1. No permit can be issued for this project until a) permission is given by the current
owners to allow construction of a parking lot on their parcel, or b) proof is provided
that MBK Northwest has purchased the site. This issue must be cleared up as soon as
possible.
2. Fifteen (15) feet of landscaping is required along Minkler Blvd., per the landscaping
requirements of the Tukwila Urban Center zoning district.
3. The landscaping plan for the parking lot must be revised to meet the landscaping code,
which was amended. in June, 1999. A copy of the ordinance adopting the changes is
attached. Please see TMC 18.52.035, Interior Parking Lot Landscaping Requirement,
items 3 and 4 and TMC 18.52.040, General Landscape and Screening Requirements.
A copy of the parking lot site plan is attached with the portions of the parking lot
subject to TMC 18.52.035 3.a. and 3.b. identified.
4. When the landscaping plan is resubmitted, please include the landscaping square
footage calculations to illustrate compliance with the landscaping code.

NOTICE OF PUBLIC HEARING
MBK Northwest has filed a revision to the approved design for the Parkway Supercenter
Development located at the east side of Southcenter Parkway north and south of S.
180th Street. The revision would combine and expand three existing tenant spaces in the
northeast corner of the development in order to accommodate a 45,000 sf Best Buy store. An
additional vacant triangular parcel of land adjacent to Minkler, east of the development, will be
developed for additional parking.

Hauling Permit
A new environmental checklist has been submitted with the permits identified above.

Project Description:
The project would combine and expand three existing tenant spaces in the northeast corner of the
Parkway Supercenter Development in order to accommodate a 45,000 sf Best Buy store. An
additional vacant triangular parcel of land adjacent to Minkler, east of the development, will be
developed for additional parking.

Comments to SEPA Checklist:
A comment letter was received from representatives of the Upland Drive Business Park
Condominium with the following concerns:
1. The Condominium vigorously contests and denies the right of the applicant to utilize any
portion of the Upland Drive Business Park Condominium for parking, ingress and egress, or
any other purpose.
Response:
1. No permits will be issued for the area in question or any building expansion that would require
additional parking spaces until the ownership issue is resolved to the City's satisfaction.
Summary of Primary Impacts:
1. Earth — Preload soil will be removed from a building site on the South Lot and stockpiled on a lot
behind the Ethan Allen store before being placed as preload on the Best Buy expansion site. Minor
soil erosion during preloading, transportation or construction is a possibility, but the sites are
predominantly flat and this should be easily controlled. No negative earth impacts are expected to
result from the project.

2. Air - There will be exhaust emissions from construction equipment and trucks carrying the
building debris, fill soil and construction materials during the project. The project's air emissions
when complete will consist of automotive traffic to and from the site. A trip generation report was
submitted as part of the previous environmental review and no new trips are expected due to the
remodel.
3. Water - A Class 3 watercourse is located on the stockpile lot, but is not expected to be affected
by these actions. Oil/water separators for the new parking area will be added to the storm drainage
system as required by Tukwila's Storm and Surface Water Ordinance. No hazardous wastes are
expected to be released during or after construction.
4. Plants - The existing landscaping on the project will be retained. Landscaping will be installed in
the new parking lot according the Board of Architectural Review's approved landscape plan and the
City's landscape code. No significant vegetation exists in the stockpile area.
5. Animals - The sites do not contain significant animal habitat.
6. Energy and Natural Resources - The project will require energy for construction equipment,
vehicles coming to the site and building operation after completion. The project will be required to
meet current energy codes.
7. Environmental Health - Construction equipment operation will need to comply with Tukwila's
noise ordinance.
8. Land and Shoreline Use - The proposed project will not affect the shoreline.
9. Housing - The proposal will not result in a change to the housing supply.
10. Aesthetics - The project is subject to the design review process including a hearing before the
Board of Architectural Review. The building permit drawings must agree with the BAR approved
design.
11. Light and Glare - Additional site lighting will be provided by new light standards, but offsite
lighting will be modest. The project is located in a commercial area and the additional lighting will
enhance safety without causing negative impacts.
12. Recreation - The proposal will not affect recreational facilities.
13. Historical and Cultural Preservation - The site is not known to have any historical or cultural
significance.
14. Transportation - A trip generation study was submitted along with the previous checklist for the
overall center remodel and expansion. This project is largely a retail to retail tenant improvement
and is not expected to generate additional trips. The number of parking spaces provided will be

increased to accommodate the 9,800 sf expansion of the Best Buy store. The site will continue to
be served by public transit and the existing transit waiting areas shall be retained.
15. Public Services - The project will not significantly increase demand on public services.
16. Utilities - The project will relocate some on site utilities outside of the Best Buy building pad.
Utility use is not expected to significantly increase.

