In the Approval of the Minutes of the September 12, 1977 Committee
of the Whole Meeting at the September 26, 1977 Committee of the Whole
Meeting Councilman Bohrer said he felt the description of the discussion
that took place when the proposed ordinance establishing procedures for
review of projects inconsistent with the new Comprehensive Land Use
Plan was brief and did not reflect all of the comments of the audience.
The following is a verbatim transcript from the tape on this subject.
Kjell Stoknes, OCD Director, said the proposed ordinance contains the
latest wording by the City Attorney. He said he would like to discuss
with the Council their main concerns. Councilman Pesicka said the thing
she did not like about the ordinance was that it only affects that
property that does not agree with the Comprehensive Map. The fact that
Mr. Skarbo had to come to the Council and show them what he was going to
do shows that. It is not going to stop another Canyon Estate from going
in, and it is not going to stop another warehouse like there is down
on Interurban behind Mr. Hartong's place. If that property is already
zoned that way nothing has to come to the Council. Mr. Stoknes said
Interurban Avenue along that stretch showed as commercial and under this
proposal that warehouse would have had to come before the Council. If
it is consistent with the zoning and the map it would not have to come
before the Council. Councilman Pesicka said this upset her because we
do not have an open space ordinance. We are trying to develop a policy
and this does not answer that problem. Mr. Stoknes said the open
space that the Council asked for last December or January is in this
packet and can be adopted at the next Council meeting. He said he
thought this would minimize the starknes of the apartments. Councilman
Van Dusen said if you look at this it is really a zoning map. Mr.
Stoknes said the best way to demonstrate the effect of this ordinance
is to take a piece of property that is zoned. We will take the area
directly south of the Tukwila Elementary School some is single family,
some medium density, and some high density. If an individual came in
and applied for a building permit, the project would have to come
before the Council. That is one you are comfortable with. Another
example would be the area just north of the new City Hall. That is
consistent on the zoning map in apartments, it is also the same thing
on the Comprehensive Plan, at least a portion of it. In that case we
would use the zoning ordinance, analyze it under the zoning ordinance,
and act on it without coming to the City Council. It is a zoning func-
tion. If you did not want it to be apartment zoning and it was a piece
you were concerned about you would probably show some other designation
on it. What you are saying is when it is in a high density area it is
not going to affect the single family area, it is going to be buffered
by something. Councilman Pesicka said it seems like this makes a set
of rules for some people but others will not have to follow them.
Mr. Stoknes said that is true. People who are consistent with the
map and have the zoning will not have to come and justify their proposal
before the Council. That way everyone will understand the rules. It
gives Council the opportunity to mold the community and how it is
developed. Council President Hill said one thing bothered him. For
instance, the Blackwell property is zoned R -4, if they came in and just
a corner up here is zoned R -1, the Staff could make the decision as to
whether or not there would be apartments. If it is a larger piece over
here, like the Graydon Smith, it would have to come from the Council.
It does not seem to be consistent. Mr. Stoknes said probably a better
example would have been the piece of property to the west where the
whole piece is consistent. Council President Hill said if it is zoned
R -3 and they came in for R -4, what? Mr. Stoknes said then they would
have to come to the Council and apply for a rezone. Fred Satterstrom,
Planning, said they had thought the Council would want to make their
decisions on those actions that were inconsistent with the Comprehensive
Plan, not those actions that were consistent with the land use map.
Right now, Resolution No. 489 is causing an increase in the staff load
as far as preparing staff reports. We felt if we were going to be
shackled with reviewing each application, in fact almost every building
permit for staff report on a waiver request, even actions that would
be consistent with the Comprehensive Plan, he doubted they would have
manpower to do that. Mr. Stoknes said this proposal would only bring
about 10 to 15 percent of the building permits to the Council.
Council President Hill said what Staff is saying then as an example on
152nd and Macadam Road which is indicated as high density and if

