The first meeting of the Tukwila City Council held in the new building was
opened by Reverend Walter Henderson, Burien Evangelical Church, who read
from the scripture and lead the audience in prayer.
Mayor Bauch, presiding, led the Pledge of Allegiance and called the
Regular Meeting of the Tukwila City Council to order.

Mayor Bauch explained that the portion of street requested for vacation
by Mr. Arthur D. Watkins, (2821 S. Walden, Seattle, WA 98144) lies
at approximately South 149th Street and Macadam Road. The property is
adjacent to I -5 and does not have access from a public road.
Mayor Bauch declared the Public Hearing open. There being no comment
for or against the street vacation the Public Hearing was closed.
Mayor Bauch recommended that this item be referred to the Public
Works Committee so a policy can be set as to the course of action to
be followed. The R.C.W. provides Cities the right to receive com-
pensation for vacated property up to one -half the appraised value.

Mrs. Joanne Davis, audience, suggested that when this is brought back
to Council a map be made available to the citizens.
Attorney Hard reported that he has met with the Attorneys of the property
owners and they have requested that this matter be continued one more
week. He asked Council to hold an Executive Session at the end of the
meeting to discuss the terms that were talked about.

Mayor Bauch explained that the Washington State Chapter of American
Public Works Association awarded the City of Tukwila the Safety
Award of Honor for 1978 for a Class I Type City. Also, the Puget
Sound Section of the Pacific Northwest Pollution Control Association
recognized the City of Tukwila Sewer Crew for zero lost time in
accidents for 1975 and 1976. Mr. Gene Isler and Mr. Ray Doll were
present to receive the awards on behalf of the Maintenance Department.
Mayor Bauch displayed a small statue of the American Eagle presented
to the Office of the Mayor at new City Hall by Allan W. Milligan,
Utility Accountant for the City.
Councilman Van Dusen presented two clocks, that he had made, to the City
of Tukwila. The one clock will hang in the Council Chamber, the other
he presented to the City staff and will hang in the Municipal Office
area. He expressed appreciation for the help he has received from
staff. Mayor Bauch accepted the gifts for the City.
COMMUNICATIONS, APPEALS AND SIMILAR MATTERS
John McFarland, Administrative Assistant, explained that the City had
received a claim from Mr. Gerald E. Church for the loss of a radio.
Mr. Church's vehicle was impounded by the Tukwila Police Department and
secured in the City Shop area. When the contents of the vehicle were
inventoried a Craftsman portable radio was recorded. Upon retrieving
his vehicle from the towing company, Mr. Church discovered his radio
was missing. The tow truck operator states that the vehicle did not
contain the radio when it was removed from the Shop area. Mr. McFarland
recommended that the claim be honored in the amount of $60.00 in that
the vehicle wasleft unsecured for an extended period of time.

Councilman Traynor commented that the audience in the new chambers is
too far back and asked to have the seats moved closer to the front for
the next meeting.
Mayor Bauch explained that the motion is to transfer appropriations
within the Water and Sewer Funds in order to pay for emergency repairs
as authorized by Ordinance No. 1069. The ordinance authorized repair
to a ruptured water line which crosses the Green River to the Southcenter
South industrial area.

21, 1978.

Councilman Harris noted that the ordinance is without the interest
rate
Mr. John Urbina, Foster Marshall Inc., explained that the purchase
price on the L.I.D. #27 bonds is $417,269.07. This is the balance
left after the pre payments have come in. The original assessment roll
was $552,736.42. He noted that the City Attorney had reviewed the
Purchase Contract and called Council's attention to Appendix A. The
denomination of the Bonds will be $1,000.00 except for Bond No. 1,
which will be $1,269.07. The Interest Payable will be 6.75% annually
on October 1. This offer is good tonight only. If the City accepts
the offer the money should be available by October 26, 1978.
Councilman Harris asked about Section 5, Liquidated Damages: $1,000.
Mr. Urbina explained that if the City decides not to accept the
contract this is the amount the City would pay for the time spent on
preparing the contract.
Ron Swanson, Finance Director, reminded Council that they passed Resolution
No. 651 authorizing the negotiated sale of these bonds.
Councilman Bohrer asked if they are on sale to individuals and if so
how. Mr. Urbina said they are available through their Renton Office.

trespass and amending Ordinance No. 977 and T.M.C. 8.04.530.

