PRIVATE INGRESS, EGRESS AND UTILITIES EASEMENT
This private ingress, egress' and utilities easement is entered into by and
between Gurdip Singh and Sukhbir K. Grewal, husband and wife, the "Grantor ",
having ownership in properties described as follows:

Plat thereof recorded in Volume 11 of plats, Page 31, Records of King County,
Washington
And Gurdip Singh and Sukhbir K. Grewal, husband and wife, the "Grantee ",
having ownership in the property described as follows:
The West 67 feet of Lot 17 in block 5, Adams home Tracts, according to the
Plat thereof recorded in Volume 11 of plats, Page 31, Records of King County,
Washington
For and in consideration of Ten Dollars ($10.00) and other good and valuable
consideration, the adequacy and receipt of which is hereby acknowledged,
Grantor hereby conveys, grants and warrants to Grantee a permanent non-
exclusive Easement for private ingress, egress and utilities, including
Appurtenances, under, over, through, upon, and across the real property legally
described as follows:

Grantee shall have the right, without prior institution of any suit or proceeding at
law, at times as may be necessary, to enter upon the Easement and adjoining
property owned by Grantor for the purposes of installing, constructing, operating,
maintaining, removing, repairing, replacing and using the private ingress, egress
and utilities improvements, together with all the connections and appurtenances
thereto of associated utilities systems.
The Grantee shall, if the easement is disturbed by the maintenance, removal,
repair, or replacement any portion of the above improvements restore the surface
of the Easement to a condition substantially equal to the condition that existed
prior to the commencement of the maintenance, removal, repair, or replacement.
The Grantor shall have the right to use the surface of said Easement area so
long as Grantor's use does not interfere with the work of repairing, removing,
replacing and adding to the private ingress, egress and utilities improvements,
provided that no permanent building or structure of any kind shall be located
on said Easement. The construction and installation of asphalt or concrete
surfaces by Grantor is permitted.
If the subject property is further subdivided in the future, all private ingress,
egress and utilities improvements must be installed in accordance with the
requirements and codes in effect in the City of Tukwila at the time of permit
application for those improvements.
All owners shall share all associated costs for repairs and maintenance on an
equal basis, with no fees allowed for administration by one or more of the
owners. All funds shall be due at the time that the work is billed by the respective
contractor or professional. Independent payment schedules may be used if
agreed upon by the majority of the owners. In the event that funds are not paid
when due, the aggrieved owner or owners may initiate an action to collect the
funds and shall be entitled to costs and a reasonable attorney's fee upon
recovery.
All property owners having interest in this easement acknowledge, in the event of
an emergency or the eminent possibility of damage to adjacent properties, the
right of the City of Tukwila to enter onto said easement and perform necessary
maintenance or repairs to restore proper function of the drainage system and /or
other utilities. Such work must be limited to the effort necessary to restore the
level of function of such drainage system and /or other utilities to that obtained
under the originally approved and installed system or systems at the time of the
origination of the short plat forming the subject lots. Such entry and maintenance
or repair work will be done only upon notification of all property owners,
excepting situations of a bona fide emergency nature in which time does not
allow such notification. The City of Tukwila is authorized in the event of such
work as noted above to receive reimbursement for the above such services,
provided that the property owners reserve the right to review, after the fact, full
documentation of the need for such services and to inspect and comment upon
documentation of Tabor, equipment and materials resources expended. Should
disputation arise between any of the property owners and the City of Tukwila
relating to the above, appeals will be made to the Director of Public Works and /or
the City Council and /or the Office of the Mayor.
This easement and the covenants herein shall be covenants running with the
land and shall benefit and bind the parties and their respective successors and
assigns. Grantor warrants that Grantor has good title to the property, and
warrants Grantee's title to and quiet enjoyment of the Easement conveyed
herein.

