• TMC 16.54.050(A) A permit is required for all grading activities occurring within the City
limits.
A dump truck dumped a load of dirt in the Shoreline Jurisdiction Area without a permit
Apply and Obtain an emergency grading permit from Public Works.
IMMEDIATELY cover the exposed dirt with plastic
Keep the dirt coveredwith plastic until Public Works and the Planning department
approves the work to be done.

SHORELINE VIOLATIONS AND PENALTIES
TMC 18.44.150 The following actions shall be considered violations of this chapter: 1. To
use, construct or demolish any structure, or to conduct clearing, earth - moving,
construction or other development not authorized under a Substantial Development
Permit, Conditional Use Permit or Variance Permit, where such permit is required by this
chapter;2. Any work which is not conducted in accordance with the plans, conditions or
other requirements in a permit approved pursuant to this chapter, provided that the terms
or conditions are stated in the permit or the approved plans; 3. To remove or deface any
sign, notice, complaint or order required by or posted in accordance with this chapter; 4.
To misrepresent any material fact in any application, plans or other information submitted
to obtain any shoreline use or development authorization; 5. To fail to comply with the
requirements of this chapter.
Vehicles are being stored and parked within the Shoreline Jurisdiction Area AND Rubbish
is being stored within the Shoreline Jurisdiction Area The disturbance to the shoreline
must be restored.
Because this parcel is located in the shoreline buffer for the Green River, the types of
uses that are permitted are limited. We understand that you may wish to locate a tow
truck operation on this parcel. This is not a permitted use in the shoreline buffer. You
can review the types of uses that are permitted in TMC 18.44.050 and in the shoreline
permitted uses matrix found at the end of the City's Zoning Code. The link to the City's

Discontinue all tow truck operations from the shoreline buffer area.
By: 11/18/16: Install emergency TESC measures required by Public Works: Cover the
exposed piles of dirt with plastic until a public works permit is issued.
Contact City of Tukwila Planning Department at 206 -431 -3670 to determine what is
required to restore the shoreline.

VIOLATIONS
TMC 18.54.170 The following actions shall be considered violations of this chapter.
clearing, planting, relocation, or maintenance of vegetation not authorized under or in
accordance with an approved Tree Gearing Permit, where such permit is required, or not
in accordance with the provisions of this chapter. Each tree which is cleared, not replaced,
or not maintained as required by this chapter shall constitute a separate violation.
A substantial tree was cut down in the shoreline buffei without a tree removal permit
Tree permit L16 -0061 was returned incomplete oh October 26, 203,6
Obtain a Tree Clearing Permit and comply with any required mitigation. Contact the
City of Tukwila Planning Department at 206 -431 -3670 to discuss the replanting plan that
is part of the Tree Clearing Permit.
Submit required materials for the tree permit (L16 -0061) to mitigate for the
unauthorized removal of a cottonwood tree. This plan will include mitigation plantings
and hydroseeding /groundcover on entire site.
Comply with the conditions of the tree permit, once approved.

ACCUMULATION OF RUBBISH OR GARBAGE
IPMC 308.1 All exterior property and premises shall be free from any accumulation of
rubbish or garbage.
Garbage is defined as the animal or vegetable waste resulting from . the handling,
preparation, cooking and consumption of food. Rubbish is defined as combustible and
noncombustible waste materials, except garbage; the term shall include the residue from
the burning of wood, coal, coke and other combustible materials, paper, rags, cartons,
boxes, wood excelsior, rubber, leather tree branches yard trimmings, tin cans, metals,
mineral matter, glass crockery and dust and other similar materials.
Observed wooden pallet stored on front of property that includes rubbish (automotive
parts)
Remove rubbish from property. This property is vacant undeveloped land so there is no
enclosed structure to store items.

TMC 8.28.070(B) Recreational vehicles may not be occupied as a dwelling unit in any zone,
except when parked in a licensed mobile home park.
There is evidence that the RV parked on the parcel is being occupied as a dwelling unit
Discontinue using the RV as a dwelling unit, and /or allowing anyone to use the RV as a
dwelling unit.

FAILURE TO COMPLY WITH THIS ORDER MAY SUBJECT YOU TO A MONETARY PENALTY OF UP TO $500
PER DAY PER VIOLATION FOR EACH DAY THAT THE VIOLATION EXISTS PER TMC 8.45.100(2).
Appeal Provisions
A person may, within ten days of receipt of this notice, file with the City Clerk a written notice of appeal
containing the following:
1. A heading with the words: "Before the Hearing Officer of the City of Tukwila"
2. A caption reading: "Appeal of " giving the names of all appellants participating
in the appeal.
3. A brief statement setting forth the legal interest of each of the appellants in the property involved in the
notice and order.
4..A brief statement of the specific order or action protested, together with any material facts claimed to
support the contentions of the appellant(s).
5. A brief statement of the relief sought, and the reasons why it is claimed that the notice and order should be
reversed, modified, or otherwise set aside.
6. The signature of all persons named as appellants and their official mailing addresses.
7. The verification (by declaration under penalty of perjury) of each appellant as to the truth of the matters
stated in the appeal.
8. The appeal fee for violations in the LDR zone is $100.00. All other zones $200.00. Fees must accompany the
written notice of appeals.
Failure to appeal this Violation Notice and Order shall constitute a waiver of all rights to any additional
administrative hearings. Failure to respond may result in the matter being forwarded to the City Attorney for
further action.
