DECISION SEPA Determination: The City SEPA Responsible Official has previously determined that the project is exempt from SEPA review and has not required the submittal of a SEPA Checklist. Decision on Substantive Permit: The Community Development Director has determined that the application for a TYPE II WIRELESS COMMUNICATIONS PERMIT does comply with applicable City and state code requirements and has approved that application, subject to any conditions which are set forth in the Decision based on the findings and conclusions contained in the staff report dated July 14, 2009. The following conditions have been placed on this project: 1. Prior to issuance of a building permit, the applicant shall provide sufficient proof that ALL existing antennas at the project site are being used. The applicant shall identify the provider using the antennas and each provider shall have a business license as required by TMC 18.58.070 (2). If the antennas are not being used they shall be removed pursuant to TMC 18.58.190 and all supporting infrastructure shall also be removed. 2. Prior to final approval of the building permit, Cricket shall secure a business license from the City of Tukwila for this specific location. III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code §18.104.010. One administrative appeal to the Hearing Examiner of the Decision on the Permit itself is permitted. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Hearing Examiner decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director's decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision, that is by August 17, 2009. The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. These antennas will be considered "non- concealed ". Additionally, the applicant will add additional ground equipment for the wireless communication facility (WCF) on the roof top. Typically replacing antennas with like antennas would be exempt from land use permit review by the City. However, since new ground equipment is being installed on the rooftop review of the application as a type II application is required. Existing Development The property is zoned Tukwila Urban Center (TUC). A 94 foot tall hotel building is located on the site which is occupied by Embassy Suites. There is also associated parking located on the site. The applicant has proposed to replace antennas that were previously approved for Metricom Communication in 2000 (L2000 -008). According to the applicant the Metricom facility is no longer be utilized and is abandoned. The application does not propose to remove the remnants of the old facility. Surrounding Land Uses All surrounding properties are zoned Tukwila Urban Center. A hotel is located to the south of the project site; West Valley Hwy is located to the east; Longacres Way is located to the north; and the railroad is located to the east. BACKGROUND In 2006, the City adopted a Wireless Facilities Chapter (TMC 18.71) to the Zoning Code. The chapter provides specific location and design requirements for the placement of WCF within the City of Tukwila. Location Selection Tukwila Municipal Code (TMC) provides a hierarchy of appropriate locations within the City. Generally, co- locations and utilizing existing structures are favored over the development of new standalone WCF within the City. The applicant has chosen to install a non - concealed WCF on an existing commercial building in a commercial zone. In most cases the City prefers that a concealed mounted antenna be used, however given the large size of the building compared to the size of the antennas, the applicant is proposing to install non - concealed antennas. Additionally, the applicant is proposing to replace existing antennas for a facility that the City had previously approved in 2000. WIRELESS COMMUNICATION FACILITY CRITERIA (TMC 18.58) General Design Standards (TMC 18.58.070) The City provides general design standards for the placement of WCF within the City of Tukwila. An additional business license will need to be obtained for this location. The purpose of obtaining a business license is that in case of an emergency City staff knows who to contact. 3. Only safety signage must be placed on the WCF %( 4. Accommodations for parking for maintenance personnel must be provided. 1/ There are existing parking stalls on the site that provide sufficient parking for the proposed WCF. 5. The design of all buildings and ancillary structures shall use materials, colors, textures, screening, and landscaping that will blend the tower facilities to the natural setting and built environment. Request to Use Non - Concealed Building Attached WCF in Lieu of a Concealed Building Attached WCF (TMC 18.58.140) The applicant has proposed to use a non - concealed building WCF in lieu of using a concealed building attachment. Under the City's hierarchy of preferred WCF facilities type, a concealed WCF is preferred over a non - concealed. However, the City has recognized that in some cases using a concealed WCF is not practical and in some cases can have a greater aesthetic impact than if a non - concealed facility was used. If the building where the facility is located is at or above the maximum height requirements, the antennas are permitted to extend to a maximum of 3 feet above the existing roof line. Non - concealed building mounted facilities shall not qualify as a "Rooftop Appurtenances under TMC 18.50.080. the TUC zone is 115 feet. The first preference for any proposed facility is to utilize flush - mounted antennas. Nonflush- mounted antennas may be used when their visual impact will be negated by the scale of the antennas to the building. "Shrouds" are not required unless they provide a better visual appearances than exposed antennas. CONCLUSIONS 1. As demonstrated in Tables 1, 2 and 3 the project meets all applicable development standards for the proposed type of WCF. 2. Potentially dangerous cabinet equipment will be secured from the public by placing it on the rooftop of the building. 