The Short Subdivision Committee has completed review of your short plat application (No. L08 -044), and determined that it complies
with all applicable City code requirements. The City SEPA Responsible Official has previously determined that this application does
not require a SEPA threshold determination because it is categorically exempt.
This letter serves as the Notice of Decision per TMC 18.104.170. Based on the latest project submittal, preliminary approval is granted
subject to the conditions stated below. There are three basic steps in the short plat approval process:
1. Preliminary Approval
This letter constitutes your preliminary approval. The application was reviewed by the Tukwila Short Subdivision Committee and
approved with conditions. The conditions imposed are to ensure the short plat is consistent with the Criteria for Preliminary Approval
listed at TMC 17.12.020 C in the Tukwila Subdivision Code.
Prior to Final Short Plat, the following comments and conditions need to be addressed:
Fire Protection Conditions
Conditions • A fire hydrant is to be no farther than 250' from all structures measured by vehicular travel.
-2 The access easement needs to be 15' 281 wide.
From the end of the access road, no part of any structure can exceed 150' measured by path of travel.
4. The maximum grade is to be 15 %.
5. The fmal grading plan must show a flat area below any second story rescue windows for Fire Department ground
ladder placement. If you are unable to provide a suitable flat area adjacent to the houses, please contact the Tukwila
Fire Marshal's office.
Planning Conditions
Show the building setback lines on the new lots 1 and 2.
7. Parks and Fire Impact Fees will apply to future Building Permit(s).
A side load garage is preferred on lot 1 to minimize curb cuts, front yard paving, and the appearance of the
garage on South 148th Street.
a. On your future building permit for Lot 1, no more than 50% of the front yard may be paved. The
access road, on an easement counts in this 50% calculation.

9. You have expressed interest in developing the adjacent parcel(s) in the future. To increase your options
and to create the appearance of a comprehensive design, please consider the following *:
b. Write your access and utility easements to include future development to the east and west so that
the road and infrastructure can be used for future development.
d. Include an access easement on Lot 2 for the future benefit of lots to the east.
e. Revise this application to show an easement for a fire turn around (and subtracting it from your lot
area) so it is in place. Perhaps it could be used to access the undeveloped land to the west?
f. If future development to the north, west, or east results in 5 or more adjacent homes, then the City will
require you to install the public sidewalks across the length of the project as a condition of preliminary
approval. If easements are needed, include them in this short plat. If you would like to include
sidewalks into the proposal at this time, the City will support this and generally prefers sidewalks
included in all developments. Sidewalk approval is dependant upon having adequate right -of -way
width and the City evaluating the alignment of South 148th Street.
* These are not conditions of approval but items to consider that will be supported by the City if the
applicant chooses to revise his short plat prior to final approval.
Public Works Conditions
10. Provide a draft copy of Private 15' 201 Ingress/Egress & Utility Easement and Maintenance Agreement.
(1) This document shall be recorded prior to recording of the Final Short Plat Map, and the recording
number be shown on the short plat map. (2) The Private Ingress/Egress & Utility Easement should include
language stating who will maintain the paved area and utilities, and by what portion. (See sample —
enclosed.)
11. You have previously provided a draft copy of an Operation & Maintenance Manual for Stormwater
Collection and Detention System. (1) This document shall be recorded prior to recording of the Final
Short Plat Map, and the recording number be shown on the short plat map. (2) The document needs to
meet King County recording format requirements and should include a depiction of the storm drainage
system. (See sample — enclosed.)
12. Owner /Applicant shall complete and provide a Traffic Concurrency Certificate Application. The
Transportation Concurrency Test Fee in the amount of $300.00 applies to the Future Public Works permit.

18. All sawcut areas within S. 148 Street shall be shown and labeled on the Civil flan sheet(s).
19. Turnover documents will be required for any Public infrastructure along S. 148 Street: for sidewalk,
pavement, curb /gutter, and storm drainage; within the City Right -of -Way. Provide cost(s) for each item, to
be turned over. City will prepare documents for Owner's signature.
Miscellaneous Comments
20. All utilities including power are required to be underground, per City of Tukwila ordinance.
21. Pavement mitigation fee applies to the future Public Works permit, if S. 148 Street pavement is open cut.