as described in the above file, is located on the Upland Drive Business Park Condo-
minium. The Condominium Association vigorously contests and denies any right of the
applicant to utilize any portion of the Upland Drive Business Park Condominium for

I am in Bob Kelley's office and I am writing to you regarding Unit K, Upland Drive
Business Park Condominium. We understand you are their agent and will send a copy
of this letter to them.
Mr. Kelley referred the matter to me because I am a specialist in condominium
law. I have participated in the formation of over two hundred (200) condominium
projects and represent numerous associations. I have reviewed the Declaration for
Upland Drive Business Park Condominium and the related documents regarding the
proposed change in use of Unit K.
I understand Unit K is in the process of being sold. I am astonished by your
assertion in a recent letter that the Declaration was reviewed by the buyer's attorney
and found consistent with the intended use of Unit K as a parking lot for neighboring
property. Either that is a flat misstatement, or these attorneys know nothing about
condominium law.
1. The current owner of Unit K cannot be sold and used for a parking lot or
related use for the following reasons:
2. Unit K has never been constructed in the Twenty years since the
Condominium was formed. The right to construct the building which was shown as Unit
K in the Survey map was purportedly reserved in the Declaration as a development
right. This condominium was created under the old condominium statute, R.C.W.
64.32. There is no provision in that statute for reserving a perpetual right of the
Declarant to build improvements within the condominium sometime in the future. The
Declaration specified no time within which those improvements must be built. The

failure to specify such time violates Washington law and renders this provision invalid as
violating the rule against perpetuities.
3. The Developer's sale of all of the other units in the condominium before
the construction of Unit K violated Washington law. R.C.W. 64.32.100 required that all
units must be certified "as built" before ay units could be sold. Accordingly, when the
developer sold the original units in 1979, it waived the right to construct Unit K, despite
the provisions of the Declaration. This is also consistent with the way we understand
dues have been assessed at the condominium since inception. We understand that the
owner of Unit K has never paid any dues to the Association, despite the provisions of
the Declaration requiring it to pay 18.992% of all common expenses.
4. Even if the developer still had the right- to construct Unit K, which we
believe it does not, the developer does not have the right to change Unit K to be
anything other than as is required in the Declaration and shown on the Survey Map and
Plans, Section 1(b) of the Declaration specifically states that Unit K is a 12,000 foot
building. The exterior perimeter of Unit K is shown on the Survey Map and Plans
recorded with the Declaration The Declaration is quite specific as to what is permitted
and what must be built in Unit K. The proposed changing of Unit K from the specified
building to instead be a parking lot for neighboring property is absolutely contrary to the
permitted uses by the Declaration.
5. The Survey Map and Plans clearly delineate the exterior dimensions of
Units K, where it is identified as Building 3. Everywhere outside of that building footprint
constitutes common area of the Condominium project. The Declaration and R.C.W.-
64.32 provide that each unit owner in the Condominium own undivided tenancy in
common interests in those common areas. The current owner of Unit K does not have
the right to unilaterally give rights to any third party, including a neighboring land owner,
to use any portion of those common areas. This is consistent with R.C.W. 64.32.050(4)
prohibits a unit owner from using the common areas for any purpose which hinders or
encroaches upon the use and enjoyment of those common areas by other unit owners.
5. The statute and Declaration provide that the common areas are to be
managed through the Board on behalf of all Unit owners. No one Unit owner has the
right to make any agreements or allow any third party to use any part of the common
areas. The Board will not give permission to the neighboring property owner to either
(a) cross over any common areas or (b) use any common areas for parking purposes.
We assume this letter will settle the matter, and the owner of Unit K will abandon
this attempt to allow neighboring property to use part of the condominium for parking
purposes. if not, we will recommend that the Association immediately commence legal

action to enjoin that illegal and improper action, all as permitted under R.C.W.
64.32.060.

