III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 4 decision pursuant to Tukwila Municipal Code 18.104.010. Other land use applications related to this project may still be pending. One administrative appeal to the City Council of the Board of Architectural Review Decision is permitted. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Board of Architectural Review decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision, that is by July 16, 2003. The requirements for such appeals are set forth in Tukwila Municipal Code18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. V. APPEAL HEARINGS PROCESS The City Council hearing regarding the appeal shall be conducted as a closed record hearing before the based on the testimony and documentary evidence presented at the open record hearing conducted by the Board of Architectural Review. The City Council decision on the appeal is the City's final decision. Any party wishing to challenge the City Council decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. If no appeal of the City Council decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. 2 411 VI. Materials and colors board (presented at hearing) FINDINGS VICINITY /SITE INFORMATION Project Description The city of Tukwila recently assumed ownership of Fort Dent Park under an agreement with the former owner, King County. Tukwila has subsequently entered into an agreement with Starfire Sports under which Starfire will develop and operate portions of the park as soccer and softball facilities. This proposal by Starfire Sports includes development and improvement of former Fort Dent Park for athletic field and supporting facilities. The entire project includes construction of 84,074 square feet athletic building with two indoor soccer fields, restrooms, locker rooms, offices, pro -shop, training facilities, food concessions and other support functions; construction of a cover over an existing grandstand; construction of a maintenance building next to the grandstand; addition of synthetic turf to four existing soccer fields; and development of three new soccer fields. Lighting to illuminate the play fields will be installed to permit nighttime play at the fields. The construction of this project is split in to two phases. The first stage involves construction of the proposed buildings and field enhancements to fields 1, 2, 3 and 4. The second phase involves improvements to fields 5, 6 and 7 including the adjoining area around those fields. The project was issued Mitigated Determination of Non - Significance on May 21, 2003. The proposal was found to not have a significant adverse impact on the environment if prior to occupancy of the building a parking management plan is developed and implemented; and a traffic and parking impact monitoring program is developed and implemented. The parking management plan shall include documentation that adequate parking facilities have been secured and that appropriate means of travel from parking to the site will be provided. The traffic and parking monitoring program shall address parking demand/usage, park usage and "special events" among other things. The monitoring program shall be receive approval of the Director of Public Works and shall include appropriate commitments for mitigating any identified impacts. 2 • • The project was also issued Shoreline Substantial Development permit on June 5, 2003, for the work that will be performed in the shoreline area. This project is subject to Design Review based on code amendments recently approved by the Planning Commission and scheduled for adoption by the City Council on June 23, 2003. The new proposed code changes state that when the underlying district is the LDR (Low Density Residential district) with a Public Recreation Overlay, the structures may be granted a height bonus of one (1) additional foot of height for every four (4) feet of excess setback (i.e., setback over and above the LDR minimum standard), up to a maximum height of fifty (50) feet. Structures for which a height bonus is requested are subject to Board of Architectural Review approval under the "Commercial and Light Industrial Design Review Criteria" provisions of Chapter 18.60. Ancillary structures such as field lighting poles are exempt from height restrictions but are subject to BAR review. Surrounding Land Uses The project is located within the boundaries of the existing Fort Dent Park. The park is bounded by the Green River along the south and west side. There are railroad tracks (Burlington Northern and Union Pacific) on the east side and the park extends up to Tukwila's city limits. There is an office building up above on the hill in the City of Renton. The properties south of the park are zoned RCM and contain business park type of office uses. The properties on the west side and north side (between the Green River and Interurban Ave) are zoned RCM and C /LI and contain offices, an extended stay hotel and casinos. DESIGN REVIEW CRITERIA This project is subject to Board of Architectural (BAR) design approval under Tukwila Municipal Code (TMC) Section 18.42.030 (adopted by the City Council on June 23, 2003). In the following discussion the Board of Architectural Review criterion is shown below in bold, followed by staff's comments. For the applicant's response to the criteria, see Attachment D. 18.60.050 General Review Criteria 1. Relationship of Structure to Site. a. The site should be planned to accomplish a desirable transition with streetscape and to provide for adequate landscaping and pedestrian move- ment; b. Parking and service areas should be located, designed and screened to moderate the visual impact of large paved areas; c. The