Councilman Van Dusen asked Attorney Hard to explain the amendment.
Attorney Hard explained that there is a law in the State and City
called Criminal Trespass. Basically, this means where a person
remains on someone elses property against their wishes. The owner
can invoke the power of the Police and have them removed. This law
was put into effect to allowstore owners to have undesirable persons
removed from their property.
The amended law now says, if you go into a public place and comply
with the conditions you cannot be found guilty of criminal trespass.
Basically, this is designed to make sure that someone on the premises,
who is observing all the rules, is not thrown out.
Councilman Bohrer asked if this is applicable to private residence.
Mr. Hard said it could be but the person has to be given a warning.
Councilman Johanson asked if you wish people to remain off your
property, can it be done by signing? Attorney Hard said NO, you have
to show you gave a particular person a warning.

Deputy City Attorney Hard read a resolution of the City of Tukwila,
Washington, adopting a proposed zoning regulation to become effective
upon the annexation of the unincorporated area known as "Riverton
which might reasonably be expected to be annexed by the City of
Tukwila in the future.

Councilman Johanson said the reason he voted "no" the last time on the
adoption of the Resolution is concern for some agreement, and an
understanding by both parties as to the agreement, regarding Fire
Districts, Water Districts, the whole coordinating of the two units.
He stated that there has been no clarity as to the proper time to
discuss these items and he asked when the proper time is.
Kjell Stoknes, OCD Director, distributed the Environmental Review
on the Riverton Annexation Petition and summarized it for the audience.
The Environmental Questionaire deals mainly with impacts on the earth,
air, water, flora and fauna, noise, light and glare. Under land use
there may be an impact. Under this proposal all land would annex as
single family. After annexation, zoning hearings would be conducted
to implement the City's Comprehensive Land Use Plan. The City's Plan
is very similar to that of King County. The area of concern is prob-
ably Quarry Hill and the area between So. 124th and So. 126th. The
policy indicates this as a viable residential area. This is where the
Industrial /Commercial meets the residential. Under Public Services the
Fire and Police Protection and maintenance of Public Facilities would
be assumed by the City. The comment here is that the City may request
Fire District 18 and 1 to continue providing fire protection service
on a contractual basis.
Mr. Stoknes continued with some additional information. According to
1970 Census figures, the population of the area is 1,229. This figure
may be a little high. The assessed valuation is $14,790,650 and the
land area, 270 acres. Revenue estimates to the City from the proposed
annexation is $86,407.
Councilman Hill said that so far the Council has not received any
input from the Staff as to additional personnel and equipment necessary
to serve the area. He said he doesn't believe in annexing an area if
you can't provide the services. Council needs more information.
Councilman Johanson said that costs have never come to Council and
now is as good a time as any to discuss it so everyone can have input.
Mayor Bauch reminded Council that many times you see our Police cars
outside of the City. This is because of the way the streets are laid
out. There should be no increase in the amount of staff, just in
materials.
Councilman Bohrer agreed that costs must be considered in the final
acceptance of an annexation. At the present time Council does not
have enough information for a complete cost analysis. The annexation
policy indicates that decisions by the City will be made with
consultation from the people who are going to annex. There are some
steps that need to be taken before final costs can be arrived at. The
complete analysis of costs has to wait until Council is ready to make
the final decision on the annexation.
Councilman Johanson said he would like assurance that Council, at some
point, would receive this information.

