HOW TO TESTIFY
When recognized by the Presiding Officer to address the Council, please go to the podium and state your
name and address clearly for the record. Please observe the basic rules of courtesy when speaking and limit
your comments to 5 minutes. The Council appreciates hearing from citizens and members of the public, and
may not be able to answer questions or respond during the meeting.
PUBLIC COMMENTS
Members of the public are given the opportunity to address the Council on items that are NOT included on
the agenda during PUBLIC COMMENTS. Please limit your comments to 5 minutes. If you have a
comment on an Agenda item, please wait until that item comes up for discussion to speak on that topic.
SPECIAL MEETINGS/EXECUTIVE SESSIONS
Special Meetings may be called at any time with proper public notice. Procedures followed are the same as
those used in Regular Council meetings.
Executive Sessions may be called to inform the Council of pending legal action, financial, or personnel
matters as prescribed by law. Executive Sessions are not open to the public.
PUBLIC HEARINGS
Public Hearings are required by law before the Council can take action on matters affecting the public
interest such as land -use laws, annexations, rezone requests, public safety issues, etc. Section 2.04.150 of the
Tukwila Municipal Code states the following guidelines for Public Hearings:
The proponent shall speak first and is allowed 15 minutes for a presentation.
2. The opponent is then allowed 15 minutes to make a presentation.
3. Each side is then allowed 5 minutes for rebuttal.
4. Members of the public who wish to address the Council may speak for 5 minutes each. No one may
speak a second time until everyone wishing to speak has spoken.
5. After each speaker has spoken, the Council may question the speaker. Each speaker can respond to the
question, but may not engage in further debate at that time.
6. After the Public Hearing is closed and during the Council meeting, the Council may choose to discuss
the issue among themselves, or defer the discussion to a future Council meeting, without further public
testimony. Council action may only be taken during Regular or Special Meetings.
COUNCIL MEETING SCHEDULE
No Council meetings are scheduled on the 5th Monday of the month unless prior public notification is given.
Regular Meetings - The Mayor, elected by the people to a four-year term, presides at all Regular Council
Meetings held on the 1 st and 3rd Mondays of each month at 7:00 p.m. and Special Meetings. Official
Council action in the form of formal motions, adopting of resolutions and passing of ordinances can
only be taken at Regular or Special Council meetings.
Committee of the Whole Meetings - Councilmembers are elected for a four-year term. The Council
President is elected by the Councilmembers to preside at all Committee of the Whole meetings for a
one-year term. Committee of the Whole meetings are held the 2nd and 4th Mondays at 7:00 p.m.
Issues discussed there are forwarded to Regular or Special Council meetings for official action.

SUBJECT: NEW APPOINTMENTS TO THE ARTS COMMISSION, EQUITY AND SOCIAL
JUSTICE COMMISSION AND THE PARK COMMISSION.
ISSUE
The Arts Commission, Equity and Social Justice Commission and Park Commission currently have
vacancies. I am recommending appointments as follows. A copy of the application for each applicant
is attached.
Arts Commission
Position #3: This position is currently vacant. I am recommending the appointment of Daniel
Humkey. Daniel previously served as the student representative on the Arts Commission until his
graduation from Foster High School. He is now attending the University of Washington and would
like to continue to work with the Arts Commission. The term for this position expires December 31,
2020.
Student Representative: This position is currently vacant. I am recommending the appointment of
Yuriko Rollins, a student at Foster High School. Yuriko is involved in visual and performing arts and
will be a valuable addition to the Arts Commission. The term for this position expires June 30, 2019.
Equity and Social Justice Commission
Position #2: This position is an education field position and is currently vacant. Per TMC 2.29.020
(B)(3) one of the education positions may be filled with a community representative. As we currently
have two positions representing the Tukwila School District and we received six applications for
vacant positions, none of whom were in the education field, I am recommending the appointment of
Jonathon Joseph to this position as a community representative. Jonathon resides in Tukwila, works
as an intern in the Department of Community Development and will make a valuable addition to the
Equity and Social Justice Commission. The term for this position expires December 31, 2017.
Position #4: This position is a City employee position and is currently vacant. I am recommending
the appointment of Nora Gierloff. Nora is the Deputy Director of the Department of Community
Development and her knowledge on housing issues will be beneficial to the Commission. The term
for this position expires on December 31, 2018.
Position #6: This position is a community position and is currently vacant. I am recommending the
appointment of Karl Henry. Karl is a self-employed business owner in the City of Tukwila and is very
excited to serve on the Equity and Social Justice Commission. The term for this position expires on
December 31, 2018.
Position #7: This position is a City employee position and is currently vacant. I am recommending
the appointment of Roy Busch. Roy has worked in the Sewer and Surface Water Division of the
Public Works Department for nine years and is interested in becoming more involved in Equity within
the City. The term for this position expires on December 31, 2017.

