UTILITY EASEMENT
THIS INDENTURE, made this day of aP r. 2001, between RABEL
PROPERTIES, a Washington General Partnership, hereinafter referred to as Grantor; and the CITY
OF TUKWILA, a Municipal Corporation of the State of Washington, hereinafter referred to as
Grantee;
WHEREAS, Grantor is the owner of certain lands and premises situated in the County of
King, State of Washington, described as follows:
WHEREAS, Grantee is desirous of acquiring certain rights and privileges across, over, and
upon said land and premises;
NOW, THEREFORE, Grantor, for valuable consideration, the adequacy and receipt of
which is hereby acknowledged, hereby grants to the Grantee, its successors and assigns and
its permittees and licensees, the perpetual right, privilege, and authority to construct, alter,
improve, repair, operate, and maintain utility lines and appurtenances across, under, over, and
upon the following described lands and premises situated in the County of King, State of
v Washington, to-wit:

That portion of Govemment Lot 2 and in the Northeast quarter of the Northwest quarter of
o Section 36, Township 23 North, Range 4 East, W.M., in King County, Washington described as
A strip of land 15 feet in width more or less lying 10 feet easterly from the following described
line:
The aforementioned Point "A" (from easement document recorded on September 13, 1979
(7909130671); thence S 1 °41'45 "W, a distance of 419 feet to the North Right -of -way line of South
180 Street.
Beginning at a point 10 feet easterly along the North Right -of -way line of South 180th Street
588°22'15"E; thence N 1 °41'45 "E 99 feet; thence S88 °22 15 "E 15 feet; thence S 1 °41'45 "W 99
feet; thence N88 °22' 15 "W 15 feet to the Point of Beginning.
Contains an area of 1,485 square feet or 0.034 acre.
Together with the right of ingress to and egress from said lands across adjacent lands of
the Grantor, for the purpose of constructing, reconstructing, repairing, renewing, altering,
changing, patrolling, and operating said lines, and the right at any time to remove said lines
and appurtenances from said lands.
The Grantor reserves the right to use the surface of the above- described easement in
the manner now existing, but shall not erect any buildings, structures, patios, or other
construction of any nature on said easement, however Grantor shall retain the ability to pave
acquisition area for driveway purposes. This conveyance is conditioned upon the Grantee's
obligation to replace any fences, lawns, shrubbery, or land contours that are disturbed in
connection with the exercise of the Grantee's rights hereunder in as good condition as the
same were immediately before the property was entered upon by the Grantee.
The rights, title, privileges, and authority hereby granted shall continue to be in force
until such time as the Grantee, its successors and assigns, shall permanently remove said lines
and appurtenances from said lands, or shall otherwise permanently abandon said lines, at
which time all such rights, title, privileges, and authority hereby granted shall terminate.

deed of Rabel Properties for the uses and purposes therein mentioned; and on oath stated
that he is authorized to execute the said instrument on behalf of Rebel Properties.
