 5 years to be $10,560, so the bond amount or cash assignment will be in the amount of $15,840. III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code §18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the Planning Commission of the Decision on the Permit itself is permitted. If an MDNS was issued, any person wishing to challenge either the conditions which were imposed by the MDNS decision or the failure of the Department to impose additional conditions in the MDNS must raise such issues as part of the appeal to the Planning Commission. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Planning Commission decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director's decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 21 days of the issuance of this Decision, which is by April 16, 2010. The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee of $235. V. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as an open record hearing before the Planning Commission based on the testimony and documentary evidence presented at the open record hearing. The Planning Commission decision on the appeal is the City's final decision. Any party wishing to challenge the Planning Commission decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. If no appeal of the Planning Commission decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. The City's decision to issue a DNS, an MDNS or an EIS is final for this permit and any other pending permit applications for the development of the subject property. VI. INSPECTION OF INFORMATION ON THE APPLICATION Project materials including the application, any staff reports, and other studies related to the permits are available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The project planner is Courtney Thomson, who may be contacted at (206) 431 -2164 or cthomson @ci.tukwila.wa.us for further information. Property owners affected by this decision may request a change in valuation for their property tax purposes. Contact the King County Assessor's Office for further information regarding property tax valuation changes. SEPA This project is exempt from the State Environmental Policy Act under WAC 197 -11 -800 (2), Other minor new construction. BACKGROUND Mr. Leroy Gray has applied for a Special Permission decision from the Director to allow a reduction in the buffer width of a Type 2 stream on the properties located at 12607 and 12609 East Marginal Way South. The request for a buffer reduction is in response to the change of use of an existing house that is being converted into an office building as well as the addition of associated paved parking that is required for the new use. The buffer enhancement plan is also required in response to a code violation for dumping gravel into a stream buffer without a permit. A Type 2 stream with a 100 -foot buffer runs through the west three- quarters of the applicant's property. The purpose of the buffer setback is to allow preservation of the function of the buffer area. The buffer and setbacks on this property and the surrounding properties are degraded with homes, lawn, gravel and paving. The proposed parking lot will be located on an existing gravel area, half of which is in the buffer area. In Mr: MacVeigh's March 6th letter, he requested that a 3 -foot wide pedestrian footbridge be installed across the stream to assist with maintenance and inspection of the rear sensitive area improvements. This footbridge was not included in the original application, is not approved as part of this Special Permission Permit, but will be reviewed separately. _DECISION CRITERIA TMC 18.45.100 (F) permits the Director to reduce a buffer width based upon the following criteria: CT Page 1 of 3 W: \Users \Courtney \L Files \L09-011 Sensitive Area Buffer Reduction\2010_03_26_SR.doc 03/25/2010 12:00 PM • • a) The reduced buffer area does not contain slopes over 15 %; The buffer reduction area is relatively flat with the exception of a small area that is adjacent to the rear portion of the existing house and gravel parking lot, but no construction or paving will take place here. This buffer reduction will not increase the impact on slopes over 15 %. b) The buffer reduction is not greater than 50 %; The buffer for a Type 2 Watercourse is 100 feet and the applicant is requesting to reduce the buffer to 50 feet, which does not exceed the 50% maximum. c) The buffer is vegetated and includes an enhancement plan as may be required to improve the buffer function and value; or The buffer was characterized by a narrow strip of native tree overstory, but the understory consisted of blackberry and other invasive plants. City staff has been working with the applicant to develop an enhancement plan for the stream buffer, to provide improved buffer function through the addition of native plantings that will help shade the stream and improve vegetation diversity and coverage. To date, invasive plants have been cleared and numerous native trees, shrubs and groundcover have been planted along both sides of the stream. The applicant is in the process of applying wood chips as mulch. The applicant has submitted an enhancement plan showing the general location of these plantings. d) If there is no significant vegetation in the buffer, a buffer may be reduced only if an enhancement plan is provided. The plan must include using a variety of native vegetation that improves the functional attributes of the buffer and provides additional protection for the watercourse functions and values. The applicant has submitted an "as- built" enhancement plan that shows where a variety of native vegetation has been or will be installed, including Douglas Fir, Western Red Cedar, White Pine, Alpine Fir, as well as others as listed on the Stream Bank Buffer Vegetation Documentation and Enhancement Plan, which was prepared by Bruce MacVeigh and submitted to the City on March 9, 2010. MITIGATION PLAN TMC 18.45.090 B ALTERATIONS states that a mitigation or enhancement plan must be developed and must comply with the standards of mitigation required in TMC Chapter 18.45. The applicant has submitted a mitigation plan, showing which plantings have already been added to the buffer area. The removal of invasive species and the planting of new native vegetation will significantly improve buffer function over time compared to the previous conditions on both sides of the stream. Existing native trees have been maintained in the buffer. The owner will be responsible for maintaining the buffer plantings (including irrigating plants) and manually controlling invasive plants for a period of 5 years after the buffer enhancement is accepted by the City. The owner will be required to submit annual monitoring reports to the City, starting approximately one year after the plants are installed, for a 5 year period. The report may be prepared by the owner (or contracted out to a biologist), and should include: site address, permit number, original plant list and plant count, percent survival rate, percent of invasive plants present in the buffer, photos, and maintenance activities carried out during the year. The City will schedule inspections annually after reports are received. This buffer reduction will not increase the impact to slopes greater than 15 %. 