The applicant is requesting approval of a type II Wireless Facilities Permit to install six
(6) new antennas on the Double Tree Guest Suites building. These six (6) proposed
antennas will be in three (3) sectors with two (2) antennas per sector. Two of the sectors
will be concealed by an 8' high enclosure. The third sector will be mounted to the
penthouse wall and will be considered "non- concealed ". The applicant has also proposed
the installation of one new equipment cabinet on the rooftop that will be concealed by the
parapet wall.

II. DECISION
SEPA Determination: The City SEPA Responsible Official has previously determined that this application does not require
a SEPA threshold determination because it is categorically exempt.
Decision on Substantive Permit: The Community Development Director has determined that the application for a Type II
Wireless Communications Facility Permit complies with applicable City and state code requirements and has approved that
application, subject to any conditions which are set forth in the Decision based on the findings and conclusions contained in
the staff report.

The application is approved subject to the following conditions:
1. Prior to final approval of the building permit, Cricket shall secure a business license from the City of Tukwila for
this specific location.
III. YOUR APPEAL RIGHTS
The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code § 18.104.010. Other
land use applications related to this project may still be pending.
One administrative appeal to the Hearing Examiner of the Decision on the Permit itself is permitted.
A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior
Court from the Hearing Examiner decision.
IV. PROCEDURES AND TIME FOR APPEALING
In order to appeal the Community Development Director's decision on the Permit Application, a written notice of appeal
must be filed with the Department of Community Development within 14 days of the issuance of this Decision, which is
by July 29, 2009.
The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials shall be
submitted to the Department of Community Development. Appeal materials MUST include:
1. The name of the appealing party.
2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other
group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf.
3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific
challenge to an MDNS.
4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision
being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal
shall be limited to matters or issues raised in the Notice of Appeal.
5. Appeal fee of $225.
V. APPEAL HEARINGS PROCESS
Any administrative appeal regarding the Permit shall be conducted as an open record hearing before the Hearing
Examiner based on the testimony and documentary evidence presented at the open record hearing. The Hearing
Examiner's decision on the appeal is the City's final decision.
Any party wishing to challenge the Hearing Examiner decision on this application must file an appeal pursuant to the
procedures and time limitations set forth in RCW 36.70C. If no appeal of the Hearing Examiner decision is properly filed
in Superior Court within such time limit, the Decision on this permit will be final.

VI. INSPECTION OF INFORMATION ON THE APPLICATION
Project materials including the application, any staff reports, and other studies related to the permits are available for
inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington
98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The project planner is Courtney Thomson, who may be
contacted at 206 - 431 -2164 for further information.
Property owners affected by this decision may request a change in valuation for their property tax purposes. Contact the King
County Assessor's Office for further information regarding property tax valuation changes. The notice board must be
removed at the expiration of the appeal period if no appeal is filed.

FINDINGS
Vicinity /Site Information
Project Description
The applicant is requesting approval of a type II Wireless Facilities Permit to install six (6) new
antennas on the Double Tree Guest Suites building. These six (6) proposed antennas will be in
three (3) sectors with two (2) antennas per sector. Two of the sectors will be concealed by an 8'
high enclosure. The third sector will be mounted to the penthouse wall and will be considered
"non- concealed ". The applicant has also proposed the installation of one new equipment cabinet
on the rooftop that will be concealed by the parapet wall.
Existing Development
The property is zoned Tukwila Urban Center. Currently a 90' tall hotel building is located on the
site, which is occupied by Double Tree Guest Suites. There is also associated parking located on
the site.
Surrounding Land Uses
All surrounding properties are zoned Tukwila Urban Center. An office building, gasoline service
station, and retail buildings border the northern property line site; the Target shopping center is
to the northeast; Tukwila Pond is to the east; two commercial properties border the site to the
south; Outback Steakhouse lies southeast; and McDonald's is to the west.
BACKGROUND
In 2006, the City adopted a Wireless Facilities Chapter (TMC 18.71) to the Zoning Code. The
chapter provides specific location and design requirements for the placement of WCF within the
City of Tukwila.
Location Selection
Tukwila Municipal Code (TMC) provides a hierarchy of appropriate locations within the City.
Generally, co- locations and utilizing existing structures are favored over the development of new
standalone WCF within the City.
The applicant has chosen to install four (4) concealed antennas and two (2) non - concealed
antennas on an existing commercial building in a commercial zone. In most cases the City
prefers that a concealed mounted antenna be used, however given the large size of the building
compared to the size of the antennas, the applicant is proposing to install two non - concealed
antennas.

