I recommend the SEPA be determined incomplete for the following reasons. 1) Per the Director, the SEPA checklist must be signed by the person that authored it. 2) The SEPA does not include the level of detail necessary for making a reasonable determination. The site is wet and hydrology will be a major issue to address. Staff identified sensitive area issues during the pre -application meeting. These issues are not fully acknowledged in the checklist. Terra Associates, Inc. suggested landslide conditions are present on the site in their 2/28/97 Preliminary Wetland Evaluation. The preliminary investigation also observed wetland soil conditions but were not used due to past or present disturbance related to soil movement. The "disturbed" or "problem" area methodology may be necessary for wetland determination. I feel this sensitive area condition needs to be identified or addressed in the SEPA. The potential for Type 2 wetlands to exist on the site will affect the project site plan and possibly require a Reasonable Use Exception process. At a minimum, a geotechnical study should be submitted with the SEPA permit application. Please have the applicant submit their wetland study with the revised SEPA checklist. We've got a lot of problems in this ravine with the three forks of Riverton Creek and the sewer from the old Riverton Tuberculosis Hospital, TB Hospital and all their stuff. This sewer has failed twice. I've been here 8 1/2 years. It's because of slope instability and it goes right into the stream, so we've been there several times, and what we're asking for is a geotechnical report/analysis of the hill - hillside stability and review of what's there. This one down here, the whole hill let go in the creek. The end result of this is (indeterminate comments)....30 years of Dames and Moore showing (indeterminate comments)....there's a deep rooted slide... Africa Northwest (ANW): And you think this site is just in line? RC: Well, I know through the water work you've done for well supply and well sources that the aquifer is 30 miles long (indeterminate comments)....goes up and goes down, so for your own protection, I would do that. For our before we issue anything, we want to make sure, especially with the current events and the slides everywhere is, is you need to be aware that we are gonna be extra cautious just because of the problems we've had on the hill. So you'd have the analysis and then the funding of the independent review, and the reason for that is, is we don't have source people on the staff depending on the complexity of that, because of the face of that hill and the failures we've had in other areas, we would elect to send it out to Shannon, Shannon Wilson and the people we use most often when we review. So, if you're selective in geo-engineering (indeterminate comments)....use Shannon Wilson for some reason, we'd use someone else... ANW: Sure RC: ...But we need to have somebody independent. ANW: I'll probably use (indeterminate comments).... RC: (indeterminate comments).... ANW: And is that OK? I mean, do you get along with them if they're still... RC: Well, when you do that, tell us how (indeterminate comments)....'cuz we've probably dropped a hundred grand over here `cuz it keeps coming up out of the center of the street. And it comes up out of a six foot pipe here and all of this mess... ANW: So, the water I hear running to the south of it is, I mean you put it underground in a pipe.... RC: This is a, this is a, this is a, you know, this just, this runs pure, clean, and we've had the Flow -Tote in here, and yet the Flow -Tote in the three years of draught that we experienced really didn't change - hadn't changed at all. I don't remember what they were running - 2 1/2 or 2E CFS and higher. And so at our recon here we found the same thing that Gary is saying - that there appears to be some streams and that in that geotechnical report with his sensitive areas, locate where they are and what you'll do with them. It just...if you put a shovel in that hillside, it comes out. We've got some (indeterminate comments)....spalls pit (indeterminate comments)....Just make sure you're OK for yourself and we (indeterminate comments)....we're not trying to scare you or anything, but we've seen the problems, and if you were on our side, you wouldn't, especially with the current situation... So, we witnessed that and it doesn't...we can't tell the assessors map shows that it's still there in part. So, that just needs to be clarified. ANW: I think I have the vacated in submission right here RC: I don't need it today - that's just a bookkeeping thing. Our review in here looks like some of the mapping and your mapping may not have been right in the line in there, and without doing any more, we just want to make sure that your survey and the right-of-way of the WSDOT is OK. RC: We've come down from these guys trying to find what, you know, with these other things, and we've talked. For water and sewer, and I don't remember if twenty has it - has a main in Pac Highway or not. At one of the purveyor meetings I remember talking to him and I thought there was, but I just need to look at the map. Just what are you gonna' do and how many crossing the street and generally probably need to recognize they're gonna have to cross with care. That's a 45 mile -an - hour speed limit there with