Position #6: This is a new position added to the Park Commission with the recent municipal code
updates. I am recommending the appointment of Scott Kruize to this position. Scott has served on
the Park Commission in the past and currently serves on the Library Advisory Board. The term for
this position expires December 31, 2019.

2017 Council Meeting.

I was heavily involved in student -led organizations at Foster High School, ranging from
The Growler Newspaper, Asian Student Association, stage crew/theater tech, Dawg
Squad Hip -Hop Dance Club, and National Honor Society. I served my class senior year
as vice president, working on class meetings, dance planning, and senior shirts, among
other items. I volunteered at the St. Thomas food bank from to 2011 to 2017, helping
repackage food and create monthly nutritional bags.
Hobbies/Interests:
I am a visual, graphic, and performing artist. I work with a variety of traditional mediums, including acrylic
paint, watercolor, and chalk pastel, along with my preferred medium of colored pencils. I also create
graphic media which can include advertisements, flyers, brochures, logo design, and shirt design. As a
performing artist I practice hip hop dance and have performed at various community events. I have also
taken up video and music editing in the past year.
Qualifications as related to this position:
I served on the Tukwila Arts Commission as student representative from January 2016 to June 2017. 1
am passionate about youth becoming engaged in the arts as a participant and as an audience member. I
have experience in working with high school students and creating effective communication with them. I
have seen the 'behind the scenes' work that goes into art events during my work with stage crew and
theater as well as the planning of art shows. As a former member of Foster High School's leadership
team and ASB I gained experience with event promotion and planning.

Professional/Community Activities (organizations, clubs, service groups, etc):
Currently I am a student at the University of Washington. I am completing a dual Masters
program and will graduate with both a Masters in Urban Planning and a Masters in Public
Health, with an emphasis on community oriented public health and policy. I currently serve
on the human services advisory board for the city of Tukwila. I volunteer with the Tukwila
food pantry and a local grassroots community organization called Action Tukwila. Regionally
I also serve on the board of sound discipline, a local non-profit that works with schools in
creating better learning environments for all students. My passion has been in community
development and I try to devote a portion of my time to helping this cause.
Professionally my background is in retail and banking. I ran multiple retail locations, which
included managing labor and sales trends. Attached is a copy of my resume for further
information. Additional reference information can be provided upon request.
Hobbies/Interests:
I have varied hobbies and interest... although to be honest, being in school has made
enjoying some of the hobbies a little more difficult. I like traveling, photography, swimming,
reading, watching TV and movies, hanging out with friends and family. I have started to
explore drawing and doodling and really find it a great way to relax.
My passion has always been community development so a significant portion of my time is
spent volunteering.
Qualifications as related to this position:
I believe my previous work as well as my current studies make me a good fit for this
commission. Recent studies show that the majority of the human population live in cities. Its
become apparent that the inequities present in many of our communities are a symptom of
planning policies that continue to propagate a system that disenfranchises many individuals.
I think we have done a good job of recognizing this problem as a city,however, now we must
look for solutions to dismantle said system. I believe my knowledge in urban planning and
public health would be value added to the group.
Other comments/additional information for consideration:
I am currently an intern with the Department of Community Development. This internship is
through January 2018, at which point my employment with the City of Tukwila will cease.

I served Tukwila's Parks Department as a volunteer Commissioner for five years, as Chair for
two. The other Commissioners shared my concern that all the residents of Tukwila --not just
members of this or that special interest or sports group --should get full benefit from our fine parks
system, and that we should improve and sustain it for posterity.
I belong to the Northwest Scale Modelers, which provides the Museum of Flight with
educational displays and material. I contribute to every quarterly special display to interest and
educate guests about important aviation -related history. I produced two recently, about WW2's
`Battle of the Atlantic', and `MiG Dynasty', explaining Russian airpower from 1941 to the
present day.
I've been with local church St. Thomas Parish since I moved here in 1988, supporting it
financially, with my computer expertise, and in seasonal drives for clothing and toys for less
privileged members. I also support Catholic Community Services, whose many programs serve
Tukwila residents, as well as others in the greater Seattle area.
Hobbies / Interests. -
Besides my work as computer consultant and instructor, I pursue various computer-related
functions and applications as a hobby. I ride bicycles for recreation. As noted above, I build
model airplanes (both tabletop `static display' and flying models), spacecraft, and other vehicles,
and tie these builds in with study of the history of technology.

