Water Fund Sewer Fund MOVED BY VAN DUSEN, SECONDED BY TRAYNOR, THAT DECEMBER 18, 1978, BE SET AS THE DATE FOR THE SECOND PUBLIC HEARING ON THE PROPOSED RIVERTON ANNEXATION ZONING CLASSIFICATION.* Councilman Johanson said it still concerns him that the City is holding Public Hearings on an area which we have no jurisdiction over. Attorney Hard stated that the law requires this. Councilman Harris asked if there is any doubt that the Boundary Review Board will address this. Mayor Bauch explained that if 5% of the property owners petition the Boundary Review Board will invoke jurisdiction. It is not mandatory if the criteria of the law is met. Councilman Harris asked if this area is included in the Comprehensive Plan and was told that it is. *MOTION CARRIED WITH JOHANSON VOTING NO. Claim involves actions of Tukwila Police Department. Investigation by the City's Professional Liability Carrier revealed that there is no civil liability on the part of the City nor the Police Officer involved. He recommended the claim be denied. MOVED BY VAN DUSEN, SECONDED BY HARRIS, THAT COUNCIL CONCUR WITH THE CLAIM REPRESENTATIVE AND DENY THE CLAIM. MOTION CARRIED. Councilman Van Dusen read a letter from George C. Martin, Conservation Chairman, Northwest Fly Anglers. The letter commends the Council on their action concerning the City Light Pond near Southcenter. He states that they are a fly fishing club but support any action that conserves wild life. ORDINANCES Ordinance #1087 Setting forth requirements on street vacations. RESOLUTIONS Resolution #661 authorizing the Mayor to negotiate and execute ease- ments in conjunc- tion with L.I.D. #29. Reference made by Mayor Bauch to his letter concerning the purchase of voting receivers for Valley Comm. Battery operated radios are low wattage and have a limited transmitting range. This has caused some blind spots and the loss of contact during some emergency operations. The solution to the problem is to install voting receivers or repeaters. The preliminary cost of equipment is approximately $3,700 and installation costs approximately $3,000. Continuing operational costs are $1,800 annually. MOVED BY VAN DUSEN, SECONDED BY HILL, THAT COUNCIL CONCUR WITH THE RECOMMENDATION OF THE MAYOR AND PURCHASE THE VOTING RECEIVERS FOR VALLEY COMM.* Councilman Harris asked if the $6,700 would be split equally between the Cities of Renton and Tukwila and was assured that was correct. *MOTION CARRIED. MOVED BY VAN DUSEN, SECONDED BY JOHANSON, THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED. Deputy City Attorney Hard read an ordinance of the City of Tukwila setting forth requirements on street vacations consistent with RCW 35.79.010 030. MOVED BY VAN DUSEN, SECONDED BY HILL, THAT ORDINANCE #1087 BE ADOPTED AS READ.* Attorney Hard explained the changes he has made. (1) Made editorial changes throughout. (2) Added Section 2, Definitions. (3) Added Section 8, Acquisition by Public Entity. (4) Added Section 9, Severability. Attorney Hard explained that the street vacation procedure is governed strictly by State Law, except for Section 8 which is in addition to the law. This is just putting it in a working document form. *MOTION CARRIED. MOVED BY VAN DUSEN, SECONDED BY HILL, THAT THE PROPOSED RESOLUTION BE READ BY TITLE ONLY. MOTION CARRIED. Deputy City Attorney Hard read a resolution of the City of Tukwila, Washington authorizing the Mayor to negotiate and execute easements for property in conjunction with LID #29. MOVED BY VAN DUSEN, SECONDED BY HILL, THAT RESOLUTION #661 BE ADOPTED AS READ.* Terry Monaghan, Public Works Director, explained that in engineering the road alignment for 62nd Avenue South there is a conflict with the creek and proposed City Hall landscaping if the alignment is symmetrical with the right of -way centerline. To eliminate this, the alignment has been shifted to the west. By doing this, the east curbline is approximately 25 feet west of the east right -of -way line. This preserves the creek and all but 5 feet of the west side City Hall landscaping. The proposal is to build a 34 foot roadway section. The problem is that there is no room on the west side for a sidewalk. It has been discussed with and agreed to by the developers of the land immediately adjacent to the west right -of -way that a permanent easement of at TUKWILA CITY COUNCIL REGULAR MEETING November 20, 1978 Page 3 RESOLUTIONS CONT. DEPARTMENT REPORTS Mayor's Report Finance Director's Report of Investments King Subregional Plan Budget Review ADJOURNMENT 7:55 P.M. least 15 feet for sidewalk be given to the City. The cost of the sidewalk to be included in the LID. In exchange for this, the City will grant, to the owners of this property to the west, a permanent easement for the City right -of -way to the south to be used for parking and internal driveway. This right -of -way is a State Highway Department turnback parcel and does not appear to enter into any future City property development plans. In addition, the property owners will deed and dedicate at no cost to the City the 5 foot frontage on 62nd Avenue South to allow for widening, and the northeast corner of their property to allow for a better turning radius and sight distance. Mr. Monaghan again said that one of the reasons for this is to preserve the creek. Councilman Hill asked if we need 15 feet for a sidewalk. Mr. Monaghan explained that a meandering type sidewalk is planned to maintain the character of the City Hall landscaping. Councilman Bohrer asked what the comparison is on what the area the City is getting to what the area is the City is giving. He was told that the City will be receiving 500 to 700 square feet more than the property owner. *MOTION CARRIED. Mayor Bauch displayed the citation presented to the City Employees for significantly increasing contributions to the United Way of King County. Councilman Harris read the Investment Report submitted by Ron Swanson, Finance Director. Interest income for the month of October, 1978, was $20,883.26. Investments Sold: $2,324,000 Investments Purchased: $2,230,000 Mayor Bauch reported that he has received the Environmental Impact Statement on the King Subregional Plan. The Public Hearing will be held December 15th. He recommended that the E.I.S. be placed in the Community Affairs Committee for review. MOVED BY HILL, SECONDED BY HARRIS, THAT THE ENVIRONMENTAL IMPACT STATEMENT BE PLACED IN THE COMMUNITY AFFAIRS COMMITTEE. MOTION CARRIED. It was decided to move the review of the Police Department Budget to Monday the 27th. MOVED BY SAUL, SECONDED BY VAN DUSEN, THAT THE REGULAR MEETING OF THE TUKWILA CITY COUNCIL ADJOURN.