height and scale of each building should be considered in relation to the site. 3 • • The proposed 84,074 square foot building is sited in the approximate center of the existing park and is setback at least 400 feet from all property lines. Based on the new criteria under TMC 18.42.030, one foot of additional height above 30 feet is allowed for each four feet of excess setback (above the normal LDR setback, which is 20 feet front; 5 feet sides and 10 feet rear), up to a maximum of 50 feet. The proposed building is 48 feet high and meets the criteria for additional height. Smaller structures are proposed along the north, south and west side of the main structure (184'x210') to break up the mass and scale down the impact of the large structure. A separate 1,460 square feet concession/restroom building and an attached 1400 square feet maintenance equipment storage building is also proposed next to the grandstand. The existing grandstand currently sits on a large earth berm. The north portion of the berm is proposed to be removed and a retaining wall constructed. Also, a cover is proposed over the existing grandstand. The proposed height of the grandstand cover is 32 feet. It is setback at least 60 feet from the east property line and meets the criteria for additional height. The existing park has approximately 450 parking stalls that are well screened by existing trees. Applicant is not proposing to add any new parking at this time. But applicant shall monitor the parking use and implement parking management plan as a condition of their SEPA application. No changes are proposed to the existing on -site vehicular circulation. 2. Relationship of Structure and Site to Adjoining Area. a. Harmony on texture, lines and masses is encouraged; b. Appropriate landscape transition to adjoining properties should be provided; c. Public buildings and structures should be consistent with the established neighborhood character; d. Compatibility of vehicular pedestrian circulation patterns and loading facilities in terms of safety, efficiency and convenience should be encouraged; e. Compatibility of on -site vehicular circulation with street circulation should be encouraged. The proposed buildings are located in the center of a large park site and no alterations are proposed along the boundaries. Some additional landscaping is proposed along the east property line to screen the railroad tracks. The park site is bound by the Green River on the south and west side. The surrounding development consists of business park type of office buildings on the south side. The properties on the west side and north side (between the river and Interurban Ave) are zoned RCM and C /LI and contain offices, an extended stay hotel and casinos. There are no residential properties adjoining the park. The proposed structures are located in the middle of a large park and there will be no adverse visual impact to the surrounding areas. No changes are proposed to the existing vehicular pattern. The access to the park is from Fort Dent Way across the bridge over the Green River. No changes are proposed to the access from the street. 4 • • 3. Landscaping and Site Treatment. a. Where existing topographic patterns contribute to beauty and utility of a development, they should be recognized, preserved and enhanced; b. Grades of walks, parking spaces, terraces and other paved areas should promote safety and provide an inviting and stable appearance; c. Landscape treatment should enhance architectural features, strengthen vistas and important axis, and provide shade; d. In locations where plants will be susceptible to injury by pedestrian or motor traffic, mitigating steps should be taken; e. Where building sites limit planting, the placement of trees or shrubs in paved areas is encouraged; f Screening of service yards, and other places which tend to be unsightly, should be accomplished by use of walls, fencing, planting or combination; g. In areas where general planting will not prosper, other materials such as fences, walls and pavings of wood, brick, stone or gravel may be used; h. Exterior lighting, when used, should enhance the building design and the adjoining landscape. Lighting standards and fixtures should be of a design and size compatible with the building and adjacent area. Lighting should be shielded, and restrained in design. Excessive brightness and brilliant colors should be avoided. The project involves enhancement of four existing soccer fields to replace grass - playing area with synthetic turf and development of three new soccer fields with synthetic turf. The aesthetics of the existing park will be greatly enhanced as a result of the renovation of the existing athletic fields and the addition of new fields. Six existing trees located at the building entry are proposed to be removed to accommodate a pedestrian drop -off area. However twelve additional trees and a variety of shrubs are proposed to be planted in the same area and will highlight the entrance to the proposed building. All existing trees (except the six mentioned above) in the parking area will remain. These mature trees will help reduce the apparent size of the building and maintain the existing site character. Foundation landscaping is also proposed along the north side of the building and will help break up the large facade. Additional shrubs are proposed along the east property line to add a visual buffer from the railroad tracks. Four trees are proposed to be removed to the southeast of the storm water pond since they are located within the proposed fields. The rest of the landscaping along the pond will be maintained and enhanced and there will be minimal disturbance in