Appeals
This short plat approval decision is appealable to the Hearing Examiner. One administrative appeal of the decision on the short plat,
excluding challenges to the DNS, is permitted. If no valid appeals are filed within the time, limit the decision of the Department will
be fmal.
In order to appeal the decision a written notice of appeal must be filed with the Department of Community Development within
21 days of the issuance of the Notice of Decision (09/18/09). The requirements for such appeals are set forth in Tukwila
Municipal Code 18.116.
Appeal materials shall include:
1. The name of the appealing party.
2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the
address and phone number of a contact person authorized to receive notices on the appealing party's behalf.
3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge
to an MDNS.
4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being
appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be
limited to matters or issues raised in the Notice of Appeal.
5. Appeal fee of $115.
Any appeal shall be conducted as an open record hearing before the Hearing Examiner. The Hearing Examiner's decision on the
appeal is the City's final decision. A party who is not satisfied with the outcome of the administrative appeal process may file an
appeal in King County Superior Court from the Hearing Examiner's decision pursuant to the procedures and time limitations set
forth in RCW ch. 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal.
2. Final Approval
The next step is to comply with the conditions of approval and submit the necessary short plat documents (survey, legal
descriptions, hold harmless agreement, and other required paper work). The surveyor's original signature is required on the face .
of the survey.
All taxes and fees assessed against the property must be current prior to fmal approval. Please check with the King County
Assessor's Office and the City of Tukwila Finance Department prior to submitting final documents. After the documents have
been found to be in order, and the all of the requirements of the short plat have been met, the Chair of the Short Subdivision
Committee signs your short plat which constitutes a grant of final approval.
Expiration
The fmal approved short plat must be filed with the King County Department of Records by August 28, 2010, one year from the
date of this preliminary approval or the application will expire. The City may grant a single one year extension if requested in
writing prior to the expiration date.
3. Recording
The signature of the Chairman of the Short Subdivision Committee certifies that your short plat application is ready for recording.
It is your responsibility to record the City approved short plat documents with the King County Department of Records. You will
need to pay the recording fees and submit your approved original short plat to King County. The short plat is not complete until
the recording occurs and copies of the recorded documents are provided to the Department of Community Development.
After recording, the County returns the recorded original to the City of Tukwila within 4 -6 weeks, at which time your short plat is
considered complete. You can shorten this processing time by hand - delivering a copy of the recorded short plat to the project
planner.

In many circumstances, building permits on the short platted property may not be issued until a copy of the recorded short plat (or
original) is returned to the Department of Community Development.

It is your responsibility to record the City approved short plat documents with the King County Department of Records. You will
need to pay the recording fees and submit your approved original short plat to King County. The short plat is not complete until
the recording occurs and copies of the recorded documents are provided to the Department of Community Development.
After recording, the County returns the recorded original to the City of Tukwila within 4 -6 weeks, at which time your short plat is
considered complete. You can shorten this processing time by hand - delivering a copy of the recorded short plat to the project
planner.
In many circumstances, building permits on the short platted property may not be issued until a copy of the recorded short plat (or
original) is returned to the Department of Community Development.

Your short plat is fine with planning.
Public works is fine also but noticed, since you are going to print it again, that on page two
there is a note for a 10' easement with a blank for a recording number. The easement is
located on the south end of the lot fronting the street. In your easement docs, this 10' is
included with the 15' access easement. Therefore, the note pointing to the easement can be
removed or can reference the recording number.
Finance and Fire have the plans now.

