New construction will also be added. Most work will occur within the square foot area of the existing building (10,000 square feet), to the exterior of the building. An existing graveled parking area and storage area will be paved. Landscaping and vegetation will be added. The dike at the area proposed is low and allows some localized flooding. Prior to issuing a building permit, the applicant shall discuss dike elevations with Ryan Larson. A copy of Chapter 1, of the Surface Water Design Manual is attached for reference. A. BACKGROUND This proposal was submitted December 29, 1998. The application was found incomplete on January 22, 1999. Subsequently, the Citv of Tukwila passed a six month moratorium on the establishment of new gambling uses February 1, 1999. The moratorium was lifted June 14, 2000. The applicant submitted revisions for completeness review December 15, 2000. The proposal was determined complete on February 8, 2001. Comments to Individual SEPA Checklist Items: Item 8: Materials related to surface water design may be required, per comments from lead agency review. Item 10: The following City of Tukwila permits are required, in connection with this SEPA Checklist. Design Review, Shoreline Substantial Development Lot Consolidation, and building permits. Item 11: The proposal is to convert an existing building from manufacturing use to a retail commercial use, to establish a restaurant and card room. Work will occur within the square foot area of the existing building (10,000 square feet. Modifications will be made to the exterior of the building. An existing graveled parking area and storage area will be paved, and landscaping will be added. Item 12: The work will be conducted at 14040 Interurban Avenue South. This building is located in SW1/4 of section 14, Township 23North, Range 4E. 2 • • MCI Worldcom SEPA — Memo to the File File Number E2000-022 Page 3 B. ENVIRONMENTAL IMPACTS Following is a summary of the applicant's response to the SEPA checklist. Staff has provided additional comments when necessary: Earth The site is flat, other than the slope at the riverbank. This slope ranges from 32 to 62.5%. Soil type is generally sand and gravel. No filling is proposed. Grading would be to prepare soil for paving only. Approximately 80 % will be covered with impervious surfaces after project construction. Air Dust and auto emissions after project completion would result Water Surface Water: Surface water is adjacent to the Duwamish River. The project will require resurfacing the parking areas, adding new landscaping, and rebuilding exterior walls of two existing buildings. Drainage review will be required at the time of building permit submittal. (See lead agency interdepartmental comments section above). The flood elevation is 21.15. Most of the site is below 22. Water Runoff The existing storm drainage system will be retained. Drainage review will be required at the time of building permit submittal. (See lead agency interdepartmental comments section above). It is anticipated that any waste materials will not likely enter ground or surface water. Parking areas will be resurfaced to assure proper drainage into existing catch basins. Plants Types of vegetation found on the site include the following: evergreen trees (fir, cedar, pine, and other), and grass. Site has virtually no existing vegetation. The site will be landscape per landscape plan, to be reviewed. 3 MCI Worldcom SEPA — Memo to the File File Number E2000-022 Page 4 Animals Mice and fish, other than bass, salmon, trout, herring, and shellfish are observed on or near the site. Salmon migrate past the site. No particular measures to preserve or enhance wildlife are necessary. Energy/Natural Resources Electrical and natural has will be used to meet the energy needs of the completed project. Electrical resources will be needed for cooling, building power and lighting. Natural gas resources will be needed for heating and cooking. Energy efficient equipment will be necessary. Environmental Health Noise impact will occur from traffic. Any noise will be similar to level and intensity to adjacent uses and streets. No mitigation would be required. See Traffic Impact Analysis, prepared November 5, 1998 and memo from Cyndy Knighton, City of Tukwila, prepared June 28, 2001 regarding supplemental comments to the report (Attached). Land/Shoreline Uses The current use of the site is manufacturing and auto sales. The current zoning classification is Commercial/Light Industrial. The current comprehensive plan designation is Commercial/Light Industrial. The current shoreline master program designation is "Urban". Portions of the site and proposed work area are located within the Shoreline Management Zone. Current structures on the site include; one manufacturing building; one auto sales office and/or storage; and one storage building. Approximately 180 persons will work in the completed project. The total number would be divided into three shifts; each shift would be 24 hours. The completed project would displace 10 workers. Residents are not affected by this proposal. Aesthetics Existing structures are 45 feet in height, maximum. Exterior dryvit with glass and decorative features and detailing are proposed as materials for the exterior of the building. 