Mr. Monaghan states that two bids were recieved and he recommends that award be made to Craig Taylor Co. for their alternate bid of $13,316.50 for the purchase of a 1978 John Deere Backhoe. Councilman Hill asked if the Maintenance Department has any use for the other backhoe. Mr. Monaghan stated that they do not at the present time and there is the problem of keeping up the maintenance on it. Mr. Emrich, The Mithun Associates, states that the bids received at the public bid opening have been reviewed and he made the following recommendations: 1. The low base bid for furnishings of Showroom 123 in the amount of $133,271.45 should be accepted. 2. The low base bid for carpet of Hazelrigg III, Inc. in the amount of $22,994.50 should be accepted. Bids received were as follows: J. K. Gill, "The Show Room" Showroom 123 Warren Office Equipment (Partial Bid) Architect Estimate MOVED BY VAN DUSEN, SECONDED BY SAUL, THAT COUNCIL ACCEPT THE BID OF SHOWROOM 123 IN THE AMOUNT OF $133,271.45. MOTION CARRIED. Bids received on the carpet contract were: Ery Parent Co. Hazelrigges III Architect Estimate Mayor Bauch explained that one of the bidders had a car problem on the freeway and had to be towed to a service station. They called in to report their problem and asked to have their bid considered. The incident was investigated and the decision was made to accept the bid. As it turned out, this was the low bid. MOVED BY VAN DUSEN, SECONDED BY SAUL, THAT COUNCIL CONCUR WITH THE MAYOR'S DECISION TO ACCEPT THE BID. MOTION CARRIED. MOVED BY VAN DUSEN, SECONDED BY HILL, THAT COUNCIL ACCEPT THE LOW BID FROM HAZELRIGGES III IN THE AMOUNT OF $22,994.50. Councilman Van Dusen asked how this breaksdown per square yard and was told $9.25 for the carpet and $1.59 for the pad. Council was assured by the Architect that this is a high quality carpet. PETITIONS, COMMUNICATIONS, APPEALS AND SIMILAR MATTERS Claim for Damages: John McFarland, Administrative Assistant, explained the circumstances Patricia Leckie relating to the Claim for Damages submitted by Patricia Leckie. A Tukwila Police Patrolman engaged in a search of the claimant's car. While searching the glove compartment, the locking mechanism fell loose. According to Miss Leckie the officer broke this item and the damage totals $31.15. TUKWILA CITY COUNCIL REGULAR MEETING March 6, 1978 Page 3 PETITIONS, COMMUNICATIONS, APPEALS AND SIMILAR MATTERS Continued Claim for Damages: According to a statement by the Officer, the claimant consented to a Patricia Leckie search of her vehicle pursuant to a shoplifting incident involving an Continued individual accompanying her. The officer indicated that he opened the glove compartment and the lock fell out of position. He states that he exerted no unusual force when turning the lock and had the impression that the mechanism was defective or had been previously broken. Council Motion No. 78 -03: Setting meeting time, place and date for Council Committee Meetings RECESS: 8:20 P.M. 8:25 P.M. OLD BUSINESS MOTION FAILED. 20 72. MOVED BY VAN DUSEN, SECONDED BY BOHRER, THAT COUNCIL ACCEPT THE CLAIM AND PAY THE DAMAGES. Miss Leckie and Officer Kilburg were both in the audience to explain the incident as they saw it. Council examined the glove compartment lock mechanism furnished by Ms. Leckie. Officer Kilburg stated that at the time the lock fell off, Ms. Leckie commented it was nothing to worry about leading him to believe it had happened before. MOVED BY VAN DUSEN, SECONDED BY HILL, THAT THE PROPOSED COUNCIL MOTION BE READ BY TITLE ONLY AND INCLUDE THE TIME, PLACE AND DATE OF THE COMMITTEE MEETINGS. MOTION CARRIED. Deputy City Attorney Hard read a motion of the Tukwila City Council setting the meeting time, place and date for the four standing committees. Community Affairs Committee, meetings on the first and third Wednesday of each month at 4:30 P.M. at City Hall. Finance and Personnel Committee, meetings on the first and third