As noted in the first section, I've served on the Parks Commission. My work career required
working on a wide variety of tasks with a wide variety of people: from customers at bike shops,
students at two community colleges, and a wide variety of computer users, from novices to
technological sophisticates, including medical providers and company owners and managers. I
established good working rapport with all, and with other Commissioners at our meetings. I feel I
can always work with others and serve the City of Tukwila and its citizens.
Increasingly, the library system and its resources are computerized and tied into the Internet.
My Information Technology experience and expertise would be useful to the Board and library
users, such as understanding how to find, draw in, and use data from a multitude of sources.
During the last two years, especially, I've been heavily dependent on library resources and
learned a lot about the system's capabilities, a few of its weaknesses, and its enormous potential
to help all its users.
Other comments / additional information for consideration;
Politically, I owe no economic entity or pressure group nor have excessive devotion to any
political party or philosophy. Ideologically, I stick close to the middle-of-the-road.
Economically, I'm neither wealthy nor poor, having had income near the median, and now being
near -retired. I understand and identify with the economic challenges that nearly all Tukwila's
citizens face in trying to live the good life. Intellectually, I have always sought to broaden my
knowledge and expertise, and in all my work, while I've never known all the answers, I've been
able to find them.

Issue
The City Council is required to conduct a public hearing for the emergency moratorium
ordinance 2543 that was adopted on July 17, 2017. After the public hearing, the Council may
want to adopt additional findings of fact. The moratorium prevents the development of new
hotels, motels, extended stay facilities or auto -oriented uses in the TIB study area for 6
months.
Background
The City kicked off its update of the TIB sub -area plan with the TIB Rising/Congress for New
Urbanism (CNU) community workshop. That workshop resulted in a CNU final report with
recommendations for revisions to permitted uses, building placement and heights, and a future
cross-section for TIB. Those preliminary recommendations are being analyzed and
incorporated into draft public review documents.
Discussion
The purpose of the moratorium is to prevent establishment of new uses that could potentially
become non -conforming or inconsistent with the adopted goals and policies for the TIB area.
Implementation of community goals and policies for the TIB study area started with the three-
day community workshop in February 2017 as noted above. Recommendations were
presented to the City Council on May 1, 2017. Studies of how to incorporate the
recommendations for the roadway and zoning code are underway with a Planning Commission
workshop scheduled for August 2017. The work plan for the study area is attached to the
moratorium ordinance.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, ADOPTING A 6 -MONTH MORATORIUM WITHIN THE
TUKWILA INTERNATIONAL BOULEVARD STUDY AREA IN THE CITY
OF TUKWILA ON THE DEVELOPMENT OF*CERTAIN USES SUCH AS
HOTELS, MOTELS, EXTENDED -STAY FACILITIES, OR AUTO -
ORIENTED USES; SETTING A DATE FOR A PUBLIC HEARING ON
THE MORATORIUM; PROVIDING FOR SEVERABILITY; DECLARING
AN EMERGENCY AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the City of Tukwila has adopted a Comprehensive Plan in compliance
with the Growth Management Act; and
WHEREAS, the City of Tukwila is currently updating its Zoning Code to comply with
its adopted Comprehensive Plan; and
WHEREAS, the Tukwila International Boulevard ('7113") study area, shown on
Exhibit A., is a neighborhood that orients towards TIB, and comprises goods and
services as well as higher density housing; and the study area is generally bounded by
42nd Avenue South on the east- South 160th Street on the south; International
Boulevard, Military Road, and a stepped edge that follows the boundary of the multi-
family zoning districts up to the Mixed Use Office District at approximately South 133rd
Street on the north', and
WHEREAS, within the existing Neighborhood Commercial Center (NCC) and
Regional Commercial (RC) zoning districts there are certain uses that in the future may
not be allowed or may be allowed with conditions; and
WHEREAS, the United States Department of Justice sentenced the owner and
operator of one of three crime -infested motels for conspiracy to maintain drug involved
premises; and when the three adjacent hotel, motel and extended -stay facilities within
the study area were closed, the violent crime rate in the study areas was cut nearly in
half; and the City of Tukwila acquired those government surplus properties and razed
the operations to better serve the public health and safety in the study area; and
WHEREAS, the City of Tukwila finds that hotels, motels, and extended -stay hotels
and motels (hereafter, collectively referred to as "extended -stay facilities") in this study
area generate higher than typical rates of crime and the City of Tukwila spent millions of
dollars purchasing four motel sites and demolishing those developments; and

