This letter serves as a notice of decision and is issued pursuant to TMC 18.104.170 on the following project
and permit approval.

II. DECISION
SEPA Determination: The City SEPA Responsible Official has previously determined that this application
does not require a SEPA threshold determination because it is categorically exempt.
Decision on Substantive Permit: The City Community Development Department has determined that the
application for a tree clearing permit does comply with applicable City and state code requirements and has
approved that application, subject to the following conditions:
1. Per TMC 18.54.150 (C) the tree clearing permit shall be valid for 180 -days upon issuance by the
City. All work, required inspections, required documentation shall be provided to the City prior to
expiration of the permit.
2. All work performed shall be consistent with the recommendations provided in the report by Geo
Engineers dated November 30, 2009.
3. Prior to removal of the trees the applicant shall scheduled a preconstruction meeting with City staff.
The meeting shall be scheduled at least 72 hours in advance. The meeting can be scheduled by

calling (206) 431 -3684 or by sending an email to bmiles@ci.tukwila.wa.us. Prior to the inspection,
the applicant shall clearly identify on the site a work limit line where no work is to occur.
4. All work must be performed in accordance with the approved Permit plans specified in this chapter
or revised plans as may be determined by the Director. The applicant shall obtain permission in
writing from the Director prior to modifying the plans.
5. Vegetation protective devices shall be installed around all trees and vegetation not proposed to be
removed.
6. The applicant shall at all times protect improvements to adjacent private properties and public
rights of way or easements from damage during clearing. The applicant shall restore to the
standards in effect at the time of the issuance of the permit any public or private improvements
damaged by the applicant's operations.
7. All protected and replacement trees and vegetation shown in the approved tree clearing permit
materials shall be maintained in healthy condition by the property owner throughout the life of the
project, unless otherwise approved by the Director in a subsequent Tree Clearing Permit.
8. Prior to final approval the applicant shall submit a vegetation management plan for the site. The
management plan shall include the following components: removal of blackberries as shown the
development plans; planting of deep rooted native vegetation within the blackberry area; methods
to prevent blackberry encroachment in the areas where trees are removed; planting of native trees
at a distance not closer than 25 feet from the fence line of the substation; and methods for
watering the site during the summer of 2010. If all the replaced trees (46 total) cannot be planted
on the site the applicant shall pay to the City $50.70 for each tree that cannot be planted on the
site. The City shall place all funds collected into the City's tree fund.
9. Prior to final approval the applicant shall provide the City the cost of all vegetation installed on the
subject property as required under this permit. The City shall verify the costs and the applicant
shall provide the City a financial guarantee of 150 percent of the cost of the vegetation. The
financial guarantee shall be held with the City for one year following the City's acceptance of the
initial planting. The City shall re- inspect in one year and if the vegetation planted under this permit
is still alive shall refund the financial guarantee to the applicant. It's the applicant's responsibility to
insure that the City has access to the property for the follow up inspection. If the applicant sells
the property the applicant must insure that the City can legally access the property to conduct the
City's re- inspection.
10. Portion of the property contains critical area sensitive areas of potential geologic instability (potential slide
area) therefore Puget Sound Energy (Grantor) hereby acknowledges, the Grantor shall defend,
indemnify, and hold the City of Tukwila (Grantee), its officers, officials, employees, agents, and
assigns harmless from any and all claims, injuries, damages, losses, or suits, whether brought by
grantor or third parties, including all legal costs and reasonable attorney fees, arising out of or in
connection with any injuries or damages to persons or property caused in whole or in part by any
landslide or seismic activity or soil disturbance on the subject property.
III. YOUR APPEAL RIGHTS
The Decision on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code
§18.104.010. Other land use applications related to this project may still be pending.
One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted.
A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in
King County Superior Court from the Hearing Examiner's decision.

