O The signal warrant analysis, using the years 2000 and 2010 and the forecasted number of O vehicle trips for these years did not warrant the installation of a signal. However, the analysis forecast a Level of Service (LOS) F for this intersection during the p.m. peak hour in 2010. For this reason, the City has determined that a signal will be needed at this ,—a intersection, no later than 2010. O O International Gateway East 11 LLC, the owner of the development property identified Ge above, recognizes an obligation to pay a proportionate fair share of the costs of a signal and related civil improvements at this intersection. The owner therefore waives the right to protest a future L.I.D. formed for the purpose of providing such a signal and related civil improvements at the intersection of East Marginal Way South and South 130 Street. This agreement will be recorded by the City with the King County Auditor and shall run with the land and be binding upon the parties and upon their representatives, transferees, successors, and assigns.
