PERMIT CONDITIONS: 1: ***FIRE DEPARTMENT CONDITIONS*** 2: The attached set of building plans have been reviewed by the Fire Prevention Bureau and are acceptable with the following concerns: 3: The total number of fire extinguishers required for a light hazard occupancy with Class A fire hazards is calculated at one extinguisher for each 3,000 sq. ft. of area. The extinguisher(s) should be of the "all purpose" (2A, 10 B:C) dry chemical type. The travel distance to any extinguisher must be 75' or less. (IFC 906.3) (NFPA 10, 3-2.1) 4: Portable fire extinguishers, not housed in cabinets, shall be installed on the hangers or brackets supplied. Hangers or brackets shall be securely anchored to the mounting surface in accordance with the manufacturer's installation instructions. Portable fire extinguishers having a gross weight not exceeding 40 pounds (18 kg) shall be installed so that its top is not more than 5 feet (1524 mm) above the floor. Hand-held portable fire extinguishers having a gross weight exceeding 40 pounds (18 kg) shall be installed so that its top is not more than 3.5 feet (1067 mm) above the floor. The clearance between the floor and the bottom of the installed hand-held extinguishers shall not be less than 4 inches (102 mm). (IFC 906.7 and IFC 906.9) 5: Fire extinguishers shall not be obstructed or obscured from view. In rooms or areas in which visual obstruction cannot be completely avoided, means shall be provided to indicate the locations of the extinguishers. (IFC 906.6) • • 6: Extinguishers shall be located in conspicuous locations where they will be readily accessible and immediately available for use. These locations shall be along normal paths of travel, unless the fire code official determines that the hazard posed indicates the need for placement away from normal paths of travel. (IFC 906.5) 7: Fire extinguishers require monthly and yearly inspections. They must have a tag or label securely attached that indicates the month and year that the inspection was performed and shall identify the company or person performing the service. Every six years stored pressure extinguishers shall be emptied and subjected to the applicable recharge procedures. If the required monthly and yearly inspections of the fire extinguisher(s) are not accomplished or the inspection tag is not completed, a reputable fire extinguisher service company will be required to conduct these required surveys. (NFPA 10, 4-3, 4-4) 8: Portable fire extinguishers shall be provided within a 30 -foot (9144 mm) travel distance of commercial - type cooking equipment. Cooking equipment involving vegetable or animal oils and fats shall be protected by a Class K rated portable extinguisher. (IFC 904.11.5) 9: Every room or space that is an assembly occupancy shall have the occupancy load of the room or space posted in a conspicuous place, near the main exit or exit access doorway from the room or space. Posted signs shall be of an approved legible permanent design and shall be maintained by the owner or authorized agent. (IFC 1004.3) 10: Egress doors shall be readily openable from the egress side without the use of a key or special knowledge or effort. (IFC 1008.1.8.3 subsection 2.2) 11: Each door in a means of egress from an occupancy of Group A or E having an occupant load of 50 or more and any Group H occupancy shall not be provided with latch or lock unless it is panic hardware or fire exit panic hardware on rated fire doors. (IFC 1008.1.9) 12: Door handles, pulls, latches, locks and other operating devices on doors required to be accessible by Chapter 11 of the International Building Code shall not require tight grasping, tight pinching or twisting of the wrist to operate. (IFC 1008.1.8.1) 13: Exit hardware and marking shall meet the requirements of the International Fire Code. (IFC Chapter 10) 14: Exits and exit access doors shall be marked by an approved exit sign readily visible from any direction of egress travel. Access to exits shall be marked by readily visible exit signs in cases where the exit or the path of egress travel is not immediately visible to the occupants. Exit sign placement shall be such that no point in an exit access corridor is more than 100 feet (30,480 mm) or the listed viewing distance for the sign, whichever is less, from the nearest visible exit sign. (IFC 1011.1) 15: Every exit sign and directional exit sign shall have plainly legible letters not less than 6 inches (152 mm) high with the principal strokes of the letters not less than 0.75 inch (19.1 mm) wide. The word "EXIT" shall have letters having a width not less than 2 inches (51 mm) wide except the letter "I", and the minimum spacing between letters shall not be less than 0.375 inch (9.5 mm). Signs larger than the minimum established in section 1011.5.1 of the International Fire Code shall have letter widths, strokes and spacing in proportion to their height. The word "EXIT" shall be in high contrast with the background and shall be clearly discernible when the exit sign illumination means is or is not energized. If an arrow is provided as part of the exit sign, the construction shall be such that the arrow direction cannot be readily changed. (IFC 1011.5.1) 16: Exit