This letter serves as a notice of decision and is issued pursuant to TMC 18.104.170 on the following project

II. DECISION
SEPA Determination: The City SEPA Responsible Official has previously determined that this application
does not require a SEPA threshold determination because it is categorically exempt.
Decision on Substantive Permit: The City Community Development Director has determined that the
application for a Tree Clearing Permit complies with applicable City and state code requirements and has
approved that application, subject to the following conditions:
1. Plant 30 mitigation trees at a spacing of 15' on center. If there is not adequate room on site to
accommodate for this spacing, applicant shall locate trees off-site and pay a fee -in -lieu of on-site
planting.
2. Applicant shall contact the City's Urban Environmentalist (206-431-3663) for an inspection
after plants are installed and if additional assistance with plant selection or care is needed.

3. Plants shall be mulched after planting with compost, wood chips or bark and shall be watered
for the first three dry seasons until they are established.
III. YOUR APPEAL RIGHTS
The Decision on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code
§18.104.010. Other land use applications related to this project may still be pending. One administrative
appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted. A party who is not
satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King County
Superior Court from the Hearing Examiner's decision.
IV. PROCEDURES AND TIME FOR APPEALING
In order to appeal the Community Development Director decision on the Permit Application, a written
notice of appeal must be filed with the Department of Community Development within 14 days of the
issuance of this Decision; that is by May 21, 2010.
The requirements for such appeals are set forth in Tukwila Municipal Code ch. 18.116. All appeal
materials shall be submitted to the Department of Community Development. Appeal materials MUST
include:
1. The name of the appealing party.
2. The address and phone number of the appealing party; and if the appealing party is a corporation,
association or other group, the address and phone number of a contact person authorized to receive
notices on the appealing party's behalf.
3. A statement identifying the decision being appealed and the alleged errors in the decision.
4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in
the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief
sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal.
5. Appeal fee of $235.
V. APPEAL HEARINGS PROCESS
Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the
Hearing Examiner based on the information presented to the Community Development Director, who
made the original decision. No new evidence or testimony will be permitted during the appeal hearing.
Parties will be allowed to present oral argument based on the information presented to the Community
Development Director before their decision was issued. The Hearing Examiner's decision on the appeal is
the City's final decision.
Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal
pursuant to the procedures and time limitations set forth in RCW ch. 36.70C. If no appeal of the Hearing
Examiner's decision is properly filed in Superior Court within such time limit, the Decision on this permit
will be final.

VI. INSPECTION OF INFORMATION ON THE APPLICATION

RE: L10-016 Tree Clearing Permit for Kochhar Residence, 14813 46th Ave S
BACKGROUND: Mr. Kochhar has applied for a tree clearing permit in response to two code
enforcement actions. As part of RFA09-487 code enforcement found that Mr. Kochhar cut a
total of four trees in a steep slope sensitive area prior to obtaining a permit. RFA09-194 was in
response to Mr. Kochhar building a retaining wall and deck and altering land without a permit.
Tukwila's Tree Replacement Ratio (TMC 18.54.130.3b) requires that 4 replacement trees are
required for each 12"-18" tree removed and 8 replacement trees are required for each tree over
24" that is removed. Two trees were between 12"-18" and two were over 24", so a total of 24
replacement trees will be required for the four trees that were cut down. Six additional
mitigation trees will be planted for placement of fill on site without a permit, for a total of 30
trees. The tree Replacement Plan date April 7, 2010, which was prepared by Robert Parnell
shows an equal mix of Grand Fir, Western Hemlock, and Big Leaf Maple trees at 10 -foot
spacing; however the City's Urban Environmentalist recommends at least 15 -foot spacing to
allow the trees access to adequate light and room to grow as they mature.
RECOMMENDATION: Approve the tree clearing permit for the site with the following
conditions:

