The applicant is requesting approval of a Type 2 Wireless Facilities Permit to construct a
new WCF on an existing one -story warehouse building. The work would include
installation of three (3) panel, three (3) microwave, three (3) RRU, and one (1) GPS
antennas within a 100 square foot rooftop- mounted concealment structure. Installation of
a 4 square foot equipment cabinet within the concealment structure is also proposed.

H. DECISION
SEPA Determination: The City SEPA Responsible Official has previously determined that this application does not require a
SEPA threshold determination because it is categorically exempt.
Decision on Substantive Permit: The Community Development Director has determined that the application for a Type 2
Wireless Communications Facility Permit complies with applicable City and state code requirements and has approved that
application, subject to any conditions which are set forth in the Decision based on the findings and conclusions contained in
the staff report. The application is approved subject to the following conditions:
1. Prior to final approval of the building permit, Clearwire shall secure a business license from the City of Tukwila
for this specific location.
2. The concealment structure shall be located near the northeast portion of the rooftop, so as to minimize its visual
impact from Andover Park West and South 180t Street.
3. Emergency power off button will be required for use by Tukwila Fire Department in the event of roof operations.

III III. YOUR APPEAL RIGHTS I
The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code § 18.104.010. Other
land use applications related to this project may still be pending.
One administrative appeal to the Hearing Examiner of the Decision on the Permit itself is permitted.
A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior
Court from the Hearing Examiner decision.
IV. PROCEDURES AND TIME FOR APPEALING
In order to appeal the Community Development Director's decision on the Permit Application, a written notice of appeal
must be filed with the Department of Community Development within 14 days of the issuance of this Decision, which is
by October 8, 2009.
The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials shall be
submitted to the Department of Community Development. Appeal materials MUST include:
1. The name of the appealing party.
2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other
group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf.
3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific
challenge to an MDNS.
4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision
being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal
shall be limited to matters or issues raised in the Notice of Appeal.
5. Appeal fee of $225.
V. APPEAL HEARINGS PROCESS
Any administrative appeal regarding the Permit shall be conducted as an open record hearing before the Hearing
Examiner based on the testimony and documentary evidence presented at the open record hearing. The Hearing
Examiner's decision on the appeal is the City's final decision.
Any party wishing to challenge the Hearing Examiner decision on this application must file an appeal pursuant to the
procedures and time limitations set forth in RCW 36.70C. If no appeal of the Hearing Examiner decision is properly filed
in Superior Court within such time limit, the Decision on this permit will be final.
VI. INSPECTION OF INFORMATION ON THE APPLICATION
Project materials including the application, any staff reports, and other studies related to the permits are available for
inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington
98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The project planner is Courtney Thomson, who may be
contacted at (206) 431 -2164 for further information.
Property owners affected by this decision may request a change in valuation for their property tax purposes. Contact the King
County Assessor's Office for further information regarding property tax valuation changes. The notice board must be
removed at expiration of the appeal period if no appeal is filed.

Project Description:
The applicant is requesting approval of a Type 2 Wireless Facilities Permit to construct a new telecommunication
facility on an existing one -story warehouse building. The work would include installation of three (3) panel,
three (3) microwave, three (3) RRU, and one (1) GPS antennas within a 100 square foot rooftop- mounted
concealment structure. The applicant has also proposed to install a 4 square foot equipment cabinet within the
concealment structure.
Existing Development:
The property is zoned Tukwila Urban Center. Currently a 30' tall warehouse building occupies this parcel.
There is also associated parking located on the site.
Surrounding Land Uses:
All surrounding properties are zoned Tukwila Urban Center. The site is bound by Andover Park West to the
west; South 180t St. to the south; and by Union Pacific Railroad tracks to the east. All adjacent buildings are of
a warehouse /distribution nature except for the property to the south, which is a 2 -story commercial office
building.
Location Selection
Tukwila Municipal Code (TMC) provides a hierarchy of appropriate locations within the City. Generally, co-
locations and utilization of existing structures are favored over the development of new standalone WCF's within
the City. The applicant is proposing to install a concealed, building- attached WCF on an existing structure in a
non - residential zone.

The City provides general design standards for the placement of WCF within the City of Tukwila. The following

CONCLUSIONS
1. As demonstrated in Tables 1 and 2 the project meets all applicable development standards for the
proposed type of WCF.
2. The applicant has agreed to relocate the concealment structure toward the northeast corner of the rooftop
so that it is further away from Andover Park West and South 180`h St. and largely out of public view.
Moving the structure northeast brings it closer to two adjacent warehouses; however, the warehouse
facades that face the WCF have very few windows, so the WCF will have little to no visual impact on the
occupants of these building. (See attached photos)
3. Existing trees help screen the WCF from the public right -of -way.
4. Potentially dangerous cabinet equipment will be secured from the public by placing it on the rooftop of
the building.
5. No noise will be generated from the new antennas, and the applicant is not proposing to install a
generator.
6. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use Policy
Plan.
7. Clearwire does not have a business license for this specific location as required by TMC 18.58.070 (2);
however, one can easily be obtained from the City. The purpose of the business license requirement is so
that City staff has contact information for the actual entity utilizing the WCF.
DECISION
The application is approved subject to the following conditions:
1. Prior to final approval of the building permit, Clearwire shall secure a business license from the City of
Tukwila for this specific location.
2. The concealment structure shall be located near the northeast portion of the rooftop, so as to minimize its
visual impact from Andover Park West and South 180th Street.
3. Emergency power off button will be required for use by Tukwila Fire Department in the event of roof
operations.