Mary Brummel, audience, said she knows for a fact that no one from Fire
District #18 has been approached by anyone as to their thoughts on a
Fire Protection Contract. If a contract is not possible what would
the City do? Mayor Bauch stated that the City would respond.
Sharon Mann, 3404 S. 126th, asked if Tukwila has full time Fire personnel
and was told yes. She stated that the response time from a full -time
Department would be faster than from their volunteer department.
Councilman Bohrer offered that the reason the Fire Districts have not
been contacted is because this meeting is only to correct the procedure
for adoption. Once this is out of the way it is the intent of the
Council to approach the Fire Districts.
Jim Angle, Commissioner from Fire District #18, stated that they have
no rules or regulations to allow them to serve this area for Tukwila.
They only have a Mutual Aid Agreement which says they will respond
with an old fire truck and two men.
Elizabeth Springer, audience said she has talked with someone from
District #18 who said they would not be interested in a contract with
Tukwila. She commented that Council has been stampeded into thinking
there is a large section of people in Riverton that want to join
Tukwila -this is not so. They have nothing to gain by entering Tukwila.
Their Fire and Police Service is good and the planning has been done
under the Highline Community Plan. They have much to gain by staying
in the County and little or nothing to gain by joining Tukwila.
Shirley Robinson, 13422 -40th Ave. South, stated that in the last
General Election there were 235 people that voted and there were 77
names on the petitions asking to be considered for annexation to
Tukwila.
Jim Angle, asked if the petitions are signed by land owners or voters.
Mayor Bauch stated that the law requires that registered voters
sign petitions. Council is bound to consider the petitions.
Councilman Van Dusen said he has also been looking for the economic
impact of annexation of this area. He is not too concerned about
it now as the proposal has to go to the Boundary Review Board first,
then back to the City Council for acceptance.
Mrs. Mann, speaking as a voter who signed the petition, said it has
cost a lot of money to go to the County and ask them to enforce their
land use laws. In her area they are not enjoying sewers coming in
or streets being widened or improved. They have taken time to compare
what King County has to offer and what Tukwila has to offer and they
feel that Tukwila, at this point in time, has a great deal to offer.
Councilman Van Dusen read a letter from C. Deraedt, President, Delta
Masonic Temple, Inc. "At the regular meeting of Delta Masonic Temple,
Inc., September 13, 1978, a motion was passed that Tukwila City Council
be requested to extend the City boundary to include Delta Masonic
Temple, and we therefore petition the Council of the City of Tukwila
that this property, located at 13034 -41st Ave. So., be incorporated
within the boundary of the City of Tukwila."

Attorney Hard agreed that the language in this resolution is significantly
different than the one passed earlier. The reason is, after reviewing
the State Statute on Annexation and taking into account comments by Mr.
Wallace, Attorney for Rainer Bank, in order to avoid problems later it
is necessary to take two steps on this procedure. One, pass a resolution
adopting a proposed zoning regulation for the area which would be
effective upon annexation. This Resolution says that, upon annexation
this property will come into the City as unclassified land (R -1 Resident-
ial). It also says that there will be two hearings to allow the public
to appear before Council to discuss the proposed zoning. Two, after
the annexation is in effect there will be a second set of hearings to
establish the specific zoning.
At the next Regular Council Meeting there will be a new proposed Resolu-
tion accepting the petition for annexation.
Mr. Robert Wallace, Attorney for Rainer Bank, said he still is not in
agreement that the Resolution is the proper procedure.
Mrs. Winifred Howlette, 11801 -40th Ave. So., asked what the boundaries
of the proposed annexation are so Mayor Bauch explained the area in-
cluded. The area would come into the City as unclassified. Mrs. HowlettE
asked about the Duwamish area and was told they were not included on the
petition. The people who circulated the petition drew the boundaries.
She said they receive Fire Protection from Duwamish and hoped they could
continue to do so if they are annexed to Tukwila. Mayor Bauch said that
Fire District #1 and the City have an excellent working relationship.
Mr. Dave Vanderwall, 4033 So. 128th, said it seemed to him there is a
lack of communication between the City of Tukwila and the occupants of
the area under consideration. He asked whose responsibility it is to
educate the people. Mayor Bauch offered that it is the citizens who
are seeking annexation who should inform the residents.
Mr. Curtiss Robinson commented that the single family residential is
being immediately threatened by Industrial zoning from the North. Any
delay is likely to result in more Industrial zoning. He again reminded
Council that 72 of the 235 registered voters who voted in the last
General Election signed the petition and this is enough to swing an
election.
Mr. Vanderwall said he is confused as to why the members of the Council
have so many questions which are seemingly of a procedural nature when
the Comprehensive Use Plan and the Annexation Documentation indicates
that the City is actively interested in this type of an annexation.
Councilman Johanson said he is asking the questions because of the timing.
He said he is concerned with Tukwila at this time not Riverton. When
the right time comes he will seek information on Riverton.
Councilman Bohrer, responding to Mr. Vanderwall, said the responsibility
for educating the people in the Riverton Area rests with a lot of
different people. It rests with the public process (Public Hearings and
Meetings), it depends on the petitioners, on the voters themselves and
on the press.