order to maintain the natural setting around the pond. 5 I • Trees with tree grates are proposed along the west edge of field #1. Additional trees are also proposed along the proposed plaza area that is the area that will be used by vendors to setup booths during tournaments. Lighting is proposed to illuminate the play fields to permit nighttime play at the fields. Attachment C is the lighting plan submitted by the applicant. Each field is proposed to be lit by about four light poles that range in height from 60' to 90'. The proposed light fixtures use "cutoff' fixture technology. These provide the desired light levels on the field while minimizing spillage outside the field area. The last two pages of Attachment C show the proposed location of light poles, horizontal foot - candles and maximum foot - candles at the park boundary. The maximum foot - candles at the park boundary range from .30 to 1.89 foot - candles. Some of the light poles around fields 5, 6 and 7 are in the shoreline area that limits their height to 35 feet. Since the improvements along those fields are phase two of this project, the height of those poles is related to the shoreline permit and will be resolved at a later date. 4. Building Design. a. Architectural style is not restricted, evaluation of a project should be based on quality of its design and relationship to its surroundings; b. Buildings should be to appropriate scale and in harmony with permanent neighboring developments; c. Building components such as windows, doors, eaves, and parapets should have good proportions and relationship to one another. Building components and ancillary parts shall be consistent with anticipated life of the structure; d. Colors should be harmonious, with bright or brilliant colors used only for accent; e. Mechanical equipment or other utility hardware on roof ground or buildings should be screened from view; f. Exterior lighting should be part of the architectural concept. Fixtures, standards, and all exposed accessories should be harmonious with building design; g. Monotony of design in single or multiple buildings projects should be avoided. Variety of detail, form and siting should be used to provide visual interest. The main building is composed of one large 184'x210' arena building that houses the indoor soccer fields. It consists mainly of gable- roofed structure. It is surrounded by smaller attached structures on the north, south and west sides. The structures on the south and west side are raised on piers since the project area falls within 100 -year flood plain level. The facades of these smaller structures are well articulated with window openings and multiple covered porches and open decks that provide spaces and viewing platforms with open views to the soccer fields and surrounding park, while also adding visual interest to building. 6 • The main building material used for walls and roofing is corrugated steel siding. Rough split concrete block is proposed along the base of the main structure to add visual interest and texture at the pedestrian level. On the north and south side of the main arena building an acrylit translucent panel is provided along the top of the wall to bring some natural light inside the building. The major colors of the project come from the pre - finished metal panels in the shades of green. Dark gray concrete block and natural cast concrete will enhance the base of the building. Dark bronze window frames will add definition to the openings and will emphasize their pattern on the building facades. A bright yellow paint is proposed to highlight elements of the building such as steel handrails and stairs and will serve to create interest in the active areas such as the outdoor decks and entrances. The maintenance building and grandstand cover will use the same materials, colors and details. This will provide a consistent look and tie together the different shapes and sizes of all buildings into one harmonious composition. Majority of the rooftop mechanical units are screened behind parapet walls that blend in with the form of the buildings. However a few of the units could not be located behind those parapets due to HVAC needs of different areas of the building. Applicant has submitted perspectives from different areas of the park to show that these units will not be highly visible. Also, the applicant has agreed that they will paint these units to match the color of the roof. 5. Miscellaneous Structures and Street Furniture. a. Miscellaneous structures and street furniture should be designed to be part of the architectural concept of design and landscape. Materials should be compatible with buildings, scale should be appropriate, colors should be in harmony with buildings and surroundings, and proportions should be to scale; b. Lighting in connection with miscellaneous structures and street furniture should meet the guidelines applicable to site, landscape and buildings. The proposed trash enclosure is located in landscape island in the parking area. The enclosure will be constructed of split -face concrete block that matches the block used on the building. Also, plantings are proposed to further screen the enclosure. Applicant has stated that exterior building lighting will be provided around the proposed buildings. Vinyl coated chain link fencing is provided around the fields. The location of the fencing is shown on the landscape plan. The height of the fencing will range from six feet to eight feet. Applicant is in the process of deciding if the color of the fencing will be black or green. The proposed location of fencing in some areas that are in the dike maintenance area is subject to approval by the City's Public