who led the Pledge of Allegiance. He then called the regular meeting
of the Tukwila City Council to order.

Letter dated November 2, 1977, from Mayor Bauch was read appointing
Mrs. June Kitting, 14718 58th Ave. South to the Tukwila Park Commission
The appointment is to Position No. 3which expires March 31, 1980.
MOVED BY HILL, SECONDED BY SAUL, THAT COUNCIL CONCUR WITH THE APPOINT-
MENT OF MRS. KITTING TO THE TUKWILA PARK COMMISSION. MOTION CARRIED.
This being the time and date advertised, Mayor Bauch noted that a
Public Hearing is required by law on the use of the population funds
available to the City through the Housing and Community Development
Act of 1974.
Kjell Stoknes, OCD Director, reported that approximately $14,700 in
"population" funds is available. There is also "needs" money to be
allocated to those projects which benefit the low /moderate income
families. The Planning Commission voted unanimously, at their regular
October meeting, that the following program be adopted by the City
Council:

Mayor Bauch declared the Public Hearing open. He called for comments
or questions from the audience. There being no comment, Mayor Bauch

COUNCILMEMBER PHYLLIS PESICKA ARRIVED AT THE MEETING.

Mayor Bauch read a letter from Congressmen Cunningham concerning the
proposed regulations for the HUD Block Grant Program. He is asking
for comments on these regulations and difficulties that cities have
had with the program so he can protest the proposed regulations.
Mayor Bauch stated that the new regulations would make it almost
impossible for any city in Washington State to apply for the funds
because of the population density in the low income areas.
Mrs. Rena Holloway commented that vines are growing out into the side-
walk area and wondered how this can be controlled. She stated that
there is a broken piece of cement on the sidewalk on South 144th
between 58th and 59th and felt it is a hazardous situation and should
be repaired.
Mayor Bauch introduced Mr. Pat Lowery, Crime Prevention Officer, who
explained the Crime Prevention Program and how successful it is. He
recognized two groups who have given a lot of time and effort to this
program. The first is the Senior Coordinating Group consisting of
Walt and Alice Frey and Ira Hyzer. The second group is Explorer Post
999. These young people have spent many, many hours on projects to
help provide additional safety for the citizens. He read a letter
from Slade Gorton, Attorney General, expressing pleasure at hearing
of the work of the Tukwila Explorer Post.
Mr. Lowery introduced Steve Robinson, Police Officer, who is the
leader of Post 999. Officer Robinson expressed the pleasure he has
had in working with the Explorers and thanked the entire Police
Department for their cooperation with this group.
Mayor Bauch expressed pride in Explorer Post 999 and presented each
member with a Certificate of Award for Outstanding Citizens of Tukwila.

Mayor Bauch declared a ten minute recess to have refreshments in honor
of the Explorers.
Mayor Bauch called the meeting back to order with Councilmembers
present as previously reported.
Mayor Bauch introduced Mrs. June Kitting, newly appointed member of the
Tukwila Park Commission.

