This letter serves as a notice of decision and is issued pursuant to TMC 18.104.170 on the following project and permit
approval.

Project Description: The project proposal is to obtain a tree clearing permit to remove four trees from a Type
3 wetland and wetland buffer area located within a sensitive areas tract owned by the Fosterview Estates Home
Owners' Association. All four of the trees proposed for removal are Cottonwood trees, one of which is noted as
hazardous in both estimates for tree cutting submitted with application materials. The hazard tree proposed for
removal is 10 feet in diameter.

II. DECISION
SEPA Determination: The City SEPA Responsible Official has previously determined that this application does not require
a SEPA threshold determination because it is categorically exempt.

Decision on Substantive Permit: The City Community Development Director has determined that the application for a Tree
Clearing Permit does comply with applicable City and state code requirements and has approved removal of one hazard tree
with the condition that two replacement trees be planted in fall 2010.
III. YOUR APPEAL RIGHTS
The Decision on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code §18.104.010. Other
land use applications related to this project may still be pending.
One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted. A party who is not
satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King County Superior Court from the
Hearing Examiner's decision.
IV. PROCEDURES AND TIME FOR APPEALING
In order to appeal the Community Development Director decision on the Permit Application, a written notice of appeal
must be filed with the Department of Community Development within 14 days of the issuance of this Decision; that is by
October 21, 2010.
The requirements for such appeals are set forth in Tukwila Municipal Code ch. 18.116. All appeal materials shall be
submitted to the Department of Community Development. Appeal materials MUST include:
1. The name of the appealing party.
2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other
group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf.
3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific
challenge to an MDNS.
4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision
being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal
shall be limited to matters or issues raised in the Notice of Appeal.
5. Appeal fee of $515.
V. APPEAL HEARINGS PROCESS
Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the Hearing
Examiner based on the information presented to the Community Development Director, who made the original decision.
No new evidence or testimony will be permitted during the appeal hearing. Parties will be allowed to present oral
argument based on the information presented to the Community Development Director before their decision was issued.
The Hearing Examiner's decision on the appeal is the City's final decision.
Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal pursuant to the
procedures and time limitations set forth in RCW ch. 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be
included in such an appeal. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within
such time limit, the Decision on this permit will be final. The City's decision to issue a DNS, an MDNS or an EIS is final
for this permit and any other pending permit applications for the development of the subject property.

BACKGROUND: The Reverend S. Allen Mosley has applied for a tree clearing permit to remove four trees
from a Type 3 wetland and wetland buffer area located to the south of his home within a sensitive areas tract
owned by the FosterView Estates Home Owners' Association. All four of the trees proposed for removal are
Cottonwood trees, one of which is noted as hazardous in both estimates for tree cutting submitted with
application materials. The hazard tree proposed for removal is 10 feet in diameter.
The applicant requested permission to remove the hazard tree prior to issuance of the tree permit due to his
concerns related to the condition of the tree and its proximity to his house. Staff agreed to allow the applicant to
remove the tree prior to permit issuance, under the condition that he plant two replacement trees as mitigation
for the one to be removed. Staff provided the applicant with a list of tree species appropriate for replacement of
the one hazard tree to be removed, and suggested he plant the replacement trees in the fall to promote better
plant establishment.
On July 12, 2010, staff received phone calls and emails, and two comment letters from neighboring residents
who expressed concern about the tree clearing permit and the possibility of trees being removed from the
sensitive area. The first comment letter, from Elaine Ayotte, expressed her concern that the sensitive area and
habitat it provides for wildlife including hawks, woodpeckers, owls, and rabbits be protected by the City of
Tukwila from disturbance. She stated that she believes the trees are beautiful and contribute to the ecology of
the sensitive area, and requested staff examine the trees to prevent "capricious removal of a valuable ecological
asset." The second comment letter received was from Sunny Mulholland, who expressed that she and her
husband value their proximity to the sensitive area, and the view of the trees and wildlife from her home. She is
concerned that all the trees to be removed may not pose a hazard, and she requested staff conduct a site visit to
determine whether removal of all four trees is justified. She was also concerned about the type of trees to be
replanted in place of the hazard tree, and suggested that Tukwila's Urban Environmentalist oversee the
replanting project and advise the Foster View Estates Homeowner's Association on which trees are best to plant
within the sensitive area.
Staff met with Sunny Mulholland on July 12, and conducted a site visit to assess the condition of the trees
proposed for removal. The tree shown as a hazard tree in application materials had not yet been removed at the
time the site visit was conducted, and was verified by staff to be a hazard tree during the site visit. One of the
three trees to be removed was dead, but was identified as one that should not be removed because it provides a
habitat feature for birds in the area and is not located near adjacent structures in such a way as to pose a threat to