There a few issues I need to run past you regarding the location
1. We need to stay on top of one of the column lines of this building for structural integrity. We can't be
exactly in the NE corner.
2. Additionally, the access ladder rises in this corner and we can't block that.
If we can find some middle ground we are ok moving the site in this direction — as long as the top two points
are taken into consideration.

I know the site plans may not have portrayed the stealthing accurately; but did you get a chance review the
photo sims?
The concealment matches the architectural nature of the building; and the concealment would not be identifiable
as anything but the building.
We would be happy to move the concealment; if that would satisfy the cities concerns.

Facility, Concealed Facility as a "wireless communication facility that is not readily identifiable as such, and
is designed to be aesthetically and architecturally compatible with the existing building(s) on a site."
One option may be to relocate the concealment enclosure toward the northeast corner of the rooftop so that it
is less visible from Andover Park W and South 180th St. Also, would it be possible to reduce the height of the
concealment enclosure in order to minimize the visual impact?

We had previously submitted for a Building Permit with the other application, but since the application was
rescinded we never moved forward with the Building Permit.

18.58.050 Types of Permits — Priority -- Restrictions.
A. Applications will be reviewed based on the type of wireless communication
facilities requested to be permitted. Each wireless communication facility requires
the appropriate type of project permit review, as shown in Table A [Reference
TMC for Table A]:
The proposal is construction of a WiMAX Telecommunications Facility on the
rooftop of the proposed location. Per the City of Tukwila an attached concealed
antenna to a roof top is a Type II Application.
In the event of uncertainty on the type of a wireless facility, the DCD Director
shall have the authority to determine how a proposed facility is incorporated into
Table A.
Applicant has determined the application to be a Type II Application.
B. The priorities for the type of wireless communication facility shall be based
upon their placement in Table A; most desirable facilities are located toward the
top and least desirable facilities toward the bottom. Any application for a wireless
communication facility must follow the hierarchy of Table A. For example, an
applicant must demonstrate by engineering evidence that using a transmission
tower co- location is not possible before moving to a utility pole co- location, and
so forth, with the last possible siting option being a new tower or waiver request.
C. The City's preferences for locating new wireless communications facilities are
as follows:
1. Place antennas on existing structures, such as buildings, towers, water towers,
or electrical transmission towers.
This is an application to place antennas on an existing structure; that is a
building rooftop. Criteria are met.
2. Place wireless communication facilities in nonresidentially -zoned districts and
nonresidential property.
The location is zoned as Commercial. The criterion is met.
3. Place antennas and towers on public property and on appropriate rights -of-
way if practical, provided that no obligation is created herein for the City to allow
the use of City property or public right -of -way for this purpose.

4. City Property /Public Rights -of -Way. The placement of personal wireless
communication facilities on City -owned property and public rights -of -way will be
subject to other applicable sections of the Tukwila Municipal Code and review by
other departments (i.e., Public Works, Parks and Recreation, etc.).

designated as landmark or as part of a historic district.

D. Applicants shall submit all of the information required pursuant to TMC
18.104.060 and the following:

a. A completed application form provided by the Department of Community
Development;

b. Four sets of plans prepared by a design professional. The plans shall include a
vicinity map, site map, architectural elevations, method of attachment, proposed
screening, location of proposed antennas, and all other information which
accurately depicts the proposed project. Minimum size is 8.5" by 11 ". Plans shall
be no greater than 24" x 36 ";
The applicant has submitted this to the city.
c. A letter from the applicant outlining the proposed project and an evaluation
from the applicant with regard to the City's Code requirements;
The proposal is construction of a WiMAX Telecommunications Facility on the
rooftop of the proposed location. Per the City of Tukwila TMC18.58.050 an
attached concealed antenna to a roof top is permitted through a Type II
Application.
d. Sensitive Area studies and proposed mitigation (if required);

e. If an outdoor generator is proposed, a report prepared by an acoustical
engineer demonstrating compliance with TMC Chapter 8.22, "Noise "; and

INTERFERENCE CONTROL AND STANDARDS COMPLIANCE
Clearwire desires to implement a broadband wireless system at the above
mentioned location at 1232 Andover Park, West Tukwila. The system will utilize FCC
licensed frequencies in the Educational Broadband Service ( "EBS ") and the Broadband
Radio Service ( "BRS ") operating in the 2500 - 2690 MHz range to provide broadband
wireless services to subscribers. In addition, Clearwire will utilize point -to -point
microwave systems to provide interconnections between base station sites and various
point -of- presence ( "POP ") locations in order to connect to the Internet. These point -to-
point links will utilize both licensed and unlicensed frequencies as allocated by the FCC.
In the implementation of its broadband system, Clearwire will comply with all
engineering practices and operational requirements as specified by the FCC in the rule
sections applicable to the services used by Clearwire. This includes regulations
regarding susceptibility to radio frequency interference, frequency coordination
requirements, general technical standards for power, antenna, bandwidth limitations,
frequency stability, transmitter measurements, operating requirements, and any other
federal statutory and regulatory requirements related to radio frequency interference.
In addition, the Clearwire equipment alone will not cause interference to Public
Safety Communication equipment. The operating frequency and out -of -band emissions
limitations placed on EBS, BRS and point -to -point equipment by the FCC severely
restrict radiation levels into Public Safety bands. If interference with the Emergency
Communications is found to exist from Clearwire equipment, all steps deemed
necessary to remove the interference will be taken by the applicant.