Mayor Bauch recognized, for the record, receipt of Summons No. 836155,
Ann Lovell vs. the City of Tukwila; John McFarland and his wife;
Kjell Stoknes and his wife; John Doe and his wife; and John Roe and
his wife.
Mayor Bauch noted receipt of a Claim for Damages against the City in
a bankruptcy action involving Sleep World, Inc.
Councilman Hill referred to a letterrreceived dated October 27, 1977,
from Gerald E. Schneider requesting a waiver from the provisions of
Ordinance No. 1035.
Kjell Stoknes, OCD Director, explained that the site of this proposed
development is on 65th Avenue South between the Canyon Estates and
Maple Crest Apartment complexes. Mr. Stoknes explained that he cannot
give a report on this as he has not put one together. He asked
Council to determine procedures since this is the first waiver request
to Ordinance No. 1035. The alternatives are to have waivers come
before Council first, if a staff report is found necessary then it
goes back to them. If Council has enough information on this
application, they can pass it this evening.
Councilman Hill asked if a Building Permit has been applied for.
Mr. Stoknes noted that it has been applied for and they have a
negative declaration under the State Environmental Policy Act. The
requirements of Ordinance No. 1035 have been met.
Councilman Hill explained that the property is already zoned R -4 and
RMH which allows 43 units per acre. The proposed is for 48 units
or 21.6 per acre. He needs a waiver because this area is designated
R -3 on the Comprehensive Land Use Map.
MOVED BY VAN DUSEN, SECONDED BY SAUL, THAT THIS ITEM BE PLACED ON THE
AGENDA FOR THE COMMITTEE OF THE WHOLE MEETING AND SEE IF COUNCIL CAN
MAKE THE DECISION WITHOUT IT GOING BACK TO STAFF.
Councilman Saul asked how close the proposed buildings are to the top
of the slope. Mr. Stoknes stated that six feet is the minimum setback
required. Councilman Van Dusen requested that Staff present any infor-
mation they have. Mayor Bauch stated that staff would make a
preliminary staff report.
MOTION CARRIED.
Councilman Traynor requested that Council be given the section from
the Ordinance that makes a waiver necessary.
Letter dated October 31, 1977, from Mrs. Margarette Chumlea, Chairman
of Library for Tukwila Committee, was read. She is requesting the
Mayor and Council to allow the present City Hall, when vacated, to be
used for a library for the citizens.
Councilman Hill asked if this could be referred to the Park Commission.
Mayor Bauch asked Don Williams, Recreation Supervisor, to add this
to the Park Commission Agenda. He further stated that he intends to
hold Public Hearings on the use of the City Hall /Police Station site
before any money is spent.
Councilman Van Dusen read a letter he had written to the Mayor
requesting that staff be directed to furnish input on the Thorndyke
Community Center for the Park Board and City Council. He listed a
number of questions that need to be resolved.
Mayor Bauch asked Don Williams, Recreation Supervisor, to put this
on the Park Commission Agenda.

Mayor Bauch reported that he had contacted personnel from the Block
Grant Consortium and discussed this problem with them. They will
consider it further and report back.

Mayor Bauch read a memo from Dick Williams, Acting Public Works
Director. The cost to bring the side sewer stub to the property line
is estimated at $10,000. Mr. Williams suggests that a pump station
may be the most economical way to resolve the problem.
Councilman Hill stated that a pump station requires continuous
maintenance; he felt a one -time cost would be better.
Mrs. Burton Lutz asked if other lots they have along this street
would be able to connect?
Mayor Bauch commented that he is not accepting this report, it needs
further study.
Councilman Traynor stated that we have around 16 people in our
Maintenance Department and he felt it was unnecessary to hire a
contractor for something like this. We should do it oursleves.
Councilman Van Dusen asked about the City's liability. Attorney
Hard stated that we need to take a good look at this now and determine
what the responsibility of the City is. There are other issues
involved here.
Mayor Bauch asked the Pattons if they are currently having a problem
with their sewer system? Mrs. Patton commented that they had to
rebuild the sewer system so there is no problem.
MOVED BY HILL, SECONDED BY VAN DUSEN, THAT THIS ITEM BE REFERRED TO
THE COMMITTEE OF THE WHOLE MEETING OF NOVEMBER 11, 1977.
MOVED BY BOHRER, SECONDED BY MRS. PESICKA, THAT THE MOTION BE AMENDED
TO REQUIRE A REPORT FROM THE PUBLIC WORKS DEPARTMENT WHICH TELLS
WHERE THE SEWER STUB IS AND HOW TO CONNECT TO IT.
MOVED BY VAN DUSEN, SECONDED BY HILL, THAT THE MOTION BE FURTHER
AMENDED TO REQUIRE A LEGAL REPORT. MOTION CARRIED.
MOTION CARRIED ON THE AMENDMENT.

Councilman Hill reported that resumes had been received from three
landscape architects. He recommended that Council visit the site of
a project that each architect had done. After discussion, it was
decided to meet at City Hall and take the tour on Sunday at 10:00 a.m.