IV. PROCEDURES AND TIME FOR APPEALING
In order to appeal the Community Development Director decision on the Permit Application, a written
notice of appeal must be filed with the Department of Community Development within 14 days of the
issuance of this Decision, which is by January 28, 2010.
The requirements for such appeals are set forth in Tukwila Municipal Code Ch. 18.116. All appeal
materials shall be submitted to the Department of Community Development. Appeal materials MUST
include:
1. The name of the appealing party.
2. The address and phone number of the appealing party; and if the appealing party is a corporation,
association or other group, the address and phone number of a contact person authorized to receive
notices on the appealing party's behalf.
3. A statement identifying the decision being appealed and the alleged errors in the decision, including
any specific challenge to an MDNS.
4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in
the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief
sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal.
5. Appeal fee based on the current fee schedule.
V. APPEAL HEARINGS PROCESS
Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the
Hearing Examiner based on the information presented to the Community Development Director, who
made the original decision. No new evidence or testimony will be permitted during the appeal hearing.
Parties will be allowed to present oral argument based on the information presented to the Community
Development Director before their decision was issued. The Hearing Examiner's decision on the appeal is
the City's final decision.
Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal
pursuant to the procedures and time limitations set forth in RCW Ch. 36.70C. An appeal challenging a
DNS, an MDNS or an EIS may be included in such an appeal. If no appeal of the Hearing Examiner's
decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final.
The City's decision to issue a DNS, an MDNS or an EIS is final for this permit and any other pending
permit applications for the development of the subject property.
VI. INSPECTION OF INFORMATION ON THE APPLICATION
Project materials including the application, any staff reports, and other studies related to the permits are
available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd.,
Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The
project planner is Brandon J. Miles, who may be contacted at 206 - 431 -3684 for further information.
Property owners affected by this decision may request a change in valuation for their property tax purposes.
Contact the King County Assessor's Office for further information regarding property tax valuation changes.

VII. DISCLAIMER
Removal of any tree that may be dangerous and pose an immediate threat to public safety or property
maybe commenced without the need for a permit from the City. Compliance and mitigation may still be
required for the removal of a tree, - eemed "dangerous" if the tree is located with a sensitive area buffer.

RE: Approval of Tree Cutting Permit for Puget Sound Energy (PSE), King County Parcel #
537920 -0315, (L09 -055).
BACKGROUND
Puget Sound Energy (PSE) operates an electrical substation on Southcenter Parkway that
provides power to a significant amount of the Green River Valley. Last winter a tree fell into the
fenced area and PSE has concerns that additional trees on the site could fall and damage the
substation. PSE has submitted this tree clearing permit to remove a total of 30 trees on a steep
slope that is adjacent to the substation. The applicant had originally submitted to remove a total
of 57 trees; however city staff noted concern with removing trees that were not going to pose a
risk to the substation for a number of years.
PSE owns the subject property fee simple. The property is located on the west side of
Southcenter Pkwy. There are two commercial buildings located to the north and south of the
property. The property directly borders Interstate 5 on the west side. The applicant has not
indicated nor does there appear to be any concern that the trees on the subject site pose a risk to
any adjacent properties.
As part of the applicant's permit material a geotechnical report was provided from Geo
Engineers dated November 30, 2009. The report analyzed the slope and subsurface conditions of
the subject property. The report noted that a number of trees on the property were susceptible to
wind topping due to the condition of the slope. The report also concluded that removing
blackberries on the slope and replacing them with deep- rooted native vegetation will improve the
stability of the slope.
As noted the applicant has proposed to remove 30 trees. City staff gave PSE permission to
remove all trees within 20 feet of the fence line of the substation as this permit was pending. The
attached map indicates the general location of the trees being removed. The attached excel
spread sheet identified the species of the trees being removed and the approximant diameter of
each individual tree. No trees near Interstate 5 will be removed. Over 50 percent of the site's
tree canopy will be retained. The stumps will be retained on the site.
TMC 18.54 provides a replacement ratio for trees removed on a steep slope. The applicant is
required to replace a total of 46 trees. The applicant has requested that in lieu of replanting the
trees on site that they are permitted to pay into the City's tree fund. The applicant notes that
given the use of the site as a power substation replanting trees on the site would eventually
present issues in the future as the trees mature.

