TO: Jack Pace FROM: John Jimerson RE: SEPA - Sanft Tree and Shoreline Permits DATE: September 3, 1996 emorandum SEPA Project File No. E96-0017 Underlying Permits: L96-0026 (Shoreline Permit) L96-0027 (Tree Permit) Land Altering Permit Project Description: The property is located at 14440 Interurban Avenue South. The applicant is requesting an "after the fact" shoreline permit and tree permit. The applicant removed vegetation and several trees within the shoreline zone without benefit of these required permits. Applications were submitted in response to enforcement actions by the City Attorney. The applicant removed several trees from the shoreline zone - the species, size and exact number are unknown. Using aerial photographs it appears there were roughly 15 trees removed from within the shoreline zone. Several other trees located in the northwest corner or the site but out of the shoreline zone were also removed. The applicant also removed other vegetation including grasses and bushes - most likely blackberries. At the time of inspection, large areas of bare ground had been exposed, thus triggering the requirement for a land altering permit for vegetation removal. Agencies With Jurisdiction: Department of Ecology. Comments to SEPA Checklist: Page 3. No. 11: Trees were removed without City inspection. No determination was made that the trees were hazardous. Page 4. No. 1 b: Steep river bank scopes bank exceed 3%. • Page 8, No. 4b: Attachment shows 4 trees within the shoreline as being removed. Subsequent submittal by applicant shows 8 trees as being removed. Based aerial photographs, there may have actually been about fifteen trees removed. Applicant has also indicated that blackberry bushes used to be on site - thus implying they have been removed. On site visit, large portion of site was bare to ground. Grasses were either dug up or trampled. Page 9. No. 4d: Tree permit will required replacement trees based on number of trees removed or based on canopy coverage method - to be determined with permit review. Either way, the number will far exceed six trees. Page 18 - 21: Not a non -project action. Summary of Primary Impacts: The primary impacts are related to environmental value (such as habitat and biological value) along the riparian corridor and aesthetic value. Summary of Proposed Mitigation: The City has adopted tree replacement standards (Chapter 18.54 TMC) for trees removed within a shoreline zone. New regulations become effective on July 10, 1996 which will affect those applications if you do not complete them before that date. The changes would result in a requirement that you provide mailing labels for residents and owners within 500 feet of the site (currently it is 300 feet), provide a 4' x 4' board with a notice of application on the site, and could require additional plans and information to be submitted to meet the standards for a complete application. If you do not meet this deadline, you will need to obtain new application forms from the City which identify the information necessary for a complete application.
