MEMORANDUM
TO:
Civil Service Commission
FROM:
Mike Villa, Chief of Police
DATE:
December 21, 2016
SUBJECT:
Provisional Commander - Bill Devlin
Sergeant Bill Devlin was appointed on January 4, 2016 as a Temporary Commander of the
Investigative Services Division. His six -month appointment expired on July 1, 2016. He was granted
an extension with a temporary appointment effective date of July 2, 2016 through December 31,
2016. We fully expected him to return to his normal duties as a sergeant.
Now, as we close out 2016 one our commanders is on an unanticipated administrative leave for an
undetermined amount of time. This has created the need for a provisional commander appointment
effective January 1, 2017. The commander eligibility list expired on 7/5/16.
In order to maintain continuity of operations we selected Bill Devlin as the provisional commander and
he has been assigned to the patrol division. It should be noted that he was the only candidate on the
expired list. Furthermore, we intend to announce and conduct a commander examination no later
than the end of the second quarter.
It appears that the civil service rules allows for us to make this appointment without seeking
authorization. However, given the total term of the temporary appointment and provisional
appointment within two consecutive calendar years, we believed it prudent to make the commission
aware of the situation for discussion and input. We want to be true to the intent of the rules, and not
just operate within its technical terms.
Your guidance will be appreciated.
