Councilman Traynor asked if it would be proper at this time to make a motion setting Council policy? MOVED BY TRAYNOR, SECONDED BY SAUL, THAT IT SHALL BE THE POLICY OF THIS COUNCIL THAT SUNGLASSES WILL NOT BE PURCHASED WITH TAXPAYERS' MONEY. Councilman Van Dusen stated that if the Police Patrolmen need prescrip- tion sunglasses, that should be a valid expense. Councilman Traynor stated that if they are, they should be OSHA or WISHA approved. Councilman Saul agreed that they should be just prescription glasses. Councilman Hill cited the King County ordinance regulating the purchase of glasses. He stated that he likes this ordinance because it spells out "for necessary medical care." Gary Crutchfield, employee, stated that he asked first and was told there was no problem in submitting this bill. MOTION CARRIED. This being the time and date published, Mayor Bauch explained that the purpose of the Public Hearing is to consider adoption of the new Comprehensive Plan and adoption of an ordinance to provide the City with procedures to help assure that growth will be consistent with the Comprehensive Plan. Mayor Bauch declared the Public Hearing open. J92 Fred Satterstrom, Associate Planner, read three letters for the record. 62nd Ave. South, The first from Black and Caldwell, Inc. was signed by Alan F. Black, south o4 South 153rd president. Mr. Black presented background information regarding his five -acre tract in Lot 16, Interurban Addition. The property was purchased in 1968 with a condition that the property be zoned R -4 or RMH. It was rezoned R -4 with a recorded Property Use and Development Agreement. Plans for development were completed but the 'Boeing collapse' occurred and the apartment project was aborted. In January 1977 an offer was made to purchase the property and this is still pending. Mr. Black states, "I felt you should have the benefit of this background information since any change in zoning of the five acre parcel would have very serious implications for us." The second letter was from Hometel Corporation and was signed by Leonard C. Rivero, president. Mr. Rivero explains that they have just learned that their property fronting 14800 Interurban Avenue is proposed to be rezoned from Commercial to High Density Residential. The property was purchased in October 1976 for the purpose of constructing a new motel office, restaurant and lounge, to service the 89 -unit motel facility. They checked with the planning department before purchase to verify that zoning would allow development of the site. The site appears ideal for commercial use. Mr. Rivero states, "We respectfully request that Council reconsider the proposed changed zoning and allow the existing commercial zone to remain as it is." The third letter from the Tukwila Associates was signed by Henry K. Hebeler, secretary. Mr. Hebeler submitted the following proposal for consideration: RESOLVE that the following described property Tracts 8, 9, and 10 of Interurban Addition to Seattle, as per plat recorded in Volume 10 of Plats, page 55, records of King County, together with vacated portion of South 152nd Street, lying between said Tracts 8 and 9' be designated on the revised Comprehensive Plan for (1) high density multiple family use south and west of the ridge line, and (2) medium density residential use north and east of the ridge line and south and west of the eastern most part of 175 foot contour, provided that upon actual zoning in accordance with this plan that the owners donate and deed the following two (2) portions to the City of Tukwila for reservoir, open space park, or passive recreational use: 1. 100 feet by 100 feet at the northwest corner of said property. 2. The property which is both north and east of the eastern most 175 foot elevation contour on said property. 62nd Ave. South, Mr. Alan Austin, attorney representing Black and Caldwell, presented .south o4 South 153rd an exhibit with attachments describing the property and requested it be made a part of the official record. Mr. Austin stated that the law says to change a comprehensive plan, you have to have a clear indication that the conditions have changed and emphatically call for a change. It appears that the facts as related to his client are otherwise. The property to the immediate south is the new city hall site zoned RMH and the property to the north is currently developed multiple residence and permits have been issued to them for further development. Farther to the west there are more multiple family developments. The Advisory Committee recommended medium density for this area as did the staff and Planning Commission. Staff recommended medium density to be a buffer between the high density and the single family. The comprehensive plan says there should be transitions between the high density and the single family residential. This property was purchased according to a contract approved by the City binding Mr. Black to certair conditions. Economics must be considered in this case. This property, at best, is a marginal single family area. He referenced to Section 1 of the proposed interim zoning ordinance and stated that it seems that TUKWILA CITY COUNCIL REGULAR MEETING August 15, 1977 Page 3 PUBLIC HEARINGS Cont. Conner of South 200th and Paci4 is Hig hwa y 53rd Ave. South and South 160th (Page 5) 1922 the Comprehensive Plan will be followed by rezones. Any change in zoning would be crucial to his client. Mr. Willing R. Coffin, Real Estate Consultant and Appraiser, illustrated the difference between the existing zoning, the Planning Commission's recommendation and the Council's proposed change. He noted the existing multiple development projects in the area designated by Council as single family and noted the