During this time period, cover or mulch other disturbed areas, if they will be unworked more than 2 days. Covered material must be stockpiled on site at the beginning of this period. Inspect and maintain this stabilization weekly and immediately before, during and following storms. 35: From May 1 through September 30, inspect and maintain temporary erosion prevention and sediment at least monthly. The reason for this condition is with regards to setbacks along S. 122"d Street. D13-233 was submitted to the City on July 11, 2013 and included a site plan that indicated that the proposed addition would not meet setbacks. In the City's comment letter dated July 23, 2013, the Planning Division stated that the addition did not meet setbacks and provided options for you in moving the project forward. On July 29, 2013, you responded to the City's comment letter by providing a new site plan. The site plan provided on July 29, 2013 also did not meet setbacks. In a letter dated August 13, 2013, the City stated the plans were insufficient for moving forward because they were hand drawn and had altered plans prepared by an architect. On August 19, 2013, you provided a letter from your architect stating that he was granting you permission to alter his plans. The August 19, 2013 plans show a proposed addition that now meets setbacks. The City is imposing the condition listed above on this project for the following reasons: 1. The July 11th plans, prepared by an architect, indicated that the project would not meet setbacks. To address the issues you provided the August 19th plans, which now show that the proposed addition will meet setbacks. No explanation was provided to explain why the original plans did not meet setback nor was any independent documentation provided to clearly document the property line along S. 122"d Street. 2. The August 19th plans have the following note, "Site contours and existing improvements shown are approximate. This is not a survey." This note is concerning because the August 19th plans just meet the minimum setback requirements. Once you have the property lines along S. 122"d Street staked please have the survey submit a letter to the City stating when the stakes were installed and whether the proposed addition will meet setbacks. This must occur prior to foundation inspection. The City will verify that the stakes have been installed and setbacks. Under Title 18 of the Tukwila Municipal Code (TMC) the setback from S. 122nd Street should be 10 feet, not five. The proposed addition proposes maintaining this existing non -conforming setback. TMC 18.70.050 (6) only allows a 50% increase in additional square footage, compared to what is there now. Thus, the proposed additional is too large. Furthermore, the proposed additional cannot be two stories if it does not meet setbacks. There are three options to address this situation: • Redesign the addition to that it meets backs from S. 122nd Street (ten feet); • . Remove the 2nd story addition and ensure that the size of the additional is not larger than 50% of the current intrusion into the setback area; or • Apply for a variance. 2. Public utilities operating under the regulations of the utilities and transportation commission in construction, maintenance, or development work incidental to their own business; 4. Any construction, repair, or operation incidental to the discovering or producing of petroleum or gas, or the drilling, testing, abandoning, or other operation of any petroleum or gas well or any surface or underground mine or mineral deposit when performed by an owner or lessee; 5. The sale of any finished products, materials, or articles of merchandise that are not fabricated into and do not become a part of a structure under the common law of fixtures; 6. Any construction, alteration, improvement, or repair of personal property performed by the registered or legal owner, or by a mobile/manufactured home retail dealer or manufacturer licensed under chapter 46.70 RCW who shall warranty service and repairs under chapter 46.7o RCW; 7. Any construction, alteration, improvement, or repair carried on within the limits and boundaries of any site or reservation under the legal jurisdiction of the federal government; 8. The exemption prescribed in this subsection does not apply in any instance wherein the work or construction is only a part of a larger or major operation, whether undertaken by the same or a different contractor, or in which a division of the operation is made into contracts of amounts less than five hundred dollars for the purpose of evasion of this chapter or otherwise. The exemption prescribed in this subsection does not apply to a person who advertises or puts out any sign or card or other device which might indicate to the public that he or she is a contractor, or that he or she is qualified to engage in the business of contractor; 10.