KOCHHAR TREE CLEARING PERMIT APPLICATION
WRITTEN RESPONSE TO CHECKLIST MATERIALS
IR -6 Approval Criteria:
1, Tree Retention: This tree clearing application is in response to a code violation
number RFA 09-487 for cutting -trimming trees within a sensitive area -steep slope on the
applicants property located at 14813 46th Ave. South, Tukwila. Owner cut down a total
of 4 trees and left the upper portion of the tree trunks. Two trees were 17" diameter and 2
trees were over 24" diameter. All other trees are to remain. No additional ground
vegetation is to be removed except for mitigation plantings.
2. Tree Protection Measures: No additional trees shall be removed during tree mitigation
planting. Because the location of mitigation planting is within a sensitive area, planting
shall be by hand labor only supported by small motorized non track digging equipment.
Protection measures shall include a pre construction meeting with the landscape
contractor and owner during tree delivery to site. This should ensure that no vegetation is
removed unless a replacement tree is planted in that specific area. After planting, mulch
shall be added over all disturbed area.
3. Tree Replacement: Based on the tree replacement ratio provided as part of this
application, 4 replacement trees are required for each 12"-18" tree removed and 8
replacement trees are required for each trees greater than 24". Therefore, a total of 24
replacement trees are required for the four trees cut down. Minimum sizes shall be 2.5
inch caliper for deciduous trees, 6-8 feet in height for evergreen trees. Planting and
maintenance shall be accordance with best management practices.
4. Surrounding Environment: The timing of and methods to be used in any proposed
vegetation removal shall be such that impacts to protected vegetation, wildlife, fisheries
and surrounding environment are minimized.
5. Tree Relocation: Tree relocation shall be carried out according to best management
practices and trees proposed for relocations shall have a reasonable chance for survival.
No trees are proposed for tree relocation at this time. However, small trees within the
steep slope that are under larger trees and appear not able to survive, maybe relocated
from under the shade of the large trees and used as a replacement trees up to 25%.
IR -7: Tree Regulation Deviation: No anticipated deviations are asked for at this time
and none are anticipated.
IR-8:Professional Review: Replacement Tree plan prepared by Robert N. Parnell, PE
who prepared the site plan.
IR -9 Time Schedule: Replacement tree planting to be done at a time to minimize slope
destabilization due to wet weather -precipitation runoff or hot summer days. Replanted or
transplanted trees shall be monitored for health and to ensure watering during hot
summer month periods. Distressed planted trees shall be replaced with healthy trees.

1. The letter submitted by Robert Parnell on December 23, 2009, in

sensitive area, and their location will need to be reviewed as part of this
permit. Additionally, the location of these plantings will need to be
coordinated with new trees that Mr. Kochar is required to plant as part of
a tree clearing permit he will need to submit to mitigate for trees he cut
down, to address code enforcement action under RFA09-487. We
encourage you to meet with City of Tukwila staff to talk about
appropriate plant species and planting locations.

3: 05-11-09 Meeting with Mr. Singh, Joanna Spencer, Greg V., Jamie R., Kathy S. Mary H. He is removing deck this
week and replacing sliding glass door with windows. He is repairing driveway on North Side. He plans on taking down the
rockery wall or lowering it. He does not plan on making a driveway on the South side of house. HE was told to STOP WORK
on everything until he submits detailed plans on what is the intent of the property. He must respond to the letters
from planning and public works. He must put down erosion control - was suggested he use 8 to 10 bails of straw.
Explained any work in the sensitive area of property requires a permit. He can not park vehicles on South side of his
property -sensitive area. Have building inspection on deck removal. Call public works when he takes out the rockery so
they can be there. Before he does anymore work on driveway -submit detailed plans showing drainage. (possible Feasible
study required) He agreed to have his engineer come in for a meeting with everyone.
4: 05-15-09 Mailed Followup letter from meeting with Mr. Singh.
5: 05-15-09 Received call from Bob Parnell, civil engineer with RN Parnell Co. (Issaquah) (425-643-3560). He is
working on the engineering plans for this property. Mr. Parnell stated that Mr. Singh is converting the residence to an
Adult Care Home and is "doing work inside" the structure. I told Mr. Parnell that I was happy he was on board to help
him navigate through the City's requirements and asked that he caution Mr. Singh about proceeding too far without
determining whether the ultimate use will be permitted in this zone, etc. Mr. Parnell said that he is also interested
in a short plat of this property. Mr. Parnell asked for an extension to May 26th to submit the response to correction
for the permti-and I granted that extension. He is meeting with Mr. Singh on the 18th at the site and after that
meeting may have further questions for us and may stop in.
6: 05-26-09 May 1, 2009 certified Stop Work notice was returned as Unclaimed. Will not resend.
7: 06-03-09 Received email from Bob Parnell stating that he will be submitting plans (?) on Wedensday morning, with
originals to Public Works. Email in file.

