Mayor Bauch, presiding, called the regular meeting of the Tukwila City
Council to order.

MOVED BY HILL, SECONDED BY SAUL, THAT THE VOUCHERS BE ACCEPTED AND
WARRANTS BE DRAWN IN THEIR RESPECTIVE AMOUNTS.
Councilman Traynor questioned the payment of a voucher submitted for
glasses; are they sunglasses or corrective glasses? Mayor Bauch stated
that he was unable to contact the employee for information but noted
that the invoice is dated prior to the Administrative Policy recently
issued. Based on the uncertainty, Councilman Traynor stated that he
could not vote for payment of the vouchers. Councilman Saul noted
that the Police Contract states that the employer will pay for glasses
for all employees. He wondered if the Policy supersedes the contract?
Mayor Bauch explained that it does not supersede but helps interpret it.

M I N U T E S Council Chambers
Mayor Bauch recognized, for the record, receipt of Summons NO. 834146;
Argonaut Insurance Company, a California corporation, vs. City of
Tukwila, a Washington municipal corporation. Summons has to do with
the bond issued to Shaeffer Construction for work on the Andover Park
West Lift Station in 1973.
Mayor Bauch referred to a letter dated September 9, 1977, from Dick
Williams, Office Engineer, stating that Electric Controls, Inc. had
completed the signalization project in conformance with the plans and
specifications and recommended acceptance.

Deputy City Attorney Hard read an ordinance establishing procedures for
review of projects inconsistent with the new Comprehensive Land Use Plan.

Councilman Van Dusen asked for clarification. When a land owner is
in an area on the comprehensive map that is inconsistent, who decides
whether it comes to Council?
Mayor Bauch stated that Section 3, Waiver Required, makes it clear.
Councilman Van Dusen asked about areas of constraint.
Kjell Stoknes, OCD Director, stated that there are shaded areas on the
environmental base map. If an applicant for a permit in these areas
can prove, through a professional, the property does not have the
constraint, it will not come before Council.
Councilman Van Dusen asked who will make the decision whether it comes
to Council or not?
Mr. Stoknes stated that his interpretation is that Council is passing
the authority on to the Mayor, and it is up to him to make the decision
himself or delegate it to one of his people.
Councilman Van Dusen stated that he feels Council cannot waive some
of its responsibility.
Councilman Hill agreed that he would like to see the decision on a
waiver come before Council.
Mayor Bauch stated that he does not interpret Section 3, paragraph 2
as allowing any leeway at all.

Kjell Stoknes asked for a clarification on the Ordinance. The way it
was adopted is that anything inconsistent with the Environmental Base
map would come before the Council. Everyone agreed that is what it says.

Councilman Gardner stated that the property where he lives is involved
and asked permission to leave the room during the voting.
Attorney Hard explained that the Doctrine of Necessity, in this case,
would cover any conflict of interest. The councilmen are all residents
of the City of Tukwila. If they don't make the decision, no one else
is capable of taking the action for them. There is no reason for any
one of the councilmembers to be excused.
Frank Todd, audience, commented that one councilmember had offered to
buy property from him. Does this disqualify him from voting? Mr. Todd
indicated the offer was made by Councilman Saul.
Attorney Hard explained the Appearance of Fairness Doctrine. Basically,
it says that if any council person feels they have had dealings with the
subject before them and have formed an opinion prior to the time testi-
mony is heard, they should excuse themselves from considering the sub-
ject. He cautioned Council that on each matter that comes before them,
they each must ask themselves (1) is there a financial interest
involved? (2) have I formed an opinion or actively participated, if so,
you should disqualify yourself. The Comprehensive Land Use Plan touches
all of you; you are all property owners; but, you have no choice; you
must take action on the ordinance.

Councilman Van Dusen asked what the procedure is under the Appearance of
Fairness Doctrine. Attorney Hard said he felt it was not necessary to
leave the room; it is sufficient to ask to be excused from the table and
indicate no opinion. There is no need for a vote of the other Council
Members, as they should not tell you if you have a conflict of interest;
that is up to each individual member to decide. When in doubt, ask to
be excused. He further stated he did not think Councilman Saul should
be excused.
Councilman Saul explained that the only time he even mentioned purchase
of property was in a public meeting while seated at the Council table.
Councilman Traynor stated that he bet enough reasons could be found
to vacate the whole table.

Deputy City Attorney Hard read an ordinance adopting a new Comprehensive
Land Use Plan for the City and its defined planning area, pursuant to
R.C.W. 35A.63.061, and repealing the existing Comprehensive Plan as
adopted by Ordinances 347, 484, and 768.
Kjell Stoknes suggested waiting until Fred Satterstrom, Associate
Planner, arrived with the revised map.

