TUKWILA, WA 98188 MITIGATION AGREEMENT THIS AGREEMENT is entered as of this 6rh& €1 c JJ & _ ,1996 by and between the City of Tukwila (the "city") and Dr. Alvin Pearl, ("owner"). • u Recitals 1. Owner is the owner of the real property located at 401/405 Baker Blvd, Tukwila, Washington and legally described on Exhibit A hereto (the "Property"). Owner desires to improve the Property with building improvements, a parking area, and related improvements, substantially in accord with a site plan, application and environmental checklist submitted November 2, 1995 (the "Project"). 2. The City has adopted a Sensitive Area Ordinance, TMC 18.45, et. seq. (the "SAO"). The SAO regulates, among other things, the development and improvement of wetland property. The Property contains a Type 3 wetland area of 4,480 square feet (the "Wetland") which the City contends is subject to the regulation of the SAO. 3. The City has advised the Owner that he may not fill or otherwise disturb any part of the Wetland without providing mitigation as required under the SAO. 4. The City has agreed that the Owner will have met the mitigation requirements of the SAO by the payment of the cost of on-site mitigation at the Property to the City, for its use in creating, enhancing, or restoring wetlands on City -owned or managed property. The parties now wish to reduce their agreement to writing. Agreement 1. Recitals. The Recitals set forth above are hereby incorporated by reference herein. 2. Mitigation Payment. Owner agrees to pay to the City a sum calculated as set forth herein (the "Mitigation Payment") for the purpose of creating, enhancing, or restoring wetlands and wetland buffer areas away from the Property, in place of and in full 07) satisfaction of all mitigation requirements, including without limitation any requirement of on-site mitigation and the development of a mitigation plan, set forth in the SAO or in any other City ordinance or regulation concerning the development or disturbance of wetland or other sensitive areas on the Property. (a) Calculation of Payment. The Mitigation Payment shall be in the amount of 1.5 times the cost of replacing the existing vegetation in that portion of the Wetland to be developed with substantially similar vegetation, plus the cost of excavation which would be required to create a replacement wetland in area 1.5 times the wetland area to be filled at the Property. For the purposes of this Agreement, the parties have agreed that the cost of replacement vegetation is $.30 per square foot, the cost of excavation is $3.50 per cubic yard, and the excavation of 250 cubic yards would be required to meet the terms of this Agreement, all as set out in the memorandum of Gary Schulz, Urban Environmentalist, dated February 22, 1996, and attached hereto as Exhibit B (the "Mitigation Report"). The total cost is $2,891.00. Page 2 (b) Time of Payment. The Mitigation Payment shall be due to the City on or before the date of issuance to Owner of the final permit for the development of the Wetland. 3. Use of Mitigation Payment. The City agrees to use the Mitigation Payment for the creation, enhancement, or restoration of wetland areas within the same watershed as the Property on City -owned or managed property. 4. Improvement Right. In return for the Mitigation Payment, the Owner, its successors, and assigns shall have the right to develop the wetland as necessary or desirable to complete the Project; provided that any such development shall be undertaken in accordance with all other applicable laws and regulations. 5. Voluntary Agreement. This Agreement is entered into voluntarily by the City and by Owner. 6. Miscellaneous. (a) Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of Washington. (b) Entire Agreement. This Agreement constitutes the entire Agreement between the parties and cannot be changed or modified other than by a written agreement executed by both parties. (c) Counterparts. This Agreement may be executed in more than one counterpart, each of which shall be deemed an original. (d) Attorney's Fees. ExHiGIT Ea John W. Rants, Mayor Steve Lancaster, Director During the SEPA review of the project's proposal to construct a new parking lot, a small wetland area was identified. The wetland is dominated by emergent wetland vegetation, Agrostis/Juncus species, and surrounded by Himalayan blackberry (Rubus discolor).. Talasea Consultants have recently delineated the wetland area. The land survey of the boundary has determined the wetland size to be 4,480 square feet (0.1 acres). The wetland hydrology is surface water runoff that was impounded within an old fill area between existing buildings. Most of the influencing surface water was likely a result of uncontrolled runoff from an adjacent building's rooftop connected with the project. The old fill material does not allow the water to freely drain and over time wetland conditions have formed. The subject wetland is rated a Type 3. Because of small size and limited habitat, this wetland is considered to have very low functions. Although not intentionally created, this area would be an artificial Wetland. The current Sensitive Areas Ordinance (SAO) does not provide a clear process to exempt wetlands that were unintentionally created by man -caused activities. Therefore, because of the uniqueness of this situation combined with low wetland function, the City will consider accepting a wetland mitigation payment in lieu of creating a new wetland area prior to permitting this project. The City will use the mitigation payment to help create, enhance, or restore wetlands as soon as feasible as possible and preferably in 1996. The wetland payment was calculated to be $2,891.00 using $ .30/square foot for wetland vegetation and $ 3.50/cubic yard for excavating and hauling of 250 cubic yards of material. During the SEPA review of the project's proposal to construct a new parking lot, a small wetland area was identified. The wetland is dominated by emergent wetland vegetation, Agrostis/Juncus species, and surrounded by Himalayan