This work includes the removal and restoration of 8 x 100 linear feet of existing pavement, excavation and restoration of approximately 75 linear feet of access road, construction of a rock toe key and vegetated geogrid, installation of fish habitat components, revegetation of the disturbed areas, and installation of a catch basin and pipe under South 104th Street (outfalling to the Duwamish River). Agencies with Jurisdiction: None. Summary of Primary Impacts: • Earth The riverbank at this location is steep, containing Class 2 slopes which are nearly vertical where sloughouts have occurred. The foundation soil includes sands with gravels at the upper soils levels and silty sands and silts at the lower pile elevations which are typical of those found along the Duwamish River. In the past, the riverbank and roadway foundations in the vicinity have required remedial work for stabilization purposes. There will be approximately 1,200 cubic yards of excavation and fill to accommodate the construction of the 75 foot long access road. This road will drop 12 linear feet from the existing roadway grade. Although erosion control measures will be in place, some silt will likely enter the Duwamish as a result of construction activities. Construction will occur at low tides and will be carried out expeditiously. A catch basin and outfall pipe will collect and convey drainage from the street and adjacent properties to a discharge point in the rip rap. This mitigation will prevent future saturation of the upper bank as required by FEMA. • Plants Blackberry and various grasses are currently found along the riverbank. Proposed property restoration suggests a constructed geogrid with willow plantings of Red Osier Dogwood (Cornus stolonifera) along the upper and lower riverbank. However, due to the salinity of the river at this location, Red Osier Dogwood will not tolerate inundation. Staff recommends the substitution of Pacific Willow (Salix lasiandra) and Sitka Willow (Salix sitchensis) for use along the lower riverbank. Both Willow species have salinity tolerance. Red Osier Dogwood may be used along the upper riverbank. Plantings are to occur above the O.H.W.M. to provide additional riverbank stabilization and will replace the existing blackberry and grasses in that location. Additionally, seeding and the embedding of tree trunks will occur in the rip rap. • Animals Northwest Chinook Salmon are found in the Duwamish River and may be listed as a threatened species in 1999. The river is part of a migration route for anadromous fish. The site is located within the Pacific Flyway, a migration path for various waterfowl. Environmental Health Noise generated by construction equipment will occur on a short term basis. The hours of construction will comply with the City's noise ordinance. • Land/Shoreline Use • The site is in the Shoreline Overlay Zone and the current King County Shoreline Master Program designation of the site is Urban. A waiver of the Shoreline Substantial Development Permit has been requested under WAC 173-27-040. South 104th Street (a two-lane public roadway adjacent to the east riverbank) is used primarily by commercial traffic. The land within a 500 foot radius of the site is zoned MIC/H - Manufacturing Industrial Center -Heavy. Housing No housing is proposed nor will any residential structures be removed. Aesthetics The proposal is not subject to Board of Review design review and standards. Disturbed areas will be revegetated and fish habitat components will be installed. Light and Glare It is not anticipated that any light or glare will be produced by the project. Recreation A recreational trail along the west riverbank will remain. Historic and Cultural Preservation No known places or landmarks. It is a two-lane public roadway serving commercial traffic. The project is not expected to increase or impact vehicular or pedestrian traffic. • Public Services No increase in public services is expected. • Utilities Project will not increase demand on the utility systems. Recommendation: Determination of Non -Significance. • • MEMORANDUM TO: Deborah Ritter, Assistant Planner Phil Fraser, Senior Engineer FROM: Gary Schulz, Urban Environmentalist DATE: March 5, 1998 RE: River Bank Stabilization/Repair on S. 104th Street - SEPA E98-0002. At your request, I have reviewed the SEPA checklist, plan drawings, and contract document for this project. Also, I have visited the site with planning and public works staff. The project is obviously an emergency situation. My comments are as follows. SEPA checklist 1) Under Section 4. Plants, "red osher polewood" is meant to be red osier dogwood. Due to the salinity of the River in this location, I would not use this shrub on the bank where it may be inundated. I would recommend that both Pacific willow (Salix lasiandra) and Sitka willow (Salix sitchensis) cuttings be used in this project as they have some salinity tolerance. 2) Under Section 5. Animals b., it would be reasonable to mention the proposed listing of Northwest Chinook salmon. Under c. I think the site is part of a migration route for anadromous fish and we are located within the Pacific Flyway which is migration of waterfowl etc. Riverbank Plans 1) My first comment is repeated from above which is not to stake red osier dogwood low on the bank; however, it is appropriate to stake it on the upper portion. Secondly, the temporary access road, as shown, may require some stabilization after it is excavated into the river slope. Due to the oversteepened condition of the bank some additional toe rock could be necessary. i • i • 104th St. River Bank Stabilization 3/5/98 Page 2 Contract Document 1) Even though there is a 1 -year 10% retainage for the purpose of guaranteeing the work, the specification of 75% survival of plantings after 1 year could be expanded to include cover and vigor of willows. I observed the last bank fix to the east to have relatively poor willow growth and cover. I would recommend that there be some additional language to encourage better growth and additional staking of cuttings for areas that do not exhibit good growth the first year. MEMO TO: Phil Fraser FROM: Deb Ritter DATE: February 25, 1998 RE: South 104th Street Sloughout-Drainage SEPA (E98-0002) Waiver of Development Permit (L98-0005) PMT's When you originally submitted this application I advised you that one set of. PMT's reduced to 8-1/2" x 11" was required. This is necessary so that copies of the plans can be sent to the appropriate agencies as part of the notice process. When we discussed this requirement, you indicated that Public Works did not have the capability to accomplish this. Michael Jenkins advised me that Kinko's will reduce the plans to either 8-1/2" x 11" or 11" x 17". As this is a standard requirement which Public Works