4 • • MCI Worldcom SEPA — Memo to the File File Number E2000-022 Page 5 This proposal is subject to Board of Architectural Review approval. Light/Glare Decorative lighting plus parking and walkway lighting will be included in the site design. Lighting will occur from dusk until dawn, seven days per week. Shields for glare reduction will be used to reduce glare to other buildings and on the shoreline. Recreation Foster Golf Course and a pathway to public recreation trail are adjacent to the property. The project will not displace any existing uses. Should any portion of the project impact wither of the public recreational uses, during this current construction or in the future, further review will be necessary by select departments of the lead agency (City of Tukwila). Transportation The property is adjacent to Interurban Avenue South. Existing access to the site from S. 140th and S. 14151 Street will be retained. The site is adjacent to public transit. The approximate distance to the nearest transit stop is within 1/8 of a mile. 118 parking spaces will be available since existing parking areas will be resurfaced only. S. 140th Street will be relocated northwest into an existing right-of-way. Existing curbs and public recreation path will be retained. The project provides a net loss of 13 vehicular trips from previous uses, on and adjacent to the site. Peak volumes are anticipated to occur after 7pm. Public Services Utilities All public utilities are available at the site. All existing utilities will be retained. Your request to continue review of these land use permits is granted. This extension is valid for 120 calendar days from the date of expiration, November 22, 2000. The extension will apply to L98-0101 (Shoreline Substantial Development); E98-0035 (SEPA); and L98-0102 (Design Review). Permit number L98-0100 (Conditional Use) will no longer be required. Ordinance 1917, approved June 14, 2000 by City Council to allow certain house - banked social card games with up to 15 tables, will supercede the need to submit this permit application. The Department of Community Development will refund you the fee for this permit application. To date, the City of Tukwila has received revisions to the Shoreline Substantial Development and SEPA Review. Completeness review on these applications is underway. We have not received your permit application for Design Review. Please submit this as soon as possible. This will assist us to process your permit applications as expeditiously as possible. Otherwise, you have up to 120 calendar days from November 22, 2000 to submit the remaining application, though extending the time frame of your submittal can delay the approval of the permit applications that are currently under review. A copy of the comments is attached for your convenience. This letter also is to clarify the statement you made in your letter, second paragraph, about building in the river environment, the first forty feet (40 ft) measured from the mean high water mark. Development in the river environment is allowed, but only the uses listed in Chapter 18.44.130 of the Tukwila Municipal Code. A copy of this section of the code is attached for your convenience. WHEREAS, the State legislature and State Gambling Commission have expanded the ability of establishments holding gambling llcenses to conduct house -banked social card games as a commercial stimulant so that such establishments may operate up to 15 tables of house -banked social card games (house - banked cardrooms also known as "mini -casinos"); and WHEREAS, that type of gambling activity is distinct from other existing types of gambling activities, including player -funded social card games, pull tabs, and punch boards; and WHEREAS, as a' result of this change there has been a great proliferation of mini -casinos in the region; and WHEREAS, the City of Tukwila adopted a Comprehensive Plan in compliance with the Growth Management Act, and a Zoning Code and development regulations consistent with that Comprehensive Plan; and WHEREAS, the City did not address mini -casinos within its Comprehensive Plan, Zoning Code, or development regulations; and WHEREAS, there is ambiguity in the legal opinions on whether the City has any zoning authority with respect to mini -casinos (the Gambling Commission maintains that cities have no authority to zone); and WHEREAS, other jurisdictions that took specific actions to address gambling issues have been subjected to both threatened and real legal challenges; and WHEREAS, the State legislature was considering the issue of whether local jurisdictions should be provided with express authority to zone gambling establishments; and WHEREAS, due to the City not addressing mini -casinos within its Comprehensive Plan, Zoning Code, and development regulations, due to the legal uncertainties, and due to the lack of direction from the State legislature, the City imposed a moratorium on the acceptance of applications related to the development of gambling establishments, so that it could carefully consider public input on the issues, consider the use within its land use policies and its Comprehensive Plan, and so that it could gain guidance from the State legislature; and