blackberry (Rubus discolor). Talasea Consultants have recently delineated the wetland area. The land survey of the boundary has determined the wetland size to be 4,480 square feet (0.1 acres). The wetland hydrology is surface water runoff that was impounded within an old fill area between existing buildings. Most of the influencing surface water was likely a result of uncontrolled runoff from an adjacent building's rooftop connected with the project. The old fill material does not allow the water to freely drain and over time wetland conditions have formed. The subject wetland is rated a Type 3. Because of small size and limited habitat, this wetland is considered to have very low functions. Although not intentionally created, this area would be an artificial wetland. The current Sensitive Areas Ordinance (SAO) does not provide a'clear process to exempt wetlands that were unintentionally created by man -caused activities. In accordance with the SAO, Type 3 wetlands may be filled if appropriate mitigation to replace area and function is planned. The mitigation requirement of replacing wetland area at a 1.5 to 1.0 ratio cannot be achieved on the project property. Therefore, because of the uniqueness of this situation combined with low wetland function, the City will consider accepting a wetland mitigation payment in lieu of creating a new wetland area prior to permitting this project. Land Values Land values for the area are highest for retailing uses at $14 per square foot and then decline to values of $7 and $8 per square foot as one travels south, away from retailing centers to predominantly industrial uses. (Please see the map following the Plat Map.) It thus appears that industrial land, i.e. land used for industrial purposes, is based on an -$8/SF foot value. New development of industrial properties has historically relied on relatively inexpensive land due to relative low rents paid on these properties. Very little new industrial development is going on in the immediate area. I feel that this is due to the Boeing downturn and the relatively high land prices in the Southcenter area. For industrial use, the subject's current use, no user would pay the $10/SF assessed value, nor $8/SF or $6 if it was designed as a speculative building to be leased to third -parties. Industrial rental rates will not support new development with land that is this expensive. The undeveloped portion had been previously filled. Apparently due to a combination of poor grading of the fill material and the dumping of water from roof down spouts into the area, a wetland has developed. This wetland is apparently larger than the 1000 square foot exemption in the Zoning Code (Ch 18.45). For a variety of reasons I have concluded (preliminarily) that there is no exemption available for the mitigation requirements of the Code in this instance. However, mitigation on-site would apparently be quite difficult and would probably make the expansion of the parking lot impractical. I am therefor proposing that we allow the property owner to pay a mitigation fee that would be sufficient to re-create at another site the wetland values lost to his project (at the Code -required ratio of 1.5:1). This approach was attempted several years ago for a NC Machinery project, but was abandoned due to the Corps of Engineers stepping in and taking jurisdiction (it was a much larger wetland fill proposal, and Corps involvement in the Pearl case is not likely). The NC case got to the point where there was a draft mitigation agreement that had apparently met with Mike Kenyon's approval. I have taken that previous draft agreement and modified it slightly to fit the current situation, for your consideration. A Copy is attached. I have also attached a copy of the last draft version of the NC agreement, along with Mike's (final?) comments. Please review these at your earliest convenience. We have been struggling with this situation for a while, and the applicant is getting understandably impatient. Since you were out this week, and in the interest of time, I have also provided a copy of my draft agreement to the applicant's representative (broker) Mr. Al Robertson. He was going to have Mr. Pearl and presumably his attorney review and comment. I hope this is OK. I have also asked PEARL2.DOC Gary Schulz to start working with Mr. Pearl's consultants to determine the appropriate fee. Finally, I have spoken with Ron Cameron about the appropriate use of any funds received to enhance wetlands associated with city projects, and he assures me there are good opportunities available. The project proposes to convert the existing 14,760 sq. ft. light industrial building into a retail facility. The 17,400 sq. ft. office warehouse building, to the west of the proposed conversion building, will not change use at this time. We have visited the project site and surrounding street network, and have prepared this study per our telephone conversation with Mr. Ron Cameron, P.E., City Engineer of Tukwila. This report provides a trip generation distribution and pro rata share contributions to identified City of Tukwila street projects. The conclusions and recommendations begin on page 4 of this report. PROJECT DESCRIPTION Figure 1 is a vicinity map showing the location of the site and the surrounding street network. Figure 2 shows a preliminary site plan received by TP&E, Inc. The plan shows existing building structures with the 14,760 sq. ft. easternmost light industrial building to be converted to retail use. There will be 73 parking stalls including two handicap stalls. Currently the site has four driveways onto Baker Boulevard with the proposed use conversion one of the center driveways will be removed. Curb, gutter and sidewalk exists along the 405 building site's frontage to Baker Boulevard. TRIP GENERATION AND DISTRIBUTION The retail project is expected to generate the vehicular trips during an average weekday and during the AM and PM street traffic peak hours as shown on Table 1. The noon peak hour trip generation (not shown on Table 