someone came in with a permit to build 40 to 50 units per acre the
Council would likely never see it, it could be handled by Staff. Mr.
Stoknes said that is correct. He continued the real reason, the
weakness for that, is the fact that the high density apartment area
does not have an upper limit. It just says 17 plus. If the Council
put an upper limit on that and said 17 through 28, then if it were
higher it would come before the Council. Council President Hill said
it looks like it would be nice to have condominiums and town house
type buildings with what we have now. Could R -4 and RMH be limited with
height and open space requirements? Mr. Stoknes said in zoning that is
a very typical way to hold the density down. Councilman Van Dusen said
he was trying to get this ordinance clearer so he could vote for it.
He said he thought this type of ordinance was needed with the Comprehen-
sive Plan. He wished the Council had been working on this ordinance
all along with the Comprehensive Plan. He said he was worried about the
phrase "present community values." He doubted anyone could tell what
the present community values are. He said in Paragraph 5 he would sug-
gest it read: "WHEREAS, it is clear that the zoning map for the City
of Tukwila no longer reflects the Comprehensive Plan of the community,
its legislative body and currently- recognized state of the art of
planning." He also asked about Section 3, last paragraph, where it
states building permits for single family homes are exempt from the
provisions of this ordinance. He asked why just them? Is it meant
they cannot be detrimental? Councilman Traynor said unless things are
changed you can build R -1 anywhere in the City, except in recreation.
Councilman Van Dusen said he thought if they had to do the map all over
again, he did not think they could come out with things very different.
Mr. Stoknes said the reason they made building permits exempt for single
family homes is because of the Shoreline Management Act which the
Council adopted. State law prohibits building permits for single
family homes within the shoreline. Whenever they come up with some-
thing of this nature they look back and see if there is something to
go by. He suggested changing the wording in Section 1, Policy State-
ment. He said he also agreed with Councilman Van Dusen's suggestion
for the change in the fifth paragraph. Chris Crumbaugh, audience, said
you have adequate control under the Shoreline Management Act so he
would propose that anything shown within 200 feet of the river is in an
environmental sensitive area and would not have to come for a waiver
because you already have that control. In Section 3 (1) that is a
section that says what comes before the Council, and it says land use
actions which are inconsistent with the new Comprehensive Land Use
Plan Map. If a person came in with a commercial use under the indus-
trial zoning and shows commercial on that map even though the zoning
says industrial, is that inconsistent? He would say it would not be
and he would like some kind of clarification that would recognize that.
Mr. Stoknes said the legend in the Comprehensive Plan under Light
Industrial says that areas characterized by light manufacturing uses,
commercial and office and offices. He said he did not see any problems
with the wording. It does not change the meaning. Mr. Crumbaugh said
he would not request a change in the wording if that is the intent of
the meaning. Mr. Stoknes said he thought Mr. Crumbaugh's concern is tha
Staff should not have the right to determine what is compatible in that
area until that particular subject is worked out under the zoning
ordinance. That is the way it should be. Dennis Robertson, audience,
referring to Section 5 (3), said there seems to be some confusion. He
said he felt the word "no" should be inserted between "that" and "other.
Councilman Van Dusen said he would like Mr. Stoknes to explain Sec-
tion 5 (6). Mr. Stoknes said basically it is saying would granting a
waiver to a proposal be such a policy commitment that it would take
away from the zoning ordinance efforts. He said he thought in reading
this the policies have already been made with the Comprehensive Land
Map. Those are the policies. When you get to zoning they are much
more specific. Fred Satterstrom, Office of Community Development, said
he might be able to clarify it. He referred to the Anderson rezone
about a year ago. This was the criteria that was applied to it. The
Anderson rezone was rezoned to C -2 along Southcenter Parkway. At that
time it appeared from all of the maps that the Council had seen that
had been proposed by the Planning Commission and the citizen groups
that it would be commercially designated along Southcenter Parkway.
Now Anderson came in for a rezone along an area that it seemed was
inevitable to go commercial on Southcenter Parkway, because of the land
use pattern, because of the zoning pattern, and because of the way the