density of each. He stated that it is awkward for the Black Property to develop under any combination of single- family and multiple family because of the topography. The property was bought subject to the zoning under a contract. If the property is sold, the price is predicated on the use of R -4 zoning. Any buyer will have to carry out the conditions of the contract. If they cannot take advantage of the R -4 zoning, there will be a substan- tial loss to the owner. Mr. Alan F. Black, owner, stated that single family residential is not economically feasible for this property. Mr. Ted Hacket, representing the Boeing Engineers (Tukwila Associates), pointed out the location of their property and stated that the property lies just south of the Elementary School and is presently zoned R -1. Economically, this zoning is not good. Mr. Hacket reviewed the proposal suggested by Mr. Hebeler, Tukwila Associates, in the letter previously read for the record. Mr. Robert W. Thorpe, 815 Seattle Tower, representing Tukwila Associates, stated that they submitted the request for a waiver back in February trying to work out some type of a Planned Unit Development. He stated that their proposal is compatible with the existing comprehensive plan and is consistent with the recommendations of the Planning Commission one staff. They are concerned with the removal of the medium density /multi- family. There will be no transition zone between the high density and single family. In talking to staff they understood that the City wants to buffer single family. Mr. Thorpe discussed the use of the two areas they are proposing to deed to the City. He stated that they hope Council will be responsive to their proposal. Mr. Kjell Stoknes, OCD Director, identified the location of the ridge lines discussed in Mr. Hebeler's proposal. Mr. Fred Satterstrom, Associate Planner, explained that the topographic maps that the City deals with are not as detailed as you would expect an engineering study to be. The staff followed the topographic map flown by Walker and Associates. The survey done for the Boeing Engineers shows a different ridge line one which was not clouded by trees. This explains the difference in the two ridge lines. Councilman Saul explained an error he feels was made. Council changed the commercial property at South 200th and Pacific Highway to single family residential, and he recommended the corner remain commercial. Fred Satterstrom addressed the area adjacent to the commercial referr6d to by Councilman Saul. It is already developed into apartments or condominiums. Mr. Wynn Anderson, 6415 South 153rd, stated that he was surprised to see the elimination of buffer areas between high rise and residential and feels it is a step backward and a mistake. Mr. Jack Bryant, architect; representing Jack Anderson, owner of property located at 53rd Ave. South and South 160th Street; stated he would not speak now but would express opinions under the waiver request later on the agenda. He reminded the audience that the map under discussion is a Comprehensive Plan; it does not reflect zoning. Mr. John L. Barnes, 15814 51st Ave. South, commented that Council has heard him before on this subject. He identified the area he is speaking on as being bounded on the east by I -5, the north by 405, and the newly purchased City Park site on the south and on the west another piece of 4Sperty, 9 acres which is wooded and considered a buffer zone. Based on this, Mr. Barnes stated that there should be no reasonable objections to leaving the zoning as it is and changing the proposed comprehensive plan. Mr. William Sutton, 15816 53rd Ave. South, stated that he purchased a home at this address but since moving in has found it unsuitable for single family residence because of the traffic and the noise. He endorsed what Mr. Barnes said and would like to see it left multiple residence. Mr. Dennis Robertson, president of the Tukwila McMicken Action Committee, noted several points: (1) the concept of buffer zone is fine if it buffers you from something you don't want, and we don't want apartments. (2) noise is not an acceptable argument. (3) apartments would bring in greater traffic problems and problems in our schools. (4) we would like to see the new park marked on the map. Mr. Frank Todd, 14444 59th Ave. South, stated that the proposed comprehensive plan doesn't appear to correspond to the policy statement at the beginning of the book. In the north area, outside Tukwila but abutting industrial zoning, there is no buffer zone between that and the single family. Mr. Todd questioned the designation of Public Facility on his property on Interurban,south of the Village Green Apartments. He asked Council to take a second look at how the plan proposes to buffer industrial to residential. He would like to see an ordinance prepared to accommodate Planned Unit Developments. He suggested another ordinance to allow Contract Zoning. He believes the City would be better off if all zoning was by contract. Fred Satterstrom, responding to Mr. Todd's question concerning the Public Facility designation, stated that this was checked on the Kroll Map and the King County Assessor Map as it showed this property owned by Puget Power. Mr. Todd offered to supply Planning with a copy of his deed. Mayor Bauch asked if there was anyone in the audience who wished to address the proposed ordinance on Interim Zoning Control. Mr. Bob Oldright, owner of the Tuk -Inn, noted that the City Light property in front of the restaurant is designated Public Facility and stated that he has it leased and thought some consideration should be given to it. Mr. Jack Grant, 4220 42nd Ave. South, stated that he bought the property located at South 139th and 56th