Section A
1. Item 11 should mention removal of the pre -load from the South Lot, storage of the
pre -load, and reuse on the Best Buy site.
2. Item 12 should mention the South Lot and the fill storage site.
3. Item 13, there is a Class 3 watercourse and steep slopes on the fill storage site.
Section B
4. Item 1, include descriptions of the fill storage site in your answers.
5. Item 3 a. 1, fill storage site has a Type 3 watercourse.
6. Item 3 a. 2 and 3, will the fill be placed within 200 feet of the watercourse?
7. Item 8 h, see response to Item 13 above.

The Public Works Department has completed its review of the SEPA Checklist and the
site/civil plans. The Applicant needs to make the necessary corrections, resubmit a new
set of plans, and return the "redlines." Based upon this review, the following comments
are provided.
General Comments
1. The plans and documentation accompanying the permit application E99-0026 and
D99-0293 are deemed incomplete and unsatisfactory.
2. The SEPA submittal (E99-0026) and the Land Altering/Utilities submittal (D99-
0293) are not coordinated and supportive of each other. The Land Altering plans
do not include the proposed development of the additional parking area to the:.
northeast - along Minkler Avenue. Additionally, the SEPAA submittal mentions
that 3,500 cubic yards of fill material will be removed from the site south of 180th
Avenue, temporarily stockpiled on a vacant piece of property behind the existing
Ethan Allen building, and then used as pre -loading material -for the proposed. new
Best Buy building. Yet there are no temporary erosion control plans for the Ethan
Allen stockpiling site included with the Land Altering package.
3. The proposed project is complex enough to warrant separate plans for each phase
of the work. Too much work is being shown on a single plan sheet. Therefore
the following set of plans should be submitted:
A. Project Information/Cover Sheet/Parcel Plan that will show:
• Vicinity map with scale and north arrow.
• Area of site shown.

• Existing property lines and difnensions.
• ' Existing and/or proposed easements and right-of-way lines.
• Project name, Table of Contents, Phone Number of "One Call"
utility locator, City's Public Works Department-pre-

number of surveyor, name and number of engineer, name and
number of owner/agent.
• Legal description; etc.
B. Site Plan to include:
• All natural and proposed drainage collection and conveyance
• systems with catch basins numbered.
• Property area development.
• Right -of -Way layout.
• Street names
• Indicate units of measurement for all slopes as either % or ft/ft.
• The City's standard -General and Drainage notes that apply to the
plan shall be provided on the sheet.
• Cut and fill quantities of proposed site work.
C. Temporary Erosion Control Plan to include:
• Pre -load for Best Buy.
• Drainage and collection systems (Ethan Allen site too)
D. Grading and Paving Plan
E. Drainage/Sewer/Water Plan
4. A geotechnical report that addresses:
• Scope of work; site conditions; structural fill; retaining walls; foundation
support; foundation settlement; slab -on -grade support; pavement design
considerations; and drainage considerations.
5. A drainage control report is• needed -that addresses drainage for the new building
and the new parking area.
Pre -Load Plan, Sheet 1 of 3
1. •A note on the plan refers the contractor (Which contractor?) to the geotechnical
• engineering report prepared by Geotechnical Engineering Services. Why is this
note on the plan? Why is the contractor being asked to refer to the geotechnical
report? What's the specific concern or issue?

2. What is the -Vertical Datum .- should be either,KCAS or NGVD-29.
3. The proposed building footprint appears to be larger than the area being pre-
loaded. The pre -load area should exceed the building footprint by 5 feet.
Important: See next comment.
4. A note on the plan states that the new utilities are to be installed before the pre-
load pad is constructed. It appears that if the pre -load pad is increased in size to
exceed the footprint of the building that there is a chance that the pre -load pad
will also cover the new utility lines. If this is the_case, there is a possibility that
the new utility lines may incur damage due to settlement.
5. Although there is a note that a filter fabric fence is to be installed at the toe of the
pre -load pad, where will the surface water drain should it rain? The plan needs to
show a collection system and drainage path as part of the temporary erosion
control plan. King County Surface Design Manual calls for mulching to cover
disturbed areas that will remain unworked for more than two days during the
rainy season - Refer to Appendix D, pages 8 and 9 for more detail. Pre -load pad
needs to be covered with mulch.
Utility Relocation Plan, Sheet 2 of 3
1. There is a note on the plan that states the contractor must maintain fire service to
adjacent buildings. How will this be accomplished?
2. Show a profile of the sanitary sewer lines and the water lines to ensure that there
is a minimum of 18 vertical inches separating them.
3. There are three sanitary sewermanholes that need to be brought up to City
standards. They are circled on the plan.
4. There is a water line in the north section of the project area with a valve between
the existing building and the water main. Are the valve and the entire line to be
removed? On this same line where it currently connects to the water main, a new
- valve and thrust block are to be installed.
5. Two valves are to be installed on the new water lines that enter the new building.
6. Catch basins need to be numbered sequentially.
7. A Type II catch basin is needed in lieu of the specified Type I at approximately
the midpoint of the building. It is circled on the plan.
8. Show sanitary sewer line slopes.