City was looking at land use at that time. It almost would have
been an imposition to the property owner not to recognize the fact
that the area was going to be commercial, and that the designation for
the rezoning of the property along Southcenter Parkway to C -2 to
commercial to allow the use he had specified would not have been a
major policy that would have committed the City to considering that
type of land use all along Southcenter Parkway. The City was already
thinking that way. We are asking that if the Council could make a
decision on the property as to whether or not a certain action should
take place on the property because it would not make a commitment as
to how you would approach zoning in that area later on. Then perhaps
that action was alright. If a person came in for a waiver for an
apartment building in an area that he had zoning for but the Comprehen•
sive Plan had it designated single family I would think that the
Council would be committing themselves as far as the policy decision
is concerned for its future zoning area if they would approve that
waiver, but if the property owner came in for say 16 to 18 units
along the perimeter of say a medium density strip the Council may
not be making a major policy commitment for its future zoning. Mr.
Stoknes said he thought this was also encompassed within Item 5 of
Section 5. Councilman Bohrer said since we are talking about zoning
we still have the capability of applying conditions on zoning as we
have on past zoning actions. Mr. Stoknes said Mr. Crumbaugh made a
couple of statements that he would like to respond to. He talked
about single family dwellings being developed in an environmental
sensitive area. He said he thought that was a point well taken.
You can grade in a steep area. Also, he talked about the slash
marks on the land use map requiring a waiver along the Green River.
Actually those slash marks do not require a waiver, it is under the
Shoreline Management Act. He mentioned standards of denial and there
should be separate ones for sensitive areas. Rather than make this
ordinance cumbersome they had felt that to improve the concept that
Item 5 of Section 5 should be added. Councilman Bohrer said in
Item 4 of Section 5 he thought there should be some qualifier for
"mitigating measures." He suggested the word "sufficient" be inserted
between "that" and "mitigating." Councilman Gardner said even goals
are changing. The government spent 40 years in grants moving people
out of the cities and now they are spending money moving them back.
John Merrick, audience, said his question was do we assume from the
statement on waivers that if these conditions are met that rezoning
in an area is going to be automatic with or without the awareness
and opinions of the adjacent property owners. Mr. Stoknes said this
ordinance does not address rezoning. The zoning ordinance requires
that adjacent property owners be notified. Mr. Merrick said the
notifications are not reaching them. He said the triangle on
65th Street is under consideration for rezoning at the present time
and notification was not legal and proper for this. We need certified
return receipts. Chris Crumbaugh, audience, said if a valid attempt
is made to notify property owners he felt that would satisfy legal
requirements.
Council President Hill said in making motions on the proposed ordinanc
they would start with Paragraph (1) and go right through it. He
said it was acceptable through the fourth paragraph and the followng
motions were made to reflect desired changes. (See Minutes of

Kjell Stoknes, OCD Director, explained the location of the proposed
rezone application. He stated the Planning Commission had recommended
the reclassification of the property with some stipulations. This being
in the event that development of the property affect the land area
above approximate 35 feet elevation, a grading and reclamation plan
consistent with Chanter 70 of the Uniform Building Code and a reclamation
bond posted with the City of Tukwila in an amount equal to 150% of the
estimated cost of reclamation shall be required prior to issuance of
the Building Permit. That development of the site shall include a
pedestrian sidewalk of five feet in width. That the forced main sewer
connection line be installed in accordance with City of Tukwila stand-
ards at the full expense of the property owner. Operation and mainten-
ance of the pump and sewage force main shall be at the expense of the
owner. At such time as a L.I.D. is formed the property will agree to
participate in such L.I.D. A charge in lieu of assessment to be paid
to the City at a rate to be established by the final assessment roll of
L.I.D. No. 27. On -site construction shall conform to the height, yard,
and area restrictions and architectural review of the Tukwila Municipal
Code. Mr. John Markinson, representing the Skarbos, stated they are
agreeable to the conditions that have been imposed. Councilman
Bohrer said when this matter was discussed earlier there was a question
about the placement of the building. Mr. Stoknes said the location of
the building had been approved. Councilman Gardner asked if this is
going to be a retail store. Mr. Stoknes said it was. Council President
Hill asked about fire protection. Mr. Fred Satterstrom, Planning
Assistant, said the Fire Department reported they would not have any
problems.

and explained by Mr. Stoknes. Councilman Bohrer referred to Item 4

for "mitigating measures." He suggested the wording be "sufficient
mitigating measures." John Merrick, audience, asked if adjoining proper=
ties were notified when rezoning is requested. Mr. Stoknes said they
were. Mr. Merrick said the notifications were not reaching the owners.
He suggested the use of certified mail with a return receipt. Chris
Crumbaugh, audience, said it was his impression if a valid attempt at
notification was made that was acceptable.

The meeting was called back to order by Council President Hill with
Council Members present as previously listed.
MOVED BY VAN DUSEN, SECONDED BY PESICKA, THAT THE LETTER FROM BURLINGTON
NORTHERN BE READ AND CONSIDERED AS ITEM 4 (A) OF THE AGENDA. CARRIED.
Council President Hill read the letter from Burlington Northern regarding
the Glacier Park Company property lying east of the Burlington Northern
tracks and south of Longacres. They wished reconsideration of the
proposed down zoning of this property from heavy industrial to light
industrial. Mayor Bauch said the property is zoned M -1 so the letter
is in error. Fred Satterstrom, Planning Assistant, said that is true
it is light industrial and the M -2 classification does not conform to
the City of Renton's M -2 zoning. The property is not being down zoned.
The light industrial does conform and does not represent a down zoning.