Route\126 is proposed to be eliminated. Tukwila Transit Plan recommended linking it to the
Light R�i1 Station. It should be replaced with a route that better connects Tukwila
Neighbor oods with Light Rail station. /'

Route 154: he proposed change to go on S 133rd St instead of SR 599 is helpful, as it will serve
employment sites along East Marginal Way South. However the loop along Gateway Drive
should still be maintained to connect with BECU, which offers free passes to transit riders. The
frequency of trips neds to be increased from 4 peak hour trips to 6 peak hour trips. Tukwila
Transit Plan recommended eliminating portion between Auburn and Kent, which is a duplication
of Route 150. This wouFd\allow all peak trips to begin and erid at the Sounder Station and they
could be timed to connect with Sounder trains. All these major employers Boeing, Group Health
and BECU would also be better served by connecting them to Light Rail.
Route 128: The proposed change to go south on 42nd Ave from S. 144th St. is a good connection
to the Light Rail Station. Howeve� with the elimination of Route 126, the neighborhoods north of
S. 144`h St do not have a connection t•■ the Lig t "Rail Station. Also, the current span and
frequency of Sunday service does not meet th needs of the Tukwila Urban Center. The
frequency needs to be increased on Sunday and it needs to run later on Sundays to serve
employees & shoppers since many businesses at Southcenter are open past 8 pm.
Route 140: It should be rerouted to cross over I -405 on the 66`h Ave bridge. As currently
proposed, Route 140 will turn on 61 s` Avenue with no stops along Southcenter Boulevard, west
of the 61S` Ave bridge. There is significant congestion along Southcenter Boulevard between the
61st Ave bridge and the I -5 off/amp, making it difcult to add a stop that will serve the office
employees (one of whom is aaCTR affected employer) along Southcenter Boulevard. Also,
Route 140 should serve the/Sounder station on all tit* not just peak, thereby improving on -time
performance as the route/would not have to travel thru "the heavily congested Grady Way /West
Valley Highway /I- 405interchange. This route revision ould also provide Amtrak passengers
the opportunity to transfer to transit service during the da
Route 150: It is currently not scheduled for changes, but shopld be operating every 15 minutes
during weekday/mid-day.
Route 156: This would be the only connection from Federal Wa \to Southcenter via a transfer
from Rapid Ride at SeaTac Airport. In the Tukwila Urban Center it should go down Southcenter
Parkway and cross over Minkler and up Andover Park West, instead of crossing at Strander
Boulevard.
Route 155: It is currently not scheduled for changes. But, poor service frequency severely
reduces the effectiveness of the route service on Southcenter Parkway. Increasing the frequency
to every 30 minutes on weekdays and weekends would make it a realistic option for people
traveling to Southcenter Pkwy. Tukwila Transit Plan also recommended implementing Sunday
service.

Operation and Maintenance of Short Plat Storm System
The operation of both the common and individual lot portions of the system is
simple and requires only occasional inspections and maintenance
procedures. Attached within this manual is a set of checklists with
scheduling and maintenance requirements.
The commonly maintained storm system consists of a single main infiltration
trench located under the private common road, and connected to two Type 1
catch basins. The trench is 90 foot long by 4 foot wide by 18 inch deep
infiltration trench. The system collects and infiltrates storm water from the
private road surface, and the separate house roofs and driveways. When
filled during very heavy storms, it overflows into the culvert system fronting
the site on S. 148th Street.
It is the joint responsibility of all of the homeowners to inspect, clean and
maintain this part of the system. The handling of this joint responsibility is
spelled out in the storm drainage easement recorded with the original short
plat.
The water from the private road passes through sediment control tees, one of
which is located in each private road catch basin. The inspection, cleaning
and maintenance for these sumps is a common or joint responsibility.
Details for the overall system's inspection and clean out, for both floating
debris and sediment in the bottom of all catch basins, are given in the
attached checklists, along with maintenance items which may affect the
system's proper operation. Note that they apply to the commonly maintained
portion of the system.
The responsibilities and obligations of the separate lot owners relating to the
maintenance and repair of this drainage system is given in the related
ACCESS, EGRESS AND UTILITIES EASEMENT for this short plat, recorded
separately but concurrently with this 0 and M Manual.

