Rants, Mayor Department of Community Development Steve Lancaster, Director MEMORANDUM TO: Deb Ritter, Assistant Planner FROM: Gary Schulz, Urban Environmentalist DATE: July 6, 1999 RE: Silver Dollar #E99-0015 — SEPA, Wetland Restoration & Buffer Reduction for Proposed Parking Lot Improvements. I have reviewed the current wetland mitigation plan submittal completed by Talasaea Consultants (Wetland Restoration & Buffer Enhancement Plan dated 6/8/99). Regardless of SEPA issues, the project is subject to sensitive area regulations and compliance. The current mitigation plan is designed to resolve both buffer reduction and restoration impacts to on-site and off-site areas. My comments are as follows: 1 The wetland boundary delineation was conducted By Talasaea in April, 1999. Given the amount of past disturbance, the boundary appears correct as it is determined by fill material. However, it is likely that wetland soils are present under some of the fill placed for temporary parking. 2. The Wetland Restoration & Buffer Enhancement Plan is not complete to approve as a final plan. Some additional information is needed combined with plan detail revisions. Buffer reduction - As we discussed, the current parking lot layout has reduced the buffer setback to less than 25 feet in several locations. This is not allowed by the SAO and must be corrected. Wetland restoration - The design is appropriate and mostly complete; however, a measured calculation of the off-site wetland area to be restored is needed. This square footage will allow the total number of plants to be determined for the landscape contract and performance security. Wetland performance - The proposed monitoring and maintenance period of three years is acceptable. An estimate or actual contract cost for installing the total number of plants will need to be submitted for approval prior to final permitting. Also, the related bond or other form of security will also need to be submitted before the permit can issued. However, the SAO states that "Where feasible, compensatory mitigation projects shall be completed prior to activities that will permanently disturb wetlands and immediately after activities that will temporarily disturb wetlands....and shall be completed prior to use or occupancy of the activity." (TMC 18.45.080 C. e.) The definition of Compensatory Mitigation "means replacing project -induced wetland and buffer losses or impacts..." This definition includes restoration, creation, and enhancement actions. Depending on the time of year the project permit is near issuance, the City could require the mitigation work to be implemented before the project is permitted. Ideally the time of year would be around the month of October. Also, the performance amount could be lowered after the mitigation is complete. The site, is approximately 63,000 square feet in size and is currently comprised of a 4,531 square foot building and parking lot containing approximately 95 parking spaces. A Type 2 wetland has been delineated in the southwestern portion of the site and extends off-site, in a westerly direction, for approximately 40 feet. The parking lot is primarily gravel surfaced (39,490 s.f.) with a portion of existing pavement (17,755 s.f.) along the north side of the property. The proposed improvements include the paving of the gravel portion of the parking lot and the creation of 104 striped parking spaces. Agencies with Jurisdiction: None. Summary of Primary. Impacts: • Earth The majority of the site is generally level. The Natural Resources Conservation Service (formerly the Soil Conservation Service) has mapped the entire site as "Urban Land" (Ur). 6300 Southcenter Boulevard, Suite #100 0 Tukwila, Washington 98188 ° (206) 431-3670 0 Fax (206) 431-3665 ! • E99-0015 Silver Dollar Casino Parking Lot Improvements July 1, 1999 Page 2 The southwestern portion of the site is considered to be an area of potential geologic instability and is designated Class 3. A Class 3 area is described as having high landslide potential and includes areas sloping between 20% and 40% which are underlain by relatively impermeable soils or by bedrock. This Class 3 area continues off-site and encompasses the steep slope running parallel to the Silver Dollar's west property line. The site will be graded and approximately 50 to 100 cubic yards of select fill may be imported during the construction of the parking lot improvements. An erosion control plan will be employed during construction. • Air Dust and exhaust emissions will be generated during construction, with watering as necessary to control dust. • Water Per the Wetland Restoration and Buffer Enhancement Report (dated April 22, 1999 and revised June 9, 1999), a Type 2 wetland has been delineated at the southwestern portion of the site. This wetland extends beyond the site, in a westerly direction, approximately 40 feet. The applicant has requested a reduction in the on-site wetland buffer from 50 to 25 feet in width under a Type 2, Special Permission Application. According to the above -referenced wetland report, existing vegetation was cleared in portions of the wetland (both on and off-site) prior to January 1999. The cleared vegetation included black cottonwood, red alder, blackberry and reed canarygrass. The wetland report included a Wetland Restoration and Buffer Enhancement Plan (dated June 8, 1999), showing the location