Councilman Van Dusen said this matter was discussed at the Public
Safety and Health Committee Public Hearing. At that hearing it was
brought out that the police station is a refuge and when it is closed
at night it is an inconvenience to the citizens. He said money has
not been budgeted to keep it open 24 hours a day, but he felt sure the
money can be found to accomplish it. He said petitions have been
circulated, which he did not originate. He read the petition that had
been circulated. He said he thought the police station had been closed
due to a misunderstanding. Officer Tom Kilburg said he was speaking in
behalf of the Tukwila Police Officers Association in an effort to present
their feelings. He said the officers meet the people and see their
needs. He cited instances where lives were likely saved because the
police station was open and could offer aid. He said the police
station is where you go for help and safety and you expect it to be open.
Councilman Van Dusen said he had invited Officer Kilburg to attend this
meeting and offer information.

Councilman Traynor asked what personnel would be needed to keep the sta-
tion open 24 hours a day without taking officers off the street. Mayor
Bauch said it would take two people, the number that were reduced when
we went to Valley Comm. Robert Conner, police officer, said when a
person has a problem it is real to them. In a stress situation people
remember a place like the police station. Ed Robinson, audience, said
he has been followed up the hill from Southcenter and he knew if he
kept coming up the hill he would come to the police station. Diane
Johnson, audience, said she has been a resident of Tukwila for 19 years
and she has never had occasion to call the Police Department. In the
past she has taken walks at 2 a.m. and had known she could do so safely.
She has stopped by the police station and told them she was out walking.
She said she had taken a petition around requesting the police station
be open 24 hours a day. About 95% of the people have been in favor of
the police station being open. She said right now criminals know
Tukwila is not a safe place to ply their trade. Frank Todd, audience,
said he thought the City Council should act on the testimonies that have
been given. He thought the necessary personnel should be hired. Ed
Robinson, audience, said there are other areas where money could
be saved. There is a band playing in the park and maps are done in
multi color, all of this is expensive.

NECESSARY ARRANGEMENTS TO MAN THE POLICE STATION TWENTY -FOUR HOURS A
DAY.
Councilman Van Dusen said the money will have to be budgeted. Mayor
Bauch stated we are talking about $30,000 a year. Mae Harris, City
Treasurer, asked if the personnel hired would be part -time or full -time.
Councilman Traynor said it did not matter as long as the police station
is manned 24 hours a day.

Interior Decorator Mayor Bauch said it is necessary to know whether the interior of the

said we had been willing to accept the architect's decision regarding
the functional part of the engineering and he thought we should listen
to the recommendations of the architect regarding the interior decoration
Tom Emrich, Mithun Associates, said it was his hope that the City would
seek the assistance of professional help in the matter of interior dec-
orating. He said under their contract space help can be given. Interior
designers can provide space planning and design that is needed. Another
plan would be to make all of the decisions regarding interior design in-
house. He said he felt this would be a mistake. It would take a lot of
time. Councilman Pesicka said the City hired Mithun because they liked
the inside and outside of their buildings. She thought the Council
should respect their recommendations. Mr. Emrich said they could make
recommendations. If the City wants them to provide this function they
will do so. Council President Hill asked about the fee. Mr. Emrich
said most interior designers work on a percentage basis or an hourly
basis percentage is usually 12 to 15 percent of the finished cost.
The City has acquired some furniture that could be reused. Mae Harris,
City Treasurer, asked about carpets and draperies. Mr. Emrich said the
draperies are slatted blinds and they would be part of the building. He
said if the City has his firm proceed with this they would hire a consul-
tant to help them. The actual design would involve space planning. The
actual design would involve space planning. He said his firm could be
hired on a separate contract or under the existing contract. ,.To proceed
under the existing, it would be at an hourly rate plus some costs. It
would authorize them to hire a consultant and the cost would be borne
by the City. Councilman Van Dusen said he would like some money. figures.
Mayor Bauch said he felt there should be some kind of a lid on the fur-
nishings. Money has been allocated for interior design plus the carpet.

LETTER FROM JIM EWINS, CONSTRUCTION MANAGER FOR MCDONALDS RESTAURANT.

Mr. Jim Ewins said he requested by letter that the City Council water
committee intercede in what they consider to be an arbitrary requirement
of Chief Crawley in regards to the installation of a fire hydrant on
the west side of Southcenter Parkway. He said the owner of the property
has indicated that the intent of the City was to have located fire
hydrants at the stubs provided in the water main on the east side of
Southcenter Parkway. Two such locations are closer than 300 feet from
the furtherest portion of their building. They suggest that an east
side location would be in conformance with Ordinance No. 729. He said
to their knowledge, this would be the only location in the City required
to install hydrants on both sides of the street wherein the structure
is within 300 feet of a hydrant. He said their location adjacent to
the freeway precludes construction of structures west of them which
would need fire protection. They have concern for fire protection but
it does not appear beneficial to expend upwards of $7,000 above the
cost of domestic water for a hydrant just 70 feet closer to the building.
Councilman Traynor asked if there are hydrants on both sides of the
street. Mr. Ewins said they are all on the east side. Councilman
Van Dusen suggested the Council have discussion with the Fire Department
and the office engineer.