1. A detail for a Catch Basin Insert is shown, but on the previous sheets there is no
indication as to where this detail applies. Indicate on the new temporary erosion
control plan those catch basins that are to be protected with the insert.
Recommendations
1. SEPA - Since the SEPA Checklist mentions moving 3,500 cubic yards of earth
from Parcel C to the Ethan Allen site (temporary storage) and then to the Best
Buy site for the pre -load pad, the Applicant needs to submit a Temporary Erosion
Control Plan (Plan Sheet) for the Ethan Allen site. Further, the Temporary
Erosion Control Plan for the Best Buy site is considered inadequate — see above
comments. These two plans are needed before a SEPA recommendation can be
made.

Purpose of Checklist:
ORIGINAL
The State Environmental Policy Act (SEPA), chapter 43.21 RCW, requires all governmental agencies
to consider the environmental impacts of a proposal before making decisions. An environmental
impact statement (EIS) must be prepared for all proposals with probable significant adverse impacts
on the quality of the environment. The purpose of this checklist is to provide information to help you
and the agency identify impacts from your proposal (and to reduce or avoid impacts from your
proposal, if it can be done) and to help the agency decide whether an EIS is required.
Instructions for Applicants:
This environmental checklist asks you to describe some basic information about your proposal. The
city uses this checklist to determine whether the environmental impacts of your proposals are
significant, requiring preparation of an EIS. Answer the questions briefly, with the most precise
information known, or give the best description you can.
You must answer each question accurately and carefully, to the best of your knowledge. In most cases
you should be able to answer the questions from your own observations or project plans without the
need to hire experts. If you really do not know the answer, or if a question does not apply to your
proposal, write "do not know" or "does not apply." Complete answers to the questions now may avoid
unnecessary delays later.
Some questions ask about governmental regulations, such as zoning, shoreline, and landmark
designations. Answer these questions if you can. If you have problems, the City staff can assist you.
The checklist questions apply to all parts of your proposal, even if you plan to do them over a period
of time or on different parcels of land. Attach any additional information that will help describe your
proposals or its environmental effects. The City may ask you to explain your answers or provide
additional information reasonably related to determining if there may be significant adverse impact.

Nonproject proposals refer to actions which are different or broader than a single site specific
development project, such as plans, policies and programs.

This Phase II expansion consists of the removal of the removal of 57 parking stalls and
the addition of 90 parking stalls within an additional parcel along Minkler Avenue
adjoining Parkway Supercenter. In addition, the original Parkway Supercenter will be
renovated with approximately 9,800 square feet of building area for a new Best Buy.
This proposal also includes the removal of existing excess material from Tukwila
South Lot to a storage area located behind the existing Ethan Allen vacant lot and pre-
load of the proposed Best Buy expansion.

The site within Parkway Supercenter has gentle slopes of 2 percent.
The existing storage lot behind the Ethan Allen store has some slopes
exceeding 40 percent. No work is proposed within the steep slopes of
this site.
b. What is the steepest slope on the site (approximate percent slope)?
Two percent for the site within Parkway Supercenter (Best Buy) and 40
percent within the storage site, behind Ethan Allen.
c. What general types of soils are found on the site (for example, clay,
sand, gravel, peat, muck)? If you know the classification of
agricultural soils, specify them and note any prime farmland.
Virtually 100 percent of the site is existing asphalt pavement and
buildings. The pavement and structures are placed on 2 feet to 10 feet
of imported granular fill over silt alluvium (silt and sand). The