Ave. South in 1965 as Commercial property and requested that Council leave as is so he could build apartments or condominiums. The property referred to is known as the 'Cartner Property'. Mr. Carl Brewer, 13750 56th Ave. South, asked about the proposed designation of his property on Interurban. Mayor Bauch explained that part of it is medium density and part of it is high density. Mr. Brewer stated that he has been paying taxes on Commercial property and would like it left as it is. Mayor Bauch asked if anyone else would like to speak. Since there were no further comments, he declared the Public Hearing closed. CITIZENS' COMMENTS McMicken Park Waiver from Res. #489, (Slope Stability) 53rd Ave. South South 160th, requested by Jack Anderson /72V MOVED BY HILL, SECONDED BY TRAYNOR, THAT COUNCIL RECESS FOR TEN MINUTES. MOTION CARRIED. Mayor Bauch called the meeting back to order with all Council Members present as previously reported. Mayor Bauch stated that the question had been raised if the Public Hearing was closed or whether the Interim Zoning Measure would be discussed. He stated that the Public Hearing has been closed but it is a policy of the Council to hear the public at any meeting and these items will be discussed again next Monday night. Dennis Robertson commented that the Tukwila McMicken Action Committee will discuss work in the new park in September, after vacations. PETITIONS, COMMUNICATIONS, APPEALS, AND SIMILAR MATTERS Mayor Bauch announced that this request for waiver has been continued from two previous meetings because of lack of attendance by those requesting the waiver. Mr. Jack Bryant, architect representing the owners of the property, Mr. and Mrs. Jack Anderson and Mr. Glen Butler, explained the request for a waiver to build 130 -unit apartment complex. The proposed construction site is located at 53rd Ave. South and South 160th Street. Mr. Bryant stated that, historically, multiple residential zoning surrounds industrial and commercial areas. Zoning is to put land to its best use. The proposal to change this area to single family is opposed to logical planning, and it should be left the zoning it is now. It has been RMH for the last 16 years. Mr. Bryant addressed the staff report. The waiver request is not for zoning but has to do with potential stability problems. He stated that they had furnished staff with a report from Pacific Testing Laboratories completed in 1969 and quoted from the structural recommendations section of the report. Based on the report, the reasoning behind the instabilit of this site is not well founded. The density of the proposed develop- ment is considerably less than that allowed under the RMH zoning. Mr. Bryant stated that the objectives listed in the staff report are practically impossible to comply with in development of RMH property. He again stated that the major question raised by staff is the stability and the tests that have been made, compared to the proposed development, show they are not taking any chances with the stability of the property. He explained that the state has gone to great expense to stabilize the hillside by installing a number of pumps to bring the sub -water to the surface. Their proposed development will help in that the surface drainage will be directed into a drain system and not enter the sub water problem. Mr. Bryant discussed the staff report further and explained the proposed regrading of the site. He stated that they felt traffic would go toward Klickitat rather than up into the residential area. If the property is down graded to single family, the property becomes worthless and this is not logical. The down grade to single- family is completely against all planning rules. Councilman Saul asked how many units per acre the developer is proposing, and he was told approximately 43. Councilman Gardner asked how they intend on handling water that comes down the hill. Mr. Bryant explained the drainage system and how they propose to use holding tanks along the north boundary. Ordinance #1031 Reclassification of certain land from R -3 and C -1 to RMH and C -2, VIP Restaurant Site /925' Dennis Robertson stated that there is a creek running through the property right now and it could not be retained in a 4 -inch main. Paving this area isn't going to help. He felt that most of the traffic will go up the hill into the residential area. Mr. Glen Butler, owner, stated that everyone wants this to be residentia but no one has considered that the first sewer hookup will cost $20,000 and this property would only accommodate about six houses. Councilman Bohrer asked if the trees on the drawing exist and was told no, not in the size shown. Fred Satterstrom, speaking on behalf of the staff report, stated that the proposal was analyzed with respect to the natural environment element of the Comphrehensive Plan and generally was not found to be in conformance with the emerging policy. He explained that he has not seen a proposal come as close to disturbing or influencing the entire site as this one. As many units as this on this small piece of ground, laid out in this manner, necessarily disturbs the entire site and it must be regraded. This is why staff recommended as they did, to have the applicant revise the plans to reflect a greater concern for the natural environment. Jack Anderson, owner, stated that the going rate for apartment property is $2,000 per unit. Councilman Bohrer stated that the soils report doesn't appear to address the slide areas. Mr. Bryant read a short section from the soils report concerning the slides: There is no evidence of recent or poten- tial massive movement." MOVED BY MRS. PESICKA, SECONDED BY BOHRER, THAT COUNCIL GO ALONG WITH STAFF'S RECOMMENDATION AND