3. The proposed use of a non - concealed attached WCF is appropriate given the building size and design. Additionally, the overall size of the building will assist in screening the antennas from view. 4. No noise will be generated from the new antennas. All ground equipment has been placed indoors and the applicant is not proposing to install a generator. 5. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. 6. The applicant will be required to obtain development permits from the City's Building Division for the proposed construction. 7. Cricket Communications does not have a business license for this specific location as required by TMC 18.58.070 (2). However, one can easily be obtained from the City. The purpose of the business license requirement is so that City staff has contact information for the actual entity utilizing the WCF. 8. As noted, the applicant will be utilizing a facility that was previously approved by the City in 2000. The applicant has proposed to replace some of the antennas from that were approved for MetroCom. TMC 18.58.190 provides requirements for the removal of abandoned wireless communication facilities. B. (Sitesafe), an independent Radio Frequency (RF) regulatory and engineering consulting firm, to determine whether the communications site, SEA -019 -A - Embassy Suite, located at 15920 West Valley Highway, Seattle, WA, is in compliance with Federal Communication Commission (FCC) Rules and Regulations for RF emissions. Sitesafe's field personnel visited SEA -019 -A - Embassy Suite on March 3, 2009. This report contains a detailed summary of the RF environment at the site including: • photographs of the site; • diagram of the site; • inventory of the make / model of all transmitting antennas found on the site (where possible); • tabulation of any Maximum Permissible Exposure ( "MPE ") measurements taken on the site, as applicable; and • theoretical MPE based on modeling. This report addresses exposure to radio frequency electromagnetic fields in accordance with the FCC Rules and Regulations for all individuals, classified in two groups, "Occupational" and "General Public." All computer modeling and analytical methods have been performed in accordance with the FCC's Office of Engineering and Technology Bulletin 65 ( "OET Bulletin 65 "), Evaluating Compliance with FCC Guidelines for Human Exposure to Radio Frequency Electromagnetic Fields, Edition 97 -01, published August 1997. This document specifically addresses compliance of Cricket Communications's transmitting facilities independently and in relation to all collocated transmitting facilities, which together constitute the RF environment at the site. Any deviation from the Cricket Communications proposed deployment plan could result in the site being rendered non - compliant. 1.3 Actions for Site Compliance R. Safety Recommendations Based on common industry practice and our understanding of FCC and OSHA requirements, this section provides a statement of recommendations for site compliance. RF alert signage recommendations have been proposed based on existing measurements and theoretical analysis of MPE levels. Barrier locations have been identified where required for compliance and /or Cricket Communications policy. Barriers can consist of locked doors, fencing, railing, rope, chain, paint striping or tape, combined with RF alert signage. This site is conditionally compliant with the FCC rules and regulations. In its field visit, Sitesafe documented the presence and location of signs and barriers. Areas that require action in order to meet corporate policy are listed below. At that time, a diagram of the site was verified, obtained or produced, of the locations of all accessible antennas on site. These antennas were recorded and photographed, and the transmitting operator's power and antenna types were verified or collected. 2.1 Site Access Procedures The following general information was gathered regarding site access at the facility. Site access was locked at the time of the site visit. Building Engineer was required to unlock the door for Sitesafe field personnel. There was no RF Advisory signage posted at any site access point. Figure 1: Site Access 2.2 Transmitting Antenna Inventory The Antenna Inventory shows all transmitting antennas on the site (see Section 3). This inventory was verified on site, and was utilized by Sitesafe to perform software modeling of RF emissions. The inventory coincides with the site diagrams in this report, identifying each antenna's location at SEA -019 -A - Embassy Suite. Actual measurements locations at which these data points were collected are included in the RF emission diagram provided in Section 3.2 of this report. Measurements collected include both maximum and spatial average values. The spatial averaging technique involves measuring the average power density over the dimensions of a typical human body. . The measurements below were obtained from accessible areas located at the site at the time of Sitesafe's visit. Whenever possible, measurements are taken in front of the