property. The other two trees were not located immediately adjacent to any structures, and did not meet the
definition in Tukwila Municipal Code section 18.06.395 of a Hazard Tree, which is "a tree with a structural
defect or disease, or which impedes safe vision or traffic flow, or otherwise currently poses a threat to life or
property."
Due to (1) the location of the trees within a wetland and wetland buffer area which provides wildlife habitat, (2)
the location of the dead tree far from adjacent structures so as not to pose a threat to property; and (3) the
healthy condition of two of the trees that were not identified as hazard trees in application materials for this
permit, staff determined that only the hazard tree should be permitted to be removed at this time. Due to the
hazard tree's location within the sensitive area, two replacement trees shall be planted in the fall as mitigation
for the hazard tree removal. Staff observed the healthy condition of two Western Red Cedar trees in the
applicant's yard, and recommends the applicant plant two Western Red Cedars within the sensitive area as
replacement for removal of the hazard tree.
RECOMMENDATION: Approve removal of the one hazard tree only. The other three trees requested to be
removed shall remain. The applicant shall coordinate with staff to determine the location and method of
planting the replacement trees, and to arrange inspection of replacement trees to be planted in fall 2010.

Jamie, Thank you for the information this morning. I am hoping that any further action on this
sensitive wetland gets intense review. We have so little open area left that it is very important
to protect it.
I was watching a family of hawks yesterday that nest in the area. We see woodpeckers, owls,
rabbits there. It is their home. Incursion into their environment is upsetting and can uproot
them. There are nests and feeding areas in the trees.
The trees are beautiful and contribute to overall good ecology. I appreciate any further review
of this situation and hope that this area can be saved from capricious removal of a valuable
ecological asset.

Monday July 12th. A tree company, AAgro, says that they have a.permit
to remove the tree from the green belt.
Under what conditions is a tree clearing permit issued for a
sensitive area? Do the neighbors have to be notified as to the reason
for the removal and regarding the resultant noise and probable
pollution? Does AAgro really have a valid permit? Has a city arborist
verified that the tree needs to be removed? No trees in the area
appear to be dead. What recourse does a citizen have to protest the
removal of a tree from a sensitive area? Can this removal be delayed
until more information is available regarding the necessity of removal
and/or mitigations are in place regarding safe, nondamaging access to
the sensitive area?
I would appreciate some answers as soon as possible, hopefully before
a healthy tree is removed from this sensitive area and valuable
wetlands are damaged. Thank you.