Tuesday of each month at 4:30 P.M. at City Hall. Public Safety Committee, meetings on the second and fourth Wednesday of each month at 4:30 P.M. at City Hall. Public Works Committee, meetings on the second and fourth Tuesday of each month at 4:30 P.M. at the City Annex. MOVED BY VAN DUSEN, SECONDED BY SAUL, THAT CITY COUNCIL MOTION NO. 78 -03 BE ADOPTED AS READ. Councilman Hill stated that Thursday is a bad day for him to attend the Public Works Committee Meeting. Councilman Johanson agreed that it was not a good time. MOVED BY TRAYNOR, SECONDED BY HILL, THAT COUNCIL RECESS FOR FIVE MINUTES TO ALLOW THE COMMITTEE MEMBERS TIME TO DECIDE A NEW MEETING DATE. MOTION CARRIED. Mayor Bauch called the meeting back to order with Council Members present as previously reported. MOVED BY HILL, SECONDED BY JOHANSON, THAT COUNCIL MOTION BE AMENDED TO READ THAT THE PUBLIC WORKS COMMITTEE WILL MEET ON THE SECOND AND FOURTH TUESDAYS AT 4:30 P.M. AT THE CITY ANNEX. MOTION CARRIED. MOTION CARRIED AS AMENDED. Final Acceptance Letter from Terence R. Monaghan, Public Works Director, was read 1977 Street recommending the 1977 Street Improvement Project be accepted. TUKWILA CITY COUNCIL REGULAR MEETING March 6, 1978 Page 4 NEW BUSINESS Recommendation of URS Company for Engineering on 1978 Street Improvement Project ORDINANCES Ordinance #1051 Unlimited General Obligation Bonds, 1978 Ordinance #1052 Limited General Obligation Bonds, 1978 Terence Monaghan, Public Works Director, reviewed his letter to Council recommending that URS Company be approved and a professional services agreement be executed to provide the design phase engineering and the design survey in accordance with the terms of their proposal to Mr. Monaghan dated February 24, 1978. 1978 Street Improvement Design Fee Design Survey Fee MOTION CARRIED. Total 17,500 3,400 20,900 2073 The scope of this project is drainage, paving, curbs and sidewalks, and the installation of rockeries and /or retaining walls on the following streets: 56th Avenue South from So. 144th Street to So. 147th Street 57th Avenue South from So. 144th Street to So. 149th Street So. 147th Street from 56th Avenue South to 58th Avenue South MOVED BY VAN DUSEN, SECONDED BY SAUL, THAT URS COMPANY BE ENGAGED FOR THE ENGINEERING SERVICES ON THE 1978 STREET IMPROVEMENT PROJECT. Councilman Hill asked if Council could meet with Mr. Steve Fusco of the firm to discuss the public participation portion as he felt this was a very important part of the project. He was assured it could be arranged. Mr. Robert Hawkins, URS Company, suggested that, prior to completion of the design phase, a public meeting be held to allow property owners input on the project. Those that do not attend the meeting will be contacted personally. Councilman Bohrer asked if the City is locked into improvement of the streets listed in the proposal. Mr. Monaghan stated that the money is proposed to do only a certain length of street and that different streets can be improved this year. Council President Van Dusen read an Ordinance of the City of Tukwila, Washington, providing for the issuance, specifying the maturities and maximum effective interest rate, and fixing the form of $1,850,000 par value of "Unlimited General Obligation Bonds, 1978," authorized by the qualified voters of the City at a special election held on November 2, 1976, in conjunction with the general state election held on the same date, pursuant to Ordinance No. 987 of the City Council passed September 7 1976; creating a special bond redemption fund and a special acquisition fund; providing for theissuance of interest bearing warrants pending the deposit of bond proceeds in such acquisition fund; and providing for the sale of such bonds. Council President Van Dusen read an Ordinance of the City of Tukwila, Washington, providing for the issuance of $450,000 par value of "Limited General Obligation Bonds, 1978," of the City to provide funds to pay part