Works Department. Applicant is in the process of deciding on the signage needs for this project. The signage proposal will be reviewed separately at a later time. 7 CONCLUSIONS (1) Relationship of Structure to Site. The proposed buildings are located in the center of the park and meet the additional height criteria. The height and scale of the buildings is well related to the subject site. Parking and service areas are well screened by existing mature landscaping. (2) Relationship of Structure and Site to Adjoining Area. The size and location of the existing park is such that it is well buffered from adjoining areas. There will be no visual impact of the proposed improvements to the surrounding areas and the aesthetics of the park will be enhanced. No changes are proposed to the access to the park. (3) Landscaping and Site Treatment. The enhancement of soccer fields will improve the aesthetics of the park. All existing trees in the parking area (except six in front of the building) will remain and will help reduce the apparent size of the building. Foundation landscaping along the main building will help reduce the impact of the large building. All trees around the pond (except for four trees in the proposed field areas) will be retained. Additional landscaping along the plaza area will add visual interest. The proposed lighting fixtures to illuminate the play fields will minimize the impact on the adjoining areas by cutting off spillage outside the field areas. Some of the light poles around fields 5, 6 and 7 are in the shoreline area that limits their height to 35 feet. Since the improvements along those fields are phase two of this project, the height of those poles is related to the shoreline permit and will be resolved at a later date. (4) Building Design. The proposed location of the buildings is appropriate in scale and in harmony with adjoining development. The main building is well modulated and articulated by smaller structures. The materials and colors are selected to provide visual interest and blend in with the surrounding park environment. Majority of the rooftop units are well screened by architectural features of the proposed building and the rest will be painted to match the color of the roof. (5) Miscellaneous Structures and Street Furniture. The proposed trash enclosure is well screened by split -face concrete enclosure and plantings around the enclosure. Vinyl coated chain link fencing around the fields is a better alternative than regular fencing. The proposed location of fencing in some areas that are in the dike maintenance area is subject to approval by the City's Public Works Department. The signage proposal will be reviewed separately at a later time. Relationship of Structures to Site: The proposed buildings are sited in the approximate center of the existing park and do not impact existing public streets or rights -of -way. Existing lots provide the parking required for the building and athletic fields. Minimal alteration of the existing park vehicular circulation system is proposed. The existing park buildings will not be altered as part of this project. The scale of the main arena building is consistent with and complementary to the scale of the site. The building design has also been modulated with ancillary shed and saddlebag structures to relate to the human scale of the user. The maintenance building is similar in character to the shed buildings of the main structure. It is tucked into the hillside and will also moderate the scale of the existing grandstand and it's new canopy. The existing stadium field grandstand currently sits on a large earth berm. The north portion of this berm will be removed and a retaining wall constructed to provide adequate room for the proposed fields. 2. Relationship of Structure and Site to Adjoining Area The project is located within the boundaries of existing Fort Dent Park. To minimize the impact on surrounding properties, minimal alteration of the site boundaries is proposed., Plant material will be added along the east property line to screen the existing railroad property from the site. No work will affect the existing planting on the banks of the adjacent Green River. The surrounding neighborhood contains many uses from business parks to hospitality to industrial. The project is compatible with these uses and will even enhance some of the properties near the park. The proposed buildings are compatible with the proposed uses for the park as well as the surrounding properties. Additionally, because the buildings are located in the middle of a large park site, they will not adversely impact surrounding properties. 3. Landscape and Site Treatment This project will enhance the existing park in many ways. The renovation of the existing athletic fields will significantly enhance their playability and aesthetics. The existing stormwater detention pond will be enhanced in several ways. First, water from the site will be introduced into the pond to increase water flow through the pond. Also, though a few trees will be removed to allow for construction, new plantings will be added to the pond area. These will increase plant material diversity, improve the pond's aesthetics and make it a more enjoyable feature for all park users. Site grading is designed to allow handicapped access throughout the site. All hard - surfaced areas are paved with asphalt, concrete or crushed rock. RECEIVED JUN 0 9 20G3 COMMUNITY DEVELOPMENT i% _ r% • • Very few existing trees will be removed as part of this project. Six existing trees located at the building entry will be removed to accommodate a proposed pedestrian drop -off area. Proposed planting at the building entry