Dear Jaimie,
Thank you for your help and consideration today. I would like to go on record with my
concerns with the tree clearing permit application filed with the City of Tukwila by the Foster
View Estates Homeowner's Association on July 8, 2010.
First of all, let me explain how I learned of the tree removal. On the evening of July 9,
2010, my husband and I found a note stuck in our door from an independent tree service
worker- one Chris Murphy of AAGRO Tree Service. The note stated that he would be taking
a tree down in the sensitive area next to our house on Monday July 12, and he left
his number asking us to call him. My husband called him and Mr. Murphy said that he had a
city permit to cut the tree down and that he had the right to enter our property to gain
access to the sensitive area to cut down the tree. My husband expressed concern and asked
a lot of questions, and the phone call was lost somehow.
On Saturday July llth, I learned of a Tukwila City Council Chat that was to take place from
10 am -12 noon that day. So I attended and spoke with Councilwoman Joan Hernandez
about this tree issue. Ms. Hernandez actually visited my property after the Council Chat to
look at the sensitive area and the at risk tree. She told me I should call the City of Tukwila
Community Development Department on Monday morning, and to attend the Community
Affairs & Parks Committee meeting regarding the Sensitive Areas Ordinance at 5 pm
Monday evening, as well as the City Council Committee of Whole Meeting at 7 pm Monday
evening, to voice my concerns. I said I would.
Mr. Murphy called my husband back on Sunday July llth, and again said he was planning
on using our property to get to the sensitive area and the tree. My husband said he was not
comfortable with this, especially without seeing a permit and knowing more about the tree
removal. That is when Mr. Murphy called my husband a choice name and said that the tree
was coming down first thing in the morning whether we liked it or not.
The morning of Monday July 12th, I called the City of Tukwila's Community Development
Department and spoke with Jaimie Reavis, Assistant Planner, at great length concerning this
issue. That is when I learned that there is indeed an approved tree permit for the removal
of said 'hazardous tree'. I was also informed that there is a pending permit for the removal
of three more trees in the sensitive area. 1 was concerned and said I would like to give
some input regarding the pending tree permit.
Jaimie Reavis set up an appointment at 1:15 pm on Monday July 12th for my husband and I
to express our concerns about the tree permit issue with herself, Sandra Whiting and Minnie
Dhaliwal. The meeting was very productive and I felt relieved to be able to express my
concerns regarding tree removal in this sensitive area. Later that day, Jaimie and Sandra
came out to my property and the property of the homeowner who applied for the tree
clearing permit to see the trees at issue here. The hazardous tree was, in fact, deemed
to have a lot of rot and it will need to come down. The other three trees, while the permit
is still pending, will probably not need to come down, it appears. The prompt and helpful
nature of everyone in the Community Development Department has been amazing. I am
very appreciative. The tree cutter, Mr. Murphy, appears to have really inflamed this
situation. I have learned from Jaimie and Sandra that he would have needed to receive
written permission from us to enter our property.
We bought our house at 13731 44th Ave S. in February of this year, 2010. One of the
assets of our property which motivated us to buy our house was its proximity to the
sensitive area of trees and wildlife. We have further learned that it is a wetlands buffer and
serves a purpose as a home for wildlife and native trees, shrubs and other plants. There is a
family of four Cooper's Hawks who live in this protected sensitive area, we see them flying
and hunting daily. We see rabbits in this area daily. We see owls, woodpeckers and other
birds, raccoons and coyotes. This is an area that needs to be preserved and protected. We
cannot take down healthy trees simply because some homeowners are worried trees may
fall. I understand that a hazardous or diseased tree should be inspected and it should be
determined if it is a risk. However, it needs to be taken into consideration that this is a
sensitive area, and the preservation of the vegetation within it should be looked at very
closely and taken very seriously.
Upon looking over the tree ordinance, I support a revision of the tree ordinance
and regulations. They are vague and don't appear to protect the trees enough. I do not
want a precedent to be set with individuals being able to acquire permits to remove trees so
easily. In the instance of these four at risk trees, it is my understanding that an
environmental impact statement doesn't even have to be done. I am also concerned about
the replanting of native species of trees to replace the hazardous tree that is going to be cut
down. I think it would be wise to have a city employee (Sandra Whiting, Urban
Environmentalist for the City of Tukwila, suggested she could be this person) oversee the
replanting project and advise the Foster View Estates Homeowner's Association on which
trees she recommends as best for that area.
A positive thing that came out of this whole tree clearing issue, is that my husband and I
are committed to being involved with the upkeep of the sensitive area next to our home, as
well as other sensitive areas in the entire City of Tukwila We are also planning on keeping
informed of, as well as giving input on, the Sensitive Areas Ordinance. We would love to be
involved in Stream Team, and be on a Citizen Board that will hopefully be developed in
order to aid in revising the tree ordinance for the City of Tukwila.