property.
1: 12-29-09 Received a complaint from Kelly Turner, neighbor about 5 or 6 trees that have been cut down on Sunday.
Wanted to know if they had received a permit. She had gone over to the workers and told them that they were not allowed
to cut down any tree with out City permission - they did not answer her and continued working.
2: 12-30-09 I inspected and found 2 trees have been cut all the way down to ground the one I could measure with a
tape was 17 inches in diamater. Another one cut all the way down but on to much of a slope to get to was about the same
size. The other 2 trees in excess of 24 inches I found were topped to such a degree as they might not survive.
3: 01-05-10 Prenotice, Tree Clearing Permit and TMC sent to property owner.
4: 01-13-10 Contact Jaimie Reeves when we receive the Tree Clearing Permit - for PW08-105.
5: 01-14-10 Mr. Singh called and said he received a notice but he already took care of that. I explained that this
notice is for the 4 trees that he cut down and he has not taken care of anything. He is required to apply for a tree
clearning permit. He asked how much that would cost, I told him, that any questions he has about this permit, he would
need to speak with the planner on the property which was Jaimie Reeves, I gave him her phone number. 206-913-3477.

REVIEW CRITERIA
The applicant bears responsibility for demonstrating that the proposal satisfies all of the permit
approval criteria. Planning Division staff are available to discuss the decision criteria you must
respond to and necessary supporting materials.
PERMIT APPROVAL CRITERIA
To the extent that vegetation retention and/or replacement is consistent with project feasibility or
reasonable use of the property, vegetation clearing shall be planned and conducted to meet all of
the criteria below. These criteria shall be the basis for approval, approval with conditions or
denial of any tree clearing included in a Tree Clearing Permit application.
1. Tree Retention - Site improvements shall be designed and constructed to retain as many
existing healthy trees as possible, and to meet the following criteria:
a. Priority shall be given to retention of existing stands of trees, trees at site perimeter,
trees within the shoreline Low -Impact Environment, in Sensitive Areas or Sensitive
Area Buffers, and healthy mature trees.
b. All understory vegetation within the essential root zone of protected trees shall be:
(1) retained; OR
(2) removed by methods which are non -damaging to the tree, and replaced with
vegetation with horticultural requirements which are compatible with protected
trees.
c. Vegetation removal shall be undertaken in such a manner as to preserve, to the degree
possible, the aesthetic and ecological benefits provided by such vegetation.
2. Tree Protection Measures -
a. The proposal shall include tree protection measures which meet or exceed best
management practices and current standards of professional arboriculture, and which
are sufficient to ensure the viability of protected trees and other vegetation identified
for retention pursuant to requirements of this chapter, and shall include measures
sufficient to protect any Sensitive Area, its Buffer and vegetation within the shoreline
Low -Impact Environment.
b. During clearing and/or construction activities, all protected vegetation shall be
surrounded by protective fencing which prevents adverse impacts associated with
clearing from intruding into areas of protected vegetation.
3. Tree Replacement - The site shall be planted with trees to meet the following minimum
requirements:
a. Each existing significant tree removed shall be replaced with new tree(s), based on the
size of the existing tree as shown below, up to a maximum density of 70 new trees per
acre.

c. Prior to any vegetation removal, the applicant shall demonstrate through a Landscape
Plan, Sensitive Area Mitigation Plan or other materials required per the requirements
of this chapter that vegetation replacement will meet the following minimum
standards:
(1) Minimum sizes shall be 2.5 -inch caliper for deciduous trees, 6 to 8 feet in height
for evergreen trees, 24 inches in height for shrubs, and 1 gallon for groundcover.
(2) Replacement plants shall meet current American Association of Nurserymen
standards for nursery stock;
(3) Planting and maintenance of required replacement vegetation shall be in
accordance with best management practices for landscaping which ensure the
vegetation's long-term health and survival.
4. Surrounding Environment - The timing of, and methods to be used in any proposed
vegetation removal shall be such that impacts to protected vegetation, wildlife, fisheries and

TREE REGULATION DEVIATIONS
0 The Director may grant exceptions from the requirements of chapter 18.54 when undue
hardship may be created by strict compliance with the provisions of this chapter. Any
authorization for exception may prescribe conditions deemed necessary or desirable for the
public interest, or necessary to meet the intent of this chapter. An exception to this chapter
shall not be granted unless all of the following criteria are met:
1. Strict compliance with the provisions of this code may jeopardize project feasibility or
reasonable use of property.
2. Proposed vegetation removal, replacement, and any mitigation measures proposed, are
consistent with the purpose and intent given in this chapter.
3. The granting of the exception or standard reduction will not be detrimental to the public
welfare or injurious to other property in the vicinity.
In addition to the above criteria, the Director may also consider any of the following in
reviewing an exception request:

