Dwight R. Gardner, George D. Hill, Phyllis D. Pesicka, Daniel J. Saul, Dwayne D. Traynor, Lionel Bohrer. MOVED BY HILL, SECONDED BY TRAYNOR, THAT COUNCILMAN VAN DUSEN BE EXCUSED FROM THE MEETING. MINUTE APPROVAL MOVED BY HILL, SECONDED BY TRAYNOR, THAT THE MINUTES OF THE REGULAR MEETING OF SEPTEMBER 19, 1977, BE APPROVED AS PUBLISHED. MOTION CARRIED. VOUCHER APPROVAL MOVED BY HILL, SECONDED BY TRAYNOR, THAT THE VOUCHERS BE ACCEPTED AND WARRANTS BE DRAWN IN THEIR RESPECTIVE AMOUNTS. BID OPENINGS AND AWARDS Councilman Hill asked for clarification of the following vouchers: Voucher #3776 shows there was $900 damage to a police car. John McFarland Administrative Assistant, explained that the accident involved a cow that was loose on an unlighted stretch of road on South 196th. The insurance company is trying to recoup the repair costs from the owner of the cow since the livestock was at large on the freeway. Voucher #3777 is for 14 sheets of plywood for the Fire Department. It was explained that the Fire Show is coming up and these are probably for the booths. Voucher #3880 is $500 for taking down a tree and removing dead wood. Councilman Hill said he saw a private vehicle loading some of the wood and felt it should be left in the park to be used by the citizens. Voucher #3864 is $959 to U.R.S. Company for an LID on a sewer project. Mayor Bauch stated this is for LID #28. Voucher #3843 is for an electric bill to replace fuses in a Puget Power transformer box. Councilman Hill wondered why we are replacing fuses. Voucher #3837 for a water truck for washing the street. Why didn't the City use the street sweeper? Mayor Bauch noted that just part of it was street cleaning, the rest was for flushing manholes. Mayor Bauch stated he would check on these vouchers. MOTION CARRIED. Current Fund Street Fund Fed. Seven bids were received by General the City and opened at 2:00 P.M., October 3, 1977. MOTION CARRIED. Interest Cost 973,800.00 979,865.00 988,800.00 989,597.50 994,282.50 996,142.50 1,006,356.25 Interest Rate 5.160572% 5.192713% 5.2400% 5.24428% 5.2691% 5.278975% 5.333% The letter recommended that the City Council accept the par bid of Foster Marshall, Inc. at an average interest cost of 5.160572 percent. It was explained that Foster Marshall, Inc., has been the advisor to the City on this bond sale. They set up the official notices. MOVED BY HILL, SECONDED BY TRAYNOR, THAT THE BID FOR THE SALE OF THE LIMITED GENERAL OBLIGATION BONDS BE AWARDED TO FOSTER AND MARSHALL FOR 5.160572 PERCENT. MOTION CARRIED. Letter from Hubert H. Crawley, Fire Chief, was read stating that bids were opened at 4:00 P.M. on September 30, 1977, and recommending accep- tance of the bid from Western Salvage Company, 6901 East Marginal Way South, Seattle, in the amount of $1,010. Councilman Hill requested that, after this, letters of recommendation note the number of bids that were received. In this case, there was only the one. MOVED BY HILL, SECONDED BY MRS. PESICKA, THAT COUNCIL ACCEPT THE BID OF $1,010 FROM WESTERN SALVAGE COMPANY AS RECOMMENDED BY CHIEF CRAWLEY. Councilman Traynor commented that he hopes they won't be back in the near future with a request for a new ladder truck. Mayor Bauch noted that the Chief's letter recommending surplusing this truck stated they had no foreseeable use for this vehicle. Kjell Stoknes, OCD Director, introduced Lynn Devoir who has just been hired to fill the position of Recreation Specialist. MOVED BY HILL, SECONDED BY TRAYNOR, THAT THE AGENDA BE AMENDED TO INCLUDE THE RECEIPT OF A SUMMONS. MOTION CARRIED. Mayor Bauch recognized, for the record, receipt of a Summons; Teamsters Local Union No. 763 vs. City of Tukwila, Washington, and Edgar D. Bauch, Mayor, City of Tukwila. The summons states that a dispute has arisen under the labor agreement anc the Union has demanded arbitration of said dispute. The City has refused to submit the dispute to arbitration. Mayor Bauch noted that there is no explanation of what the dispute is. Mayor Bauch reminded Council that Carl Stixrood of the OCD Department completed a preliminary plan for the landscaping, but Mr. Stixrood is no longer with the City. The architect has indicated it is imperative that the plan be completed now so the contractor will know where to move the dirt. Councilman Hill stated he thought the Park Board was studying this: maybe we should wait for them to make a recommendation. Defining "Recreation Space" and providing standards and regulations DEPARTMENT REPORTS Mayor's Report Kjell Stoknes, OCD Director, stated that the Park Board did recommend the Annex building be turned into an observatory -type structure and that the pond be maintained. Their main comment was that they be involved in any changes that occur. He recommended asking the Park Board to the meeting when the landscaping is discussed so they can have some input. Councilman Traynor stated he thought Council had a consensus on how the landscaping should look. Mayor Bauch stated that now the final plan is needed so the City can go out for bids, and there is no one to do this. Tom Emrich, Mithun Associates, stated that