1) is expected to be approximately 5% to 20% higher depending on location than in the PM peak hour based on existing traffic volume patterns. For analysis purposes we have assumed that the noon peak hour is 10% higher than during the PM peak hour. Therefore, 11 net new noon peak hour trips are projected to occur, one more trip than during the PM peak hour. The trip generation is calculated using the average trip rates in the Institute of Transportation Engineers (ITE) Trip Generation, Fifth Edition, 1991, for Shopping Center (ITE Land Use Code 820) and Light Industrial (ITE Land Use Code .110). The trip generation for the new retail development was estimated using the rate for a center with over 1.6 million square feet. The reason for using the higher square footage is because of the project site's close proximity to the substantia I amount of retail activity associated with Southcenter Mall and surrounding environs. A vehicle trip is defined as a single or one direction vehicle movement with either the origin or destination (exiting or entering) inside the study site. These trip generation values account for all site trips made by all vehicles for all purposes, including employee, customer, visitor, recreation, and service and delivery vehicle trips. A pass -by trip is an existing trip that comes directly from the traffic flow on a road adjacent to the project site, and does not require a diversion from another roadway. A diverted linked trip does require a diversion from another roadway. Both of these types trips can be deducted from the total primary trips because they are not new to the street network. Based on pass -by and diverted linked trip percentages found in Section VII of Trip Generation and previous traffic studies, we estimate that approximately 35% of the site -generated trips can be classified as pass-by/diverted linked trips. The net new project trips were calculated by subtracting the pass-by/diverted linked trips from the total driveway volumes for the proposed project and the trip generation from the existing warehouse building. The distribution is based on the characteristics of the street network, existing traffic volume patterns, the location of likely trip origins and destinations (residential, employment, shopping, social and recreational opportunities), expected travel times, and previous traffic studies. TRAFFIC IMPACT MITIGATION REQUIREMENTS The City has indicated that they are collecting contributions for several intersection improvement projects throughout the City. The developer should offer to pay contributions for those intersections which are expected to be impacted by net new noon peak hour project trips. According to our trip generation analysis the net new noon peak hour trips generated by the project is 11. Therefore, the following intersections and their associated cost per noon peak hour trip are listed in Table 2. CONCLUSIONS AND RECOMMENDATIONS We recommend that the Pearl Building project be constructed as shown on the site plan with the following traffic mitigation: Offer to contribute $3,433.00 for proposed City road improvement projects as identified on Table 2 of this report. The City of Tukwila has adopted the 1991 Uniform Fire Code. This and other nationally recognized standards will be used during construction and operation of this project. (TMC 16.16.120) [_ej 2. Fire hydrants will be required. (City Ord. #1626) X.1 3. Required fire hydrants shall beapproved for location by the Fire Department, approved for purity by the Water Department, and fully in service prior to start of construction. Automatic fire sprinklers, audible and visual devices, and a minimum of one pull station per floor are required for this project. Sprinkler plans shall be submitted to Washington State Surveying and Rating Bureau, Factory Mutual or Industrial Risk Insurers for approval prior to being submitted to Tukwila Fire Marshal for approval. Doors: Doors should have quality locking mechanisms with minimum one inch deadbolt locks. All exit doors shall be operable from the interior without the use of a key or any special knowledge or effort. The Crime Prevention Unit should be contacted for information regarding correct hardware usage at 242-8408. Security Alarm: Recommend installing a security alarm system during construction that would report a burglary in progress when the business is closed. 3. Windows: Consideration should be given to providing hardened coverings (suchas security film, etc.) for ground level windows where glass breakage would allow for access to building interiors by burglars. 4. Orientation of Windows: Windows should be located so that the parking lot area can be easily surveyed by employees inside the business. 5. , Graffiti Prevention Program: It is important to win the war against the graffiti "artist" and keep your building attractive for customers. New non-stick anti -graffiti water-based or wax like coatings are now available to make an effective barrier against graffiti or other potentially staining substances. Contact the crime prevention unit. Landscaping: Plant materials should be placed and maintained so to provide visibility and prohibit hiding places for unauthorized people around ground level door and window areas. Sticker shrubs may discourage crime activities. Low shrubs and umbrella trees (where the canopy is maintained above five(5) feet from the ground) will allow surveillance opportunities, hence reducing the potential for criminal behavior. Lighting: Energy efficient security lighting is a relatively low-cost, yet extremely effective way to protect your business. By providing sufficient lighting in the parking lot and around your building you will discourage burglars and vandals who don't like light, preferring the cover of darkness for their dirty work. Also the lighting will provide a legitimate sense of security for not only you, but your employees and customers. 8. Identity: Addresses for each individual business should be visible upon entering the.area, both in daylight and during darkness.