III. WIRELESS COMMUNICATION FACILITY CRITERIA (TMC 18.58)

The City provides general design standards for the placement of WCF within the City of Tukwila. The

The applicant has proposed to use a non - concealed building WCF in lieu of using a concealed building
attachment. Under the City's hierarchy of preferred WCF facilities type, a concealed WCF is preferred
over a non - concealed. However, the City has recognized that in some cases using a concealed WCF is
not practical and in some cases can have a greater aesthetic impact than if a non - concealed facility was
used. The City allows an applicant to request to use a non- concealed WCF is lieu of a concealed under
the following requirements:

CONCLUSIONS
1. As demonstrated in Tables 1, 2 and 3 the project meets all applicable development standards for
the proposed type of WCF.
2. Potentially dangerous cabinet equipment will be secured from the public by placing it on the
rooftop of the building.
3. The proposed use of a non - concealed attached WCF is appropriate given the building size and
design. Additionally, the overall size of the building will assist in screening the antennas from
view.
4. No noise will be generated from the new antennas. All ground equipment has been placed
indoors and the applicant is not proposing to install a generator.
5. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use
Policy Plan.
6. Cricket Communications does not have a business license for this specific location as required by
TMC 18.58.070 (2). However, one can easily be obtained from the City. The purpose of the
business license requirement is so that City staff has contact information for the actual entity
utilizing the WCF.
DECISION
The application is approved subject to the following conditions:
1. Prior to final approval of the building permit, Cricket shall secure a business license from the

Cricket is proposing to place six (6) antennas on the rooftop of an existing office building located 16500
Southcenter Parkway. The proposed antennas will be located in three (3) sectors with two (2) antennas
per sector. One sector will be placed on the existing penthouse wall and the other two will be located
within an RF transparent enclosure for screening purposes. The equipment cabinet will be placed on the
rooftop on an existing steel platform.
Applicants Statement:
18.58.100 Concealed Building Mounted Development Requirements. 1. Height — The proposed facility
must meet the height requirement of the applicable zoning category. The antennas can qualify under
TMC Section 18.50.080, "Rooftop Appurtenances ", if the antennas are located in a church spire,
chimney or fake chimney, elevator tower, mechanical equipment room, or other similar rooftop
appurtenances usually required to be placed on a roof and not intended for human occupancy. Stand-
alone antennas shall not qualify as rooftop appurtenances.
Response: The height limit of the zone is 115' and the highest point the antennas are proposed will be
88' 7 ".
2. Antennas aesthetics —The antennas must be concealed from view by blending with the architectural
style of the building. This could include steeple -like structures and parapet walls. The screening must be
made out of the same material and be the same color as the building. Antennas shall be painted to
match the color scheme of the building(s).
Response: 2 sectors of the antennas are proposed to be placed inside a RF compatible shroud that will
conceal the antennas from view and the 3`d sector is proposed upon the existing penthouse and painted
to match the building.
3. Feed lines and coaxial cables — Feed lines and cables should be located below the parapet of the
rooftop.
Response: The feed lines and cable are proposed below the parapet of the rooftop.
4. Cabinet equipment — If cabinet equipment cannot be located within the building where the wireless
communication facilities will be located, then the City's first preference is to locate the equipment on
the rooftop of the building. If the equipment can be screened by placing the equipment below the
parapet walls, no additional screening is required. If screening is required, then the proposed screening
must be consistent with the existing building in terms of color, style, architectural style and material. If
the cabinet equipment is to be located on the ground, the equipment must be fenced with a 6- foot -tall

fence, and materials shall be used to screen the equipment from view. Barbed wire may be used iriatFLoPmENT

Response: The equipment is proposed on the rooftop upon an existing metal platform, below the
parapet walls.
5. Setbacks — The proposed wireless communication facilities facility must meet the setback of the
applicable zoning category where the facility is to be located.
Response: The setbacks for the TUC zone are 15' for the front, and 10' for the sides and rear. All of the
equipment is at least 100' from the property lines on all sides. Plan sets reference C -1.

and applicable standards and all other federal, state and local laws and regulations.
As the applicant for this project, Cricket Communications will assure that such installation,
repair, operation, upgrading, maintenance, and removal of antenna(s) by the wireless
communication provider shall be lawful and in compliance with all applicable laws, orders,
ordinances, and regulations of federal, state, and local laws and regulations. Antenna usage will
not interfere with other adjacent or neighboring transmission or reception communications
signals.
FCC COMPLIANCE
The Federal Communications Commission (FCC) has determined through calculations and
technical analysis that wireless telecommunications facilities, such as those operated by Cricket
Communications are highly unlikely to cause human RF exposures in excess of FCC guideline
limits. The proposed facility will have a maximum ERP of less than 5,463 watts per sector. Thus
the proposed Cricket Communications wireless telecommunications facility is in compliance
with the FCC's RF exposure rules. As the applicant for this project, Cricket Communications
will comply with all FCC guidelines relating to the use of Radio Frequency (RF) and related
spectrum and wil • - onstrate that it is licensed by he FCC.
