Mullet, Mayor Department of Community Development Steve Lancaster, Director December 29, 2000 Mr. Jerry Knudson c/o Green River Construction 6402 South 144th, Suite 1 Tukwila, WA 98168 Re: SEPA Review (E99-0029) Proposal to Grade & Fill Special Permission (L2000-081) Reduce Wetland Buffer to 25 feet 149XX 58th Avenue South, Tukwila Tax Parcel 115720-0394 Dear Mr. Knudson: We have reviewed the additional items you submitted on December 15, 2000 in connection with the above -referenced applications. Your original SEPA checklist (submitted on September 17, 1999) indicated that you intended to import 1,600 cubic yards of fill for future development on the site. However, your December 15th submission now limits your proposal to the grading work that has already occurred. We have the following comments. SEPA Determination: A SEPA Determination is required whenever 500 cubic yards of import or export is anticipated. Given the change in your proposal described above, a SEPA Determination will not be needed at this time. We have closed your SEPA file and have enclosed a refund of your application fee in the amount of $325.00. Reduction in Wetland Buffer: As you know, there is a Type 2 wetland on your neighbor's parcel, located immediately to the south of your property. This type of wetland requires a 50 foot buffer, much of which is believed to lie on your property. The site work you proposed in September, 1999 indicated the need to reduce the size of the required wetland buffer from 50 feet to 25 feet in width. Such a reduction in a wetland buffer is processed via a Special Permission application, which you submitted on December 15th. However, given the change in your proposal, a reduction in the wetland buffer will not be needed at .this time. We have closed your Special Permission file and have enclosed a refund of your application fee in the amount of $200.00. Further Actions Please be advised that the previous permits issued to you for construction of your home and associated site work are now officially closed. No additional work will be authorized under either of those permits. Accordingly, you should be aware of the following basic requirements if, in the future, you decide to further develop your property: 6300 Southcenter Boulevard, Suite #100 • Tukwila, Washington 98188 • Phone: 206-431-3670 • Fax: 206-431-3665 . Jerry Knudson December 29, 2000 E99-0029 (SEPA) L2000-081 (Special Permission) Page 2 1. As stated above, under SEPA, there is a 500 cubic yard threshold for the import or export of material. We believe that you have already imported 500 total cubic yards of material to your site under previous permits. For example, under Land Altering Permit P93-0055 you were authorized to import 470 cubic yards of material. Therefore, you may not import or export any additional material on the site without first obtaining a SEPA Determination. 2. Any proposal involving the removal, deposit or displacement of more than 50 cubic yards of material will require a Land Altering permit. This also includes the stockpiling of topsoil, peat, bark and similar materials and/or the clearing of areas larger than 5,000 square feet. 3. No work may occur inside the 50 foot wetland buffer. Any proposal requesting a reduction in this buffer (to no more than 25 feet) must be processed under a Special Permission application. The associated fees total $525 ($325 for SEPA and $200 for Special Permission). Per Steve Lancaster this date, please refund the $525 to the applicant. The check should be payable to Jerry Knudson. We have attached copies of the check receipts for your reference. MEMORANDUM TO: PLANNING DEPT. — Deborah Ritter, Assistant Planner FROM: PUBLIC WORKS DEPT. — David McPherson, Associate Engineer DATE: December 15, 2000 SUBJECT: Knutson Property 14925 - 58th Ave. South Parcel Nos. 115720-0394, 0403, 0407 General Comments SEPA — E99-0029 1. Owner will not import new fill material, prior to obtaining applicable permits from the City. No plan for improvements at this time, as of December 15, 2000. 2. No land alteration, temporary storm pond, swales, or TESC measures required at this time. 3. Stop work order was issued on May 18, 1999 for land alteration without a permit. 4. Geotechnical Report (TIR) is not required, until addition site work applied for. 5. Existing 12" public storm pipe & manholes require a public easement to be executed. 6. Engineer, Scott Traverso P.E., has made field visits and prepared a Civil Plan to show current conditions and locate sanitary sewer & storm drainage systems. A private sanitary sewer system and private easement exist across the site. A public storm drainage system exists across the South portion of the site. 7. Owner is allowed to place rock along the upper portion of his driveway as part of his original 1988 permit, for his primary residence. Per Public Works Director, December 14, 2000. 8. Public Works did not find record of primary residence building permit from 1988. 9. Public Works Inspector will release stop work order based on current conditions, as of December 15, 2000. The owner agrees to place straw and/or other erosion control methods, as needed to cover exposed areas. 10. Site has long history of land alterations, utilities construction both private and public, and City utility work on or near the property. Attn: Deborah Ritter 1. Special Permission Application for a Wetland Buffer Reduction: Items a,b,c,d, & e are included 2 Revisions to SEPA checklist: A revised checklist is submitted with this application.. The checklist is applicable to the request for a reduction in wetland buffer width from 50' to 25'. 