WHEREAS, it is now apparent that the State legislature will not provide that guidance to the cities on whether local jurisdictions have zoning authority; and WHEREAS, the City is aware that it does have the authority to prohibit such uses within the City pursuant to RCW 9.46.295; and WHEREAS, because the Gambling Commission has taken the controversial legal position that cities may not exercise zoning authority with respect to gambling establishments, the City is left with the options of either allowing gambling establishments anywhere within the City or allowing no such uses within the City; and 1 WHEREAS, there are four existing mini -casino establishments with identified locations within the City: Riverside Casino at 14060 Interurban Avenue South, Golden Nugget Casino at 14025 Interurban Avenue South, Silver Dollar at 14027 Interurban Avenue South, and Pete's Flying Aces at 14101 Tukwila International Boulevard; and WHEREAS, there is a proposed mini -casino establishment with an Identified location within the City, Las Vegas Boulevard Casino at 14040 Interurban Avenue South, which has applied for a State gambling license, which has submitted development permit applications to the City prior to the effective date of the City's moratorium, and which has Invested considerable capital toward that proposed establishment; and WHEREAS, the City's moratorium will expire on July 14, 2000; and WHEREAS, the City desires that the existing mini -casinos and the proposed mini -casino may continue in operation within the City as currently located; and WHEREAS, in April, 2000, the City conducted an inventory of the areas devoted to house -banked social card games in each of Tukwila's four existing mini -casinos and found that these areas range from 1,500 square feet to 2,500 square feet in size; and WHEREAS, the City wishes to provide sufficient flexibility in regard to the size of the physical premises associated with mini -casinos, so as to not interfere with the ability of each mini -casino to comply with State gambling regulations; and WHEREAS, the City desires to ban all other house -banked social card games within the City pursuant to the authority provided to it under RCW 9.46.295; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. New Chapter 4.10 Added. A new Chapter 4.10, entitled "Certain Gambling Activities Prohibited", shall be added to the Tukwila Municipal Code, to read as follows: Chapter 4.10 CERTAIN GAMBLING ACTIVITIES PROHIBITED 4.10.010 Certain gambling activities prohibited. A. Prohibited activities. Any license issued under the authority of state law to engage in any gambling activity shall be legal authority to engage in those gambling activities for which the license was issued throughout the City, except that the City, in accordance with RCW 9.46.295, as the same now exists or may hereafter be amended, prohibits the conduct or operation of house -banked social card games as a commercial stimulant, as defined in RCW 9.46.0217 and RCW 9.46.0282. B. Exceptions. The following businesses ("Excepted Businesses") are excepted from 4.10.010.k 1. Those businesses conducting or operating house -banked social card games as a commercial stimulant within the City on the effective date of this ordinance may continue to do so. 2. Those businesses for which a gambling license has been suspended or revoked by the Washington State Gambling Commission as of the effective date of this ordinance may resume the operation of house -banked social card games under the provisions of this ordinance upon reinstatement of said gambling license by the Washington State Gambling Commission or by a court of law, regardless of the length of time that has elapsed between the suspension or revocation of the gambling license and its reinstatement. 3. Those businesses that have done all of the following prior to the effective date of the City's moratorium related to gambling activity development permit applications (February 1, 1999) are permitted to conduct or operate house -banked social card games as a commercial stimulant within the City: a. applied for a gambling license from the State to conduct or operate house -banked social card games as a commercial stimulant; and b. identified a specific location within the City for its business establishment; and c. submitted development applications to the City. • 4.10.020 Excepted businesses' expansion of business premises limited. A. An excepted business identified in TMC 4.10.010.B.1 can continue to conduct or operate house - banked social card games as a commercial stimulant within the City, and it may Intensify the operation of house -banked social card games, so long as the area devoted to the playing of house -banked social card games in.the excepted business does not exceed 4,000 square feet in area. If the area devoted to the playing of house -banked social card games in an excepted business under 4.10.010.B.1 exceeds this 4,000 square foot maximum, it can no longer conduct house -banked social card games within the City and it falls within the prohibition set forth in TMC 4.10.010A B. An excepted business identified in TMC 4.10.010.B.2 can, upon completion of its physical premises, conduct or operate house -banked social card games as a