a. Whether the recommendation of a certified arborist supports the exception.
b. Evidence that the size of the site or project cannot support the number of required
replacement trees, and off-site tree planting is proposed which furthers the goals of this
chapter and other City policies.
c. On-site planting of all required replacement trees is not feasible, and the project includes
an equivalent contribution in funds and/or labor and materials for off-site tree planting as
jointly agreed by the applicant and Director.
d. Smaller -sized replacement plants are more suited to the species, site conditions, and to
the purposes of this chapter, and are planted in sufficient quantities to meet the intent of
this chapter.
0 Retention and Replacement of Canopy Cover - on undeveloped sites or sites with dense
stands of trees, where the cost of identification of individual tree species and sizes is
inordinate relative to the project, the Director may allow the applicant to use the tree canopy
cover approach outlined below to calculate retention and replacement of trees:
1. The site shall have a minimum canopy cover equal to 20% of the site area, or equal to the
existing canopy cover whichever is less.
2. To meet the requirements for site canopy cover, canopy cover may consist of any
combination of existing trees and replacement trees. Canopy cover of each new tree
shall be calculated at 314 square feet.

INFORMATION
Tukwila's Tree Ordinance regulates the clearing of trees and understory vegetation in or near environmentally sensitive
areas and within 200 feet of the Green River. Specific exemptions from the requirement to obtain a Tree Clearing Permit
are listed at TMC 18.54.050.
18.54.050 Permit - Exempt Activities
The following activities are exempt from the application of this chapter and do not require a Tree Clearing Permit:
1. Clearing of any vegetation; UNLESS the site on which clearing is to occur is located in a sensitive area, sensitive
area buffer, or shoreline zone.
2. On sites within a sensitive area, or sensitive area buffer, or shoreline zone:
a. Clearing of up to 4 significant trees on a site currently zoned and developed for single-family residential use
within any 36 -month period; UNLESS the significant trees to be removed are located within a wetland,
watercourse and their associated buffers or within the shoreline zone.
b. Clearing of any vegetation located outside a sensitive area, sensitive area buffer or outside the shoreline zone.
c. Removal of hazardous trees.
d. Routine maintenance of vegetation necessary to maintain the health of cultivated plants, to contain noxious
weeds, or to remedy a potential fire or health hazard or threat to public safety per TMC Commercial parking
subject to TMC Chapter 18.56, "Off -Street Parking and Loading Regulations."8.28, Nuisances.
e. Vegetation removal necessary to the operation of an established Christmas tree farm or commercial plant
nursery.
f. Construction and maintenance of streets and utilities within City -approved rights-of-way and easements.
DEFINITIONS:
Sensitive areas means wetlands, watercourses, areas of potential geologic instability (other than Class I
areas), abandoned coal mine areas, and fish and wildlife habitat conservation areas.
Shoreline zone means a 200 -foot area surrounding any shoreline in Tukwila composed of three zones: (1) river
environment, (2) low -impact environment, and (3) high impact environment.
Significant tree means a tree (Cottonwood excluded) which is 4 inches or more in diameter as measured 4.5 feet
above grade. However, removal of any cottonwood tree that is 12 inches or greater in diameter (as measured 4.5 feet
above grade) within the first 100' from the river shall require a tree permit, TMC 18.44.110.
PROCEDURES: At the time you submit your application you must have all of the items listed on the attached
"Complete Application Checklist." You may request a waiver from items on the checklist that are not applicable to your
project. Please discuss this waiver request with City staff either at a pre -application meeting or at the time of application
submittal. Within 28 days of receiving your application, City staff will determine if it is complete based on the attached
checklist. If not complete City staff will mail you a letter outlining what additional information is needed. If you do not
submit requested materials within 90 days from the City's request for additional information the City may cancel your
application. Once the application is complete it will be reviewed by the Director who will issue a decision to approve,
modify or deny the application based on the review criteria.
EXCEPTIONS: Per TMC 18.54.140 the Director of Community Development may grant exceptions from the
requirements of the Tree Ordinance when undue hardship may be created by strict compliance with the provisions of the
chapter. An application for an exception must be submitted by the property owner to the Department of Community
Development and shall accompany the Tree Clearing Permit application.

Works Department and the Department of Community Development. Please contact each Department if you feel that
certain items are not applicable to your project and should be waived. Application review will not begin until it is

The initial application materials allow project review to begin and vest the applicant's rights. However, the City may
require additional information as needed to establish consistency with development standards.