will provide transition and scale for the building entry. Trees will help provide human scale to the space and shrubs will help transition the building to the surrounding landscape. All existing trees in the parking areas will remain. These mature trees will help reduce the apparent size of the building, as well as provide shade and maintain the existing site character. No trees will be removed along the Green River shoreline or levee. Also, no trees will be removed along the east property line. This planting provides a buffer between the site and the adjacent railroad tracks. Additional planting in this area will further enhance this buffer planting. The proposed plaza area west of the stadium field is designed to accommodate large groups of people attending tournaments. It also provides a place for vendors to setup booths during tournaments and other gatherings. Power and water will be provided to some vendors and trees along the eastern part of this area will provide shade and scale for a portion of the area. The soccer fields will be lighted. The lighting will use current "cutoff' fixture technology. These provide the desired light levels on the field while minimizing spillage outside the field area, both horizontally and vertically. Site lighting will provide lighting for pedestrian circulation. Exterior building lighting will provide required pedestrian and accent lighting. 4. Building Design The arena building form consists mainly of the gable- roofed structure that houses the indoor soccer fields. It is surrounded by smaller shed roofed structures in a variety of shapes and sizes. The south and west saddlebags are raised on piers. The multiple covered porches and open decks provide spaces which open views to the soccer fields and surrounding park, while also providing additional visual . interest to the building. The building facades will be animated with operable windows and garage doors that will create a constantly changing image of activity. A variety of materials and textures will be used including rough split face concrete block and corrugated steel siding and roofing. The maintenance building and grandstand cover will take their cue from the main arena building and will use the same family of materials, colors and details. This will provide a harmonious composition within the disparate shapes and sizes of all the buildings. Most of the rooftop mechanical units are screened behind parapet walls that blend in with the form of the buildings. The remaining units have been located in a thoughtful way that blends with the design aesthetic and adds to the visual interest of the structure. The major colors of the project come from the metal panels that will be painted shades of green. This will serve to connect the structures to their verdant surroundings. Dark gray concrete block and natural cast concrete will enhance the grounded base of both buildings. Dark bronze window frames will add definition to the fenestration and will emphasize the rhythm the openings provide to the facades. A bright yellow paint will highlight elements of the building such as steel • • handrails and stairs and will serve to animate the active areas such as the outdoor decks and entrances. 5. Miscellaneous Structures and Street Furniture The proposed trash enclosure will be constructed of split -face concrete block that matches the block used on the building. It will also include a sight- obscuring gate to provide full screening of this service area. Planting around the enclosure will minimize its impact on park users. Exterior building lighting will provide required pedestrian and accent lighting. 6. Consistency with Adopted Plans and Regulations This project is a unique Public / Private partnership between the City of Tukwila and Starfire Sports. Starfire Sports has made every effort to comply with applicable City codes, policies, objectives and goals throughout the development process. City staff has been instrumental in providing timely assistance, processing and guidance. The project complies with all current City of Tukwila codes and policies. Additionally, it provides many opportunities and benefits to the City including: economic stimulus, recreation opportunities not available to most cities, relieves the City of the maintenance burden for the park provided to them by King County in January, 2003 and many more. The space that is being added will replace an area that is already paved. Therefore, this work should not change the original Mitigated Determination of Non - Significance issued on May 21, 2003. No further site -work or site changes are proposed beyond the provision for exiting from the building. Relationship of Structure to Site- The addition is designed to be consistent with the massing of the existing building. The roofline is parallel to the existing roofline and is well below all height limits. The majority of the addition is screened from view from most of the parking areas because of its orientation on the site. The parking requirements for the use of this space are consistent with existing parking usage and plans. Relationship of Structure and Site to Adjoining Area- The proposed modification does not affect the project relationship to adjoining areas. Landscaping and Site Treatments- No changes are proposed to the existing landscaping and site treatments. There is no landscaping in the area of the proposed addition. Site treatment will consist of minimal concrete walkways to provide access to exits. Building Design- The design of the addition is architecturally consistent with the existing building. Both the addition and the remodeled structure are diminutive relative to the main building structure.