DENY THE WAIVER. Councilman Bohrer stated that if the waiver is denied and the applicant comes back with a less severe proposal he would like to see the subject of a scale drawing addressed and the sub surface water issue. Also, he would like to have the City consider having a soils expert review the data submitted. Councilman Van Dusen agreed with staff's recommendation. MOTION CARRIED. MOVED BY SAUL, SECONDED BY MRS. Deputy City Attorney Hard read an ordinance approving the reclassifi- cation of certain land from R -3 (Three and Four Family Dwellings) and C -1 (Neighborhood Retail Business) to RMH (High Density Multiple Residence) and C -2 (Local Retail Business) for a new motel and expansion of the present restaurant, all subject to certain conditions. OLD BUSINESS Bluff Street Hiking Trail City Hall Landscape Plan /9'26 Councilman Bohrer asked if provisions have been made to handle the noise from two freeways that pass directly in front. Representative of VIP's Restaurants, Inc. stated that, at this point, they haven't definitely decided on double glass, but it will be evaluated when they discuss heating. Councilman Bohrer expressed concern about the architecture on the front of the building. It forms a cavern for noise to go directly in. He also questioned the scale of the building versus the scale of the surrounding hillside and wondered if the peak of the building would be above the level of some of the apartments behind them. The building may be high enough to block the view of some of the apartments. Councilman Saul asked if everything that was included in the staff report is included in the Ordinance. Kjell Stoknes, OCD Director, assured him that it was. He questioned paragraph L "In the event the proposed project is not completed to an extent such that the reclama- tion bond is exercised, the zone classifications hereby granted shall revent." He asked if therev,as a time stated on this. Kjell Stoknes explained the meaning and said Council could set a time limit. Councilman Hill questioned if the length of time for the bond should be stated and suggested three years. Councilman Bohrer said he would like to see: (1) a completion date, (2) a noise level requirement, and (3) a projection of the building from the Southcenter area. It appears to be a very excellent project. He further suggested bringing it back to the table on September 6. The Representative of VIPS stated if they have to go one more meeting, they will not be able to start the project for one more year. Kjell Stoknes, referring to Councilman Bohrer's question on height, said the height of the building will not be as high as the foundation of any of the structures above. MOVED BY BOHRER, SECONDED BY VAN DUSEN, THAT THE ORDINANCE BE AMENDED TO INCLUDE A COMPLETION DATE OF THREE YEARS FROM THE PRESENT DATE AND ALSO THAT THE NOISE LEVEL IN THE ROOMS, FROM OUTSIDE SOURCES, NOT EXCEED THE CITY OF SEATTLE STANDARDS. MOTION CARRIED. MOTION CARRIED AS AMENDED. Kjell Stoknes reported that he has nothing back from Dames and Moore on the Bluff Street Hiking Trail. Carl Stixrood reported that he met with the architect to discuss the landscape plan, and Mr. Emrich had several suggestions. Mr. Stixrood displayed a new drawing incorporating these ideas. He explained that the gazebo was eliminated as it distracted from the building. The original pond and shrubbery would be left. There would be a path through a uniform sloping lawn from the parking lot to the street. The water area on the west would be preserved. The water area was discussed further, preserving the existing apple trees was noted, use of the existing basement for storage was discussed along with fill of the front lawn area. Mayor Bauch cautioned about losing sight of proposed future expansion of a wing along the south parking lot. TUKWILA CITY COUNCIL REGULAR MEETING August 15, 1977 Page 8 OLD BUSINESS Cont. FIRST READING /9Z7 It was generally agreed by Council that they liked the idea of the water area to the west, the sloping front lawn, the curved path, saving the existing trees and leaving the existing pond and shrubbery. Cost of fill material was discussed along with cost of building the two suggested bridges. Kjell Stoknes explained the problem with bridges was having to make a cut of possible 12 feet whereas a culvent can give the same visual effect. Mr. Stixrood stated that it appears that Council favors the revised drawing and Council agreed. Ordinance #1032 MOVED BY TRAYNOR, SECONDED BY SAUL, THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. Deputy City Attorney Hard read a resolution granting approval, subject to certain conditions, of the final plat of Upland's Tukwila Industrial Park being Office of Community Development, Planning Division File No. MF -77 -7 -SUB. MOVED BY HILL, SECONDED BY SAUL, THAT RESOLUTION NO. 599 BE ADOPTED AS READ. Councilman Bohrer asked for a brief explanation of what the resolution does. Kjell Stoknes stated that this is acceptance of the final plat. The requirement of the Council for a ten foot pedestrian access easement has been met with the option for the City to improve it when the need is there. MOTION CARRIED. Mr. Dave Ulrich, Upland Industries, stated that they would like to include the ten foot easement as part of the plat subject to the same easement rights granted to the Railroad Company for installation, operation and maintenance of railroad facilities. Mayor Bauch reported that Benaroya Company has filed suit against the City over an application for a sign that was denied; it was appealed to the Board of Adjustment and again denied. Councilman Saul read the City Treasurer's monthly investment report. Revenue from interest income was $9,426.30 earned during the month of July.
