MINUTES REGULAR MEETING CALL TO ORDER/PLEDGE OF ALLEGIANCE /ROLL CALL Mayor Ekberg called the Regular Meeting of the Tukwila City Council to order at 7:01 p.m. and led the audience in the Pledge of Allegiance. ROLL CALL Christy O'Flaherty, City Clerk, called the roll of the Council. PROCLAMATIONS A proclamation proclaiming December 10, 2016 as "Seattle Sounders FC Spirit Day. Mayor Ekberg read a proclamation encouraging all community members to join him in cheering on the Seattle Sounders FC in the MLS Cup and urging community members to wear Seattle Sounders FC attire and colors in support of this hometown team. The Mayor presented the proclamation to Roger Levesque, Director of Community Outreach with the Seattle Sounders FC. Mr. Levesque is a former Sounders FC player who spent nearly 6 seasons with the USL -1 Sounders from 2003 -2008. In 2009, he signed with the MLS Sounders and made 53 appearances in 3.5 seasons with the club. Mr. Levesque provided Sounders scarves to the Mayor and Councilmembers and expressed great appreciation for the support provided by the City of Tukwila to the team. CITIZEN COMMENTS Robert Neuffer, 13813 37th Avenue South, said he expects the City to take proactive action to fight the President - Elect. He would like it conveyed that the City will not cooperate with "round -ups" of people from any segment of our community and urged the Council to ensure that Tukwila is a sanctuary City. He will not tolerate any threat from the federal government to his neighbors and urged people to stand up and say "no." He has friends from many ethnic groups, and they should remain free to live here and feel welcomed. Mayor Ekberg stated that he was recently at the Mosque in Tukwila and assured the leadership there that we stand united. (title shown below) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, REAFFIRMING ITS COMMITMENT TO BEING A DIVERSE, TOLERANT AND INCLUSIVE CITY. The Councilmembers wanted to consider additional language changes, to include those submitted via email from Christine and Robert Neuffer. The three changes included: 1. Addition of the word "abilities" after the word ethnicities on page 1, paragraph 5 2. Addition of the words "our abilities" after the word orientation on page 2, paragraph 2 3. Change the order of the words to read "to not" <as opposed to "not to "> on page 1, paragraph 4 MOVED BY KRULLER, SECONDED BY DUFFIE TO COMBINE AND ACCEPT THE ABOVE AMENDMENTS. MOTION CARRIED 7 -0. MOVED BY SEAL, SECONDED BY DUFFIE THAT THE PROPOSED RESOLUTION BE ADOPTED AS READ.* Brooke Alford, 4724 South 122nd Street, spoke in wholehearted support of this resolution and hopes vulnerable populations in the community will be made aware of its existence, to include policy decisions that may come from it in the future. Councilmember Quinn reflected on Tukwila's history book, "Community at the Crossroads," where there are multiple sections referencing immigrants in the valley - making up about 1 in 3 of the population in 1889. The tremendous past of the City of Tukwila is about embracing and supporting immigrants; this resolution builds on the structure and culture already in place in the City. Many in the community weighed in and helped develop the language in this resolution. Councilmember Kruller confirmed that the language in this resolution has been reviewed and approved by the City Attorney's Office. Rachel Turpin, City Attorney, responded in the affirmative. Ms. Kruller emphasized the importance of every citizen, resident and guest of Tukwila being proud of the language in this resolution. Council President Duffie expressed that Tukwila took a stand on a very important issue, and the word should go out to all local schools, churches, news media, radio, and tv to ensure people are aware. He asked that Mr. Neuffer receive a copy of the resolution. Councilmember Hougardy said this embodies the views of the Council and the community and reinforces that Tukwila is a safe and welcoming City. Councilmember Seal thanked the Community Affairs and Parks Committee for their work on this important legislation, and she is proud to forward this on to the NLC (National League of Cities) Youth, Education, and Families Committee as a way of helping other communities. Councilmember McLeod said this resolution reflects a shared moral code that is not new to Tukwila, and it will continue to be built upon over time. Mayor Ekberg stated he is fully in support of this resolution. He recently visited the Islamic Center, as well as Latino students at Foster High School, to assure community members that Tukwila will remain a welcoming place. MOVED BY QUINN, SECONDED BY ROBERTSON THAT THE PROPOSED ORDINANCE BE ADOPTED AS READ.