WHEREAS, in addition, the Comprehensive Plan goals and policies for the TIB
study area are to create a pedestrian oriented, walkable destination, and auto -oriented
services, uses and developments are not in keeping with those goals and policies; and
WHEREAS, the City of Tukwila is in the process of updating its land use
regulations to comply with the goals and policies of its adopted Comprehensive Plan for
the TIB study area and has budgeted for a work plan, shown on Exhibit B, to address
the changes that will bring consistency between the City's Comprehensive Plan and
Zoning Code; and
WHEREAS, the City of Tukwila conducted a three-day workshop in February 2017
on the future improvements and land use regulations for the TIB study area and
preliminarily determined hotels; motels; extended -stay facilities; and auto -oriented
commercial uses, including, but not limited to, gas stations, vehicular repair or services,
vehicular sales or rentals, vehicular storage, and drive-throughs should be regulated
differently than currently regulated; and
WHEREAS, the City desires to ensure the public has many opportunities to provide
input on this matter; and
WHEREAS, the City desires to preserve the status quo for the protection of the
health, safety and welfare of City residents, as it relates to development in Tukwila, until
these matters are more fully considered;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, HEREBY ORDAINS AS FOLLOWS:
Section 1. Preliminary Findings. The recitals and findings set forth above are
hereby adopted as the City Council's preliminary findings in support of the moratorium
imposed by this ordinance. The City Council may, in its discretion, adopt additional
findings at the conclusion of the public hearing referenced in Section 5 below.
Section 2. Moratorium Imposed. Pursuant to the provisions of Article 11,
Section 11 of the Washington State Constitution, RCW 35A.63.220, and RCW
36.70A.390, a moratorium is hereby enacted prohibiting within the NCC and RC zoning
districts of the TIB study area in the City of Tukwila the development, expansion,
intensification or establishment of any new hotel; motel; extended -stay facility; or auto -
oriented commercial uses, including, but not limited to, gas stations, car washes,
vehicular repair or services, vehicular sales or rentals, commercial parking; and drive-
throughs. No land use approval, building permit, construction permit, occupancy
permit, or other development permit or approval shall be issued for any of the uses
listed above while this moratorium is in effect. Any land use approval, development
permits or other permits for any of these operations that are issued as a result of error
or by use of vague or deceptive descriptions during the moratorium are null and void
and without legal force or effect.
Section 3. Definitions. As used in this ordinance, the following terms have the
meanings set forth below:
A. "Hotel" means a building, or buildings or portion thereof, the units of which are
used, rented, or hired out as sleeping accommodations only for transitory housing.
Hotel rooms shall have their own private toilet facilities, and may or may not have their

own kitchen facilities. Hotels shall not include dwelling units for permanent occupancy.
A central kitchen, dining room and accessory shops and services catering to the
general public can be provided. No room may be used by the same person or persons
for a period exceeding 30 calendar days per year. Not included are institutions housing
persons under legal restraint or requiring medical attention or care.
B. "Motel" means a building or buildings or portion thereof, the units of which are
used, rented, or hired out as sleeping accommodations only for the purposes of
transitory housing. A motel includes tourist cabins, tourist court, motor lodge, auto
court, cabin court, motor inn and similar names but does not include accommodations
for travel trailers or recreation vehicles. Motel rooms shall have their own private toilet
facilities and may or may not have their own kitchen facilities. Motels are distinguished
from hotels primarily by reason of providing adjoining parking and direct independent
access to each rental unit. Motels shall not include dwelling units for permanent
occupancy. No room may be used by the same person or persons for a period
exceeding 30 calendar days per year. Not included are institutions housing persons
under legal restraint or requiring medical attention or care.
C. "Extended -stay hotel or motel" means a building or buildings or portion thereof,
the units of which contain independent provisions for living, eating and sanitation
including, but not limited to, a kitchen sink and permanent cooking facilities, a bathroom
and a sleeping area in each unit, and are specifically constructed, kept, used,
maintained, advertised and held out to the public to be a place where temporary
residence is offered for pay to persons for a minimum stay of more than 30 days and a
maximum stay of six months per year. Extended -stay hotels or motels shall not include
dwelling units for permanent occupancy. The specified units for extended -stay must
conform to the required features, building code, and fire code provisions for dwelling
units as set forth in the Tukwila Municipal Code. Nothing in this definition prevents an
extended -stay unit from being used as a hotel or motel unit. Extended -stay hotel or
motels shall be required to meet the hotel/motel parking requirements. Not included
are institutions housing persons under legal restraint or requiring medical attention or
care.
D. "Auto -oriented commercial uses" means the use of a site for primarily the
servicing, repair, rental, sales or storage of vehicles, or the servicing of people while in
their vehicles such as restaurant drive-throughs. Typical uses include, but are not
limited to, gas stations; battery, tire, engine or body repair shops; vehicular sales or
rental lots; and commercial parking.
Section 4. Effective Period for Moratorium. The moratorium set forth in this
ordinance shall be in effect for a period of 6 months from the date this ordinance is
passed and shall automatically expire at the conclusion of that 6 -month period unless
the same is extended as provided in RCW 35A.63.220 and RCW 36.70A.390, or unless
terminated sooner by the City Council.
Section 5. Public Hearing. Pursuant to RCW 35A.63.220 and RCW 36.70A.390,
the City Council will hold a public hearing at the City Council's regular meeting at 7:00
p.m. in Council Chambers on September 5, 2017, or as soon thereafter as the business
of the City Council shall permit, and which date is no more than 60 days after the date
of adoption herein, to take public testimony and to consider adopting further findings.