TREE REPLACEMENT PLAN
As noted, a total of 30 trees will be removed from the site. Using the ratio found in TMC 18.54
the applicant is required to replant a total of 46 trees. The applicant has not submitted a tree
replacement plan and instead has requested to pay a fee in lieu of planting trees on the site.
In seems prudent given the use of the site to limit tree plantings near the substation. As
indicated, this substation provides electrical power to significant area of the Green River Valley.
Replanting trees on the site must be balanced between protecting the substation, the City's tree
protection requirements, and stability issues with the slope. As mentioned in the geotechnical
report, removing the blackberries on the site and replacing with deep rooted vegetation will
improve the slope stability.
Funds paid into the City's tree fund will be used to fund planting of street trees and trees at City
Parks. The urban environmentalist, who is a master gardener and has significant experience
preparing enhancement and planting plans has provided a cost estimate of $50.70 per tree. The
cost estimate includes the following labor activities, mobilization/transport of materials; hand
removal of invasive; incorporating compost, planting and mulching. Additionally, the cost also
includes the following materials, compost; 2 inch caliper trees in one gallon containers; and
mulch which will include bark 3" deep.
RECOMMENDATION
Approve the L09 -055, Tree Cutting permit for King County Parcel, 537920 -0315 with the
following conditions:

by the City. All work, required inspections, required documentation shall be provided to

This letter accompanies application for tree removal at Puget Sound Energy's (PSE) substation
located at 16715 Southcenter Parkway. This application is directly in response to a tree which
fell into the fenced substation last winter. Luckily, although it fell into the substation itself the
tree did not hit any equipment which could have resulted in a serious and delayed outage. PSE's
vegetation management group assessed surrounding trees and determined that 57 trees over 4"
D.B.H. are considered danger trees that pose imminent threat to falling into the substation.
Due to the steep slope, the use of heavy equipment is not proposed. PSE proposes simply to lop
and scatter the identified removal trees on the steep slope, with no stump removal. This plan is
the least impact available and is supported by the attached geotechnical letter.
The unique landuse as a utility along with the dependency of the surrounding commercial and
industrial uses on reliable electric service from this substation necessitates preventative measures
to avoid more trees from toppling into the station. To this end, PSE respectfully requests a
deviation from the City's tree regulations requiring retention or replacement at this location.
Please consider the aerial photograph included in this application which clearly shows an
abundant canopy cover on this property. It appears that over 20% of canopy will remain on the
property after the proposed removal. As we have also discussed, PSE is interested in
participating in a City tree fund opportunity as well.

INTRODUCTION AND PROJECT UNDERSTANDING
This report summarizes the results of our geologic hazards assessment for the existing PSE Southcenter Substation,
located at 16715 Southcenter Parkway in Tukwila, Washington. The site is shown relative to surrounding features
on the Vicinity Map (Figure 1) and the Site Plan and Slope Profile (Figure 2). We previously provided a draft version
of this report dated November 25, 2009; this version supersedes our previous report.
We understand that PSE is planning to conduct vegetation management activities on the steep slope to the west of
the fenced substation, including cutting down hazard trees that pose a risk to the substation. The area of the
planned tree removal is outlined in pink on the attached Figure 2. Our geologic hazards assessment services were
completed in general accordance with our proposal dated September 11, 2009. Our understanding of the project is
based on our discussions with Chris Listfjeld of PSE.
SITE CONDITIONS
General Information
The City of Tukwila Municipal Code (TMC 18.45) regulates Environmentally Sensitive Areas in the city, which includes
the Areas of Potential Geologic Instability (18.45.130) that are present at this site. The City of Tukwila designates the
site as mixed Class 2 and Class 3 slope on their Sensitive Areas on the Shoreline map, with slope classes defined as
follows:
U Class 2: "Landslide potential is moderate; slope is between 15 percent and 40 percent and underlain by
relatively permeable soils."
❑ Class 3: "Landslide potential is high; slope is between 15 percent and 40 percent and underlain by
relatively impermeable soils or by bedrock; also includes all areas sloping more than 40 percent."

