SENSITIVE AREAS VIOLATIONS
TMC 18.45.195 The following actions shall be considered violations of this chapter: 1. To
use, construct or demolish any structure, or to conduct clearing, earth - moving,
construction or other development not authorized under a Special Permission, Reasonable
Use or other permit where such permit is required by this chapter; 2. Any work that is not
conducted in accordance with the plans, conditions or other requirements in a permit
approved pursuant to this chapter, provided the terms or conditions are stated in the
permit or the approved plans; 3. To remove or deface any sign, notice, complaint or order
required by or posted in accordance with this chapter; 4. To misrepresent any material fact
in any application, plans or other information submitted to obtain any sensitive area use,
buffer reduction or development authorization; 5. To fail to comply with the requirements
of this chapter.
TMC 18.45.070 Sensitive Area Permitted Uses and TMC 18.45.090 Wetland Uses,
Alteration and Mitigation.
*Installed a concrete pad and sidewalk within the buffer /sensitive area.
*Vehicles were parking /being stored in the buffer /sensitive area.
*Trees in the buffer area /sensitive area and entire property had been limbed up.
*Trees that had fallen had been removed from buffer /sensitive area.
*Filling in the wetland buffer is prohibited. There was wood, branches, and leaves dumped
in the stream to alter the water flow.
* Working in the buffer /sensitive area without a permit. The buffer area has been removed
of vegetation.
• Identify the buffer area by a qualified wetland /stream biologist to delineate the
stream buffer area of property.
• Install a permanent split rail fence along the buffer area identified by the
wetland /stream biologist to dearly delineate the buffer area.
• Remove the concrete pad and sidewalk installed in the buffer area.
• Submit a planting plan for the buffer /sensitive area that was disturbed.
• Restore the entire buffer /sensitive area where area was disturbed with native
plants.
• Submit a monitoring report for three years for the restoration area.
• Cease all parking or storing of vehicles in the buffer /sensitive area.
• Cease all storage of rubbish in the buffer area /sensitive area.
• Cease all work in buffer /sensitive area without a permit.

Compliance Date: 2/23/2017
FAILURE TO COMPLY WITH THIS ORDER MAY SUBJECT YOU TO A MONETARY PENALTY OF UP TO $500 PER DAY
PER VIOLATION FOR EACH DAY THAT THE VIOLATION EXISTS PER TMC 8.45.100(2).
Appeal Provisions
A person may,.within ten days of receipt of this notice, file with the City Clerk a written notice of appeal
containing the following: •
1. A heading with the words: "Before the Hearing Officer of the City of Tukwila"
2. A caption reading: "Appeal of " giving the names of all appellants participating
in the appeal.
3. A brief statement setting forth the legal interest of each of the appellants in the property involved in the
notice and order.
4. A brief statement of the specific order or action protested, together with any material facts claimed to
support the contentions of the appellant(s).
5. A brief statement of the relief sought, and the-reasons why it is claimed that the notice and order should be
reversed, modified, or otherwise set aside.
6. The signature of all persons named as appellants and their official mailing addresses.
7. The verification (by declaration under penalty of perjury) of each appellant as to the truth of the matters
stated in the appeal.
8. The appeal fee for violations in the LOR zone is $100.00. All other zones $200.00. Fees must accompany the
written notice of appeals.
Failure to appeal this Violation Notice and Order shall constitute a waiver of all rights to any additional
administrative hearings. Failure to respond may result in the matter being forwarded to the City Attorney for
. further action.
