MOVED BY VAN DUSEN, SECONDED BY HILL, THAT COUNCILMAN TRAYNOR BE EXCUSED FROM THE MEETING. MOTION CARRIED. LAWRENCE E. HARD, Deputy City Attorney; KJELL STOKNES, OCD Director; MAXINE ANDERSON, City Clerk. MOVED BY VAN DUSEN, SECONDED BY SAUL, THAT THE MINUTES OF THE REGULAR MEETING OF DECEMBER 18, 1978, BE APPROVED AS PUBLISHED. MOTION CARRIED. MOVED BY VAN DUSEN, SECONDED BY HARRIS, THAT THE VOUCHERS BE ACCEPTED AND WARRANTS BE DRAWN IN THEIR RESPECTIVE AMOUNTS.* Councilman Bohrer inquired about the two vouchers for City Hall signs. Mayor Bauch explained that the signs have been delivered but not installed. The bill, previously submitted, was for signs and installation. He is recommending appointment of Mr. Lawrence Hard as City Attorney. He is also recommending that Mr. Richard Kirsop be re- appointed to Position #6 and Mr. Steve Welsh to Position #7 on the Tukwila Planning Commission. MOVED BY VAN DUSEN, SECONDED BY HILL, THAT COUNCIL CONCUR WITH THE MAYOR'S RECOMMENDATIONS. MOTION CARRIED. Mayor Bauch recognized, for the record, the receipt of the documents for a lawsuit filed by the Tukwila Police Guild against the City of Tukwila. Councilman Van Dusen requested an Executive Session at the end of the meeting to discuss this matter. MOVED BY VAN DUSEN, SECONDED BY SAUL, THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED. City Attorney Hard read an ordinance of the City of Tukwila to Amend Chapter 4, Definitions, of the Uniform Building Code, 1976 Edition. Recess: 7:25 PM- 7:30 PM Ordinance #1094 Repealing Ordinance Nos. 448, 544, 634, 738, 753, 767, 997, and 1019. RESOLUTIONS Resolution #668 Establishing Petty Cash and Change Funds MOVED BY VAN DUSEN, SECONDED BY SAUL, THAT ORDINANCE NO. 1092 BE ADOPTED AS READ.* *MOTION CARRIED. MOVED BY VAN DUSEN, SECONDED BY SAUL, THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED. Mr. Pieper, Building Official, said the purpose of this is so the intent of the code can't be circumvented by changing the grades, to gain an additional story. City Attorney Hard read an ordinance adopting the 1977 Edition and Supplement No. 1 of the Standard Specifications for Municipal Public Works Construction as the Code of the City of Tukwila; repealing Ordinance 998. MOVED.BY VAN DUSEN, SECONDED BY HILL, THAT ORDINANCE NO. 1093 BE ADOPTED AS READ.* Mayor Bauch suggested recessing long enough to check the Ordinance being repealed and noted that the body of the proposed ordinance does not contain the repeal provision. MOVED BY HILL, SECONDED BY HARRIS, THAT COUNCIL RECESS FOR FIVE MINUTES. MOTION CARRIED. Mayor Bauch called the regular meeting back to order with Council Members present as previously reported. MOVED BY VAN DUSEN, SECONDED BY HILL, THAT SECTION 4 BE ADDED REPEALING ORDINANCE NO. 998. MOTION CARRIED. *MOTION CARRIED AS AMENDED. MOVED BY VAN DUSEN, SECONDED BY SAUL, THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED. City Attorney Hard read an ordinance repealing ordinance Numbers 448, 544, 634, 738, 753, 767, 997, and 1019. MOVED BY VAN DUSEN, SECONDED BY SAUL, THAT ORDINANCE NO. 1094 BE ADOPTED AS READ.* Councilman Bohrer noted that Resolution No. 614 established the salary grades for the non -union employees but di d not establish salary grades for the unionized employees. This was done in Ordinance No. 1019. Mayor Bauch explained that Resolution No. 614 superseded Ordinance No. 1019, but a Resolution cannot repeal an Ordinance. Councilman Bohrer asked if the ranking in 1019 shouldn't be incorporated into Resolution 614. Mayor Bauch agreed that it would be appropriate but would have to be done by a separate action. *MOTION CARRIED. MOVED BY VAN DUSEN, SECONDED BY SAUL, THAT THE PROPOSED RESOLUTION BE READ BY TITLE ONLY. MOTION CARRIED. City Attorney Hard read a resolution repealing Resolution No. 631 and establishing petty cash and change funds. ADJOURNMENT: 8:50 P.M. c.23,5 Councilman Van Dusen asked what is considered petty cash. Mayor Bauch explained that by Administrative Policy any item costing less than $10.00 is considered a petty cash item. *MOTION CARRIED. Mayor Bauch announced that the Police Annex at Southcenter Mall is being closed. It is no longer used now that the Police Station is closer and the Mall has use for the space. The City has received a request from the City of Renton to see if Tukwila would negotiate a contract for fire service to an area lying between I -405 on the North and South 180th to the South; the Valley Freeway to the East and Tukwila City Limits to the West. Mayor Bauch said he wanted Council concurrence prior to the start of the negotiations. Council agreed that the Mayor should proceed. It will come back to them at a later date for approval. Mayor Bauch explained that he has considered forming an Employee Donation Fund and asked for Council reaction. The fund would cover the summer picnic, the Christmas Party and remembrances to employees on special occasions. Donations to the fund would amount to $1.00 per month per employee. This would be made by pay roll deduction; Inturn, all wages would be raised by $12.00 per year. If there isn't 100% participation by the employees the idea would be dropped. The concept was discussed and the Mayor said he would bring it back to Council for more discussion at a later date. Attorney Hard stated that as long as this is a voluntary program he doesn't see anything unlawful. Council has no control over the employees donating to a fund. Attorney Hard reported that December was relatively uneventful. Tuesday, the appeal in the Kinney -vs- Bauch lawsuit will be heard in Court of Appeals. MOVED BY SAUL, SECONDED BY VAN DUSEN, THAT COUNCIL GO INTO EXECUTIVE SESSION. MOTION CARRIED. Session called to discuss the recent lawsuit filed by the Tukwila Police Guild. Attorney Hard, Mayor and Council in attendance. MOVED BY HARRIS, SECONDED BY SAUL, THAT THE EXECUTIVE SESSION BE CLOSED. MOTION CARRIED.