Dear Reverend Mosley,
It was nice to meet you at the counter today and talk about the tree replacement plan and the possibility of
meeting with the homeowners association to discuss the dos and don'ts for maintaining the wetland and stream
on the property.
I have made up and attached a list of suggested trees for replacement of the cottonwoods being removed from
the wetland/wetland buffer. There are small photos included so you can get an idea of what the leaves/flowers
look like. As I mentioned, because the trees being removed are in a sensitive area, the replacement trees must
be native to the Puget Sound region. The trees on the list vary in their mature size, but would be suited to
planting in a moist to dry area.
I understand from talking with Jaimie Reavis (the planner that took in your tree clearing application), that you
would like to remove the large tree, that presents the greatest hazard as early as Monday. Given that it is
hazardous, that would be acceptable. Regarding the removal of the other hazard trees, we noticed that one of
your quotes gave you a bid for topping the trees. Topping a tree should never be done (unless it is under an
overhead utility line) and it is a very poor tree management practice as it weakens the tree and the regrowth
(and cottonwoods will regrow) comes in weaker and more brittle and subject to breakage and wind damage -
thus increasing the hazard. It is better to completely remove the tree, rather than topping it.
In order to reduce your cost, you are encouraged to have the tree removal company put the Togs from the tree
removal into the wetland buffer or wetland, as it provides good wildlife habitat. That way you would only need
to have the leafy branches chipped and hauled off-site, which should represent a cost savings. You could save
some of the chips on-site for mulching around the replacement trees.
I recommend that the tree replacement planting be done in the fall to take advantage of cooler weather and the
rainy season to help get the trees established. You will still be required to water the trees during the next dry
season and weed around them. We would like to see this work done by the end of September and will schedule
an inspection in early October as part of the compliance with your tree removal permit.

We are requesting a permit to remove 4 trees in our common green area of the Fosterview
Estate HOA. These tress are all Cottonwoods and are hazardous to the home owners
property as well as occupants. We are requesting permission to remove them on
7/12/2010 as one of them is an emanate danger to the community, as it has a large rotten
area in the middle of the tree. (See attached picture)
There is a total of four tree all of which are Cotton Woods the largest is 10 feet round the
remaining tree are less than 7 feet round. We also request that you help us in planning the
replacements according to the specification of the green belt area. We have two quotes for
cutting the trees down in compliance with the green belt area, both of which were
recommended by John Howat in the Public Works department.
Thank you for pushing this issue through as quickly as possible as we have been advised by
John as well as the removal teams these trees are of great danger to the community.

Dear Reverend Mosley,
It was nice to meet you at the counter today and talk about the tree replacement plan and the possibility of
meeting with the homeowners association to discuss the dos and don'ts for maintaining the wetland and stream
on the property.
I have made up and attached a list of suggested trees for replacement of the cottonwoods being removed from
the wetland/wetland buffer. There are small photos included so you can get an idea of what the leaves/flowers
look like. As I mentioned, because the trees being removed are in a sensitive area, the replacement trees must
be native to the Puget Sound region. The trees on the list vary in their mature size, but would be suited to
planting in a moist to dry area.
I understand from talking with Jaimie Reavis (the planner that took in your tree clearing application), that you
would like to remove the large tree, that presents the greatest hazard as early as Monday. Given that it is
hazardous, that would be acceptable. Regarding the removal of the other hazard trees, we noticed that one of
your quotes gave you a bid for topping the trees. Topping a tree should never be done (unless it is under an
overhead utility line) and it is a very poor tree management practice as it weakens the tree and the regrowth
(and cottonwoods will regrow) comes in weaker and more brittle and subject to breakage and wind damage -
thus increasing the hazard. It is better to completely remove the tree, rather than topping it.
In order to reduce your cost, you are encouraged to have the tree removal company put the logs from the tree
removal into the wetland buffer or wetland, as it provides good wildlife habitat. That way you would only need
to have the leafy branches chipped and hauled off-site, which should represent a cost savings. You could save
some of the chips on-site for mulching around the replacement trees.
I recommend that the tree replacement planting be done in the fall to take advantage of cooler weather and the
rainy season to help get the trees established. You will still be required to water the trees during the next dry
season and weed around them. We would like to see this work done by the end of September and will schedule
an inspection in early October as part of the compliance with your tree removal permit.