signs shall be illuminated at all times. To ensure continued illumination for a duration of not less than 90 minutes in case of primary power loss, the sign illumination means shall be connected to an emergency power system provided from storage batteries, unit equipment or on-site generator. (IFC 1006.1, 1006.2, 1006.3) 17: Emergency lighting facilities shall be arranged to provide initial illumination that is at least an average of 1 foot-candle (11 lux) and a minimum at any point of 0.1 foot-candle (1 lux) measured along the path of egress at floor level. Illumination levels shall be permitted to decline to 0.6 foot-candle (6 lux) average and a minimum at any point of 0.06 foot-candle (0.6 lux) at the end of the emergency lighting time duration. A maximum -to -minimum illumination uniformity ratio of 40 to 1 shall not be exceeded. (IFC 1006.4) 18: Aisles leading to required exits shall be provided from all portions of the building and the required width of the aisles shall be unobstructed. (IFC 1013.4) 19: Maintain sprinkler coverage per N.F.P.A. 13. Addition/relocation of walls, closets or partitions may require relocating and/or adding sprinkler heads. (IFC 901.4) i • 20: Sprinklers shall be installed under fixed obstructions over 4 feet (1.2 m) wide such as ducts, decks, open grate flooring, cutting tables, shelves and overhead doors. (NFPA 13-8.6.5.3.3) 21: All new sprinkler systems and all modifications to existing sprinkler systems shall have fire department review and approval of drawings prior to installation or modification. New sprinkler systems and all modifications to sprinkler systems involving more than 50 heads shall have the written approval of Factory Mutual or any fire protection engineer licensed by the State of Washington and approved by the Fire Marshal prior to submittal to the Tukwila Fire Prevention Bureau. No sprinkler work shall commence without approved drawings. (City Ordinance No. 2327). 22: An approved manual fire alarm system including audible/visual devices and manual pull stations is required for this project. The fire alarm system shall meet the requirements of Americans With Disabilities' Act (I.B.C.), N.F.P.A. 72 and the City of Tukwila Ordinance #2328. 23: Maintain fire alarm system audible/visual notification. Addition/relocation of walls or partitions may require relocation and/or addition of audible/visual notification devices. (City Ordinance #2328) 24: All new fire alarm systems or modifications to existing systems shall have the written approval of The Tukwila Fire Prevention Bureau. No work shall commence until a fire department permit has been obtained. (City Ordinance #2328) (IFC 104.2) 25: An electrical permit from the City of Tukwila Building Department Permit Center (206-431-3670) is required for this project. 26: All electrical work and equipment shall conform strictly to the standards of the National Electrical Code. (NFPA 70) 27: The maximum flame spread class of finish materials used on interior walls and ceilings shall not exceed that set forth in Table No. 803.5 of the International Building Code. 28: In occupancies of Groups A, E, I and R-1 and dormitories in Group R-2, curtains, draperies, hangings and other decorative materials suspended from walls or ceilings shall be flame resistant in accordance with NFPA 701 or be noncombustible. Where required to be flame resistant, decorative materials shall be tested by an approved agency and pass Test 1, as described in NFPA 701, or such materials shall be noncombustible. Reports of test results shall be prepared in accordance with NFPA 701 and furnished to the fire code official upon request. (IFC 805.1, 805.2) 29: New and existing buildings shall have approved address numbers, building numbers or approved building identification placed in a position that is plainly legible and visible from the street or road fronting the property. These numbers shall contrast with their background. Address numbers shall be Arabic numbers or alphabet letters. Numbers shall be a minimum of 4 inches (102mm) high with a minimum stroke width of 0.5 inch (12.7mm). Such bracing shall be independent of any ceiling splay bracing. 41: All construction shall be done in conformance with the Washington State Building Code and the Washington State Energy Code. 42: All food preparation establishments must have Seattle/King County Department of Public Health sign -off prior to opening or doing any food processing. Arrangements for final Health Department inspection shall be made by calling Seattle/King County Department of Public Health, (206/296-4928), at least three working days prior to desired inspection date. On work requiring Health Department approval, it is the contractor's responsibility to have a set of plans approved by the agency on the job site. 43: There shall be no occupancy of a building until final inspection has been completed and approved by Tukwila building inspector. No exception. 44: Remove all demolition rubble and loose miscellaneous material from lot or parcel of ground, properly cap the sanitary sewer connections, and properly fill or otherwise protect all basements, cellars, septic tanks, wells, and other excavations. Final inspection approval will be determined by the building inspector based on satisfactory completion of this requirement. 