DATE ATTACHMENTS 01/09/17 Informational Memorandum dated 1/4/17 City of Tukwila Allan Ekberg, Mayor INFORMATIONAL MEMORANDUM TO: City Council FROM: Rachel Bianchi, Communications and Government Relations Manager CC: Mayor Ekberg DATE: January 4.2017 SUBJECT.- Council discussion on support for legislative issues: human trafficking and abandoned homes ISSUE Jennifer Ziegler, TUkVV\@'S lobbyist for the 2O17 state legislative session, has contacted the City seeking support on two particular issues. Per the City's established process, when legislative requests such as these are not specifically addressed in the City's adopted Legislative Agenda, the full Council will be asked io discuss whether or not to support the naquest(a)at the next Committee 0f the Whole. These issues are iO their infancy, and staff iG looking for direction aS to whether the Council supports the basic framework; staff can return once actual bills are drafted that address the issues. DISCUSSION Mm a prostitute" provisions Senate Law @ Justice Chair Mike Padden (R-Gpok@Oe\/8UeV/4m[}iSt.) and Representative Tina Orwall (D-Des Moines/33 rd Dist.) are sponsoring a proposal which makes a technical fix to state law relating to patronizing m prostitute. Law enforcement agencies are increasingly trying to crack down on the use of"BaohPago" ads for trafficking via decoy stings but this has recently been legally challenged oD the basis Ofwhere the crime took place. Current law does not currently ensure the crime can be charged and considered tohave taken place either where the act was first initiated and where the contact was received, and this bill proposes to correct that. Increasing municipal authority tm address abandoned homes The City has received very preliminary draft language proposing to clarify state law and potentially give cities increased authority to address abandoned homes. Elements include mandatory notification, the ability to fine banks for not keeping foreclosed properties up to code and other potential measures. While this iSiO very early stages, staff iS seeking Council support for the concept of providing cities with more tools to address abandoned homes. |f Council ie supportive of the legislation's formulation, City staff will provide technical assistance on its development 8S well as keep the Council updated OD its progress. RECOMMENDATION Staff recommends Council consensus for the City tO support both items. ATTACHMENT a Draft bill modifying patronizing a prostitute regulations El BILL REQUEST - CODE REVISER'S OFFICE BILL REQ. #: S-0052.2/17 2nd draft ATTY/TYPIST: AI:amh BRIEF DESCRIPTION: Modifying patronizing a prostitute provisions. 1 AN ACT Relating to patronizing a prostitute; amending RCW 2 9A.88.110; and prescribing penalties. 3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF WASHINGTON: 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 Sec. 1. RCW 9A.88.110 and 1988 c 146 s 4 are each amended to read as follows: (1) A person is guilty of patronizing a prostitute if: (a) Pursuant to a prior understanding, he or she pays a fee to another person as compensation for such person or a third person having engaged in sexual conduct with him or her; or (b) He or she pays or agrees to pay a fee to another person pursuant to an understanding that in return therefor such person will engage in sexual conduct with him or her; or (c) He or she solicits or requests another person to engage in sexual conduct with him or her in return for a fee. (2) The crime of -patronizing a prostitute may be committed in more than one location. The crime is deemed to have been committed in any location in which the defendant commits any act under subsection (1)(a), (b), or (c) of this section that constitutes part of the crime. A person who sends a communication to patronize a prostitute is considered to have committed the crime both at the place from Code Rev/AI:amh 1 5-0052.2/17 2nd draft 1 which the contact was made pursuant to subsection (1) (a) , (b) , or (c) 2 of this section and where the communication is received. 3 (3) For purposes of this section, "sexual conduct" has the 4 meaning given in RCW 9A.88.030. 5 ((+3-)) (4) Patronizing a prostitute is a misdemeanor.