of the cost of acquiring certain real properties known as the "Foster Golf Links," for recreational purposes and making certain capital improvements thereto; specifying the maturities and fixing the form and maximum effective interest rate of such bonds; establishing a "Limited General Obligation Bond Fund, 1978 and providing for the sale of such bonds. Council President Van Dusen read a Resolution of the City of Tukwila, Washington, repealing Resolution No. 529. MOVED BY VAN DUSEN, SECONDED BY TRAYNOR, THAT RESOLUTION NO. 619 BE ADOPTED AS READ. MOTION CARRIED. MOVED BY VAN DUSEN, SECONDED BY TRAYNOR, THAT HE READ THE PROPOSED RESOLUTION. MOTION CARRIED. Council President Van Dusen read a Resolution of the City of Tukwila, Washington, designating the Record Chronicle as the newspaper for all legal publications. MOVED BY VAN DUSEN, SECONDED BY HILL, THAT RESOLUTION NO. 620 BE ADOPTED AS READ. Attorney Hard advised Council that he had discussed this item with an attorney for the Association of Washington Cities. The matter is of some interest to them so the Executive Director of the AWC has requested an opinion from the Attorney General's Office in Olympia. Attorney Hard stated that he stands behind the opinion, in his letter dated March 1, 1978, that the City of Tukwila may have its ordinances and other legal notices published without calling for bids from competitive newspapers. MOTION CARRIED. Mayor Bauch urged everyone to stop by new city hall for a tour. The framing is almost complete. He stated he is very pleased with the progress Mayor Bauch stated he has been reviewing all past employee benefit ordinances back as far as 1962. He will be meeting with the Finance and Personnel Committee to discuss this. Eventually these ordinances will be repealed. Attorney Hard stated that the main items he has been working on this month are trying to solve LID #25, and the Foster Golf Links procedure. MISCELLANEOUS AND FURTHER AUDIENCE COMMENTS Councilman Bohrer cancelled the Public Safety Committee meeting for Wednesday of this week. Mr. Leo Sowinski, audience, asked when the city -wide clean -up week will be. Mayor Bauch noted that it will probably be the third week in April. This year there will be one clean -up week in the spring and one in the fall. Mr. Sowinski said the Jack Anderson property at South 160th and 51st Avenue South in McMicken Heights is being used as a dumping ground and asked if the City could do something. Bauch Mayor, City of Tukwila 14475 59th Avenue South Tukwila, Washington 98067 (206) 624 -1040 March 1, 1978 Re: Publication of Legal Notices Dear Mayor Bauch: You have asked for our opinion as to whether the City of Tukwila must call for bids from newspapers desiring to publish city ordinances and other notices required by law. In our opinion, the City of Tukwila may have its ordinances and other legal notices published without calling for bids from competitive newspapers qualified to publish said notices. As a code city, Tukwila is not required to call for bids for services and items which are not specifically described in RCW 35A.40.200. The Attorney General of the State of Washington, in an opinion issued early this year, has stated that a code city is not required to call for competitive bids when contracting for the purchase of supplies, materials and equipment which are not being procured in connection with a public -work or improvement project. (AGO 1977, No. 4.) Since the publication of legal notices does not meet the criteria of items requiring bids, no such proceedure is required. The City should be aware that in selecting a newspaper for publication, RCW 35A.65.020 requires the selection of a newspaper of general circulation within the City having the qualifications set forth in RCW 65.16, et seq. Councilman Johanson stated that South 153rd Street is extremely dirty. This is caused by the trucks hauling construction material to the San Juan Apartment Complex.