of the wetland buffer boundary. This buffer is less than 25 feet in width in several places. Corrections must be made to the wetland plan establishing a minimum buffer that is 25 feet in width at all points. Additionally, the Parking Lot Paving Plan prepared by Resco, Inc. (dated April 7, 1999) shows the proposed parking lot improvements encroaching into the above - referenced wetland buffer. These encroachments occur at the south and southwest perimeter of the proposed parking lot. Corrections must be made to the paving plan to resolve the encroachment problems. All cleared portions of the wetland are to be restored with native plantings, as referenced in the report. Approval of the request for a reduction in the wetland buffer and approval of the wetland report must be provided prior to implementation of the wetland restoration. Said restoration will be a condition of the associated land altering permit (required for construction of the parking lot). The amount of impervious surface created by the paving of the parking lot will increase from 22,286 square feet (existing) to 53,599 square feet (proposed). The project requires surface water treatment which has been approved by the Public Works Department and designed to King County Surface Water Design Manual standards. • Plants Nearly the entire site appears to have been historically filled and is currently largely devoid of vegetation. Vegetation within the uncleared portion of the on- site wetland (southwestern corner of the property) is dominated by red -osier dogwood, Himalayan blackberry, reed canarygrass and black cottonwood trees. • Animals • No endangered or threatened wildlife species have been identified at the site. The Wetland Restoration and Buffer Enhancement Report documents the presence of American crow, American robin and eastern gray squirrel. Energy/Natural Resources Not applicable. Environmental Health Noise generated by construction equipment will occur on a short-term basis. The hours of construction will comply with the City's noise ordinance. • • E99-0015 Silver Dollar Casino Parking Lot Improvements July 1, 1999 Page 4 • Land/Shoreline Use The project is located in the Regional Commercial Mixed -Use zone (RCM). The RCM zone continues north and south of the property along Interurban Avenue. The property to the west is zoned Low Density Residential (LDR) and the property to the southwest is zoned High Density Residential (HDR). There is an existing single-family dwelling at the southeast corner of the property, which is legally non -conforming. Housing No housing is proposed nor will any residential structures be removed. Aesthetics The proposal is not subject to Board of Review design review and standards. Landscaping in and around the parking lot will be required as a condition of the land altering permit. Wetland restoration and wetland buffer enhancement will also be required as a condition of the land altering permit. Light and Glare Site lighting will be provided by new "no glare" light standards. Recreation Not applicable. Historic and Cultural Preservation No known places or landmarks. Transportation The project is located on Interurban Avenue South, a four -lane public roadway serving commercial traffic. Metro bus service is available along this street. The project proposal identifies an increase in the number of available parking stalls from 95 to 104. The project is expected to generate between 250 and 600 vehicular trips, with peak volumes occurring on Fridays and Saturdays. • 1 E99-0015 Silver Dollar Casino Parking Lot Improvements July 1, 1999 Page 5 The Parking Lot Paving Plan prepared by Resco, Inc. (dated April 7, 1999) shows six parking spaces along the western side of the existing building. The Fire Department requires a fire lane in this area for emergency access and will not allow the placement of spaces in this location. Corrections must be made to the paving plan to reflect the removal of these six parking spaces. These corrections to the paving plan will be a condition of the associated land altering permit (required for construction of the parking lot). • Public Services No increase in public services is expected. • Utilities Project will not increase demand on the utility systems. Recommendation: Determination of Non -Significance. WETLAND: As you know from your conversations with Gary Schulz, Tukwila Urban Environmentalist, there are wetland disturbance issues, both on and off the site. These issues will be dealt with during the technical review phase of your SEPA application. As part of your SEPA application packet, you submitted a wetland report (dated April 22, 1999) prepared by Talasaea Consultants. This report proposes that the 50 -foot buffer associated with the project's Type 2 wetland be reduced to 25 feet in width. This aspect of your proposal will require approval by the Director of Community Development. The review is a Type 2, Special Permission decision. The special permission review must be completed before a SEPA Determination will be issued by the Department of Community Development. Under TMC 18.435.040(4)(a) "any buffer reduction proposal must demonstrate to the satisfaction of the Director that it will not result in direct or indirect, short-term or long-term adverse impacts to wetlands and watercourses ... ". We are enclosing a copy of that part of the code for your reference. Your