The near - surface geologic units in the project area primarily consist of materials deposited during two or more glacial
and interglacial episodes. The United States Geologic Survey's Des Moines 1:24,000 Geologic Map shows ice
contact deposits (Qvi) at the site, which are described as
poorly -sorted to moderately -well- sorted, stratified sand and
gravel within a silt -rich matrix with lenses and pods of till.
Surface Conditions
We visited the site on September 25, 2009 to evaluate the
surface conditions on the steep ascending slope to the west
of the substation. The ground surface topography is shown on
the Site Plan and Slope Profile (Figure 2).
The existing substation is located in a relatively flat area at the
east side of the site adjacent to Southcenter Parkway. The
ground rises immediately to the west of the substation, with a
total elevation change of approximately 95 feet from the
substation to the west property line. The slope varies from approximately 4H:1V (horizontal:vertical) up to 1H:1V in
some areas. In general, the slope is flatter along the bottom of the slope (areas shown on Figure 2 outlined in
purple /pink) and steeper in the higher areas of the slope (area shown on Figure 2 outlined in dark green).

We observed a small incised erosion gulley that roughly
bisected the steep slope, extending southwest to northeast
down the slope. Numerous large alder trees growing along
the edge of the gulley were observed to have shallow roots
that are being undermined by the erosion, increasing their
susceptibility to wind toppling. There is no evidence of
significant surface sloughing/raveling, or shallow landslides or
other slope movement on the steep slope, other than the
erosion gulley.
The soils observed on the steep slope were generally hard,
moist gray silt/clay with sand, gravel, cobbles, and boulders.
There was no evidence of significant groundwater seepage or
wetland vegetation on the upper slopes. However, groundwater seepage in a thin exposure of soft, wet silt/clay was
observed at the toe of the slope immediately adjacent to the gravel substation pad.

CONCLUSIONS AND RECOMMENDATIONS
Based on our evaluation of the existing slope conditions, it is our opinion that the proposed vegetation management
activities (tree removal) on the lower portion of the slope will reduce the risk of trees toppling and damage to the
substation. Removal of the alder trees will also reduce the risk of future slope instability that can be caused by the
uprooting of trees when they topple. Additionally, we understand that the blackberries on the steep slope (shown on

Figure 2) may be removed in the future. It is our opinion that removal of the blackberries and replacement with
deep - rooted native vegetation will improve the stability of the slope.
LIMITATIONS
We have prepared this report for the exclusive use of Puget Sound Energy for the Southcenter Substation project in
Tukwila, Washington.

REPORT LIMITATIONS AND GUIDELINES FOR USE1
This appendix provides information to help you manage your risks with respect to the use of this report.
Geotechnical Services Are Performed for Specific Purposes, Persons and Projects
This report has been prepared for Puget Sound Energy and their authorized agents and regulatory agencies. The
information contained herein is not applicable to other sites.
GeoEngineers structures our services to meet the specific needs of our clients. No party other than Puget Sound
Energy may rely on the product of our services unless we agree to such reliance in advance and in writing. This is to
provide our firm with reasonable protection against open -ended liability claims by third parties with whom there
would otherwise be no contractual limits to their actions. Within the limitations of scope, schedule and budget, our
services have been executed in accordance with our Agreement with the Client dated DATE and generally accepted
geotechnical practices in this area at the time this report was prepared. Use of this report is not recommended for
any purpose or project except the one originally contemplated.
A Geotechnical Engineering or Geologic Report Is Based on a Unique Set of Project- Specific Factors
This report has been prepared for Southcenter Substation. GeoEngineers considered a number of unique, project -
specific factors when establishing the scope of services for this project and report. Unless GeoEngineers specifically
indicates otherwise, it is important not to rely on this report if it was:

Ea not prepared for your project,
O not prepared for the specific site explored, or
O completed before important project changes were made.
For example, changes that can affect the applicability of this report include those that affect:
the function of the proposed structure;
• elevation, configuration, location, orientation or weight of the proposed structure;
• composition of the design team; or
• project ownership.
If important changes are made after the date of this report, we recommend that GeoEngineers be given the
opportunity to review our interpretations and recommendations. Based on that review, we can provide written
modifications or confirmation, as appropriate.