they will provide input if it is desired. Councilman Traynor asked if there is enough information now for Council to hire an architect on an hourly basis. Tom Emrich stated that Council approved a general schematic plan for the landscaping. This represents the feelings of Council in very general terms about what the landscaping should be. It is a good tool for a landscape architect to work with but it needs further refinements and modifications to be more in line with what you have indicated. It needs to be documented in working drawings and specifications to put out for bid. He recommmended that Council hire a landscape architect to complete the project. Councilman Gardner said he thought it was important for the City to use a qualified landscape architect. MOVED BY TRAYNOR, SECONDED BY SAUL, THAT COUNCIL SEARCH FOR A LANDSCAPE ARCHITECT. MOTION CARRIED. Councilman Saul suggested the landscape architect be hired in the same manner as the architect for city hall. He thought they should be at the meeting on October 24, 1977. Tom Emrich distributed a letter illustrating the probable cost of developing the site exclusive of building, parking and pedestrian circulation. Mayor Bauch pointed out that review of the Tukwila Municipal Code after the last Committee of the Whole meeting indicates that a public hearing is required on this ordinance. MOVED BY TRAYNOR, SECONDED BY SAUL, THAT A PUBLIC HEARING BE HELD ON OCTOBER 17, 1977, ON THE PROPOSED ORDINANCE DEFINING "RECREATION SPACE" AND PROVIDING STANDARDS AND REGULATIONS. MOTION CARRIED. MOVED BY HILL, SECONDED BY SAUL, THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED. Deputy City Attorney Hard read an ordinance defining "Recreation Space" and providing standards and regulations for the provision of Recreation Space in all R -2, R -3, R -4 and RMH zone districts. MOVED BY HILL, SECONDED BY MRS. PESICKA, THAT THIS ITEM BE PLACED ON THE AGENDA FOR THE COMMITTEE OF THE WHOLE MEETING OF OCTOBER 10, 1977. MOTION CARRIED. Mayor Bauch made the following announcement: The City of Tukwila has been awarded a grant for the construction of the Christianson Trail in the amount of $20,272. This will cover paving of the bicycle path and trees for the divider. TUKWILA CITY COUNCIL REGULAR MEETING October 3, 1977 Page 4 DEPARTMENT REPORTS Cont. Mayor's Report HUD has approved the Block Grant for the Walkway Project so we can now Cont. proceed on this program Attorney's Report Tukwila Noise Program Claim for Damages filed by Steven Stine Salary and Wage Plan The advertisement for a Finance Director is in the newspaper. The closing date is November 1, 1977. The 8 surplus vehicles were sold at auction and the City received $7,350. There has been a lot of inquiry by citizens along 58th, 59th and South 149th as to the approach to their property when the overlay project is completed. Mayor Bauch stated that each house will be personally contacted to see what the problems are and to work them out. Attorney Hard reported that there have been two new lawsuits filed. The first one by Argonaut Insurance Company concerning the performance bond issued to Shaeffer Construction on construction of the Andover Park West Lift Station. The second is by Teamsters Local Union No. 763. It was noted that there is no cause number on the summons, and he will check to see if it has been filed. Attorney Hard explained that there was a hearing on the Fire Department lawsuit and the Judge ruled in favor of the Fire Fighters. The City must return to the Fire Fighters the City's portion of the Social Security refund and the City must negotiate with the Fire Fighters whether or not the City is obligated to make contributions in the same dollar amount as Social Security to a private annuity plan. He asked Council to call an Executive Session to discuss this matter further. MISCELLANEOUS AND FURTHER AUDIENCE COMMENTS Councilman Hill noted receipt of a memo from the Public Safety Committee regarding the Tukwila Noise Program. MOVED BY HILL, SECONDED BY TRAYNOR, THAT THE NOISE PROGRAM BE REFERRED TO THE COMMITTEE OF THE WHOLE MEETING OF OCTOBER 10, 1977. MOTION CARRIED. John McFarland, Administrative Assistant, reported on the Claim for Damages filed by Steven A. Stine on August 2, 1977. Mr. Stine was involved in an accident on South 180th Street. The insurance carrier, after investigations, found the City not responsible, and he recommended denial of the claim. MOVED BY HILL, SECONDED BY SAUL, THAT COUNCIL DENY THE CLAIM FOR DAMAGES FILED BY MR. STEVEN A. STINE. MOTION CARRIED. John McFarland reported that the Salary and Wage Plan is almost completed and will be ready to present to Council shortly. If it isn't completed in full, it will be at least the recommendation on how to move to the midpoint on the salary plan. This would be a combination of longevity and satisfactory job performance. Mayor Bauch stated that he hopes to have the recommendation to the Council by next Monday night. Community Affairs Councilman Traynor announced the Community Affairs Committee Meeting on Committee Meeting Wednesday, October 5, 1977, 5 P.M. at the Annex.