antenna in the transmitting direction. However, because of the antenna configuration at this site, specific emissions could not be discerned from nearby facilities, and no attempt was made to determine power density levels from a specific transmitting antenna. For this reason, all measurements below 1% are identified as <1% in our reports. Measurements provide a view of MPE percentage levels at the site at the time of Sitesafe's visit and are used to validate modeling results. Theoretical modeling is used for determining compliance and the percentage of MPE contribution, unless measured results exceed predictive modeling. Software modeling was performed for all transmitting antennas located on the site. Sitesafe has further assumed a 100% duty cycle and maximum radiated power. The site has been modeled with these assumptions to show the maximum RF energy density. Sitesafe believes this to be a worst -case analysis, based on best available data. Areas modeled to predict emissions greater than 100% of the applicable MPE level may not actually occur, but are shown as a worst -case prediction that could be realized real time. Sitesafe believes these areas to be safe for entry by occupationally trained personnel utilizing appropriate personal protective equipment (in most cases, a personal monitor). Thus, at any time, if power density measurements were made, we believe the real - time measurements would indicate levels below those depicted in the RF emission diagram(s) in this report. By modeling in this way, Sitesafe has conservatively shown exclusion areas - areas that should not be entered without the use of a personal monitor, carriers reducing power, or performing real -time measurements to indicate real -time exposure levels. Use of Generic Antennas For the purposes of this report, the use of "Generic" as an antenna model, or "Unknown" for an operator means the information about a carrier, their FCC license and /or antenna information was not provided and could not be obtained while on site. General Population /Uncontrolled Environment - defined by the FCC, as an area where RFR exposure may occur to persons who are unaware of the potential for exposure and who have no cont rol of their exposure. Effective Radiated Power (ERP) - In a given direction, the relative gain of a transmitting antenna with respect to the maximum directivity of a half wave dipole multiplied by the net power accepted by the antenna from the connecting transmitter. Equivalent Isotropic Radiated Power (EIRP) - The product of the power supplied to the antenna and the antenna gain in a given direction relative to an isotropic antenna. Transmitter Power Output (TPO) - The radio frequency output power of a transmitter's final radio frequency stage as measured at the output terminal while connected to a load. Maximum Permissible Exposure (MPE) - The rms and peak electric and magnetic field strength, their squares, or the plane -wave equivalent power densities associated with these fields to which a person may exposed without harmful effect and with acceptable safety factor. Duty Cycle - The percent of pulse duration to the pulse period of a periodic pulse train. Also, may be a measure of the temporal transmission characteristic of an intermittently transmitting RF source such as a paging antenna by dividing average transmission duration by the average period for transmission. Specific regulations regarding this topic are listed in Part 1, Subpart I, of Title 47 in the Code of Federal Regulations. Currently, there are two different levels of MPE - General Public MPE and Occupational MPE. An individual classified as Occupational can be defined as an individual who has received appropriate RF training and meets the conditions outlined below. General Public is defined as anyone who does not meet the conditions of being Occupational. FCC and OSHA Rules and Regulations define compliance in terms of total exposure to total RF energy, regardless of location of or proximity to the sources of energy. It is the responsibility of all licensees to ensure these guidelines are maintained at all times. It is the ongoing responsibility of all licensees composing the site to maintain ongoing compliance with FCC rules and regulations. Individual licensees that contribute less than 5% MPE to any total area out of compliance are not responsible for corrective actions. OSHA has adopted and enforces the FCC's exposure guidelines. A building owner or site manager can use this report as part of an overall RF Health and Safety Policy. It is important for building owners /site managers to identify areas in excess of the General Population MPE and ensure that only persons qualified as Occupational are granted access to those areas. Occupational Environment Explained The FCC definition of Occupational exposure limits apply to persons who: • are exposed to RF energy as a consequence of their employment; • have been made aware of the possibility of exposure; and • can exercise control over their exposure. OSHA guidelines go further to state that persons must complete RF Safety Awareness training and must be trained in the use of appropriate personal protective equipment. In order to consider this site an Occupational Environment, the site must be controlled to prevent access by any individuals classified as the General Public. Compliance is also maintained when any non - occupational individuals (the General Public) are prevented from accessing areas indicated as Red or Yellow in the attached RF Emissions diagram.