45: A Certificate of Occupancy shall be issued for this building upon final inspection approval by Tukwila building inspector. 46: All plumbing and gas piping work shall be inspected and approved under a separate permit issued by the City of Tukwila Building Department (206-431-3670). 47: All electrical work shall be inspected and approved under a separate permit issued by the City of Tukwila Permit Center. 48: VALIDITY OF PERMIT: The issuance or granting of a permit shall not be construed to be a permit for, or an approval of, any violation of any of the provisions of the building code or of any other ordinances of the City of Tukwila. RECITALS WHEREAS, the Chateau Event Center, owned by Viva Events Center, DBA Chateau Event Center, is a commercial business desiring to locate in the City of Tukwila; and WHEREAS, the City of Tukwila, through the police powers provided to it by the State of Washington and Title 18, "Zoning Code," of the Tukwila Municipal Code (TMC), regulates any offsite parking impacts; and WHEREAS, TMC 18.56 requires a parking determination for assembly uses such as the proposed Event Center; and WHEREAS, building permit D13-261 was issued with the understanding that for a maximum occupancy of 350 people, a total of 165 parking spaces must be available, and this was intended to be accomplished with 100 spaces on site and an agreement with the neighboring Embassy Suites for an additional 65 spaces; and WHEREAS, the blanket agreement for overflow parking at Embassy Suites sites is no longer valid, and it has been revised to allow parking on a per event bases only if there is any surplus available; WHEREAS, the Business Owner has proposed a valet parking plan to accommodate a total of 153 parking spaces on-site; and WHEREAS, the Business Owner is responsible for managing parking on its property with no negative off-site parking impacts; and and WHEREAS, the Business Owner is responsible for maintaining the fire lanes open at all times; 1 I WHEREAS, both the City and the Business Owner wish to resolve the parking issue at the Event Center in a manner which allows for operation of the Event Center without negative off-site parking impacts; and NOW THEREFORE, in consideration of the mutual promises set forth herein, the parties hereto agree as follows: III. AGREEMENT Section 1. The Subject Property. The Chateau Event Center, King County Parcel No. 2523049007, is located at _16401 West Valley Highway, situated within the City of Tukwila, King County, Washington and depicted in Exhibit "A" attached hereto. Section 2. Violations. The Department of Community Development Director has determined that the minimum number of parking spaces required for the Chateau Event Center is 165 spaces. The Business Owner acknowledges that there is no longer a blanket parking agreement with Embassy Suites to meet this requirement, which was the premise under which building permit D13-261 was approved. The Parties hereby agree that without a blanket covenant parking agreement bringing the total number of available parking spaces up to 165, the Business Owner shall be in violation of the TMC should the Chateau Events Center hold any event in excess of 200 attendees without securing 65 additional parking spaces via a covenant parking agreement pursuant to TMC 18.56.070 and providing an offsite parking plan to the City as set forth in Section 3 herein. The Business Owner acknowledges that it is his responsibility to manage all parking on-site, and that he is responsible for any violations of the Zoning Code related to the parking standards set forth in TMC 18.56, or any violations of this Agreement. Section 3. Required Corrective Action. The Business Owner shall manage all parking on-site for any planned events per the valet parking plan, attached hereto as Exhibit B. If any offsite parking is required for compliance with the City's parking regulations, the Business Owner shall provide a plan to the City for approval at least 10 working days prior to the event. The plan shall include documentation that agreements are in place for any offsite parking. In addition, for any events where occupancy of more than 200 people is expected, the Business Owner shall provide a parking management plan to the City for approval at least 10 working days prior to the event. In the event the Business Owner fails to comply with this Agreement or if any complaints are received for any off-site parking impacts, the Business Owner shall have 30 days in which to secure a blanket Covenant Parking Agreement as set forth in TMC 18.56.070 to meet minimum parking requirements, or to apply for a building permit for city's approval to reduce the maximum building occupancy to 200 people. All events shall be limited to a maximum occupancy of 200 people until the new blanket Covenant Parking Agreement is approved by the city. In the event a correction is not achieved in such timeframe and the requirements met, the business owner agrees to then forfeit the Certificate of Occupancy for Chateau Event Center and shall cease and desist all operations until a revised parking 