Subsurface Conditions Can Change
This geotechnical or geologic report is based on conditions that existed at the time the study was performed. The
findings and conclusions of this report may be affected by the passage of time, by man -made events such as
construction on or adjacent to the site, or by natural events such as floods, earthquakes, slope instability or
groundwater fluctuations. If more than a few months have passed since issuance of our report or work product, or if
any of the described events may have occurred, please contact GeoEngineers before applying this report for its
intended purpose so that we may evaluate whether changed conditions affect the continued reliability or applicability
of our conclusions and recommendations.
Most Geotechnical and Geologic Findings Are Professional Opinions
Our interpretations of subsurface conditions are based on field observations from widely spaced sampling locations
at the site. Site exploration identifies the specific subsurface conditions only at those points where subsurface tests
are conducted or samples are taken. GeoEngineers reviewed field and laboratory data and then applied our
professional judgment to render an informed opinion about subsurface conditions throughout the site. Actual
subsurface conditions may differ, sometimes significantly, from those indicated in this report. Our report,
conclusions and interpretations should not be construed as a warranty of the subsurface conditions.
Geotechnical Engineering Report Recommendations Are Not Final
The construction recommendations included in this report are preliminary and should not be considered final.
GeoEngineers' recommendations can be finalized only by observing actual subsurface conditions revealed during
construction. GeoEngineers is unable to assume responsibility for the recommendations in this report without
performing construction observation.
We recommend that you allow sufficient monitoring, testing and consultation during construction by GeoEngineers to
confirm that the conditions encountered are consistent with those indicated by the explorations, to provide
recommendations for design changes if the conditions revealed during the work differ from those anticipated, and to
evaluate whether earthwork activities are completed in accordance with our recommendations. Retaining
GeoEngineers for construction observation for this project is the most effective method of managing the risks
associated with unanticipated conditions.
A Geotechnical Engineering or Geologic Report Could Be Subject to Misinterpretation
Misinterpretation of this report by members of the design team or by contractors can result in costly problems.
GeoEngineers can help reduce the risks of misinterpretation by conferring with appropriate members of the design
team after submitting the report, reviewing pertinent elements of the design team's plans and specifications,
participating in pre -bid and preconstruction conferences, and providing construction observation.
Do Not Redraw the Exploration Logs
Geotechnical engineers and geologists prepare final boring and testing logs based upon their interpretation of field
Togs and laboratory data. The logs included in a geotechnical engineering or geologic report should never be redrawn
for inclusion in architectural or other design drawings. Photographic or electronic reproduction is acceptable, but
separating logs from the report can create a risk of misinterpretation.

Give Contractors a Complete Report and Guidance
To help prevent costly problems associated with unanticipated subsurface conditions, we recommend giving
contractors the complete geotechnical engineering or geologic report, but preface it with a clearly written letter of
transmittal. In that letter, advise contractors that the report's accuracy is limited. In addition, encourage them to
confer with GeoEngineers and /or to conduct additional study to obtain the specific types of information they need or
prefer.
Contractors Are Responsible for Site Safety on Their Own Construction Projects
Our geotechnical recommendations are not intended to direct the contractor's procedures, methods, schedule or
management of the work site. The contractor is solely responsible for job site safety and for managing construction
operations to minimize risks to on -site personnel and adjacent properties.
Read These Provisions Closely
It is important to recognize that the geoscience practices (geotechnical engineering, geology and environmental
science) are less exact than other engineering and natural science disciplines. Without this understanding, there
may be expectations that could lead to disappointments, claims and disputes. GeoEngineers includes these
explanatory "limitations" provisions in our reports to help reduce such risks. Please confer with GeoEngineers if you
need to know more how these "Report Limitations and Guidelines for Use" apply to your project or site.
Biological Pollutants
GeoEngineers' Scope of Work specifically excludes the investigation, detection, prevention or assessment of the
presence of Biological Pollutants. Accordingly, this report does not include any interpretations, recommendations,
findings or conclusions regarding the detecting, assessing, preventing or abating of Biological Pollutants, and no
conclusions or inferences should be drawn regarding Biological Pollutants as they may relate to this project. The
term "Biological Pollutants" includes, but is not limited to, molds, fungi, spores, bacteria and viruses, and /or any of
their byproducts.
A Client that desires these specialized services is advised to obtain them from a consultant who offers services in
this specialized field.