commercial stimulant within the City within the premises as constructed, and it may intensify the operation of house -banked social card games, so long as the area devoted to the playing of house -banked social card games in the excepted business does not exceed 4,000 square feet in area. If the area devoted to the playing of house -banked social card games in an excepted business under TMC 4.10.010.B.2 exceeds this 4,000 square foot maximum, It can no longer conduct house -banked social card games within the City and it falls within the prohibition set forth in TMC 4.10.010A C. Nothing in this section shall limit the construction or expansion of a business premises for purposes other than the operation of house -banked social card games if such purposes are otherwise allowed by CIty Code. 4.10.030 Excepted businesses' discontinuation of use. A. An excepted business identified in TMC 4.10.010.B.1 or 2 can continue to conduct or operate house -banked social card games as a commercial stimulant within the City so long as the excepted business does not discontinue the operation of house -banked social card games for a continuous four-month period within one year or for more than a total of 180 days within any two-year period. If an excepted business discontinues its use as described in this section, it can no longer conduct house -banked social card games within the City and it falls within the prohibition set forth in TMC 4.10.010.A, except as provided in subsection B, C and D of this section. B. Should the physical premises of an excepted business (as identified in TMC 4.10.010.B) be destroyed as the result of a fire, flood, earthquake or other natural disaster, it may be reconstructed subject to all of the following conditions: 1. The excepted business applies for all required City, state and federal permits within 60 days from the date of the fire, flood, earthquake or other natural disaster. 2. The excepted business obtains all required City, state and federal permits within one year from the date of the fire, flood, earthquake or other natural disaster. 3. The excepted business devotes no more than the maximum of 4,000 square feet for the playing of house -banked social card games. C. An excepted business (as identified in TMC 4.10.010.B) may construct a new physical premises on the property it currently occupies, subject to all of the following conditions: 1. The excepted business applles for, and receives, all required CIty, state and federal permits for the new premises. 2. The excepted business devotes no more than the maximum of 4,000 square feet in the new premises for the playing of house -banked social card games. 3. The old physical premises of the excepted business is demolished prior to the issuance of a City of Tukwila Certificate of Occupancy for the new premises. However, the new physical premises may be occupied prior to the demolition of the old physical premises subject to all of the following conditions: a) the old premises is closed to the public; and b) a financial security (such as a surety bond, irrevocable letter of credit, assignment of account or cash deposit) is provided to the City of Tukwila (1n form and content satisfactory to the City Attorney) in the amount of 150% of the total estimated cost of the demolition of the old physical premises. _1..._. Peak Hour Trips Dear Mr. Barnett: I stopped by your office yesterday {November 4th) to see what traffic volume and accident data you may have on file along Interurban Avenue from I-5 to I-405. Similarly, I met with the developers and the architect for the above casino to review such items as project scale, access and so on. Indeed, I even started to assess the use of the zip code addresses of clients as a means of defining the trip distribution. However, on a close examination of new expected trip generation versus trip generation in former days, namely pre -January 1998, it appears that the new usage, while generating larger daily traffic volumes, produces smaller p.m. peak hour volumes. Given this unusual outcome it would seem to me that there is no need for a traffic study, per se. It goes without saying that while I would look forward to the challenge of such an impact analysis with this kind of land use it would serve no useful SEPA related purpose. That is the time of day and associated traffic generation that is used for arterial street impact assessment, not the least being how well your driveways function, and so on. Next, the new facility includes a restaurant in the same building as before but reduced in scale to 330 seats -- the reduction being undertaken to accommodate gaming tables and so on. This is not to mean your daily traffic is less. Rather, with your peak hour beginning; after about 7:00 p.m. and continuing through the night I would expect your "daily traffic" to be much larger. However, in thecontext of traffic impacts, the new use is a betterment since it reduces the peak hour loading. This leads to the next issue. Since the proposed development reduces the p.m. peak hour volume there is little reason to conduct a traffic study, per se. Indeed, as a traffic mitigation measure I would suggest you request that a traffic study not be a requirement of your building application.
