PLANNING COMMISSION WORKSESSION
MINUTES
Date: November 16, 2017

Present: Chair, Miguel Maestas; Vice -Chair Nhan Nguyen; Commissioners Mike Hansen,
Sharon Mann, Louise Strander and Dennis Martinez

Secretary
A work session was held on the proposed revisions to TMC 18.54, Tree Regulations and revisions
to definitions found in TMC 18.06 related to landscaping, urban forestry and trees.
Carol Lumb, Senior Planner, Department of Community Development explained the process and
how they arrived at the documents provided for the Planning Commission's review.
Andrea Cummins walked through the key definitions, as
questions.

Commissioner Strander requested instead of holding the public hearing scheduled on this topic in
December that another work session is held so that the PC can thoroughly go through the
document. The Planning Commission was in consensus.
Action Items:
• Commissioner Strander inquired on other jurisdiction's codes and what they designate as
their'average diameter of significant trees. She requested that staff provide more
information regarding the difference for Tukwila compared to other jurisdictions at the
December meeting. Commissioner Nguyen suggested staff make sure the designated size is
evidence based.
• Commissioner Martinez requested verbiage be added to the invasive nuisance tree
definition regarding damage to underground utilities from trees.
•
Commissioner Strander requested more information from the city Attorney on the
property owner's ;liability regarding street trees, as set forth in TMC 11.20.
Commissioner Mann acknowledged the staff for their efforts.

Sharon Maim, Louise Strander, and Dennis Martinez
Staff: Minnie Dhaliwal, Planning Supervisor; Moira Bradshaw, Senior Planner, and Wynetta
Bivens, Planning Commission Secretary
Chair, Maestas called the public hearing to order at 6:35 PM.
Adoption Commissioner Mann made a motion to adopt the 10/26/17 minutes
of Minutes: Commissioner Strander seconded the motion.
Commissioner Maestas requested one correction. The motion passed unanimously.
Chair Maestas swore in those wishing to provide testimony and opened the public hearing.
The Commissioners were asked the Appearance of Fairness questions. Commissioner Maim disclosed
that she is the Co -Chair of TIBAC and has been involved in the planning and progress of Tukwila
Village. No one was opposed to Commissioner Mann hearing the case.
PLANNING COMMISSION REVIEW
I. STAFF PRESENTATION
Moira Bradshaw, Senior Planner, Department of Community Develop, gave the presentation. She
provided background on the project and went over the design criteria. Staff recommended
approval with four conditions as listed in the November 6, 2017, staff report.
II. APPLICANT PRESENTATION
Diana Keys, Director of Housing, Johnson Braund gave the presentation for the applicant. She
provided a detailed description of the project and answered questions.
III. PUBLIC TESTIMONY
Bryan Park, Tukwila Village Developer, provided information on the timeframe for completion of
the project.

There was no additional testimony.
The public hearing was closed.
IV. DELIBERATION
Commissioner Strander requested that the verbiage for Condition #1 be revised from 'at least
one trash receptacle' to `two trash receptacles'.
Commissioner Mann suggested one trash receptacle be located at the entrance and one at both
ends of the building, for a total of three for both buildings.
V. MOTION:
Commissioner Mann moved to approve case number L17-0056, Design Review with staff's
finding, conclusions and four conditions, with one revision to condition number one requiring
three trash receptacles. Commissioner Strander seconded,the motion passed unanimously.
Commissioner Mann thanked Derek Speck and the staff for all their time and efforts on the
project.
VI. DIRECTOR'S REPORT:
•
Instead of holding a public hearing in December there will be another work session on
the Tree Ordinance, as requested by the Planning Commission.
Briefing was provided on the previously approved school district project that the School
District may not build B2K facility, which would mean a new Conditional Use Permit
(CUP) will be needed for Foster High School, as the previous CUP was for combined
both facilities. Any changes to the site plan of Foster High School would be reviewed
by the Director of Community Development as minor modifications to the Design
Review approval by the Board of Architectural Review. The new CUP would be
reviewed by the Hearing Examiner instead of coming back to the PC.
• In response to Commissioner Martinez's request, staff will provide the PC with some
information on Airbnb or a timeframe of when the policy will be completed.
• Commissioner Strander requested that the Tree Ordinance be the only item on the work
session agenda in December.