* Nora Gierloff, Community Development Deputy Director, provided a summary of this topic. This ordinance updates the City's rental housing licensing program. The proposed ordinance has both housekeeping changes and a new section requiring documentation from landlords regarding their pest control practices. The requirement that rental housing complexes keep their units free of pests and vermin is not new. That requirement has been in place through the Healthy Housing Code for a number of years. With the adoption of this ordinance, the landlords will be required to provide documentation of what measures have been taken to ensure controls are in place. There was discussion at the meeting last week regarding Section 3 that deals with inspections being required when a unit goes from owner - occupation to being rented. That language has been refined for better clarity. Tukwila City Council Regular Meeting Minutes December 5, 2016 Page 7 of 11 The other item that was under discussion is in regard to the size of complex that would be subject to the requirement regarding providing documentation of pest control. Staff had originally proposed 20 or more unit buildings, and there was discussion about reducing that number. Mayor Ekberg asked Ms. Gierloff if there is a current staff recommendation. Ms. Gierloff explained that outreach was provided on the proposed changes to landlords of complexes with 5 or more units. That group was notified about the public hearing and received information about the potential changes. She has concern about the lack of outreach to those landlords under the threshold of 5 unit complexes. Councilmember Seal referenced paragraph 3 on page 314 of the agenda packet and is in favor of changing the threshold for consideration to 2 or more unit buildings, such as a duplex. Additionally, there is a public outreach and educational component that will be part of the ordinance implementation. We have heard a great deal from the community about this issue, and she supports changing the threshold to involve 2 or more unit buildings. " ** Ms. Gierloff explained that this would significantly increase the processing time for each rental and those new to the process would need detailed explanations of next steps. Mayor Ekberg expressed that if all rentals were included in the City, the number would be approximately 600. The staff was prepared to do 20 unit buildings and above, and after additional review could include the range from 5 -19 unit buildings, adding approximately 50 units to the process. Discussion ensued among the Councilmembers regarding amending the ordinance to include additional units, with the following comments: • Councilmember Kruller advocated for the inclusion of single units and those single family homes that are being rented out. She has heard from neighbors about single family rentals that have severe pest issues that go unresolved. She feels it is the Council's obligation to include these rentals as part of the ordinance. If this does not occur as part of the process this evening, she wants to see a date certain in the next year that this is addressed by the Council. • Councilmember Hougardy expressed concern for the impact on staff time that can take away from other priorities. Additionally, she does not feel it is a positive business practice that owners that will be impacted by this change were not notified in advance of the decision. While she is supportive of the ordinance, she is unable to support the amendment based on the process not being applied to those who will be impacted. • Councilmember Robertson said that he would like to see the amendment as presented (2 or more units) be adopted this evening as a first step and get the process up and running. He also supports ensuring the process is applied to all rental units in the next year or year after, with public outreach going to all affected properties. • Councilmember Quinn supports the amendment as presented (2 or more units), and adding these additional components is not out of step with the spirit of the Healthy Housing Code. Sometimes the process pieces can present challenges to taking essential action. • Councilmember McLeod emphasized the importance of ensuring that public outreach be provided to those affected, which has not happened in this instance. He is unable to support the amendment at this time for that reason. • Council President Duffie said it is essential that pest control be applied at the highest level throughout the City. * *MOTION CARRIED 5 -2 TO AMEND THE ORDINANCE, WITH HOUGARDY AND MCLEOD VOTING NO. *MOTION CARRIED 7 -0, TO ADOPT ORDINANCE NUMBER 2519, AS AMENDED. Authorize the Mayor to sign a 2017 -2018 lease agreement with Alliance One Receivables Management, Inc., for use of space in the Municipal Court in the amount of $900.00 per month paid to the City of Tukwila. The Committee members were unanimous in forwarding this to the Regular Meeting. Alliance One provides collection services for court fines and fees and manages long -term payment plans for customers. Councilmember Kruller, who works in a neighboring court system, expressed concern regarding a recent leadership change with Alliance One, with a desire to ensure the City is being served at the highest level. Kimberly Walden, Tukwila Municipal Court Judge, said the payment window in the Court is doing well and is a vital part of their program. David Cline, City Administrator, explained there is a 30 -day termination clause in the contract in the event the City wanted to make a change. *MOTION CARRIED 7 -0. b. Authorize the utilization of Lodging Tax Funds for Seattle Sounders FC events in the amount of $30,000. Brandon Miles, Business Relations