Fred Satterstrom, President of USTME, stated that his discussion
is not about all of Ordinance No. 1019 which adopted the Salary
Grades and Steps but only about the Step portion of this Ordinance.
He requested an Executive Session to discuss this matter with Council.
MOVED BY HILL, SECONDED BY MRS. PESICKA, THAT COUNCIL HOLD AN
EXECUTIVE SESSION TONIGHT WITH THE U.S.T.M.E. MEMBERS. MOTION
CARRIED.
Councilman Van Dusen reported that a local Fisherman had called
him and asked why Christensen Road can't be opened for Fishermen
during the season. They like to park their vehicles close to
the river so they can sit in them and still see their poles.
Mainly what they need is a place to get out of the weather.
Mr. Stoknes stated that there is nothing in the grant to put
shelters along the river. The action of Council was to close the
road to vehicles. He recommended that if Council wants to reconsider
they put it on the Park Commission agenda for discussion. Now
is the time to consider this, before the development of the road.
Councilman Saul stated he is not in favor of allowing vehicles
on the road, maybe a shelter would be feasible. Councilman
Pesicka asked if it would be possible to open a section of it for
the season. Mr. Stoknes stated that it is possible but he doesn't
recommend it. Councilman Traynor stated that he does not want the
road opened to traffic. He questioned how shelters could be
controlled.
Mayor Bauch stated that once the Christensen Trail is developed
they can not drive on it. There will be an asphalt road for
emergency vehicles only. The Fishermen now have access to the
local parking lots along the road but can not see their poles
from their cars. This is a valid use of the river and the
suggestions certainly should be explored. We should listen to the
Fishermen Organizations and see what their recommendations are.

Deputy City Attorney Hard read a resolution of the Tukwila City
Council stating the City's 1978 priorities as they relate to
Housing and Community Development Block Grant Applications pursuant
to the Housing Community Development Act of 1974.
MOVED BY HILL, SECONDED BY BOHRER, THAT RESOLUTION NO. 604 BE ADOPTED
AS READ.
Councilman Van Dusen asked if an elderly person qualifies for the
money how can they get the repair done? Gary Crutchfield, Planning
Associate, explained that this is the opportunity for low income
families to obtain up to $2,000 in assistance. This money can be
used to hire a contractor to do the work or do it yourself.
Councilman Van Dusen asked about the money being used to establish
an office area and employ a program operator rather than to
directly hire Teenagers. Has this been tried so we know it
will work? Don Williams explained that the program would function
as a liaison between employers and teenage youths seeking employment.
It has been tried in other areas and does work.

Councilman Van Dusen stated that $5,000 might fix up and paint a
wood -work shop area but not purchase much in the way of tools.

Joanne Davis, audience, stated that she hopes we won't forget
the youth in our McMicken Heights area. They should have the
same opportunities as those in the Southcentral School District.
Mr. Stoknes stated that the Park Commission will discuss how to
involve the McMicken Heights people more in the recreation
programs.

BE FORWARDED TO THE COMMITTEE OF THE WHOLE MEETING. MOTION CARRIED.
Mayor Bauch read a letter to Hubert Crawley, Fire Chief, concerning
a recertification program developed by Lieutenant Les Flue. The
letter states that "you and your Department can be proud of what
you are doing toward emergency medical care. Your Department
and Departments similar to yours are making Washington a leader
in Emergency Medical Care The letter was signed by Tom Torrell,
Training Coordinator for King County Emergency Medical Services.
The Budget is balanced and ready to go to the printer. Councilman
Hill asked to have the discussion on the scheduling of work
sessions on the agenda for the Committee of the Whole.
Mayor Bauch commented on the progress of City Hall and predicted
that the roof would be on by December 1.
Attorney Hard stated that a number of Claims have been filed
against the City this past month. He reported that the Kinney
vs Tukwila lawsuit is scheduled to start next week. The Fire
Fighter suit has been filed in the Court of Appeals. The second
issue, on manditory contributions, is being appealed. It could
be one to one and a half years before we have an answer to this.
The Law Firm has moved their office to the 39th floor of the
Seattle -First National Bank Building.

Attending the Executive Session on the Fire Fighter negotiations
were Mayor Bauch, all Council Members, Attorney Hard and John
McFarland.
Attending the Executive Session on the Kinney Lawsuit were Mayor
Bauch, all Council Members and Attorney Hard.
