COMMITTEE OF THE WHOLE MEETING
MINUTES
CALL TO ORDER Council President Pam Carter called the Committee of The Whole
Meeting to order and led the audience in the Pledge of Allegiance.

It was the Consensus of the Council to amend the agenda to move
Citizen's Comments forward on the agenda to precede Special
Presentations.
Barbara Heller, Development Director, Ruth Dykeman Youth
Family Services; and Lee Rosenstein of the same organization,
commented on the many services this organization provides to kids
and families. Heller commented that their purpose for coming
tonight was to invite the Council to an event called the "Highline
Community 24 Hour Relay Challenge." The event is a fundraiser
for youth programs in the Highline Community. Funds are raised
by recruiting sponsors to pledge or make a donation to this cause.
The events begin Saturday, October 5, 8:30 a.m. thru 10:00 p.m.;
and again on Sunday, October 6, 6:00 a.m. thru 10:15 a.m., at
Sylvester Middle School in Burien, WA. Rosenstein stated he is
hopeful that this Relay Challenge will be an opportunity for youth
and adults to partner with each other to plan an event that models
the healthy community we want to live in by building community
and bridging generations. Flyers were distributed.
Dwight McLean, 13015 38th Avenue South, representing the Hwy
99 Action Committee, invited the Council to the Committee's First
Annual Barbecue to be held Saturday, September 14, at The
Church By The Side of The Road, located at South 148th Pacific
Highway South. McLean said local and state government leaders
have been invited along with the press. He said this affair is being

An ordinance adopting animal
control regulations
held to promote continued support to Highway 99 cleanup efforts
of crime in and around the Highway 99 corridor within the City of
Tukwila. Flyers were distributed.
Pacific Highway South Revital. Moira Bradshaw and Diana Painter, Associate Planners, DCD,
Plan -Draft Design Criteria presented the "marked -up" version of the July 3 Draft Design
Guidelines Criteria and Guidelines. Painter explained that on August 26 the
Highway 99 Task Force presented to the City Council its
recommendations relating to the proposed design criteria and
guidelines for development within the Highway 99 corridor.
Those recommendations are reflected here. To assist in Council
review of the document and recommendations, the Planners
explained that the design criteria and guidelines are intended to:
better communicate to developers and citizens what the community
expects in terms of good design; improve the pedestrian
environment and orientation of the area while meeting business
needs for vehicular accessibility; emphasize personal safety and
security in site planning and development; promote a positive
transition from commercial to residential land uses along zoning
district boundaries; and increase flexibility in certain situations to
promote superior design over strict conformance to dimensional or
similar standards.

Councilmember Haggerton explained that this issue had been
discussed in the Finance Safety Committee resulting from a
citizen complaint about dog litter on the sidewalk which her child-
care class used for a walk every day. A pooper scooper provision
to the animal code was considered by the Committee. At the same
time they approved some changes to the exotic animal section of
the code which had changed at King County and which Tukwila's
assigned animal control officers had requested. Adding provisions
for potentially dangerous and dangerous dogs; deleting sections for
vicious and nuisance dogs; requiring leashes on dogs at large;
clarifying what makes a nuisance violation; and making it a

penalty to keep a dog in a hot car; were just some of the changes
made to the ordinance.
Councilmember Linder commented that the intent of the ordinance
is to protect the dogs. However, if people are not aware of the
ordinance's existence, it isn't going to be effective. Therefore, she
suggested the City take advantage of its inhouse publications
and/or any other source of getting the word out.
Mayor Rants pointed out that "Section 12 (Enforcement authority)
clearly shows King County as being the ultimate authority to
enforce this ordinance. The City's Police Department will not be
impacted in any way.
Ms. Cote- Laciste, 15144 65th Avenue South, commented that the
problem she called to the Council's attention at the April 22, 1996
Committee of The Whole Meeting, regarding dog waste on the
sidewalks (between Tukwila Elementary School and Canyon
Estates Condominiums), has gotten worse. It's totally out of
control. She says she hopes the pooper scooper law is passed real
soon.
It was the consensus of the Council to forward the ordinance, with
amendments, to the next Regular Council meeting.
The Council waded through the draft document page by page
making changes as each felt it necessary.
Bradshaw commented that DCD Staff will prepare a revised draft
to include tonight's comments from Council as well as cosmetic
amendments and grammatical changes. The draft document will
then be made available to the public. The revised version will
form an element of the proposed Highway 99 Revitalization Plan,
and will be the subject of formal public scrutiny and hearings prior
to adoption.
Council President Carter called the meeting back to order at 9 :35