8F ON THE AGENDA FOR THE PURPOSE OF WAITING TO REVIEW THE COMPREHENSIVE

Deputy City Attorney Hard read an ordinance providing for the appropria-
tion and transfer of funds to adjust for certain unanticipated expenses,
to close the Park Trust Fund, and amend the 1977 Budget Ordinance #1002.

AS READ. MOTION CARRIED.
Councilman Traynor requested the location of the property under
consideration be identified for the benefit of the audience.

Deputy City Attorney Hard read an ordinance reclassifying certain
property located on the west side of Southcenter Parkway approximately
1,100 feet south of Strander Boulevard from R -1 zoning classification
to C -2 zoning classification within the City of Tukwila.

Deputy City Attorney Hard read an ordinance extending the loan period
on L.I.D. #28 and amending Section 2 of Ordinance No. 1003.

Attorney Hard stated that the extension of time is necessary because of
two problems: right -of -way acquisition and the lawsuit that is pending.

Fred Satterstrom arrived and placed the map on display for Council
review.

Councilman Pesicka called attention to an article in the September
Nation's Cities Magazine titled "New Construction and Abandonment:
Musical Chairs in the Housing Stock." She stated that the government is
getting alarmed over the development of apartments in suburban areas,
and they are considering ways to try and stop it. We are not in as bad
a position as people would like us to believe when we have tried to cut
down on the growth of apartments in our area.
Councilman Van Dusen stated that there are certain sections of this map
that he doesn't like; there are sections that other Councilmen don't like
but Council has spent a lot of time on it and has compromised so he is
going to vote for it.
Councilman Hill stated that the map doesn't live up to promises that were
made and that was 'to be fair to everybody.' There are certain
inequalities. The blue along Interurban belongs to Puget Power, and we
can't tell them they have to make it into a public facility. The City
doesn't need heavy industry. The M -1 can handle anything we need. Also,
he questioned the property lying east of the railroad tracks as it does
not show on the map. He was told the property is designated Light
Industry.
Councilman Traynor stated that there were things he didn't like about the
map either. It is difficult for seven people to compromise enough to
get something as big as this done. He would like to see the M -1 and
M -2 left off completely and make Industrial Parks. This would have
given enough control along Interurban to keep the warehouses off the
property lines. This is my compromise; I just hope we will have enough
guidelines in the M -1 to stop this type of development. This is a
compromise of seven people.
Councilman Gardner again stated he would like to leave the room while
Council votes on the Comprehensive Land Use Plan.
Councilman Saul stated that he is happy tonight has arrived and Council
can vote on this. There has been a compromise; each one of us had to
decide if it was fair. If we need to make a change after a couple of
years, there is nothing wrong with that. This is a big step in the right
direction.

Deputy City Attorney Hard read a resolution relating to a joint project
funds application with King County and other consortium cities for a
"Weatherization Program" under the Housing and Community Development
Block Grant Program in Program Year 4.

We now have the Quit Claim Deed to the new McMicken Heights Park
property.
The construction of City Hall is progressing on schedule. The
contractor should start pouring the first foundation tomorrow.
Noise Survey Councilman Van Dusen asked Council to allow time now for him to
present the results of his noise survey.

Councilman Saul asked how the $15,000 was arrived at. Mayor Bauch
explained that it was about 7 percent of the total interior decorations.
The employing of a Public Works Director has taken a setback. The first
two candidates had personal problems arise so neither is able to come
to work at this time.
The City is gathering data on the position of Finance Director. The
job descriptions we have received are quite varied. This position was
not budgeted in the 1977 budget.
Councilman Saul asked about Bluff Street. Mr. Stoknes reminded Council
that a representative of Dames and Moore will report on this at the
Committee of the Whole Meeting of September 26, 1977.
Councilman Traynor asked about the asphalting of 59th Avenue and was
told that the contractor should be laying the crushed rock any day.
He is working under an October 15 penalty clause.
Councilman Saul read the report submitted by Mabel J. Harris, City
Treasurer.

Noise Survey
Cont.
ADJOURNMENT
Councilman Van Dusen reported on the results of the noise survey
mailed out by the Public Safety Committee. Two hundred thirteen
surveys were received back for a 14.2 percent response. This is one
of the best results the City has had on a survey to the citizens. Of
the people that responded, 45.07 percent live in single family
residence and 52.1 percent live in apartments. Under Part C "Which
of the following comes closest to summing up your present attitude
toward noise in general the majority answered "Noise bothers me and
others, and I believe it can and should be reduced." Under Part B
"Noise sources which affect you," The top five were large aircraft,
automobiles, motorcycles, trucks and music.
Councilman Van Dusen asked Council if they want to follow through on
this and commented that it is going to be as tough a job as the
Comprehensive Plan. He suggested an Ad Hoc Committee made up of
citizens,administration and Council. There are certain things that
can be done on a local level to help some of these problems.
Councilman Traynor asked Chief Crawley about the results of the Fire
Department survey. The Chief stated he had good response and would
be back to Council with the results.