Manager, explained that the Seattle Sounders FC will be playing in the MLS Cup on December 10, 2016. The Sounders FC practice field is in Tukwila at the Starfire Sports Complex. City staff is working with the Sounders to host two events for fans, in an amount not to exceed $30,000. Lodging tax funds will be used for these events, which requires approval from both the Lodging Tax Advisory Board and the City Council. Lodging tax funds are generated from hotel stays and must be used for events and activities such as this. The City's General Fund dollars will not be utilized for this event. MOVED BY DUFFIE, SECONDED BY MCLEOD TO AUTHORIZE THE UTILIZATION OF LODGING TAX FUNDS FOR SEATTLE SOUNDERS FC EVENTS IN THE AMOUNT OF $30,000. MOTION CARRIED 7 -0. REPORTS a. Mayor Mayor Ekberg attended the Soundside Alliance breakfast where Councilmember Hougardy did a great job as the Master of Ceremonies. He also met with citizens from the Somali community regarding healthy homes. He attended the open house for Seattle Chocolates on December 1, 2016. Additionally, he had a meeting with School District staff regarding the Foster High School Early Learning Center and potential street improvements. b. City Council Councilmember Robertson reported that the Council has been requested to review intersections in the Cascade View neighborhood of South 135th St and 34th Avenue South, South 137th Street and 34th Avenue South, and South 149th Street and 62nd Avenue South for the application of possible multi -way stop signs and /or marked crosswalks. An engineering study was undertaken based on the Manual of Uniformed Traffic Control Devices to determine next steps. One of the intersections at South 137th Street and 34th Avenue South showed justification for a marked crosswalk and school crossing signage, as well as vegetation removal to improve sight distance. These improvements are anticipated to be completed by December 31, 2016 based on weather conditions. Staff will also consider using reflective sign post markers on the existing stop signs and crosswalk signs in the area. Public Works staff will continue to monitor intersections throughout the City for potential safety concerns. Councilmember Kruller requested that this information be provided electronically, so it can be shared with concerned citizens. Councilmember Robertson responded in the affirmative. Tukwila City Council Regular Meeting Minutes December 5, 2016 Page 10 of 11 Councilmember Hougardy participated in the Soundside Alliance breakfast as the Master of Ceremonies. This Alliance is intended to bring economic development into the region. The primary sponsor was Alaska Airlines, which has recently acquired Virgin Airlines, a move that will add more routes to and from major cities. She referenced the portion of the City Administrator (CA) Report that outlined Detective Sturgill and K9 Apollo graduating from K9 school as first in the class. Councilmember Quinn participated in the IRC (International Rescue Committee) garden and restoration event on December 3, 2016. Many great volunteers were working to ensure the garden will produce vegetables, and he thanked the Church by the Side of the Road for fostering this public - private partnership. Councilmember Kruller attended the SCA (Sound Cities Association) dinner where the discussion of public - private partnerships was a focus point. At the end of the meeting, the SCA staff provided 38 framed pictures that include symbols of each of the cities that make up SCA. She provided Tukwila's photo to Mayor Ekberg. Councilmember McLeod also attended the Soundside Alliance breakfast and found the discussion enlightening about what is occurring in the region, with Tukwila well represented with quality projects, events, and activities. Next week, Mr. McLeod will be representing the City at the SCA caucus where he will vote for the SCA Board of Directors. c. Staff David Cline, City Administrator, referenced the City Administrator (CA) Report in the packet and offered to answer any questions. Councilmember Seal referenced the portion of the CA report that reflects that beginning January 5, 2017, the Finance Department counter will open to the public at 10:30 a.m. on Thursdays. This will allow for staff training and collaboration that will lead to enhanced services to the public. d. City Attorney There was no report. e. Intergovernmental There was no report. MISCELLANEOUS Council President Duffie thanked the Public Works Street Department for their good work in handling the recent weather related issues that keep Tukwila's streets safe. Mayor Ekberg acknowledged the passage of the Public Safety Bond to keep Tukwila safe, which was certified on Tuesday, November 29, 2016 and passed by 60.4% of the vote. The next day, with Council authorization, the bond issuance occurred at a very favorable rate. He thanked the Finance and Safety Committee, the Finance Department, and the full Council for supporting moving this forward. Councilmember Kruller said the City of Renton has a monument that says "Welcome to Renton and the home of the Seattle Seahawks." She feels Tukwila should have something similar that reflects, "Welcome to Tukwila, home of the Seattle Sounders."