proposal for a reduction in the wetland buffer must be accompanied by documentation that can be used to evaluate your request. After water quality parameters have been met, this water can "then be accepted in storm drains. As you were advised in January, any discharge of drainage water directly or indirectly into storm drains without the use of an approved._detention facility is an illegal activity. PARKING REQUIREMENTS: The required number of parking spaces is determined by the type of uses they are supporting. You are proposing 104 parking spaces in your plan to develop the Silver Dollar's parking lot (95 of which are already existing). We will consider these 95 spaces to be "grandfathered" for the purposes of calculating parking for the existing restaurant and tavern uses. v However, there has been a change in use on the second floor of the Silver Dollar (from apartment to office). To determine how many additional parking spaces will be required for that office use, you will be asked to submit a dimensioned and scaled plan of the second floor. This request will be made during our technical review phase. The number of additional parking spaces required will be added to the existing 95 spaces. The resulting sum will represent the total number of required spaces for the Silver Dollar parking lot. As I have informed you, I fully intend to help you resolve several issues (Permit for Parking Lot/Wetland Procedures/SEPA/Excess Drainage Water Pumping) that impede your permit approval. Please understand that it is important to gather as much information as possible that will affect your situation. Once I have compiled this information, I will inform you of the current status of your project. In addition, I will provide you with the necessary steps to take in order to expedite your permits. After speaking with the appropriate individuals regarding your situation, I have determined that the following issues must be addressed: PARKING LOT PAVEMENT AND PERMITS In order to get your plans reviewed further, you must inform the Dept. of Community Development Planning staff of how many parking spaces are currently at this location that are marked and in regular use. You must also be more clear as to how many parking spaces will be added as a result of paving the parking lot. This information was unclear to our Planning staff and requires clarification. Upon supplying this information, you will then receive a more detailed description of what is needed to facilitate this from DCD staff. In order for you to continue pumping this excess drainage from your site, you must use a City of Tukwila Dept. of Public Works approved detention apparatus to house the initial drain water. After the soils and automotive runoff have been removed, this water can be accepted down storm drains. If, through inspection or other means, it is determined that a person engaged in land -altering activity has failed to comply with the approved land -altering plan and/or other permit conditions, any or all of the enforcement actions prescribed in this chapter may be initiated. When permit violations are identified, a notice of violation shall beserved upon that person by registered or certified mail or other means. The notice shall set forth the measures necessary to achieve compliance with the plan, specify the time period to commence and complete corrections, and indicate the consequences for failure to correct the violation. No use or development may occur in a Type 1 and Type 2 wetland or its buffer except as specifically allowed by TMC 18.45.080A, 080B and 080H. Any use or development allowed is subject to the standards of this section. b. Only isolated Type 3 wetlands can be altered or relocated, and then only with the permission of the Director. A mitigation or enhancement plan must be developed and must comply with the standards of compensatory mitigation required in this chapter. c. Mitigation plans shall be completed for any proposals for dredging, filling, alterations and relocation of wetland habitat allowed in TMC 18.45.080A, 080B and 080H. 2. Compensatory Mitigation. a. The mitigation plan shall be developed as part of a sensitive area study by a specialist approved by the Director. Wetland and/or buffer alteration or relocation may be allowed only when a mitigation plan clearly demonstrates that the changes would be an improvement of wetland and buffer quantitative and qualitative functions. The plan shall follow the performance standards of this chapter and show how water quality, wildlife and fish habitat, and general wetland quality would be improved. b. In order to achieve the City's goal of no net loss of wetland functions and acreage, alteration of wetlands will require the applicant to provide a restoration, enhancement or creation plan to compensate for the impacts to the wetland and will compensate at a ratio of 1.5 to 1. c. Mitigation Location. (1) On-site compensation, shall be provided, except where the applicant can demonstrate that: (a) The hydrology and ecosystem of the original wetland and those who benefit from the hydrology and ecosystem will not be damaged by the on-site loss; and (b)On-site compensation is not scientifically feasible due to problems with hydrology, soils, waves or other factors; or (c) Compensation is not practical due to potentially adverse impact from surrounding ©1997 Code Publishing, Inc.