Section 6. Work Program. The Director of Community Development is hereby
authorized and directed to address issues related to appropriate zoning regulations
within the TIB study area of hotels, motels, extended -stay facilities, and auto -oriented
commercial uses in the Tukwila Municipal Code.
Section 7. Severability. If any section, subsection, paragraph, sentence, clause
or phrase of this ordinance or its application to any person or situation should be held to
be invalid or unconstitutional for any reason by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of the
remaining portions of this ordinance or its application to any other person or situation.
Section 8. Corrections by City Clerk or Code Reviser. Upon approval of the
City Attorney, the City Clerk and the code reviser are authorized to make necessary
corrections to this ordinance, including the correction of clerical errors; references to
other local, state or federal laws, codes, rules, or regulations; or ordinance numbering
and section/subsection numbering.
Section 9. Declaration of Emergency - Effective Date. For the reasons set forth
above, and to promote the objectives stated herein, the City Council finds that a public
emergency exists, necessitating that this ordinance take effect immediately upon its
passage by a majority plus one of the whole membership of the Council in order to
protect the public health, safety, property and general welfare. This ordinance shall
take effect and be in full force immediately upon passage by the City Council. A
summary of this ordinance may be published in lieu of publishing the ordinance in its
entirety.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
TUKWILA, WASHINGTON, AMENDING VARIOUS ORDINANCES
AS CODIFIED IN TUKWILA MUNICIPAL CODE CHAPTER 5.04,
"LICENSES GENERALLY," TO REPLACE "FTE" WITH
"EMPLOYEE" IN RELATION TO THE BUSINESS LICENSE FEE
STRUCTURE AND TO ELIMINATE REFERENCE TO A
"COMBINED" BUSINESS LICENSE FEE; PROVIDING FOR
SEVERABILITY; AND ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the City has analyzed current business license fees; and
WHEREAS, the City has received multiple public comments that the existing
business license and revenue generating regulatory license (RGRL) fee calculation
based on full-time equivalent (FTE) can be difficult to calculate correctly; and
WHEREAS, calculating the fee by "Employee" rather than FTE will simplify the fee
calculation process for the public and City staff; and
WHEREAS, the City Council finds that in the interest of compliance with the state
law (per Engrossed House Bill 2005), to improve current practice and to provide a
simplified fee calculation process for the public and City staff, the City should set a
single business license fee pursuant to RCW 35A.82.020 for revenue generating
purposes; and
WHEREAS, the City Council has considered this ordinance, together with all public
comment, and has determined the proposed amendments are in accord with the
Comprehensive Plan; will not adversely affect the public health, safety, or general
welfare; and are in the best interest of the citizens of the City;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUKWILA,
WASHINGTON, HEREBY ORDAINS AS FOLLOWS:

Section 1. No Impact on 2017 Business Licenses. It is the City Council's
intention that the following amendments apply to Business Licenses issued by the City
for 2018 and beyond, and have no impact on Business Licenses issued by the City for
2017.
Section 2. TMC Section 5.04.010 Amended. Ordinance Nos. 2496 §1, 2381 §1,
2356 §1, 2333 §1 and 2315 §1 (part), as codified at Tukwila Municipal Code (TMC)
Section 5.04.010, Subparagraph 10, are hereby amended to read as follows:
5.04.010 Definitions
10. "Employee" means and includes each of the following persons who are not
required by the City to have his/her/its own separate City of Tukwila business license:
a. Any person employed at any business who performs any part of their
duties within the City of Tukwila; and
b. Any person who is on the business's payroll, and includes all full-time,
part-time, and temporary employees or workers; and
c. Owners, officers, managers, and partners; and
d. Any other person who performs work, services or labor at the business
including, but not limited to, family members, regardless of whether they receive a wage
from the business.
Employee is a unit of measure used to determine the Business License fee.
Section 3. TMC Section 5.04.020 Amended. Ordinance Nos. 2496 §2, 2425 §1,
2381 §3, 2356 §2, 2333 §3 and 2315 §1 (part), as codified at TMC Section 5.04.020,
are hereby amended to read as follows:
5.04.020 Applications and fees required
A. Application Required. Any person desiring to establish or conduct any
business enterprise or undertaking within the corporate limits of the City shall first apply
to the Finance Department for a license to conduct such business. The application shall
be upon a form furnished by the Finance Department on which the applicant shall state
the company name and address; the nature of the business activity or activities in which
he/she desires to engage; the place where the business will be conducted; the number
of employees, whether full or part-time, on the payroll as of January 1, or, if a new
business, the number to be employed on the opening date; the Washington State
Unified Business Identifier (UBI) number; and other information pertaining to the
business as required by the City. Owners of residential rental property are not subject
to the application requirements in this chapter but shall adhere to the application
requirements in TMC Chapter 5.06.

