Street Frontal Improvement Proportionate Fair Share Agreement TMC 11.64 requires the construction of curb, gutter, sidewalk and other frontal improvements for new and remodeling construction when: floor area is increased by 20% alterations, repairs, remodeling exceed 25% of the previous building value 25,000 square feet is added or building value is increased by $250,000.00 The proposed tenant improvements for on Partn LC at 4611 S. 134 Place in Tukwila (Tax parcels 26130 -0042, 2610047 an 1 -0048) meets or exceeds at least one of the conditions stated in TMC 11.64. Arion Partners, LLC is obliged to participate O in funding future frontal improvements, and waives the right to protest L.I.D. or U.L.I.D. O formation. Arion Partners will pay a proportionate fair share based upon construction O costs for the frontal improvements if the City proceeds with construction. r-0 O This agreement shall be binding upon the parties, their respective heirs, legal V 4 representatives, assignees, transferees and successors, and runs with the land. O This agreement shall be recorded by the City Clerk with the King County Auditor as O required by RCW Chapter 35.91, and the cost of said recording will be paid by the City. CIQ So that Arion Partners, LLC can remove encumbrances from the property caused by this agreement, Arion Partners, LLC can pay the City Arion Partners, LLC pro -rata share for the project costs. These costs will be made available to Arion Partners, LLC upon written request to the Public Works Director.
