corporation hereinafter referred to as GRANTOR.` for SI0.00. which is hereby
acknowledged to be fair and lust compensation, do by these presents _rant unto THE CITY
OF TUKWILA. a municipal corporation of King County, Washington, hereinafter referred
to as GRAN a perpetual right -of -way easement for c. a8fc signal loops. traffic signal
Doles. mast arms and cabinets purposes with the n...rssan appurtenances through, over and
across the property crosshatched and described on Exhibit A, which property- is situated in
King County. Washington.
GRANTEE shall have the right, without prior institution of any suit or pros eding at laves. at
times as may be necessary to enter upon said property_ for the purpose of con; :action.
repairing, altering or reconstruction said traffic siet>c1 loops, traffic signal poles, mast arms
and cabinets or making. any connections therefore; provided that such constructing.
repairing, altering or re.constrpctirg of said traffic signal loops. cafric sign poles. mast
arms and cabinets shall be accomplished in such a manner that the private improverne-ts
existing outside the sidewalk area in this right -of-way shall not be dismrbed or desuoved, or
in the event they are disturbed or destroyed, they will be replaced in as good a condition as
thep were immediately before the property was entered upon by the GRANTEE.
The GRAN shall retain the right to use said easement, so long as said use does no:
interfere with the installation and maintenance of the uc_;i,. signal loops, traffic signal
poles, mast arms and cabinets and so lone as The use does nor interfere with use and
purposes herein mentioned.
GRANTEE agrees that upon completion of such work, the surface of such easement shall be
restored and replaced to a condition substantially equal to that before the work was
commenced, to the extent that it is practiel to do so.
GR _NTOR shall nor be liable for. and GRANTEE shall defend, indemnify. hold harmless
and protect GRANTOR from any claim or liability, which may be made, incurred or
asserted by GRANTEE, GRANTEE s agents or employees, contactors, or anv third
parties, arising directly of indirectly- from the construction, repair, alteration, improvement
or use of the traffic signal loops, traffic signal poles mast arms and cabinets.
This easement shall be a covenant running with the land and shall be binding upon the
successor, heirs and assigns of the GRANTOR hereto.