2 approval is obtained from the City. The City will reissue the Certificate of Occupancy Once after all parking issues have been resolved. Section 5. Right of Entry. The Business Owner agrees that the City may inspect the premises as may be necessary to determine compliance with this Agreement. Section 7. Abatement. The Business Owner agrees that the City may abate any off-site parking violations, and may recover its costs and expenses as described in TMC 8.45.105 and/or a monetary penalty pursuant to TMC 19.12.170 and/or TMC Chapter 8.45 if the terms of this Voluntary Correction and Limited Right of Entry Agreement are not satisfied. Section 8. Waiver of Right to Appeal. By signing below, the Business Owner agrees to voluntarily waive the right to appeal the City's determination of the violations of the specified corrective actions set forth herein. Section 10. Effective Date. This Agreement shall commence upon final execution of the agreement by both parties. Section 11. Assignment of Interests, Rights and Obligations. This Agreement shall be binding and inure to the benefit of the Parties. No Party may assign its rights under this Agreement without the written consent of the other Party, which consent shall not unreasonably be withheld. This Agreement shall be biding upon and shall inure to the benefit of the heirs, successors, and assigns of the Business Owner and the City. Business Owner agrees to provide a copy of this agreement to any perspective purchaser of the business. Section 12. Incorporation of Recitals. The Recitals contained in this Agreement, and the Preamble paragraph preceding the Recitals, are hereby incorporated into this Agreement as if fully set forth herein. Section 13. Severability. The provisions of this Agreement are separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section, or portion or the invalidity of the remainder of this Agreement, or the validity of its application to other persons or circumstances, shall not affect the validity of the remainder of this Agreement, or the validity of its application to other person or circumstances. Section 14. Governing Law and Venue. This Agreement shall be construed and enforced in accordance with the laws of the State of Washington. Venue for any action shall lie in King County Superior Court. Section 15. No Third -Party Beneficiaries. This agreement is for the benefit of the Parties hereto only and is not intended to benefit any other person or entity, and no person or entity not a signatory to this Agreement shall have any third -party beneficiary or other right whatsoever under this Agreement. No other person or entity not a Party to this Agreement may enforce the terms and provisions of this Agreement. 3 Section 16. Integration. This Agreement represents the entire agreement of the parties with respect to the subject; matter hereof. There are no other agreements, oral or written, except as expressly set forth herein. Section 17. Authority. The Parties each represent and warrant that they have full power and actual authority into this Agreement and to carry out all actions require of them by this Agreement. All persons are executing this Agreement in their representative capacities and represent and warrant that they have full power and authority to bind their respective organizations. Section 18. Releases. The Business Owner may free itself from further obligations relating to the sold, assigned, or transferred property, provided that the buyer, assignee or transferee expressly assumes the obligations under this Agreement as provided herein. Section 20. Notices. Notices, demands, or correspondences to the City and Business Owner shall be sufficiently given if dispatched by pre -paid first-class mail to the addresses provided by the executing parties below. Notice to the City shall be to the attention of both the Director of Community Development and the City Attorney. Notices to subsequent business owners shall be required to be given by the City only for those owners who have given the City written notice of their addresses for such notice. The parties hereto may, from time to time, advise the other of new addresses for such notices, demands or correspondence. Section 21. Police Power. Nothing in this agreement shall be construed to diminish, restrict or limit the police powers of the City granted by the Washington State Constitution or by general law. Section 22. No presumption Against Drafter. It is DCD's understanding that the building will be used for events, such as weddings, private parties, and other similar events. You have indicated in the past that the building will not be used as nightclub. On March 13, 2014, the City received a revised building permit application. The revised application showed restaurant style seating in the building. This seating is movable and has the ability to be relocated in the building. The restaurant style seating reduces the building occupancy load. According to the revised plans, the buildings total occupancy will be 352 occupants (main floor and mezzanine). There are a total of a 100 parking stalls on site. You have provided a copy of a letter from Embassy Suites, located at 15920 West Valley Highway, which