I. PROJECT INFORMATION Project File Number: L09 -016 Applicant: Rick Cardoza for Verizon Wireless Type of Permit Applied for: Type 1 Wireless Telecommunications Facilities Permit Project Description: Modification of an existing antenna, which includes relocating two existing sectors to the top of tower, replacing panel antenna, and replacing coax. The height of the existing monopole is 121'. Some of the antennas were attached at 121' and others at 71'. This proposal is to relocate the antennas at 71' to 121' and add some new antennas at 121'. Location: 13130 44`h Avenue South Associated Files: N/A Comprehensive Plan Commercial/Light Industrial (C/LI) Designation/Zoning District: II. DECISION SEPA Determination: The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on Substantive Permit: The City Community Development Director has determined that the application for a Type 1 Wireless Telecommunications Facility does comply with applicable City and state code requirements and has approved that application, subject to any conditions which are set forth in the Decision. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code § 18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted. If an MDNS was issued, any person wishing to challenge either the conditions which were imposed by the MDNS decision or the failure of the Department to impose additional conditions in the MDNS must raise such issues as part of the appeal to the Hearing Examiner. A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision, that is by May 20, 2009. The requirements for such appeals are set forth in Tukwila Municipal Code ch. 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee of $225. V. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the Hearing Examiner based on the information presented to the Community Development Director, who made the original decision. No new evidence or testimony will be permitted during the appeal hearing. Parties will be allowed to present oral argument based on the information presented to the Community Development Director before their decision was issued. The Hearing Examiner's decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW ch. 36.70C. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. The City's decision to issue a DNS, an MDNS or an EIS is final for this permit and any other pending permit applications for the development of the subject property. VI. INSPECTION OF INFORMATION ON THE APPLICATION Project materials including the application, any staff reports, and other studies related to the permits are available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The project planner is Courtney Thomson, who may be contacted at 206 - 431 -2164 or via email at cthomson @ci.tukwila.wa.us for further information. Property owners affected by this decision may request a change in valuation for their property tax purposes. Files \2009_05_06_WCF_StaffReport.doc • • FINDINGS Vicinity /Site Information Project Description The applicant is requesting approval of a Type I Wireless Telecommunication Facilities [WCF] Permit to modify an existing antenna at 13130 44`h Avenue South. The project includes relocating two existing sectors to the top of tower, replacing panel antenna, and replacing coax. The height of the existing monopole is 121'. Some of the antennas were attached at 121' while some were at 71'. This proposal is to relocate the antennas at 71' to 121' and add some new antennas at 121'. Existing Development Aside from the tower, the only existing structures on the parcel are two equipment shelters. Surrounding Land Uses The property and all adjacent parcels are zoned C/LI. The site is bordered to the south by South 133rd Street and to the west by Highway 599. BACKGROUND In 2006, the City adopted a Wireless Facilities Chapter (TMC 18.71) to the Zoning Code. The chapter provides specific location and design requirements for the placement of WCF within the City of Tukwila. The WCF being modified was originally approved by the City in 2000 (L2000 -050) through a conditional use permit. Location Selection Tukwila Municipal Code (TMC) provides a hierarchy of appropriate locations within the City. Generally, co- locations and utilizing existing structures are favored over the development of new standalone WCF within the City. An applicant may request to install a non - concealed building attached facility, under TMC Section 18.58.150. The applicant is modifying an existing transmission tower co- location antenna. This decision does not require the use of any new facilities for placement of the new antennas. Design Standards The City provides specific design standards for the placement of WCF within the City of Tukwila. The table below indicates if the applicant's proposal complies with required standards. Generators must comply with TMC 8.22 regarding noise. 2.Business License Requirement Verizon has a business license with the City. 3. Only safety signage must be placed on the WCF The applicant does not propose any signage. 4. Accommodations for parking for maintenance personal must be provided. Towers shall either maintain a galvanized steel finish or be painted a neutral color so as to reduce its visual obtrusiveness. Existing tower will maintain its galvanized steel finish. 6. The design of all buildings and ancillary structures shall use materials, colors, textures, screening, and landscaping that will blend the tower facilities to the natural setting and built environment. No new buildings or structures are proposed. 7. Antennas shall have the same color scheme as the structure they are located on. Replaced antennas will match existing materials. 8. WCF poles and towers shall only have safety lights if required by a government agency. No lighting is proposed. 9. No advertising is permitted on WCF No advertising is proposed. 10. Each service provider shall be limited to an equipment enclosure of 360 square feet. No new equipment enclosures are proposed. 11. In residential zones, the height of the replaced utility pole is limited to 10 above the replaced pole and no taller than 50. The existing facility being modified is not within a residential zone and the proposal is not for a utility pole relocation. 12. The replaced utility pole must be used by the owner of the utility pole to support their utility lines. This is not a utility pole facility. This is not a utility pole facility. 14. Coaxial cables greater than one -half inch in diameter must be within the utility pole. Coaxial cables will be routed inside pole. 15. The proposal shall not result in a significant change in the pedestrian environment or preclude the City from making pedestrian improvements. The proposed modifications will not affect pedestrian facilities. 16. All cabinet equipment must be placed outside of the City ROW, unless an exception is granted. The cabinet equipment is not mounted in the public ROW. 17. The WCF shall meet setbacks for the zone in which it is locate, unless an exception is granted. The WCF meets setbacks for the C /LI zone. 18. When adding antennas to existing WCF towers, height must not exceed what was approved under the original application to construct the tower. The height remains the same as that approved previously. 19. Antennas shall be painted to match the color scheme of tower. Antennas and tower are galvanized steel. 20. Feed lines and coaxial cables shall be located within the tower. Coaxial cables will be routed inside tower. A new cabinet No new cabinet is proposed. shall be located within the equipment enclosure that was approved as part of the original application. CONCLUSIONS 1. The proposed modifications to the existing antenna will not significantly alter the conditions that currently exist. The height of the antenna and the number of antennas will not change. 2. All coaxial cables and feed lines will be routed inside the tower. 3. As demonstrated in Table 1 the project meets all applicable development standards. 4. The proposed modifications will not alter the surrounding land uses in terms of traffic and pedestrian circulation, building or site design. 5. No noise will be generated from the new antennas being installed. 6. The wireless communications facility has been designed in a way to minimize any visual impact from the project. 7. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. RECOMMENDATIONS The recommendation to the Director of Community Development is to approve this application for a Type I Wireless Telecommunication Facility permit as applied for by Verizon Wireless with no conditions. The radio frequency engineer report shall include a discussion of the information required under TMC Section 18.58.070. The report shall also explain why a tower must be used instead of any of the other location options outlined in Table A. 17. Engineering Plans for the proposed tower. 18. A vicinity map depicting the proposed extent of the service area. 19. A graphic simulation showing the appearance of the proposed tower and ancillary structures and ancillary facilities from five points within the impacted vicinity. Such points are to be mutually agreed upon by the Director of DCD and applicant. All plans and photo simulations shall include the maximum build -out of the proposed facility. 20. Evidence of compliance with Federal Aviation Administration (FAA) standards for height and lighting and certificates of compliance from all affected agencies. 21. Evidence that the tower has been designed to meet the minimum structural standards for wireless communication facilities for a minimum of three providers of voice, video or data transmission services, including the applicant, and including a description of the number and types of antennas the tower can accommodate.