INSTRUCTIONS FOR USE OF MAINTENANCE CHECKLISTS
The following pages contain maintenance needs for most of the components that are part of
your drainage system, as well as for some components that you may not have .Ignore the
requirements that do not apply to your system. You should plan to complete a checklist for all
system components on the following schedule:
1. Monthly from November through April
2. Once in late summer (preferable September)
3. After any major storm (use 1 -inch in 24 hours as a guideline), items marked "S"
only.
Using photocopies of these pages, check off the problems you looked for each time you did an
inspection. Add comments on problems found and actions taken. Keep these "checked"
sheets in your files. Some items do not need to be looked at every time an inspection is done.
Use the suggested frequency at the left of each item as a guideline for your inspection.
REQUIRED ACTIONS: The following actions shall be taken to ensure that pollution generated
on site shall be minimized:
1. Warning signs (e.g., "Dump No Waste - Drains to Stream ") shall be painted or embossed
on or adjacent to all storm drain inlets. They shall be repainted as needed. Contact the
Municipality regarding availability of stenciling supplies.
2. Parking Tots shall be swept when necessary to remove debris and, at a minimum, twice a
year. Use of newer model high - velocity vacuum sweepers is recommended as they are
more effective in removing the more harmful smaller particles from paved surfaces.
3. Sediment removed from detention vaults shall be disposed of in a proper manner.
Contact the Municipality for instruction prior to completing this task.
4. No activities shall be conducted on site that are likely to result in short-term high -
concentration discharge of pollution to the stormwater system. Such activities may
include, but not be limited to, vehicle washing, vehicle maintenance, and cleaning of
equipment used in the periodic maintenance of buildings and paved surfaces.

Hello Gary, in researching the property for our report it was discovered that the title was derived by means
of a Treasures Deed. I have attached a copy for your reference.
Our underwriting practice is to not insure title through a Treasures Deed until at least three Years after its
recording. We have had the Deeds overturned due to insufficient notification of the parties involved in the
foreclosure.
We have insured prior to the three year period expiring if the parties have the title judicially quieted into
their names.
I hope this helps explain our position.

2. If the proposed Insured has or acquired actual knowledge of any defect, lien, encumbrance, adverse claim or
other matter affecting the estate or interest or mortgage thereon covered by this Commitment other than
those shown in Schedule B hereof, and shall fail to disclose such knowledge to the Company in writing, the
Company shall be relieved from liability for any loss or damage resulting from any act of reliance hereon to

Project Overview:
This Technical Information Report has been prepared for a 2 -lot short plat located on
the existing parcel located at 4644 S. 148th Street. The proposed project will create a
total of two single family residential building lots.
A new 15 foot wide paved private road to serve the two future residences will be
constructed as a minor strip road with its entrance at the east side of the property onto
the north side of S. 148th Street. It will be located within a 15 foot wide access and
utilities easement. The section of the new road will consist of 14.33 foot roadway, with
an 8 inch thick minor retaining wall elevating the east edge of the road surface about
two feet above the adjacent property. The top of the wall will extend 6 inches above the
road surface to act as a curb, and may also be used as a base for a property line fence.
The existing parcel is approximately 67 feet wide east -west and approximately 310 feet
north - south, with an area of 0.48 acres. The site is located on the north side of S. 148th
Street in the 4600 block in Tukwila, Washington. An older residence occupied the site
until recently, but has been removed in preparation for the short plat. Areas not
disturbed by the house removal are in their previous meadow vegetated state.