Attorney Hard explained that this way, if the resolution is passed, Council
is saying this land will be considered unclassified -this is a separate
and distinct declaration. Then, the statute requires two or more public
hearings so the citizens can talk about it. This is a better, safer,
more prudent course of action.
Councilman Van Dusen said he believes Council should follow the Attorney's
advice in this matter.

for these positions.
Mr. Monaghan reported on a Staff Report he had received from John
McFarland, Personnel Director. The Resolution provides for an amendment
of the position classification schedule for the Office Engineer from
salary grade 5, to salary grade 4, the creation of the position of
Engineering Technician I at salary grade 8, and the creation of the
position of Building Maintenance Superintendent at salary grade 6.
The aspect of building maintenance has changed with the acquisition
of the Southgate Facility and the opening of New City Hall. Both
facilities have some high level mechanical /electrical systems. The
position was originally to be staffed from the Park Department but
there is no one who fits the requirements.
Councilman Harris asked if the individual who comes into this position
would start at salary grade I. Mr. Monaghan offered that the person
would come in at a grade 5 and that he has an individual in mind.
Councilman Saul asked how many hours a day the person would actually
work in this position. Mr. Monaghan said his guess is about 20 hours
per week and that he would do ground maintenance at City Hall and South-
gate to relieve the Park Department. This person could work into the
Park Crew for the summer time and be stationed at the City Shop June
through August.

Councilman Traynor said he would like to see Council put this in the
Personnel Committee to review the Job Descriptions to see if they
agree with the Salary Grade.
Councilman Bohrer asked how many positions this resolution involves.
Mr. Monaghan said he would like to establish the titles of Junior
Engineer (Engineering Technician) and Senior Engineer (Office
Engineer). Other titles could fall into these catagories. Then,
there is the Building Maintenance Supervisor.
Councilman Bohrer said he has a couple of concerns-the first is to
understand what the structure of the Public Works Department will be

Mayor's Report Mayor Bauch reminded Council of the Suburban Mayors meeting, on Wednes-
day, at the Red Lion Inn.
Display Area Councilman Van Dusen suggested some type of softwood be installed for
display purposes instead of pinning maps to the present wood.
City Attorney's Attorney Hard reported that September was a calm month. He reported

a new lawsuit filed against the City by Alfred Schmid involving a
proposed apartment development at So. 160th.
The City Light Pond issue is coming to the foreground.
The brief in the Shirley Kinney suit has been filed in the Court of
Appeals. The next step is to set a hearing date.
On October 12th there will be a hearing before the Court of Appeals
on the Fire Department Social Security Lawsuit.
L.I.D. #28 is still in the Court of Appeals. The City is asking to
have this suit dismissed. This will be decided on October 6th.
Requested Resolution Councilman Traynor requested that a Resolution of appreciation be drawn
thanking the Doubletree Inn for their part in the grand opening
ceremony of new City Hall.
