Mayor Bauch, presiding, led the Pledge of Allegiance and called
the Regular Meeting of the Tukwila City Council to order.

Councilman Bohrer noted Voucher No. 1150 for a Ballroom Dance
Class for 108 students at $7.20 per student, total $777.60.
Mayor Bauch explained that this is a reimbursable to the
instructor. The students pay for the lessons. Councilman
Bohrer asked to have someone find out how many lessons were in
the series.

APPOINTMENTS
Board of Letter of recommendation from Mayor Bauch appointing Miss
Adjustment: Wendy Morgan to the Board of Adjustment was read for Council
Miss Wendy approval. Miss Morgan will fill vacant position No. 2 which
Morgan expires December 31, 1979.
MOVED BY VAN DUSEN, SECONDED BY HILL, THAT COUNCIL CONCUR
WITH THE MAYOR'S APPOINTMENT OF MISS WENDY MORGAN TO THE
BOARD OF ADJUSTMENT. MOTION CARRIED.
PROPOSED USE OF Mayor Bauch explained that the law requires that all
REVENUE SHARING Municipalities receiving Federal Revenue Sharing Funds hold
FUND Public Hearings on the use of the funds. Also, the City is
required to hold a Public Hearing on the Budget proposed for
PROPOSED 1979 1979. With this, Mayor Bauch declared the Public Hearing
BUDGET open for citizen comment on both subjects.

Mrs. Marie Gardner, 14112 57th Avenue South, asked if there
were funds provided in the proposed budget to renovate the old
City Hall to make it usable as a library. Mayor Bauch explained
that there are funds available in the Land Acquisition and
Building Development Fund. It is not known at this time
what will be required to upgrade the building. Mrs. Gardner
said representatives of the King County Library are willing
to come out and work with the City. Mayor Bauch offered that
$35,000 has been allocated for the operation of the Library.
Mayor Bauch called attention to the proposed use of the
Revenue Sharing Funds (Page 146 A). All of the money will
be used for Capital equipment.
There being no further questions or comments, the Public
Hearing was closed.
Councilman Van Dusen, announced that Council will hold their
final Budget review meeting on Saturday, the 9th at 8:00 A.M.
PETITIONS, COMMUNICATIONS, APPEALS AND SIMILAR MATTERS
MOVED BY VAN DUSEN, SECONDED BY HILL, THAT COUNCIL CONCUR
WITH THE RECOMMENDATION OF HUBERT CRAWLEY, FIRE CHIEF.*
Letter dated November 30, 1978, from Chief Crawley was read
for the record. He is recommending that the 1973 Aid Car be
offered to the Valley Medic 1 Provider Group to be used as
a secondary aid unit. A fair price would be $4,000. He
asked that they be given 30 days to respond to this offer.
If they do not accept, he recommends that the unit be
surplussed as soon as possible.
Councilman Van Dusen asked if the new unit is functional and
was told it is in operation.

Memorandum from Terry Monaghan, Public Works Director, was
read. He states that the Signal Project installed by Totem
Electric is now complete to the satisfaction of the Public
Works Department, and he recommends that the project be
accepted.
MOVED BY VAN DUSEN, SECONDED BY HILL, THAT COUNCIL ACCEPT
THE SIGNAL PROJECT AS RECOMMENDED BY TERRY MONAGHAN. MOTION
CARRIED.
MOVED BY VAN DUSEN, SECONDED BY HILL, THAT COUNCIL HOLD A
SPECIAL WORK SESSION WITH FIRE DISTRICT NO. 1 ON TUESDAY,
DECEMBER 5th, 7:30 P.M. AT SOUTHGATE. MOTION CARRIED.
Mayor Bauch recognized for the record the receipt of Summons
No. 854813, dated November 29, 1978. The lawsuit, involving
the Police Department, has been filed against the City by
Ronald James Buehler.

RESOLUTION BE READ BY TITLE ONLY. MOTION CARRIED.

Mayor Bauch announced a proposed Work Meeting with Fire
District No. 1 to be held December 5th, 7:30 P.M. at Tukwila
Southgate Community Center. This meeting is to discuss fire
service to the proposed annexation area.

Deputy City Attorney Hard read a resolution of the City of
Tukwila, Washington, authorizing the Mayor to negotiate and
execute a Community Antenna Television (CATV) Contract for
services.

662 BE ADOPTED AS READ.*
Councilman Bohrer asked if it is the intent that this
contract be for a one year duration. It was noted that
the proposed contract is for two years.
MOVED BY BOHRER, SECONDED BY SAUL, THAT THE TERM OF THE
CONTRACT BE ONE YEAR. MOTION CARRIED.

ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED.
Deputy City Attorney Hard read an ordinance of the City
of Tukwila, reclassifying certain property from C -1 and
R -3 to R -4 as contained in the Planning Division Master
File No. 78 -23 -R, subject to certain conditions.

1088 BE ADOPTED AS READ.*
Councilman Saul asked about Section 2, Items "a" and "e
Kjell Stoknes explained that he is recommending expanding
the wording in Item "a" to include the participation in
an LID for the improvement of street, utilities, sidewalk,
lighting and all related improvements. Item "e" is a
recommendation that no recreational vehicles shall be
allowed to park on the site. This requirement would be
included in the By -Laws and Covenants. The City really
has nothing to do with this document; they are only a third
party. The City should be careful that the wording is
included.
Mr. Ehmke, property owner, discussed the proposal to make
a 12 foot cut at the intersection of 62nd Ave. South and
So. 153rd Street. He said the property owners are wondering
if a cut of 6 to 8 feet would not be adequate. They all need
the LID.

Councilman Hill said it bothers him that someone may look
at it and question if we are treating all home owners the
same whether they are in a single family home or a condominium.
Are we discriminating? Mr. Stoknes explained that this is
an attempt to encourage less asphalt. This proposal has a
higher parking ratio than any other multiple development in
the City and none of the others address recreational vehicles.
Attorney Hard explained that this is a Rezone Ordinance and
nothing more. Council does not have to grant the rezone, the
burden is on the applicant to show why his reasons for the
request are valid. He is asking that a particular law be
changed and so this could be defended in court. If they
don't like this condition, they can withdraw their application.
Mayor Bauch commented that, as far as enforcement, there is
the health and safety aspect and the Fire Department has
reviewed it. The City will enforce the obstruction of
traveled ways and the blocking of Fire Lanes.

Councilman Hill commented that going up 62nd Avenue the grade
is so steep you cannot see the road as you make the intersection.

Mayor Bauch reported that Fire Chief Crawley has been appointed
to serve on the King County Hazardous Chemical Committee.
The Committee will develop a program for handling hazardous
chemicals in case of emergency.
Attorney Hard reported that the past month has been relatively
quiet. LID #28 has now gone to the State Supreme Court.
The Court is now deciding whether they are going to take
the case and make a decision on it or not. If they don't
they will uphold the position of the City.
Tomorrow there is going to be a hearing before the Motions
Department in the King County Superior Court in the lawsuit
of Alfred Schmid vs. The City of Tukwila. The City is
asking the Court to rule for Summary Judgment to dismiss the
case.
The lawsuit of Kinney vs. Bauch is set for January before
the Court of Appeals to hear oral argument. After that it
will take about two months before the decision is made.

EXECUTIVE SESSION AFTER A FIVE MINUTE RECESS. MOTION CARRIED.
Executive Session requested by Attorney Hard to discuss the
matter of Ann Lovell vs. City of Tukwila.

BE CLOSED. MOTION CARRIED.