probably 50 mile -an -hour speeds. That, that, that gets us to the loading zone that just we don't like and probably will permit, and the reason for that is, again over 50 mile - an -hour speeds here...it's wide open, and there's two things we don't want is somebody backing in... And, and people, I mean, ya' know, several killed. In, in, including putting a couple peds, you know, a couple three -hundred feet down the street and through...and, not pretty. So, we had all this neighborhood business in there. They're very...some of 'em highly concerned that we closed this, and we signalized this arterial and this arterial. And, uh, and we worked with Burney for his drive through trucks, and these people come to council and say "yeah, it's supposed to happen that way," but, oh, like one of the neighbor people came in here in her van - Right turn only, and she turned right out here and got picked off by a truck coming through the signal against the sign. And we've seen the trucks do it. And the communication has been that way for three years. And the truck loading and going the wrong way - and if you think I'm gonna touch one down here with a ten foot pole, go find another site. And, and I don't mean to sound hard, but the history here, and the accidents, and the community concern, and the planning commission is that this is a fixture in the Tukwila community. He's been here, he's been in the paper a hundred years - and so you've got the people that say "Burney walks on water" and you've got the people that hate the trucks. So, there wasn't anything we could do there that would not be a mess. So, the drive-thru thing on the trucking is something we, we, we look at it - we push the radiuses around and, and the structure is designed so that it, you know, it's meant to work one way, or something like that. And if you - you can demonstrate that - that the deliveries all come from the north on 599, you know, not, not just by control 'cuz signs aren't gonna do it. They haven't 6 worked for us for Burney, and you - just like we said, you know (indeterminate comments)....the design has to do it. So, the design includes the marketing that the delivery stuff comes from the north or from the south and we'll look at that, but that... ANW: Well, that's... RC: ...that backin' in deal... ANW: No, I'm just sayin'...yeah, I'm just sayin' that that's somethin' I can't control... RC: No, no, neither can we. So, we need to approve something that precludes that. So, you know, I get to do all the good news for you - the dirt and the trucks. But.I think that - I, I still think that they're both still workable... ANW: Yeah, I can do it. RC: The rest of these checks on here are just the standard METRO side sewer and you will need to do land altering permits ANW: I wouldn't be this far along if I didn't think it wasn't solvable. Yeah, I mean, this is...do you think it's buildable? I mean, I mean if my photo guys looked at it and said - he said "without cores - you know, core samples, it's stable. Short of doing that, it's stable where you wanna build." RC: Did he walk it? ANW: Yeah. He went out with the guys who did the water... RC: No, I've been on this property that has been under tremendous scrutiny for years right here, and it looks like that to me, so....and I'm not a geotech and I just kind of look at it and go... ANW: There's, there's big differences RC: That big hole up there is the fill for Southcenter and the freeway, and this piece here hasn't had anywhere near the magnitude in the number of yards taken away.. Areas of Potential Geologic Instability are addressed in the Ordinance which is Section 18.45.080 E. of the Tukwila Municipal Code (TMC). 2) As part of project review a geotechnical investigation will be required to demonstrate the feasibility of the project and to determine adequate building design. The geotechnical investigation will depend on the degree of development related to sensitive slope areas. On-site grading may affect slope stability and groundwater movement. Significant groundwater discharge and the appearance of earth movement is evident throughout the on-site slope. 3) Slope areas, exceeding 20 percent grade, that are cleared for development will be subject to the Tree Ordinance (Tree Regulations - TMC Chapter 18.54). A required landscape plan will consist of tree retention and tree planting per the standards of the Ordinance. Tree replacement is required for those greater than 4 inches in diameter at breast height (DBH) except for black cottonwood trees. Only trees present on sensitive area slopes will be subject to the Tree Regulations. 4) In addition, there is a potential for associated wetland areas or seepage wetlands. Per the SAO, sensitive area study will be required for wetland determination (TMC 18.45.020 f.). If wetlands are present using the 1987 Army Corps of Engineers Wetland Delineation Manual, their ratings must be determined. Lighting: Energy efficient security lighting is a relatively low-cost, yet extremely effective way to protect the building and its visitors. By providing sufficient lighting in the parking lot and around your building you will discourage burglars and vandals who don't like light, preferring the cover of darkness for their dirty work. Also the lighting will provide a legitimate sense of security for the employees and the visitors. 6.
