The required changes include adding: more detailed mapping, a use matrix, an aquatic shoreline environment, sign standards; modifying certain permitted uses; and clarifying building height standards. BACKGROUND Adoption of a local jurisdiction's shoreline master program is a joint effort between that jurisdiction and the Washington Department of Ecology (DOE). After a multi -year process, the Tukwila City Council adopted a new Shoreline Master Program (SMP) on December 14, 2009. The SMP was then submitted to the Department of Ecology for its review and approval on January 22, 2010. The Department of Ecology accepted written public comments on the City's adopted SMP and held a public hearing on September 29, 2010. During the 14 months since the City adopted its SMP, DCD staff has been working with Ecology to address Ecology identified issues with the City's SMP. Staff drafted language to address a number of the issues identified by DOE which are reflected in many of the DOE required changes, such as the lack of a use matrix, criteria for signs in the shoreline, the use of FEMA maps and corrections to the sensitive area standards. The DOE required changes are technical in nature and some are repeated in several places in the document. DOE has completed its review of the City's adopted Shoreline Master Program (SMP) and provided the City with required and recommended changes to the adopted Program. A work session was held on May 11, 2011 to review the required and recommended changes. Materials provided to the Council for the work session included: A Summary of Required Changes to Council Adopted Shoreline Master Program; A copy of the Department of Ecology Correspondence and Attachments; A Matrix Comparing the Tukwila Shoreline Master Program with the Ecology Required and Recommended Changes; and A copy of the December 14, 2009 Council Adopted Shoreline Master Program with Staff Recommended Ecology Required and Recommended Changes Incorporated. CL Page 1 of 2 06/22/2011 9:04:00 AM W: \Long Range Projects \Shoreline \Council Review 2\ Council Info Memo 5 -4 -11 3 June 27, 2011 City Council Public Hearing Informational Memo June 22, 2011 DISCUSSION A public hearing is required in order to repeal the original ordinances that adopted the Shoreline Master Program and implementing regulations and adopt new ordinances with revised attachments and revised implementing regulations. The draft ordinances that are included in the Council packet reflect the changes required by the Department of Ecology to receive Ecology approval of the City's SMP and some of Ecology's recommended changes to the SMP. These are the same required and recommended changes that were reflected in the materials the Council received for the May 11, 2011 work session. After the public hearing is conducted, the Council has several options: 1. Forward the ordinances to a Regular Meeting to adopt all of the Ecology required and some of the recommended changes to the City's SMP; or 2. Reject the Ecology required and recommended changes to the City's SMP; or 3. Propose alternative language to the Ecology required changes. Any action other than accepting all of Ecology's required changes will necessitate another round of review by the Department of Ecology and possibly another public hearing on any additional proposed changes to the SMP and its implementing regulations. RECOMMENDATION Conduct the public hearing on the four amending ordinances and then provide direction to staff on which, if any, of the options identified above the Council wishes to take. ATTACHMENTS 1. Ordinance repealing Ordinance 2269, and adopting a new shoreline master program; 2. Ordinance repealing Ordinance 2270, and adopting shoreline comprehensive plan goals and policies; 3. Ordinance repealing Ordinance 2271, and establishing a new shoreline overlay district, as codified in TMC 18.44; and 4. Ordinance repealing Ordinance 2272, and establishing definitions, as codified in TMC 18.06.
