The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. This letter serves as the Notice of Decision per TMC 18.104.170. Based on the latest project submittal, preliminary approval is granted subject to the conditions stated below. There are three basic steps in the Boundary Line Adjustment (BLA) approval process: 1. Preliminary Approval This letter constitutes your preliminary approval. The application was reviewed by the Tukwila Short Subdivision Committee and approved with conditions. The conditions imposed are to ensure the BLA is consistent with the Criteria for Preliminary Approval listed at TMC 17.08.030 in the Tukwila Subdivision Code. Con itions: Add City of Tukwila BLA number L10-017 to all sheets. Sound Transit performed a lot consolidation with the parcel to the south (Tukwila file L09-035) recorded under KC recording number 20100201900006. The drawing and the legal description for the Sound Transit parcel (152304-9032) does not reflect the lot consolidation. Revise the drawing and the legal description to accurately reflect the recorded lot consolidation. 9"`3?,, A small roofed structure (as seen from the street) is located to the east of the driveway. This structure is not shown on the plans. The new lot line shall be setback 5' from this structure along the south (side yard) property line and 10' from the structure along the west property (rear yard) property line to meet code. Alternatively, the structure can be removed or relocated outside the setbacks. Appeals The Decision on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code §18.104.010. A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision. In order to appeal the Community Development Director decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision, that is, by November 17, 2010. The requirements for such appeals are set forth in Tukwila Municipal Code ch. 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition, all hearing examiner costs will be passed through to the appellant. Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the Hearing Examiner based on the information presented to the Community Development Director, who made the original decision. No new evidence or testimony will be permitted during the appeal hearing. Parties will be allowed to present oral argument based on the information presented to the Community Development Director before their decision was issued. The Hearing Examiner's decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW ch. 36.70C. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final 2. Final Approval The next step is to comply with the conditions of approval and submit one full sized, signed original and three full size copies of the revised Boundary Line Adjustment documents. The surveyor's original signature is required on the face of the survey. All taxes and fees assessed against the property must be current prior to final approval. Please check with the King County Assessor's Office and the City of Tukwila Finance Department prior to submitting final documents. After the documents have been found to be in order, and the all of the requirements of the Boundary Line Adjustment have been met, the Chair of the Short Subdivision Committee signs your short plat which constitutes a grant of final approval. Expiration The final approved short plat must be filed with the King County Department of Records by November 13th, 2011, one year from the date of this preliminary approval or the application will expire. The City may grant a single one year extension if requested in writing prior to the expiration date. 3. Recording The signature of the Chairman of the Short Subdivision Committee certifies that your Boundary Line Adjustment application is ready for recording. You will need to pay the recording fees and submit your approved original short plat to King County. The Boundary Line Adjustment is not complete until the recording occurs and copies of the recorded documents are provided to the Department of Community Development. After recording, the County returns the recorded original to the City of Tukwila within 4-6 weeks, at which time your Boundary Line Adjustment is considered complete. You can shorten this processing time by hand -delivering a copy of the recorded short plat to the project planner. In many circumstances, building permits on the BLA property may not be issued until a copy of the recorded short plat (or original) is returned to the Department of Community Development. In terms of background (you may know or suspect this already) Roger Lorenzen feels like ST should be paying for the costs associated with this BLA; however, as part of the condemnation decree ST agreed it wouldn't object to any application by Lorenzen, but all costs would be the responsibility of Lorenzen. The cost estimates for the survey have been relatively high. I haven't drilled down on why the costs are high, but just so you know, ST is fine with the idea of basically a straight/diagonal line from Macadam to join up with Lorenzen's southeast property line (probably doesn't need to go all the way to the corner of his property) to accommodate joining his existing driveway to the rest of his property. We will communicate this information to Lorenzen so that he has some negotiation leverage with the surveyor. Do you have any other ideas in terms of lowering the overall cost to Lorenzen? Meaning, is there anything ST can do to ease the process and thereby lower the cost? ST cannot spend public money to help pay for his BLA, but I can offer assistance in terms of my time and/or ST cooperation. Thanks - and let me know if there is anything you need me to do. Location and floor area of all structures on the site, and their setbacks from existing and new property lines. d. Location and purpose of all easements on the site. e. Location, purpose and legal description of any new or extended easements proposed. f. Location of adjacent public roads and points of access from the public road(s) if a lot does not front on a public road, show how and where access is provided. g. Location of existing utilities and utility easements. . h. Calculations which demonstrate that required yards of the Uniform Building Code are met. 3. Before and after legal description of the affected lots. C. In order to approve a boundary line adjustment or lot consolidation, the Short Subdivision Committee shall determine the project complies with the following criteria: 1. No additional lots, sites, parcels, tracts or divisions are created. 2. The adjustment will not create nonconforming lots with respect to zoning dimension and area standards, zoning setbacks and lot area coverage standards. 3. The degree of non-conformance on existing non -conforming lots with respect to zoning dimension and area standards, zoning setbacks and floor area ratio are not increased. 4. All lots have legal access to a public road. Existing required private access road improvements and easements are not diminished below subdivision ordinance standards for lots that are served by a private access road.