has always met in the past, please make arrangements to have a complete set of the plans reduced and returned to me by no later than Friday, March 6th. TO: FROM: DATE: SUBJECT: MEMORANDUM Deborah Ritter, Assistant Planner Phil Fraser, Senior Engineer February 23, 1998 SEPA (E98-002) Request for Waiver of Shoreline Substantial Development Permit (L98-005) at South 104th Street Sloughout-Drainage Response for Additional Information D 2 1998 (31 DEVELOPMENT In response to your request for added input on right-of-way and emergency actions related to this project, I provide the following: S. 104th Street Right -of -Way: South 104th Street into which this riverbank sloughout has occurred (see attached map) is currently used as a commercial street in a public right-of-way. From my discussion with the City's engineering consultant, Mike Yoeman, L.L.S. who has researched the S. 104th right-of-way, being in a public right-of- way means the City has prescriptive rights, which means: - The City is the owner of the pavement where S. 104th currently exists - Also, the City has all precriptive land rights to maintain the integrety of the roadway, including ditches, and suporting riverbank to the toe of their respective slopes (in this case, to the toe of the ditch on the east side of the road; and, to the toe of the Duwamish River on the west side). Mike Yoeman has researched the width of the right-of-way for S. 104th and finds the City currently has a 60 foot right-of-way, eventhough some maps indicate only a 40 foot width. There is a very narrow section of privately held land (approximately 60 square feet on one parcel and approximately 100 square feet on the other parcel) which may be within the construction zone under the ownership of two properties. As with past riverbank projects within 300 feet of this project, the City (and previously, King County when this area was in unincorporated King County) will secure two temporary construction easements from the two property ownerships. Mike Yoeman advises this is appropriate. Evenso, according to Mike Yoeman, P.L.L., because this is a repair project and the re-establishment of the bank in a manner is to maintain the integrety of the roadway, all work to the ditch line or toe of riverbank is within the prescriptive rights of the City. City Emergency Actions: The slough in of the S. 104th Street riverbank and a portion of the shoulder, structural sub -base and asphalt pavement occurred at the time of and as a result of the 96'/'97 Winter Storms Event. The City responded to this federal declared disaster at the local level by: 1. A Local Procalmantion of Emergency by the Mayor of the City of Tukwila (December 30, 1996) 2. Resolution No. 1370 of the City Clouncil declaring an emergency in response to damages to public and priaave property due to sever weather conditions. I hope this information is helpful to your Department in making your decision on my request for waiver to the Shoreline Substantial Development Permit (L98-0005). WHEREAS, the City experienced severe weather conditions beginning December 26, 1996, including heavy accumulations of snow and ice which damaged public and private properties; and WHEREAS, rapid warming and heavy rainfall following the period of snow presented additional threats to property and public safety; and WHEREAS, the City has expended considerable resources in its efforts to protect public and private property and preserve public safety; and WHEREAS, the Mayor of Tukwila has issued a proclamation declaring a state of emergency in order to allow City forces to respond with appropriate resources to restore damages and prevent further impacts to public and private property; and WHEREAS, the City Council wishes to provide their support and endorsement of the Mayor in his action to declare an emergency and for the City's efforts to respond to the emergency; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: Section 1. There are class 2 slopes in the vicinity of the project, as well as the project being within the shoreline of the Duwamish River. B. ENVIRONMENTAL ELEMENTS 1. Earth a. General description of the site (circle one): Flat, rolling, hilly, steep slopes, mountainous, other: The terrain is a steep riverbank slope adjacent to a public roadway. b. What is the steepest slope on the site (approximate percent slope)? The maximum slope is almost vertical where shloughouts occurred. c. What general types of soils are found on the site (for example, clay, sand, gravel, peat, muck)? If you know the classification of agricultural soils, specify them and note any prime farmland. The foundation soils include sands with gravels at the upper soil levels and silty sands and silts at lower pile elevation levels, typical of soils found in the Duwmamish River. d. Are there surface indications or history of unstable soils in the immediate vicinity? If so, describe. There has been several remedial work in the vicinity of this project location [but not at this location], and past riverwork was carried out in order to stabilize the riverbank and roadway foundation. e. Describe the purpose, type, and approximate quantities of any filling or grading proposed. Indicate source of fill. Cuts and fills will be made to accommodate the stabilized riverbanks. At the E. Marginal Way S./S. 104th St. Riverbank Sloughout an access road will be needed. This road will be approximately 75 feet in length and drop approximately 12 1.f. from the existing grade of S. 104th/E. Marginal Way S. roadway grade. It is anticipated that approximately 1200 C.Y. of excavation and fill replacment will occur at the E. Marginal Way S. location. f. Could erosion occur as a result of clearing, construction, or use? If so, generally describe. g. Some erosion could result from the site preparation, including clearing and grubbing. Temporary erosion control techniques will limit this to a minimum, including constructing the key and rip rap during times of lowest tide.. About what percent of the site will be covered with impervious surfaces after project construction (for example, asphalt or buildings)? Only that portion of the construction which is rip -rap. h. Proposed measures to reduce or control erosion, or other impacts to the earth, if any: Temporary erosion control will be employed during construction as required. Temporary erosion control fences, or other barricades between the river water will be deployed; and while constructing the key and rip rap during times of lowest tide. 2. Air a. If so, generally describe. Runoff from the construction site drains into the river. Silt fences will minimize introduction of silt into the Duwamish River from the construction activities. However, it is not possible to completely eliminate silt from the construction site entering the Duwamish. d.