The existing site slopes to the east across the frontage, with a relatively uniform slope of
approximately 9 percent. Localized on site cross slopes to the east vary from 4 to 6
percent.
The private road storm drainage system will collect flows from the roofs and driveways
of the new residences, plus incidental yard areas, in addition to the private road. The
system will infiltrate the collected flows in a single trench located within the access
easement, with the overflow from the trench led the street culvert system. The soils on
the site have been percolation tested and been found suitable. All flows from vehicular
areas will pass through catch basins with tees prior to entering the private road
infiltration trench. The system is designed and sized based on Small Site Criteria, and
KCRTS infiltration calculations.
Conditions and Requirements Summery:
The infiltration trenches were sized for a 10 -year storm event, with overflow into the
adjacent street culvert system. A safety factor of 2.0 has not been applied to the field
measured percolation rate since positive overflow into the street system is provided.
Runoff from the new private road, house roof and driveway impervious areas will be
retained and infiltrated using KCRTS methodology, with construction standards given in
Appendix C of the Manual. The storm calculations are attached. These calculations
reflect the future full build out condition of the site.
The soils in the location of the proposed trench were found to have an upper level
consisting of porous sandy loam, underlain by layers of sandy clay and hardpan. The
sandy loam was measured to have a minimum infiltration rate of 10.0 minutes per inch.
As a conservative measure, the slowest of the rates is used. Since the sandy loam
layer is relatively shallow, the gravel in the trench will be only 18 inches deep.
The exact impervious area of the new houses is not known. For calculation purposes,
conservative roof areas of 3,400 SF will be used, with an additional 600 SF per
driveway.
The "existing" impervious area on the site as a whole is provided in the calculations.
The net new impervious surface area is 7,675 square feet. Since the net new
impervious area is between 5,000 square feet and 10,000 square feet, the use of
Appendix C control measures is suitable, however this TIR is required. Other than this
administrative requirement, the sizing of the infiltration system is sized based on actual
(or rather conservatively but realistically estimated) final impervious and other
contributing areas.
Post development water quality factors will include the 6 inch tees in all catch basins
prior to water reaching the infiltration trench.

Off -Site Analysis:
At present practically no surface runoff from the site flows beyond its borders due to the
surface vegetation and porous surface soils. The proposed drainage system will
continue or improve this condition. Based on site topography, only small backyard lawn
areas of off -site runoff enter the site from the west. These areas are accounted for in
sizing the private road trench, and are shown in the calculations. The culvert system in
S. 148th has been improved recently below the site, with a heavily riprapped ditch
running down to the street system in 51st Avenue S. While that system is known to
have some capacity problems, the City has approved the concept of the short plat due
to its small impact on that road system.
Flow Control and Water Quality Facility Analysis and Design:
As referenced above, the flows from the impervious surfaces will be retained and
infiltrated on -site in an underground trench designed for a 10 -year post development
rate, with overflow to the street system. Sizing of the infiltration trench is based on the
actual percolation tests performed in the area of the proposed trench. Drainage
standards are per Appendix C of the KCSWM Manual. The method of analysis is
KCRTS. Calculations are attached which show the length of a trench with 12 inches of
gravel (L = 100 LF) and for 18 inches of gravel (L = 90 LF). The 18 inch deep gravel
trench has been chosen for this system.
Conveyance System Analysis and Design:
The 6 inch PVC lines from the roof systems connect to the private road catch basins
and the 6 inch perforated in- trench lines are placed level. The 6 inch conveyance lines
slope at a minimum of 2 percent. They are deemed adequate by inspection.
Special Reports and Studies:
No special reports or studies were done for this site. The soils were evaluated on June
23, 2009 with three soil Togs. The percolation rate for design was also evaluated on that
date using separate shallow soil logs at approximate trench depth. The results of these
evaluations are shown on the plan and have been included in the attached calculations.
Other Permits:
The private road and the infiltration trench will be built or bonded prior to the approval of
the short plat. A permit will be required.

The frontage improvements along S. 148th Street will require a separate right -of -way
permit which is not related to the on site improvements (except to receive the overflow
from the trenches on site). No other significant work relating to this development will
occur off -site.
The design and installation of drainage lines associated with the individual new
residences will be incidental to the residential permits. A 6 inch storm line stub
connected to the trench will be run into each lot for future connection during house
construction.
ESC Analysis and Design:
As noted above, the site is small and warrants only the normal placement of standard
filter fence along the downhill limit of clearing and a stabilized construction entrance.