B. Fee — General.
1. The application must be accompanied by the appropriate application fee in
accordance with the fee schedule adopted by resolution of the City Council. The
license fee for the annual license (Business License fee) issued under this chapter shall
be determined based on the total number of employees, and calculated in accordance
with the fee schedule adopted by resolution of the City Council.
2. It will be the responsibility of the business to determine the total number of
employees and, if required, demonstrate to the satisfaction of the Finance Director that
the information pertaining to the Business License fee is accurate. Businesses without
a full year of operating history shall estimate the number of employees that will be
employed in a 12 -month period.
C. Minimum Fee. There shall be an annual minimum fee for a Business License
in accordance with the fee schedule adopted by resolution of the City Council. An entity
subject to exemption pursuant to TMC Section 5.04.090 may not pay a Business
License fee.
1. A business with less than $12,000.00 of annual gross receipts shall pay the
minimum license fee.
2. An entity engaging in some activities or functions that are exempt from the
Business License fee and some that are not exempt shall pay a Business License fee
based on the number of employees involved in the functions or activities that are not
exempt.
3. If a business has more than one location within the corporate limits of the
City, the Business License fee for each location shall be no less than the minimum fee
required under this chapter.
4. The Business License fee for a business required to be licensed under this
chapter and not located within the City's corporate limits shall be determined by
multiplying the appropriate Business License fee by the number of employees working
within the City's corporate limits, in accordance with the fee schedule adopted by
resolution of the City Council. In no event shall the Business License fee be less than
the minimum fee set forth in this chapter. If the number of employees is not known at
the time of application or renewal of the license, the business shall estimate the
maximum number of employees they anticipate working within the City's corporate limits
at any time during the 12 -month period subject to licensure.
5. Businesses doing business in the City that have no employees physically
working within the City's corporate limits shall pay the minimum fee required under this
chapter.
6. Businesses or organizations eligible for a temporary business license
pursuant to TMC Section 5.04.010 will be required to pay the minimum fee under this
chapter. This section shall not apply if the applicant is applying for a license related to

his/her participation at a City -sponsored event or as part of an event held at the Tukwila
Community Center. If the applicant is applying for a license related to his/her
participation at a City -sponsored event or as part of an event held at the Tukwila
Community Center, the applicant is required to complete all application requirements
and approvals required by the City's Parks and Recreation Department.
D. New Businesses. The Business License fee for a new business shall be
based on the estimated number of employees that will work in Tukwila for a 12 -month
period. If, during the first license year for a new business, the City determines the
actual number of employees is significantly different than the estimated number
identified by the business owner, the amount of the Business License fee will be
recalculated for the new business. If the revised Business License fee is higher than
the original Business License fee paid by the business owner for the first license year,
the business owner must pay the difference to the City within 30 days after written
notice of the amount owed is sent to the business owner by the City.
E. Over -reporting of Employees. In the event the business owner miscounted
the number of employees by an error factor of more than 15% and paid an excess
Business License fee as a result, a business may request that the City refund the
overpayment. The request must be made in writing to the Finance Department, and the
City must receive the request and all supporting documentation no later than 60 days
after the end of the calendar year in which the error was made. If the City is satisfied
the business owner paid an excess Business License fee, the City will refund the
excess amount paid to the business owner.
F. Under -reporting of Employees. If, at the time of license renewal, the City
determines the business owner under -reported the number of employees for the
preceding year by an error factor of more than 15%, the business shall pay the balance
of the corrected Business License fee (calculated as the difference between the paid
Business License fee and the corrected Business License fee). The Finance Director
shall mail written notice of the balance due to the business owner, and the business
shall pay the balance due to the City within 30 days of the date the written notice is
mailed by the City. A penalty of 20% of the balance due will be applied if payment is not
received within 30 days.
G. Payment by Draft or Check. Payment made by draft or check shall not be
deemed a payment of the Business License fee unless and until the same has been
honored in the usual course of business, nor shall acceptance of any such check or
draft operate as a quittance or discharge of the Business License fee unless and until
the check or draft is honored. Any person who submits a Business License fee
payment by check to the City, pursuant to the provisions of this chapter, shall be
assessed an NSF fee set by the Finance Director if the check is returned unpaid by a
bank or other financial institution for insufficient funds in the account or for any other
reason.

