VIOLATIONS
TMC 18.44.090 Environmentally Sensitive Areas within the
Shoreline Jurisdiction.
A. Purpose.
1. The Growth Management Act (RCW 36.70A)
requires protection of, critical areas (sensitive areas), defined as
wetlands, watercourses, frequently flooded areas, geologically
hazardous areas, critical aquifer recharge areas, fish and wildlife
conservation areas, and abandoned mine areas.
There have been changes made in the sensitive area (shoreline) on the north (river) side of
the property, including brush and /or vegetation clearing and removal, and the recent
construction of a concrete stairway leading to the river edge.

/permitting requirements for work performed in the sensitive area (slope) on the rear
portion of the property!
The permit center is located at 6300 Southcenter Boulevard, Suite 100 (next to City Hall)

TMC 18.44.080.B.2: Vegetation Protection and Landscaping: B. Tree Protection, Retention
and Replacement. 2. To protect the ecological functions that trees and native vegetation
provide to the shoreline, removal of any significant tree or native vegetation in the
Shoreline Jurisdiction requires a Shoreline Tree Removal and Vegetation Clearing Permit
and is generally only allowed on sites undergoing development or re- development. Only
trees that interfere with access and passage on public trails or trees that present an
imminent hazard to existing structures or the public may be removed from sites without
an issued building permit or Federal approval. Factors that will be considered in approving
tree removal include, but are not limited to: tree condition and health, age, risks to
structures, and potential for root or canopy interference with utilities.

Corrective Action: Within 30 days, you must apply for a Shoreline Tree Removal permit at the Permit Center!

The permit will also require re- planting with a native tree of similar size. Before rel'�
planting, you must: obtain a tree permit; submit a planting plan for the tree replacement;
provide the size of the tree(s) that were removed; submit a replanting plan showing the
ipecies and number of proposed trees. The permit application packet contains a checklist
for you to reference.'

It is also recommended that you remove the knotweed plant that is still growing in your
frt yard, as it is an invasive noxious weed that is harmful to the environment!

Violation # 3 BUILDING PERMITS REQUIRED
Code Reference: IBC 105.1 Any owner or authorized agent who intends to construct, enlarge, alter, repair,
move, demolish, or change the occupancy of a building or structure, or to erect, install,
enlarge, alter, repair,: remove, convert or replace any electrical, gas, mechanical or
plumbing system, the installation of which is regulated by this code, or to cause any such
work to be done, shall first make application to the building official and obtain the
required permit.
• Observed recent installation and related new construction framing of 3 new windows on
north side (rear) of home.
Corrective Action: Apply for and obtain building permit for construction related to the installation of new
windows within 15 days of this notice;

If you have received this Notice, the City has determined that a violation exists on the above property. In order to
bring the property into compliance, you must complete the corrective action(s) above by the compliance date
indicated. If you fail to take the corrective action above, the City may issue a civil infraction or a Violation Notice
and Order, pursuant to Tukwila Municipal Code 8.45.050. You may be fined penalties of up to $500 per day per
violation for each day that the violation exists, under the provisions set forth in Tukwila Municipal Code
8.45.100(A)(1).
Property owners may be granted extensions due to extenuating circumstances. Please contact the Code
Enforcement Officer to discuss this further.
