WOOD MEADOWS L.L.C., a Washington limited liability company, herein after GRANTOR", for
515.000 which is hereby acknowledged to be fair and just compensation. do by these presents grants unto
THE CITY OF TUKWILA, a municipal corporation of King Count, ashington, hereinafter referred to
as "GRANTEE'. a perpetual right-of-way easement for over and across the real property described on
Exhibits .A and B. attached, being a portion of:
Section 33. Township 34 North. Range 4 East, 1F i. in King County, Washington_
GRANTEE snail have the right. without prior institution of any suit or proceeding at law. at times as may

reconstruction ofsaid sidewalk, landscaping and altering or reconstructing of said sidewalk. landscaping
and wall shall be accomplished in such a manner that the private improvements existing outside the
1 sidewalk area in this right- of -wa_v shall not be disturbed or destroyed, or in the event they are disturbed
td or destroyed, they will be replace in as good a condition as they were immediately before the property
was entered upon by the GRANTEE.
GRANTEE agrees to allow GRANTOR the right to on a right- turn-in and right- tumjwt driveway at
the southwest corner of the property for the express purpose of allow ing motor vehicle access to and
from East Marginal Way that does net adversely affect traffic safety er operations. GRANTEE reserves
the right to entirely close off the said driveway, without cost or liability payment of damages to the
GRANTOR. in the event it is used for anything other than a motor vehicle oriented right turn-in and
right- turn -out driveway to and from East Marginal Way; or if traffic safety or traffic operations is
adversely affected.
The GRANTOR shall retain the right to use said easement. so long as said use does not interfere with the
installation and maintenance of the sidewalk and utilities and so long as the used does not interfere with
use and purposes herein mentioned.
GRANTEE agrees that upon completion of such work, the surface of such easement shall be restored and
replaced to a condition substantially equal to that before the work was commenced, to the extent that it is
practical to do so.
This easement shall be a covenant running with the land and shall be binding upan the successors, heirs
and assigns of the GRANTOR hereto.