Section 4. TMC Section 5.04.050 Amended. Ordinance Nos. 2496 §3, 2381 §4,
2356 §4, 2333 §5 and 2315 §1 (part), as codified at TMC Section 5.04.050, are hereby
amended to read as follows:
5.04.050 Late acquisition or renewal
A. Penalty. For new businesses, failure to pay the Business License fee by the
first day of commencing business operations pursuant to TMC Section 5.04.020 will
result in a late acquisition penalty in accordance with the fee schedule adopted by
resolution of the City Council. For renewing businesses, failure to pay the Business
License renewal fee by January 31st shall constitute delinquency and shall result in a
penalty in accordance with the fee schedule adopted by resolution of the City Council.
No business license and/or renewal for the current period shall be granted until all
delinquent fees, together with penalties, have been paid in full. The Finance Director or
his/her designee is authorized, but not obligated, to waive all or any portion of the
penalties and interest provided herein in the event the Finance Director determines that
the late payment was the result of excusable neglect or extreme hardship.
B. Collection of Fees and Penalties. Any license fee due and unpaid under this
chapter, and all penalties thereon, shall constitute a debt to the City and may be
collected in court proceedings in the same manner as any other debt in like amount,
which remedy shall be in addition to any and all other existing remedies.
C. Revocation of License. The Finance Director may revoke any business
license issued pursuant to this chapter to any business or other person who is in default
in payment of any license fee hereunder, or who shall otherwise fail to comply with any
of the provisions of this chapter. Notice of such revocation shall be issued pursuant to
TMC Section 5.04.110.D. On and after the date of the notice of revocation, any
business subject thereto that continues to engage in business shall be deemed to be
operating without a license, and shall be subject to any and all penalties herein
provided.
D. There shall be a penalty to reinstate any business license revoked through
nonpayment of the Business License fee. The penalty shall be identified in the fee
schedule adopted by resolution of the City Council.
Section 5. TMC Section 5.04.090 Amended. Ordinance Nos. 2356 §6, 2333 §7
and 2315 §1 (part), as codified at TMC Section 5.04.090, are hereby amended to read
as follows:
5.04.090 Exemption
A. Exemptions. The following entities may claim an exemption from the Business
License fee, but if exempt under this subsection such entities shall still register under
this chapter:

1. Certain Organizations Exempt from Federal Income Tax. An
organization that files with the city a copy of its current IRS 501(c)(3) exemption
certificate issued by the Internal Revenue Service.
2. A governmental entity that engages solely in the exercise of governmental
functions. Activities that are not exclusively governmental, such as some of the
activities of a hospital or medical clinic, are not exempt under this chapter.
3. A nonprofit business operated exclusively for a religious purpose, upon
furnishing proof to the Finance Director of its nonprofit status. For the purposes of this
chapter, the activities that are not part of the core religious functions are not exempt.
4. Civic groups, service clubs, and social organizations that are not engaged
in any profession, trade, or occupation, but are organized to provide civic, service, or
social activities in the City.
a. Examples of such organizations include but are not limited to:
Soroptomists, Kiwanis, Lions' Rotary, American Legion, children's and adults' athletic
leagues and similar types of groups, clubs or organizations.
5. Court interpreters who provide an oral translation between speakers who
speak different languages, and who are either a certified interpreter, qualified
interpreter, or registered interpreter, and who make less than $12,000 in gross annual
revenue in Tukwila, Washington. Certified, qualified and registered interpreters are
defined as follows:
a. "Certified interpreter" means an interpreter who is certified by the
administrative office of the courts.
b. "Qualified interpreter" means a person who is readily able to interpret
or translate spoken and written English for non -English-speaking persons and to
interpret or translate oral or written statements of non -English-speaking persons into
spoken English.
c. "Registered interpreter" means an interpreter who is registered by the
administrative office of the courts.
B. Nothing in this chapter shall be construed to require a license for any farmer,
gardener, or other person to sell, deliver or peddle any fruits, vegetables, berries, butter,
eggs, fish, milk, poultry, meats or any farm produce or edibles raised, caught, produced
or manufactured by such person in any place within the State.
Section 6. Corrections by City Clerk or Code Reviser. Upon approval of the
City Attorney, the City Clerk and the code reviser are authorized to make necessary
corrections to this ordinance, including the correction of clerical errors; references to
other local, state or federal laws, codes, rules, or regulations; or ordinance numbering
and section/subsection numbering.

Section 7. Severability. If any section, subsection, paragraph, sentence, clause or
phrase of this ordinance or its application to any person or situation should be held to be
invalid or unconstitutional for any reason by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of the
remaining portions of this ordinance or its application to any other person or situation.
Section 8. Effective Date. This ordinance or a summary thereof shall be published
in the official newspaper of the City, and shall take effect and be in full force five days
after passage and publication as provided by law.