An ordinance establishing
a curfew for minors
1997 ACC Interlocal Agreement
The Council briefly reviewed the Finance and Safety Committee's
recommended changes to the Curfew Ordinance. A public hearing
has been scheduled for September 16 to hear from citizens.
It was the consensus of the Council to forward the ordinance
establishing a Curfew in Tukwila to the next Regular Council for a
public hearing; and for taking official action should the Council
wishes to do so.
City Administrator McFarland explained that the Draft Interlocal
Agreement contains changes to the existing Interlocal that are
under consideration by the Coalition's Executive Committee.
Those changes are represented by text that is underlined in the
document he had previously provided to the Council and are
contained in Article III, DURATION AND CONDITIONS OF
WITHDRAWAL. and Article VIII, COOPERATION. McFarland
said the purposes of these changes are to address situations that
could possibly arise now that the Coalition has entered into the
litigation stage with the Port of Seattle. He said he had already
discussed the changes with our City Attorney. Attention was
called to the withdrawal provision which has gone from 60 days to
12 months. During that 12 month period, the City would remain
responsible for proportionate share of expenses. In other words, if
the City pledges $100,000 towards the efforts of the coalition for
1997 and decide to withdraw in February of that year, we would
likely be obligated for the entire amount pledged. McFarland said
the Mayor and Council should carefully consider the ramifications
of either agreeing to, or disputing these changes.
A discussion ensued with Councilmembers questioning whether to
request changes be made in the Interlocal to reflect a 12 month or
24 month budget cycle. They were skeptical in agreeing to a 24
month schedule for fear of obligating the entire amount pledged.
Mayor Rants commented that he is confident that Tukwila is
important enough to ACC that they will accept the City's 12-
month pledge.
Council President Carter commented that there are other areas in
the Interlocal that need to be clarified.

REPORTS
McFarland said he will be attending the next Executive Board
meeting of ACC on Thursday and will voice the Council's
concerns at that time.
Mayor Rants reviewed the Suburban Cities minutes that had been
placed in Councilmembers mailboxes today regarding the audit
that had been completed. The next meeting is scheduled for
September 11. However, Rants said he will be attending the
Duwamish Green River Forum on that date and wanted to know if
a Councilmember could attend Suburban Cities. Councilmember
Hernandez agreed to attend.
Councilmember Duffie reported that a citizen had informed him of
a specific business, located on Pacific Hwy, having signs posted
not only at his place of business but throughout the residential
neighborhood. Duffie asked if this particular business was under a
special contract to have signs posted where he pleases. City
Admin. McFarland responded that he will look into this matter.
Councilmember Hernandez reported that she had attended the
Equity Task Force meeting on last Thursday. She found it very
interesting and wishes to continue attending. One of her concerns
is to find out the focus of the group.
Council President Carter reported she had attended the ACC
meeting last week.
Councilmember Mullet reported that Councilmembers Duffie and
Linder will join him in attending the Ryan Hill meeting at 7:00
p.m. The date of the meeting was not announced.
Councilmember Haggerton stated that he plans to attend the
Wednesday meeting of the Duwamish Green River Forum.
Councilmember Duffie reported that the recent Police Auction was
a great success.
Councilmember Hernandez commented that she had noticed a
position posting for a Court Operations Manager and wondered
had the City's Court Administrator quit her job.

Reports (Cont'd) McFarland responded that Cathy Westerdahl had resigned to
accept a higher paying position with another municipality.
ADJOURNMENT
10:15 p.m.
Councilmember Haggerton suggested that the Council be made
aware of such personnel matters.
McFarland agreed and the Mayor concurred that the Council will
be informed when key personnel leave the City.
Haggerton also shared that the Children's Hospital SeaTac Guild,
of which his wife is a member, utilized Crystal Springs Parks
yesterday for their annual barbecue picnic. Everybody in the Guild
was complimentary about the condition and beauty of the park.