3. Application for Land Altering Permit: Coordination with your Public Works Department has produced a complete set of existing As -built plans of the subject site. Including all Tax lot #s referenced to in the SEPA check list. This research has reveled an existing storm sewer line on the South property line with City of Tukwila marking stakes that does not have a recorded easement. The City should indicate the legality of this line and endeavor to properly record it. This may be contributing to the Wetlands as a manmade condition illegally constructed: Deadline As I commented previously, you did not sent me the copy of the 18 Oct letter until 4 Dec 2000. In the 18 Oct meeting it was agreed that Mr. Knudson could complete any grading and landscaping with respect to his residence and the parcel it occupies. A legal permit was issued by the City for the land altering permit on the parcel to the South (#1157200394) in 1993, Permit # P93-0055. Field research indicates that this original fill is in the same location as permitted. The additional fill material placed in this area was to be used as topsoil for Mr. Knudson's residence when it was issued a stopwork order in 5/99. • This topsoil material has since be spread out over the permitted area and has established some vegetation growth to prevent erosion. In my discussions with Public Works it would appear that the best course of action would be not to disturb the existing vegetation and add straw mulch over the sparse area lacking a good growth of ground cover. Geotechnical investigation by Hemphill Consulting Engineers dated May 15, 2000. Mr. Hemphill's report states that there was no testing or inspection of the placement of the fill used on this site and he states the condition of the fill is unknown. In Mr. Hemphill's recommendations for the site he suggests running a heavy vibrating compactor over the site to test the compressibility of the fill, or to compact any soft or loose spots. Based on engineering and construction practices, the vibrating compactor can typically compact soils only to a depth of about 6" to 12". With fills as deep as five feet to six feet on the site, based on the drawings provided by Mr. Knudson, a vibrating compactor does not have the required capacity to obtain 95 % density in fills over 12 inches in depth. Mr. Hemphill's soil Engineering Report does not meet the City of Tukwila's requirements for an adequate report, based on the fact that no testing of the fill was performed or soil borings made to support the conclusions of the report. The City of Tukwila Public Works Department will require that the existing unsuitable fill material be removed to native soils and the proposed building foundation and slabs be placed on existing soils. If Mr. Knudson wants the foundations and slabs at grades other than existing conditions, he can rebuild the fill using suitable materials under the direction of a professional engineer and approved land altering plans. The investigation and report were authorized by Jerry Knudson during a meeting with Dale C. Hemphill of HEMPHILL CONSULTING ENGINEERS). The investigation and report are in accordance with requirements by the City of Tukwila to address "the existing and proposed conditions of the site and its ability to support a typical single family development and associated road foundations. The report shall describe the measures necessary to establish the stability of same." INVESTIGATION HEMPHILL conducted geologic research, and a site investigation, and determined that the original surface soils are glacial till, underlain by rock of the Renton Formation. 4041 WEST LAKE SAMMAMISH PARKWAY SOUTHEAST • BELLEVUE • WASHINGTON • 98008 PHONE 425 644 1080 FAX 425-643-3429 dchemphill@msn.com Project Number 2501 15 May 2000 page 2 of 3 pages HEMPHILL conducted penetration tests, visual classifications, and probing, and verified that the original soils are very dense glacial till, and determined that the fill soils are combinations of silt, sand, and gravel of glacial till origin that had been compacted to a dense condition. There was no testing or inspection of the placement of the fill, therefore the condition of all the fill is unknown. The fill had been blended into the uphill slope west and north of the site, and sloped down along the south and part of the east side of the site. Some minor runoff erosion had occurred along the downhill slopes. There was no evidence of deep instability within the slopes. EXPLANATIONS and RECOMMENDATIONS HEMPHILL recommends that the fill be tested at the time of construction by running a heavy vibrating compactor over the site to test the compressibility of the fill, or to compact any soft or loose spots. At the time that excavations are conducted for houses, the subgrade for footings can be tested for compressibility and strength. If unacceptable soils are encountered, the unacceptable soils can either be compacted, or removed and replaced with acceptable structural fill. CONCLUSIONS HEMPHILL concludes that surface testing of the existing fill by penetration tests, and rolling with rubber tired vehicles, indicates that the fill was well compacted, but since professional inspection and testing was not conducted, then. further testing can be conducted at the time of construction, as would normally be conducted anyhow. It is my understanding that this wetland was identified by the City of Tukwila during its review of a grade and fill application for your project. Based on a November 30, 1999 letter to you from Deborah Ritter, Assistant Planner for your project, the City of Tukwila believes this off-site wetland meets the criteria for a Type 2 wetland. Type 2 wetlands in the City of Tukwila generally require a standard 50 -foot buffer. enhanditions ls buffer can cement plan.be reduced by as much as 50% with implementation of a buffer Ms. Ritter's November 30, 1999 letter requested additional information to complete the City's review process. With regards to wetlands, the choice of two of twooptions aas provided: 1) maintain a 50 -foot buffer from the southern property 115720-0394; or 2) provide a wetland report for the adjacent wetland with the permission of the adjacent property owner. Certain additional information is needed from you to ensure that the project meets the substantive requirements of the City and to complete our review process. We have the following comments: Planning Department Comments: , 1. Gary Schulz, Tukwila Urban Environmentalist, has identified a wetland on the property adjacent to your Parcel 115720-0394 (your southernmost parcel). You may choose one of the following options: 1) maintain a 50 foot buffer from the southern property line of Parcel 115720-0394; or 2) provide a wetland report for the adjacent wetland with the permission of the adjacent property owner. Please submit a letter indicating which option you have chosen. 2. You must submit a geotechnical report addressing the existing --and proposed conditions of the site and its ability to support a typical single family development and associated road foundations.