2. No portion of the planned additions to the house or associated parking lot will be located closer than 50 feet from the stream, so a buffer reduction of greater than 50% will not occur. 3. An acceptable mitigation planting plan that includes a variety of native plantings to enhance the stream buffer area has been submitted by the applicant. 4. The pedestrian footbridge is not approved as part of this permit. RECOMMENDATION Staff recommends approval of the Special Permission permit with the following conditions: 1. Much of the buffer area had encroaching blackberry plants, and the area was littered with old junk and debris. The junk and debris was removed by hand. The encroaching vegetation, primarily blackberry plants, was also removed by hand, including removal of their roots. The stream, typically 3 to 6 feet wide with 6 inch to 12 inch banks, was not altered, except to remove debris. All substantial trees, as shown on the drawing, were preserved. Significant numbers of new trees were planted is scattered locations, with attention to the wetness of the soil in the planting areas. Their locations are also shown on the drawing. Numerous small trees, shrubs and ferns were also planted in scattered locations, with attention to whether it was a wet soil area or and "upland" area. Their locations are too numerous to show on the drawing, however the types of plants and number planted are shown. The plants will be monitored in the future to assist their survival. A small decorative commercial metal bridge 3 feet wide has been installed across the stream to allow access to the rear portion of the planting area for maintenance and inspection. It does not restrict stream flow. • • RECEIVED MAR 0 9 2010 COMMUNITY DEVELOPMENT In a wet trace area flowing from the west property line at the northwest of the site, and several other low areas, the skunk cabbages in place were preserved. An attractive but useful fence will be placed at the buffer limit to minimize disturbance of the stream and the new plantings. A gate will be provided to allow access for maintenance and inspection of the area. The existing significant trees were mapped by this office on February 22, 2010. The locations of the new trees planted were mapped by this office on March 4, 2010. Note that the location of the stream and pathway are reasonable accurate, but not precise, due to difficulties mapping their irregular layout. In addition, the exact caliper and type of existing trees is believed to be reasonably accurate, but may vary due to the lack of foliage at this time of year. Courtney Thompson and I visited the site on 4/22/10 to observe progress made on the buffer enhancement to date. At that time we discussed the need to do additional planting in the easternmost buffer area, especially on the top of the slope on the south lot. You indicated that you would do the planting in the fall of 2010 (because you were going to be out of the state for the summer months) and the City agreed that this was acceptable. During that visit we also discussed the need to remove or modify the footbridge because it is adversely impacting the stream banks, and could start to cause erosion. You indicated that you would weld some pieces on to the bottom of the frame to extend it so that the feet rest further back away from stream bank edge. The City agreed that this would be acceptable if done correctly. The City accepted the plants that had been installed as of the date of the site visit in April, with the understanding that you would finish the planting in the fall. To our knowledge this has not been done. Please finish the planting in the areas indicated and let me know when they are installed so that I can schedule an inspection. As a reminder, all plants must be native to the Puget Sound area. Shrubs need to be planted about 3 or 4 feet apart and trees 8 or 9 feet apart. On the slope, you should put in plants that can take dry conditions — such as Douglas Fir, Shore Pine, Red Flowering Currant, and Tall Oregon Grape. Feel free to contact me if you have any questions. Provide schedule (when will invasive plants be cut, covered with cardboard and wood chips, when will plants be installed ?) 2. Provide sign detail - what size, material, wording is proposed? Signs must be wood or metal and have some language such as: "This sensitive area is in your care, do not disturb. Contact the City of Tukwila for more information (206) 431 - 3670" or similar wording. 3. Provide details on temporary irrigation. Plants must be watered during at least the first two dry seasons until well established. Provide details about how watering will be done (sprinklers ?, soaker hoses ?, water source ?, frequency during dry periods ?, who will water ?). Frequency of watering shall be sufficient to ensure plant survival - generally 1 - 2 inches per week in dry periods. 4. Provide more detail about maintenance and monitoring. The City will require a 5 year maintenance and monitoring period, starting from the time when the buffer enhancement planting is deemed complete upon inspection by the City. Provide details on who will do the maintenance and reporting. Annual replacement of plants and mulching materials is acceptable, but monthly maintenance of invasive plants is necessary (blackberries will try and come up through gaps in the cardboard and must be kept regularly cut - or have the roots removed - to keep them from coming back). 5. Provide cost estimate for the above 5 year maintenance and monitoring period (including watering, cost of plant replacement, placement of additional cardboard and wood chips in order to arrive at a reasonable value.) This estimate will be reviewed by the city. A bond or other financial assurance device will be required for 150% of the value of maintenance and monitoring activities, and must be received prior to issuance of this permit. Owner shall submit annual monitoring reports to the City, starting approximately one year after the plants are installed. The report may be prepared by the owner (or contracted out to a biologist), and should include: site address, permit number, original plant list and plant count, percent survival rate, percent of invasive plants present in the buffer, photos, and maintenance activities carried out during the year. The City will schedule inspections annually after reports are received. 3. The owner is also responsible for ensuring that the following conditions are met and must communicate the them to the landscape contractor: a. Plant list and plant spacing must be consistent with the Teufel's Cost Proposal dated January 4, 2010. Any plant substitutions must be approved by the City prior to planting. b. Plant quality: plants must not be rootbound or have circling roots. c. Inspection: Since there is no detailed planting plan, the plant layout must be approved by the City Urban Environmentalist prior to planting. Several days notice must be provided to schedule the inspection. d. Plant installation: i. Root balls must be scarified or loosened prior to planting. ii. Plants are to be installed at the same depth as the root ball, so that the entire root ball is surrounded by soil and does not extend above the soil surface. iii. After planting cardboard and wood chip mulch must be kept 2 -3 inches away from the crown/trunk/stems of the plant. iv. Only slow- release transplant fertilizer is allowed.