AGENDA OF THE SEPTEMBER 19, 1977 REGULAR COUNCIL MEETING, THAT THE FIRE
CHIEF BE IN ATTENDANCE, AND IT BE SCHEDULED IN THE EARLY PART OF THE
MEETING SO MR. EWINS WILL NOT HAVE TO WAIT SO LONG FOR HIS MATTER TO BE

Mayor Bauch said the weatherization program has just started on the
program for 1976 -1977, but it is necessary to plan ahead for the
1978-1979 program. It is necessary to have a resolution or council
motion authorizing the City to enter into the agreement.

RESOLUTION OR COUNCIL MOTION AUTHORIZING THE MAYOR TO ENTER INTO AN
AGREEMENT FOR THE WEATHERIZATION PROGRAM. CARRIED.
Mayor Bauch reminded the Council that a Seminar would be held on
Wednesday, September 14, 1977 at 7 p.m.
Vacany on Park Bd. Mayor Bauch stated Velma Lee had resigned from the Park Board and a
replacement would be needed.
Noise Survey Councilman Van Dusen said the results of the noise survey would be
discussed at the next Committee of the Whole Meeting on September 26,
1977.

John McFarland, Administrative Assistant, said he felt he should say
something about the police station closure. He said he had been
listening to employees, as Personnel Officer, agonizing about the closure
of the police station. As the Administrative Assistant he had been
listening to citizens agonize over it. A couple of things came to mind:
This matter was presented to the Council last year during budget hear-
ings as a cost saving move. Several alternatives and their expected
outcomes were weighed by the Council. They, as a body, chose to make
the decision to go to Valley Comm concept and reduce the staffing of the
Police Department. It has been the opinion of many employees that it
was the decision of Administration to do this and they had not argued
that. He said tonight he had the distinct feeling from the audience
and the Council that the Administration had made a mistake. He said he
felt the Council should have prefaced their remarks tonight with "We
made a mistake." The feeling seems to be, in talking to the people in
the parking lot, that Mayor Bauch was unwise in doing what we did and
"we sure showed him." He did not think that was the purpose or intent
of what happened during budget hearings last year. The experiment the
Chief of Police and the Mayor made to reduce staff was a decision the
Council made. He said he thought the Council was somewhat negligent,
maybe that is too strong of a word, in not expressing their part in
going to Valley Comm. He said this is something he felt he should say
out of loyalty to his boss and being very close to the problem through-
out the establishment of Valley Comm and the attempt to find an accept-
able level of staffing for the Police Department, and the agonizing
that has come from the personnel, the citizens, and Mr. Van Dusen.
Apparently the decision that was made was the incorrect one, but it was
a joint decision. He said he did not get that feeling here tonight,
perhaps he was wrong and if he was he apologized. He said this is
something that he personally felt he had to say. Council President
Hill said this is fine but speaking for himself he, in no way felt the
police station would ever be closed due to cutting two personnel.
Councilman Pesicka said that was her thought, too. Councilman Van Dusen
said he felt it was a communication problem. He thought they agreed to
keep it open all of the time. Mr. McFarland said he remembered the
discussion on Valley Comm and there would be a reduction of staff.
Councilman Pesicka said she remembered that, but she did not remember
anything about the doors to the police station being locked. Councilman
Traynor said in no way did he visualize everyone would be on the day
shift and no one on the night shift he knew there would be a cut in
manpower. He said he visualized one on graveyard and one on second
shift in order to keep the police station open. He said he was not
pointing a finger at anyone because he knew a decision was made to cut
the staff. Mr. McFarland said he wanted them to know there was a
great deal of concern on the part of his office as Personnel Officer and
the part of the Chief of Police office in trying to find a workable level
of staffing and still keep within the budget. There was the emotional
involvement of the community. He said there is need of more communica-
tion and he would be more than happy to make himself available day or
evening. Council President Hill said the first he knew of the police
station closure was when he saw the phone being installed.

Councilman Bohrer asked about the status of the bulkhead for Bluff
Street. Kjell Stoknes, OCD Director, said it looks stable and he will
make a report at the Committee of the Whole Meeting on September 26.