states that it will provide 65 parking stalls to you; bringing the total number of parking stalls available for your use to 165. To further address how parking on the site would be managed you stated in an email dated March 26, 2014 that: "Viva Event Center has approximately 100 parking spaces on site, which will easily accommodate over 90% of the events that we expect to host at our property. During the vast majority of events, visitors will be encouraged to park in our on-site parking lot, which will have sufficient space. When we have large events planned that will stress the limits of our on-site parking capabilities, will send out notice to all invitees through direct mail, telephone calls, and social media relating the news that we are expecting a potential occupancy that may exceed our on-site parking ability and directing invitees to use public transportation if at all possible, and if the lot is full when they arrive, directions will be included to the Embassy Suites parking lot where we have an agreement to use up to 65 spots. All in all it was a good learning experience. Moving forward the venues agreement with Embassy is still in tact for future parking, just wasn't for this potential event, as they didn't want any question of legalities. I have no plan to modify the normal parking plan for the future as this event request was very very rare and would require extra special provisions addressed way out in front from the right places if they wanted to propose something along these lines again.This is a pretty out of ordinary event and I simply will not be having parking changes like this. Additionally, because of the tent permitting and moratorium question, which I don't have experience on, I instructed the group at their own risk to attain all information and permits direct with the city as needed for their plans.There was a bit of a learning curve involved here and I certainly learned a few things myself and will be a better information resource for renters in the future. I believe their intentions were good, but this area is very new area for everyone. Again, for that we have deferred to the cities position and stance and cancelled the magazines event. A covenant between the owner or operator of the principal use, the owner of the parking spaces and the City stating the responsibilities of the parties shall be executed. This covenant and accompanying legal descriptions of the principal use and the lot upon which the spaces are to be located shall be recorded with King County, and a copy with the recording number and parking layouts shall be submitted as part of any permit application for development. 2. Troy assured me there would be plenty of parking for the guests and that all overflow parking would be directed to Embassy Suites on West Valley. A letter from Embassy Suites in the file from Markie Hamlin Hotel Controller of Embassy Suites dated March 13, 2014 allowing for 65 spaces. I contacted Embassy Suites (425-227-8844) and was informed Markie Hamlin was not in, I was transferred to the Hotel General Manager Maureen Hussmann (sp?). Maureen Hussmann explained that they have not have any contact with Viva Events Center since the March 2014 letter and said that Embassy Suites will not allow them to park on their property. She said they have security and will turn the event guest away. The Fire Department has received a permit application to install three (two?) tents in the parking lot. These tents cover a many of the 100 parking spaces. I was informed the event also scheduled four food trucks that will be in the parking lot as well but have not verified this. [Parking is an issue]. 3. The City of Tukwila has moratorium on selling recreational marijuana. The website is selling "Judges Passes" for $99.00 each, included is ten .5 grams of marijuana. Legal will have to make the final determination for sale of marijuana. At this time there are other concerns such as: 4. The event website has sold 300+ tickets to the event. How will security be addressed? 5. Overcrowding of the site [45 mph intersection]. 1 6. This is a marijuana [Dope Magazine's Fourth Annual Dope Cup] event. Comments D13-261 Page 2 September 17, 2013 b) Fire Prevention There is an existing 6" Detector Double Check Valve Assembly (DCVA) on the fire line; however, Public Works has not received required annual backflow test reports since 2000. Fire Department Connection (FDC) has been removed recently. Not sure if it was stolen for scrap metal or if it was removed for replacement. FDC shall have a Storz Knox Lock Box installed. Tamper switches need to be installed on the fire line isolation valves. c) Landscape Irrigation There is a Double Check Valve Assembly on the irrigation system connection; however, Public Works has never received required annual backflow test reports. There is an existing sewer deduct meter that is not compatible with the AMR meter reading system. A SENSUS meter and radio needs to be installed if the owner wants to continue to get sewer deduction for irrigation water usage. If you need assistance locating backflow deficiencies in the field, please contact Mr. Todd Reedy, Water Department Operations Foreman at (206) 571-6309.
