Memorandum TO: Jack Pace FROM: John Jimerson RE: SEPA - Temporary 1/1/e'Storage DATE: April 25, 1995 Project File No. E95-0007 Project Description: The property is located at 10160 West Marginal Place South. The proposal is to use a 2.2 acre site for the storage and maintenance of cargo containers. The previous use was as a parking lot for Boeing. A site plan showing the containers stacked four deep on either side of a 60 foot center aisle has been submitted. Agencies With Jurisdiction: None. Comments to SEPA Checklist: Page 3, No. 12: The project site is located at 10160 West Marginal Place South. Page 5, No. 2: Emissions will be generated from the trucks delivering and retreiving cargo containers to and from the site. Page 13, No. 10: The cargo containers would be stored two high for a total of 17 feet. Summary of Primary Impacts: The proposed use will not generate significant impacts different from the previous use of the site as a parking lot, except that the use will result in unsightly storage of cargo containers. Summary of Proposed Mitigation: There is no mitigation proposed by the applicant. However, compliance with the zoning code height limitation of 20 feet on outdoor storage (18.50.020 TMC) and requirement for screening of outdoor storage (18.52.040 TMC), the aesthetic impacts will be adequately mitigated. Recommended Threshold Determination: Determination of Non -Significance. • • To: Linda Cohen From: Steve Lancaster Subject: Rhone-Poulenc Agreement Date: March 15, 1995 As I mentioned to you yesterday, item #3 of the memo I sent you on March 13 relating to the Rhone-Poulenc agreement, should be modified to read as follows: 3. Beyond 100 feet away from the East Marginal Way property line, outdoor storage of shipping containers may occur up to a height not to exceed 42.5 feet for a period not to exceed five years, provided that all applicable requirements of the King County Shoreline Master Plan, including but not limited to height limitations, are met. In the event that the City of Tukwila has not amended its outdoor storage height limitations by the end of this five year period, the parties agree to re -open discussions in an attempt to achieve a long-term agreement regarding outdoor storage on the subject property. Thanks for your assistance. • To: Linda Cohen From: Steve Lancaster Subject: Rhone-Poulenc Agreement Date: March 13, 1995 The following is the substance of the proposed agreement with Rhone-Poulenc. Thank you for your assistance in putting this in proper format. As we discussed last week, I am particularly concerned that the agreement make clear the reasons for this agreement, and why this property must be treated differently from others similarly situated. I have underlined substantive changes from the points laid out in John McFarland's letter to Rhone- Poulenc, dated February 16, 1995. 1. There shall be no outdoor storage located nearer than 25 feet from the East Marginal Way property line. 2. Between 25 feet and 100 feet away from the East Marginal Way property line, outdoor storage shall not exceed 20 feet in height. 3. Between 100 feet and 500 feet away from the East Marginal Way property line, outdoor storage of shipping containers may occur up to a height not to exceed 42.5 feet for a period not to exceed five years. In the event that the City of Tukwila has not amended its outdoor storage height li 'tations by the end of this five year period. the parties agree to re -open discussions in an attempt to achieve a long-term agreement regarding outdoor storage on the subject property. 4. All other outdoor storage shall strictly comply with the requirements of the Tukwila City Code, including screening requirements, as currently constituted or as amended in the future. 5. Landscaping and screening within the twenty-five (25) foot setback along East Marginal Way shall meet and exceed the requirements of the Tukwila Municipal Code. Landscaping shall be designed, installed and maintained so as to reduce the adverse visual impact of the proposed outdoor storage, to the satisfaction of the Director of Community Development. Criteria to be considered by the Director shall be as follows: a. A landscape plan reflecting all applicable requirements shall be prepared and stamped by a Washington State licensed landscape architect. In the event of conflict between the landscaping and screening criteria cited herein. and the landscaping and screening requirements of the Tukwila Municipal Code. the more stringent requirements shall apply b. The entire setback area adjacent to East Marginal Way. with the exception of an approved access drive. shall be landscaped in a manner that shall achieve ninety (90) percent live ground coverage within three years of planting. • • p. Outdoor storage shall be screened from East Marginal Way. Screening in this area shall be a minimum of twelve (I2) feet in height at the time of planting, d. The landscaped setback area shall be served by an automatic irrigation system incorporating soil moisture sensors. e. There shall be no fence located within the twenty-five (25) foot setback along East Marginal Way. All other landscaping and screening shall comply with the requirements of the Tukwila Municipal Code. 6. A maintenance assurance device meeting the requirements of the Director of Community Development shall be provided to the City. assuring that all landscaping remains healthy for a period of one year from completion of planting. Please note that Rhone-Poulenc has also requested that the 42.5 foot height allowance be extended to the entire property outside the 100 foot setback from East Marginal Way, and a 200 foot setback from the Duwamish River. An environmental impact statement (EIS) must be prepared for all proposals with probable significant adverse impacts on the quality of the environment. The purpose of this checklist is to provide information to help you and the agency identify impacts from your proposal (and to reduce or avoid impacts from the proposal, if it can be done) and to help the agency decide whether. an EIS is required. Instruction for Applicants: This environmental checklist .asks you to describe some basic information about your proposal. The City uses this checklist to determine whether the environmental impacts of your proposal are significant, requiring preparation of an EIS. Answer the questions briefly, with the most precise information known, or give the best description you can. You must answer each question accurately and carefully, to the best of your knowledge. In most cases, you should be able to answer the questions from your own observations or project plans without the need to hire experts. If you really do not know the answer, or if a question does not apply to your proposal, write "do not know" or "does not apply". Complete answers to the questions now may avoid unnecessary delays later. Some questions ask about governmental regulations, such as zoning, shoreline, and landmark designations. Answer these questions if you can. If you have problems, the City staff can assist you. The checklist questions apply to all parts of your proposal, even if you plan to do them over a period of time or on different parcels of land. Attached any additional information that will help describe your proposal or its environmental effects. The City may ask you to explain your answers or provide additional information reasonably related to determining if there may be significant adverse impact.