SUBJECT: Report for September 5, 2017 Regular Council Meeting
The City Administrator Report is meant to provide the Council, staff and community an update
on the activities of the City and on issues that concern Tukwila. Please let me know if you
have any questions or need additional information about any of the following items.
Intergovernmental Update
• AWC Business License Task Force: Finance staff member Cindy Wilkins hosted a
meeting of the AWC Business License Task Force at Tukwila City Hall on August 23.
• Puget Sound Salmon Recovery Council: Council President Dennis Robertson, in his
role as WRIA 9 Representative to the Puget Sound Salmon Recovery Council, and staff
members from the Department of Community Development are on a workgroup
reviewing a proposal from the Tribal Management Conference involving "bold,
innovative actions" for Chinook salmon recovery across the Sound. Action on the
proposal is on the agenda for the September 28 Puget Sound Salmon Recovery
Council meeting. If adopted, the proposal would require major changes to federal, state
and local regulations around land use, water quality, funding, and monitoring.
• WCMA Summer Conference: City Administrator David Cline attended the Washington
City Management Association Summer Conference in Spokane August 23 — 25. Mr.
Cline has served as the President of the WCMA organization for the past year.
II. Community Events
• Salmon Seeson Event: The Department of Community Development and the Parks
and Recreation department are holding the first Tukwila Salmon Seeson event on
September 23 at Codiga Park from 10 AM -1 PM. The event will include family activities
and naturalists on site to lead groups down to the water to watch the salmon, discuss
native plants, restoration activities, stormwater, and other issues integral to the salmon
survival. A Parks and Recreation van will be running every half hour to shuttle residents
between Codiga and parking at TCC.
• PSF Mechanical Wellness Fair: On August 16 Steve Batz, Fitness and Athletic
Specialist and Kerry James, Personal Trainer attended a Wellness Fair held at PSF
Mechanical, a local Tukwila company. Steve and Kerry presented information about the
City's fitness and well living options for the PSF Mechanical employees. Kerry also
conducted various strength training and balance exercises with the PSF Mechanical
staff.

• It's a Community Bike Ride: High School Intern, Mohamed Mohamud and Rose
Warren, Transportation Demand Outreach Coordinator partnered with Seattle's new
bike share, Lime Bike, to host a community bike ride where Lime Bike provided 20
bicycles available for use at Bicentennial Park in Tukwila on August 17.
III. Staff Updates
Public Safety
• International Law Enforcement Forum Workshop: Chief Villa attended the
International Law Enforcement Forum Workshop at the Alfred M. Gray Research center
in Quantico, Virginia. The workshops rotate between the UK, Canada, and the U.S.,
and share expertise and lessons learned about employment of minimal force options,
community -oriented policing and counter -terrorism operations. This year's workshop
aimed towards training decision -makers at the operational level to develop critical
thinking skills, as well as ensuring police capability to meet current threats while

• Tukwila Responds to Hurricane Harvey: Captain Pat McCoy has been deployed to
Texas as part of the Disaster Medical Assistant Team's response to Hurricane Harvey
and Captains Mark Morales and Andy Nevens and Firefighter Patrick O'Brien were
deployed as part of the Federal Emergency Management Agency Team.
• CERT Class: Tukwila Fire Department Emergency Management Division will be
offering an adult CERT class beginning September 30.
Project Updates
• Southcenter Pedestrian/Bicycle Bridge: The contractor has been installing electrical
conduits, has started painting the top of floor beams, and continues to install rebar and
forms for the decks.
• Major Maintenance on 3 Bridges: Work on all three project sites began on July 24 and
all work is expected to be complete by December 2017.
Beacon Ave Bridge: Completely closed to traffic beginning August 28 with
completion by October.
Frank Zepp Bridge: Completely closed to traffic for 10 days beginning September
15.
Grady Way Bridge: No major impacts to Grady Way with only temporary lane
closures on Longacres Drive.
• 42nd Ave Phase III: Work is proceeding on the culvert replacement and installation of
the underground power utility infrastructure. We plan to begin stream bypass and further
excavation of the culvert this week. Placement of Seattle City Light power vaults began
late last week.
• S 144th St Phase II: Contractor continues to install electrical facilities and finish up the
storm drainage pipes that are in conflict with existing SCL duct bank. Grading for the
curbs on the north side of the road and grading for the sidewalks on south side of the
road are underway. Illumination bases and conduit work for both north & south side of
the road are continuing.

• 2016 Andover Park East Sewer: Pipe installation work should be completed by August
30 and asphalt paving and raised pavement markers will take place September 1.
• Cascade View SRTS Phase II: Construction continues with the installation of concrete
curbing and the mini -roundabout.
• Distinguished Budget Presentation Award: The City received the Government
Finance Officers Association Distinguished Budget Presentation Award for its 2017-
2018 budget.

• Arts Commission: Applications have been received for the vacant positions and
recommendation for appointments is scheduled for the September 5 City Council
Meeting.
• Civil Service Commission: No vacancies.
• Community -Oriented Policing Citizens Advisory Board: Vacant Positions - Position
#8 School District Representative and Student Representative.
• Equity & Social Justice Commission: Six applications have been received for all the

Outreach
• August open house was a success. The event took place at Fire Station 54 and
approximately 150 came through to enjoy the ice cream, bouncy house, and
information on the Public Safety Plan. City staff and the fire stations and justice center
architects had the opportunity to interact with many community members interested in
the new facilities and fathered feedback on a wide variety of issues associated with the
Public Safety Plan.
Financial Oversight Committee
• First meeting was held June 29.
Siting Advisory Committee
• Siting Advisory Committee met again August 30. Link to Agenda.
